Deputy Grace Boland asked the Minister for Children, Disability and Equality the legal basis for Tusla's current interpretation of section 66 of the Child Care Act 1991 regarding superannuation eligibility for staff employed in children's residential centres listed in S.I. 124/1992, 125/1992 and 863/2004; if her Department has issued any guidance or determination limiting eligibility to staff providing direct residential care only, given that section 66(2) defines an employee as any person employed in an approved whole time post; if long standing scheme members may lawfully be removed from the relevant public service pension schemes based on an interpretation not provided for in primary legislation or the cited statutory instruments; and if she will make a statement on the matter.
