Covered foreign country means a country included in Department of State regulations as subject to certain prohibitions (i.e., Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela), as well as Russia. The Department of Agriculture must submit a report to Congress on how the Agricultural Foreign Investment Disclosure Act of 1978 should be updated to ensure accurate documentation and monitoring of foreign investment in agricultural land. Leveling the Playing Field 2.0 Act This bill addresses unfair trade practices by making various changes to U.S. antidumping and countervailing duty law. Antidumping provides relief to U.S industries and workers that are materially injured or threatened with injury due to imports of like products sold in the U.S. market at less than fair value, while countervailing duty provides such relief from imports of products subsidized by a foreign government or public entity. Specifically, the bill establishes a process for successive antidumping and countervailing duty investigations. Successive investigations may be concurrent (an ongoing investigation of the same product) or recently completed (not more than two years before the date of the initiation of the successive investigation). Further, the bill establishes a time line for the Department of Commerce to issue determinations in successive investigations. Among other provisions, the bill authorizes Commerce to apply countervailing duty law to subsidies provided by a foreign government or public entity to a company operating in a third country, use another method for calculating the cost of production in specific circumstances, and require importers to provide a certification that the imported merchandise is not subject to an antidumping or countervailing duty order. Additionally, the bill statutorily establishes procedures for Commerce to conduct circumvention inquiries, including by specifying the deadlines for preliminary and final determinations. The bill also provides statutory authority for Commerce to investigate currency undervaluation as a countervailable subsidy.

Defending American Jobs and Investment Act This bill provides for the enforcement of remedies against foreign countries that have extraterritorial or discriminatory taxes. Specifically, the bill requires the Department of the Treasury to periodically submit a report to Congress that lists each foreign country that has one or more extraterritorial or discriminatory taxes. Treasury must commence enhanced bilateral engagement with each foreign country included in the report. This engagement must (1) express the concern of the United States with respect to the adverse trade and economic effects of tax policies that violate bilateral tax treaties and international tax norms, (2) urge the repeal of extraterritorial and discriminatory taxes that target U.S. persons, and (3) advise the foreign country of remedial actions (as outlined by this bill). The bill increases income tax and withholding tax rates on certain foreign citizens, corporations, and partnerships of any foreign country listed in Treasury's report. The bill provides the executive branch with additional tools to enforce against extraterritorial and discriminatory taxes. These tools include authorizing the President to prohibit government contracting or procurement of goods or services from a foreign country listed in Treasury's report, directing Treasury to consider these taxes in assessing whether to enter into or update a bilateral tax treaty with the foreign country, and requiring the U.S. Trade Representative and the Department of Commerce to consider these taxes in assessing whether to enter into any free trade agreement or executive agreement with the foreign country.

Financing Our Energy Future Act This bill expands the types of partnerships that qualify for treatment as publicly traded partnerships instead of as corporations for tax purposes. Under current law, partnerships that meet certain gross income requirements (i.e., at least 90% of the partnership's gross income in a taxable year consists of qualifying income) are excepted from being treated as a corporation for tax purposes. This bill expands the sources of income that are considered qualifying income and make a partnership eligible for such an exception. Specifically, the bill provides that income derived from the generation of specified alternative energy, alternative fuel projects, or the associated property, storage, or transportation for such projects (e.g., the conversion of renewable biomass into renewable fuel or the storage or transportation of such fuel) is considered qualifying income.

Beginning in 2025, a hospital may not use an internet-based price estimator tool to meet the publication requirement for shoppable services. The bill also modifies the health insurance plan disclosure requirements to include the rates for certain in-network services and prescription drug payment information. The bill further requires providers of diagnostic laboratory tests under Medicare to publish online certain price information. Medicare Advantage (MA) organizations must report information about payments made to providers in which the MA organization has an ownership interest. Medicare prescription drug plan sponsors must report certain price information for covered drugs. Additionally, the bill requires health insurance plan issuers (or the PBM providing services on behalf of the plan) to report to the plan sponsor specified information about prescription drugs dispensed under the plan. This includes rebates, fees, alternative discounts, or other remuneration the plan receives from drug manufacturers. Finally, the bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with PBMs under Medicaid.

Assad Regime Anti-Normalization Act of 2023 This bill prohibits federal officials or employees from taking any action to recognize a Syrian government led by Bashar al-Assad. The bill also expands existing sanctions related to the Syrian conflict to cover additional activities and persons (individuals and entities). Current law requires the President to impose visa- and property-blocking sanctions on foreign persons engaged in certain activities related to the conflict in Syria. For example, such sanctions must be imposed on those that knowingly (1) are responsible for serious human rights abuses against the Syrian people, or (2) provide aircraft or spare aircraft parts for military purposes on behalf of the Syrian government to a foreign person operating in certain areas of Syria. This bill expands the types of activities that would subject a foreign person to sanctions, including knowingly (1) providing any type of aircraft or spare aircraft parts to the Syrian government, (2) diverting humanitarian assistance intended for the Syrian people, or (3) confiscating property in Syria or owned by a Syrian citizen for personal gain or political purposes. The bill also extends these sanctions to entities owned or controlled by a sanctioned person and to a sanctioned person's adult family members. Additionally, the bill removes an exception to the sanctions related to the importation of goods.
