Deputy Patrick O'Donovan asked the Minister for Transport, Tourism and Sport if local authorities can invoke section 76 of the Roads Act 1993 to remove water from public roads, removing the risk of flooding to private property; if he will confirm the section allows a local authority to take such action without the need to serve notice on the landowner in whose property the water may be discharged on or through; and if he will make a statement on the matter.
