Broughan asked the Minister for Transport, Tourism and Sport when he intends to commence section 38 of the Road Traffic Act 2010, which will close the loophole whereby some drivers are getting their cases struck out by claiming they did not receive the notice to pay their fine in the post and therefore did not have a chance to pay the fine before being summoned to court; the reason there has been such a delay in commencing this section of the 2010 Act; and if he will make a statement on the matter.
