Deputy Paul Murphy asked the Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation his views on whether there is a flaw in the way in which EU Directive 2019/1937 has been transposed with the Protected Disclosures (Amendment) Act 2022 in relation to the fact that the burden of proof is reversed when penalisation is alleged, but this has only been applied during Court proceedings, meaning that it does not apply during the administration process, resulting in unnecessary litigation.
