Deputy Ken O'Flynn asked the Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation whether he accepts that the evidential presumption in respect of penalisation under the Protected Disclosures Act 2014, as amended, is not currently required to be applied during the administrative handling and investigation of disclosures by public bodies; and whether he will introduce a formal policy requirement to ensure consistency between administrative decision-making and the evidential framework applied in proceedings before the Workplace Relations Commission and the courts.
