United States · United States Congress · 23 March 2021

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer.  A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. VA Supply Chain Resiliency Act

United States · United States Congress · 19 March 2021

VA Supply Chain Resiliency Act This bill addresses the Department of Veterans Affairs (VA) supply chain processes, particularly during emergency periods. The bill requires the VA to submit a report containing a description of the items and quantities of items that are critical with respect to the VA's ongoing response to the COVID-19 (i.e., coronavirus disease 2019) pandemic and future epidemic, pandemic, emergency, national emergency, or natural disaster scenarios. The VA and the Department of Defense (DOD) must enter into an agreement to provide for the participation of the VA in the Warstopper Program of the Defense Logistics Agency (DLA) of DOD. The Warstopper Program was established to satisfy requirements for sudden and sustained increases in production of critical industrial and medical items. Under such an agreement, the DLA must ensure the maintenance and stability of the items the VA identifies as critical in its report (and that the VA and DOD determine are appropriate for the program), establish guidance for the participation of the VA in the program, and use existing and new contracts and agreements to reserve the supply of critical items. Finally, the VA must ensure it does not exclusively rely on holding regional, physical inventories of critical items in order to respond to greater than expected needs during epidemic, pandemic, emergency, national emergency, or natural disaster situations.

United States · United States Congress · 18 March 2021

Secure and Fair Enforcement Banking Act of 2021 or the SAFE Banking Act of 2021 This bill generally prohibits a federal banking regulator from penalizing a depository institution for providing banking services to a legitimate cannabis-related business. Additionally, proceeds from a transaction involving activities of a legitimate cannabis-related business are not considered proceeds from unlawful activity. Proceeds from unlawful activity are subject to anti-money laundering laws. Furthermore, a depository institution is not, under federal law, liable or subject to asset forfeiture for providing a loan or other financial services to a legitimate cannabis-related business. The bill also provides that a federal banking agency may not request or order a depository institution to terminate a customer account unless (1) the agency has a valid reason for doing so, and (2) that reason is not based solely on reputation risk. Valid reasons for terminating an account include threats to national security and involvement in terrorist financing, including state sponsorship of terrorism.

The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs. DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed. Furthermore, DHS and DOJ shall cancel the removal of certain aliens who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such an alien shall receive permanent resident status upon meeting certain requirements and applying for such status within three years of this bill's enactment. DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes. This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented aliens unless those benefits are available to all U.S. nationals without regard to residency in the state.
