Permits statues honoring deceased citizens of U.S. territories (American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the U.S. Virgin Islands) to be placed in Statuary Hall of the U.S. Capitol. Limits such statues to one per jurisdiction.

Health Equity and Accountability through Research Act of 2009 - Amends the Public Health Service Act to rename the National Center on Minority Health and Health Disparities as the National Institute for Minority Health and Health Disparities. Revises and expands the duties of the Director of such Institute relating to coordination of research activities conducted by the National Institute of Health (NIH) and review of a strategic plan and budget for minority health disparity research.

Severs the United States relations with the Cherokee Nation of Oklahoma until the Cherokee Nation is meeting all of its treaty obligations and other federal statutory obligations, including all obligations with the Treaty of 1866 and has restored the rights of Cherokee Freedmen disenfranchised from the Cherokee Nation in the March 3, 2007, Cherokee Nation vote to remove them from the Cherokee Nation. Requires a report from the Government Accountability Office (GAO) on the Cherokee Nation's expenditure of federal funds, as well as other specified reports from federal agencies, the Secretary of the Interior, and the National Indian Gaming Commission. Suspends the Cherokee Nation's authority to conduct gaming operations until it is in compliance with all treaty and other obligations with the United States. Grants any Cherokee Freedman a private right to bring actions for injunctive relief, declaratory relief, or monetary damages against the Cherokee Nation, officials of the Cherokee Nation, or federal officials. Directs the Attorney General to issue a finding on whether the federal civil rights of the Cherokee Freedmen have been violated by the Cherokee Nation and/or the Department of the Interior.

Equal Rights for Health Care Act Title 42 - Prohibits discrimination on the basis of sex, race, color, national origin, sexual orientation, gender identity, or disability status against any person in the United States under any health care service or research program or activity receiving federal financial assistance.

Expresses support for: (1) the goals and ideals of National Caribbean American HIV/AIDS Awareness Day and recognizes the fourth anniversary of observing it; and (2) the development of a national AIDS strategy with clear goals and objectives to reduce new HIV infections, especially among communities of color. Encourages: (1) state and local governments to recognize such Day, publicize its importance, and encourage Caribbean Americans, Caribbean-born individuals, and all people in the United States and its territories to know their status and undergo HIV testing; and (2) media organizations to carry messages in support of such Day.

National Transportation Objectives Act of 2009 - Establishes: (1) national transportation objectives to provide a 21st century vision for the national surface transportation system, including to promote energy efficiency and achieve energy security, ensure environmental protection and safety for all transportation users, improve economic competitiveness and transportation system conditions, and provide equal access to transportation in urban, suburban, and rural communities; and (2) national transportation performance targets to meet such objectives, including to reduce per capita vehicle miles traveled by 16% and transportation-generated carbon dioxide levels by 40%, triple walking, biking, and public transportation use, increase freight transportation provided by railroad and intermodal services by 20%, and improve public safety and lower congestion costs by reducing traffic crashes by 50%. Directs the Secretary of Transportation to: (1) develop baseline levels and appropriate data collection systems for meeting the national transportation performance targets; and (2) develop and implement a National Surface Transportation Performance Plan.

Indian Health Care Improvement Act Amendments of 2009 - Amends the Indian Health Care Improvement Act to revise requirements for health care programs and services for Indians, Indian tribes, tribal organizations, and urban Indian organizations. Replaces the Urban Health Programs Branch with a Division of Urban Indian Health. Authorizes grants to urban Indian organizations for health information technology, telemedicine services development, and related infrastructure. Directs the Secretary of Health and Human Services, acting through the Indian Health Service, to provide programs of comprehensive behavioral health, prevention, and treatment. Excludes from gross income: (1) services or benefits provided or purchased by the Service; and (2) services or benefits provided by a tribe or tribal organization, directly or through insurance. Declares that these provisions are not intended as an inference to the tax treatment of governmental benefits provided by tribes to Indians. Reauthorizes the Indian Health Care Improvement Act. Amends the Indian Self-Determination and Education Assistance Act to direct the Secretary to establish the Native American Health and Wellness Foundation. Expands coverage for qualified Indians in the State Children's Health Insurance Program (CHIP, formerly known as SCHIP) under title XXI of the Social Security Act (SSA), as well as under Medicare (SSA title XVIII) and Medicaid (SSA title XIX). Authorizes related payments to Indian Health Programs operating in the state.

Enhancing Science, Technology, Engineering, and Mathematics Education Act of 2009 - Requires the President to establish, in the Office of Science and Technology Policy, a Committee on Science, Technology, Engineering, and Mathematics Education (STEM education) within the National Science and Technology Council. Establishes an Office of Science, Technology, Engineering, and Mathematics Education in the Department of Education, to be administered by an Assistant Secretary. Requires the Assistant Secretary to conduct at least every five years an evaluation of the STEM education programs administered by the department. Requires the Secretary of Education to award a grant to establish a voluntary State Consortium on STEM Education and a grant to the National Science Digital Library to establish the STEM Education Resource Alliance.

Climate and Ocean Research and Coordination Act of 2009 - Reestablishes the National Oceanic and Atmospheric Administration (NOAA) and its leadership. (NOAA was created by the Reorganization Plan No. 4 of 1970.) Includes in NOAA the National Weather Service and the Science Advisory Board. National Climate Enterprise Act of 2009 - Directs the President to establish a National Climate Enterprise to coordinate international, federal, and nonfederal activity to provide scientifically based climate and climate impact data, information, products, and services to better forecast climate, climate change, and climate variability and to understand climate impacts at regional and local scales. Requires that the Enterprise consist of an Interdepartmental Oversight Board, an Interagency Coordinating Committee, and a Climate Operations Office established by this Act, and nonfederal contributors. Requires the Office, subject to appropriations, to develop and implement a quality assurance program to certify climate products and services that satisfy this Act's standards. Defines "climate product and service" as any publicly or commercially available product or service produced by a nonfederal contributor that includes or displays climate data, meta-data, or information. Allows the Enterprise to authorize the use of the emblem or any trademark of the Enterprise on a certified climate product or service. Establishes in the Treasury the Climate Products And Services Account. Requires the Enterprise Advisory Board to provide advice to the Interagency Coordinating Committee on policy implementation by the Climate Operations Office, the effectiveness of data, meta-data, information, products, and services delivered to end-users, priorities for climate research and information needs, the performance of non-federal contributors, and critical climate research needs.

Territorial Health Parity Act of 2009 - Amends title XI of the Social Security Act (SSA) to sunset at the end of FY2009 the limitation on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Amends SSA title XIX (Medicaid) to: (1) repeal, as of the end of FY2011, the federal medical assistance percentage (FMAP) of 50% that applies to such territories; and (2) set the new FMAP for such territories at one determined by the Secretary of Health and Human Services (Secretary) in consultation with the Secretary of the Interior. Specifies a transitional FMAP for such territories for FY2010-FY2011. Requires the Secretary to report to Congress on the per capita income data used to promulgate the FMAP in the territories and how such data differ from the per capita income data used to promulgate FMAPs for the 50 states and the District of Columbia. Requires the report to include recommendations on how FMAPs can be calculated for the territories to ensure parity with the 50 states and the District of Columbia. Amends the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 to extend the Medicaid program to the citizens of the Freely Associated States (Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau). Amends SSA title XIX to set a 100% FMAP for otherwise qualified services rendered to such citizens.

Conveys to the U.S. Virgin Islands specified submerged lands in the area between the island of Saint Croix and the islands of Saint Thomas and Saint John. States that for purposes of U.S. laws, and except as otherwise provided by international law or any international agreement in force for the United States, the territorial waters of the U.S. Virgin Islands shall consist of all waters in the belt of the seas measured from the line of ordinary low water along that portion of the coast which is in direct contact with the open sea and the line marking the seaward limit of inland waters, and extending seaward a distance of nine miles.

Keep America's Waterfronts Working Act of 2009 - Amends the Coastal Zone Management Act of 1972 to direct the Secretary of Commerce, acting through the National Oceanic and Atmospheric Administration (NOAA), to establish a Working Waterfront Grant Program to make a grant, through a regionally equitable, competitive funding process, to any coastal state to implement a plan to preserve and expand access to coastal waters for persons engaged in commercial fishing, recreational fishing, aquaculture, boatbuilding, or other water-dependent coastal-related business. Authorizes the Secretary to award planning grants to coastal states to develop or revise comprehensive working waterfront plans.

National Fish Habitat Conservation Act - Establishes a National Fish Habitat Board to: (1) promote, oversee, and coordinate the implementation of this Act and the existing National Fish Habitat Action Plan; (2) establish aquatic habitat conservation goals and priorities; and (3) review and recommend fish habitat conservation projects. Authorizes the Board to designate Fish Habitat Partnerships to: (1) coordinate Plan implementation at a regional level; (2) identify strategic priorities; (3) recommend habitat projects; and (4) develop and carry out fish habitat conservation projects. Establishes Partnership approval criteria, including that a Partnership: (1) include representatives of a diverse group of public and private partners focused on conservation of aquatic habitats to achieve results across jurisdictional boundaries and public and private land; and (2) is able to address issues and priorities on a nationally significant scale. Directs the Secretary of the Interior to fund, from amounts appropriated under this Act, up to 50% of the cost of approved fish habitat conservation projects on nonfederal and 100% of projects on federal land or water. Requires the Director of the U.S. Fish and Wildlife Service to: (1) establish the National Fish Habitat Conservation Partnership Office within the Service; and (2) develop the Office's interagency operational plan. Requires the Director, the Assistant Administrator of the National Oceanic and Atmospheric Administration (NOAA), and the Director of the United States Geological Survey (USGS) to provide technical and scientific assistance to the Partnerships, the project participants, and the Board.

Home Buying Credit Expansion Act - Amends the Internal Revenue Code to: (1) extend the first-time homebuyer tax credit to all individuals who purchase a principal residence (currently, only first-time homebuyers as so defined); (2) extend such credit and the waiver of recapture requirements for such credit through 2010; and (3) expand the election to treat a purchase of a principal residence as made in a prior taxable year for purposes of such credit.

Consumer Assistance to Recycle and Save Act - Establishes in the National Highway Traffic Safety Administration (NHTSA) a Cash for Clunkers Temporary Vehicle Trade-in Program through which the Secretary of Transportation shall: (1) authorize the issuance of an electronic voucher to offset the purchase or lease price for a new fuel efficient automobile upon the surrender of an eligible trade-in vehicle to a participating dealer; (2) certify dealers for Program participation; (3) make payments to them for vouchers they accept between March 30, 2009, and April 1, 2010; (4) provide for the payment of rebates to qualifying persons; and (5) establish and provide for the enforcement of measures to prevent and penalize fraud under the Program. Prescribes requirements, including combined fuel economy, for $3,500 and $4,500 vouchers to offset the purchase or lease price for a qualifying passenger automobile or truck. Limits the number of vouchers to one per customer, including joint registered owners of a single eligible trade-in vehicle. Requires a dealer to certify that each eligible trade-in vehicle: (1) will be crushed or shredded, or transferred to an entity that will ensure it will be crushed or shredded, within the period of the Program; and (2) has not been, and will not be, sold, leased, exchanged, or otherwise disposed of for use as an automobile in the United States or in any other country. Makes any person who purchased or leased a new fuel efficient vehicle after March 30, 2009, and before the enactment of this Act eligible for a cash rebate equivalent to the appropriate voucher amount. Prescribes standards which any regulations issued by the Secretary for the Program must meet. Makes it unlawful for any person to violate this Act or any regulations issued under it, particularly by fraud. Prescribes civil penalties for any such violation. Directs the Secretary to make Program information available on an Internet website and through other means.

Mental Health in Schools Act of 2009 - Amends the Public Health Service Act to revise a community children and violence program to assist local communities and schools in applying a public health approach to mental health services, including by: (1) revising eligibility requirements for a grant, contract, or cooperative agreement; and (2) providing for comprehensive school mental health programs that are culturally and linguistically appropriate and age appropriate. Makes only a partnership between a local educational agency and at least one community program or agency that is involved in mental health eligible for such funding. Sets forth assurances required for eligibility, including that: (1) the local education agency will enter into a memorandum of understanding with relevant community-based entities that clearly states the responsibilities of each partner; (2) the program will include training of all school personnel, family members of children with mental health disorders, and concerned members of the community; and (3) the program will demonstrate the measures to be taken to sustain the program after funding terminates. Requires the Administrator of the Substance Abuse and Mental Health Services Administration to develop a process for evaluating grant program activities, including: (1) the development of guidelines for the submission of program data by recipients; and (2) the development of measures of outcomes to be applied by recipients in evaluating programs, to include student and family measures and local educational measures.

Increasing Homeownership Opportunities Act - Amends the Federal Home Loan Mortgage Corporation Act and the Federal National Mortgage Association Charter Act to increase limitations on the maximum original principal obligation of mortgages that may purchased by the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation Association (Freddie Mac). Increases such limitations in areas where 125% (currently, 115%) of the median price of residences of a particular size exceed existing mortgage purchase limitations for such residence size. Gives the Director of the Federal Housing Finance Agency (FHFA) discretion to increase existing mortgage purchase limitations where an increase is warranted by higher median home prices in an area or sub-area and will have a significant impact on the cost or availability of mortgages for such homes. Amends the National Housing Act to raise limitations on the maximum principal obligation of mortgages that may be insured by the Secretary of Housing and Urban Development (HUD). Gives the Secretary discretion to increase mortgage insurance limitations where an increase is warranted by higher median home prices in an area or sub-area and will have a significant impact on the cost or availability of mortgages for such homes.

Comparative Effectiveness Research Act of 2009 - Amends title XI (General Provisions, Peer Review, and Administrative Simplification) of the Social Security Act to provide for a program of comparative effectiveness research for health care. Defines "comparative effectiveness research" as research evaluating and comparing the implications and outcomes of two or more health care strategies to address a particular medical condition. Establishes the Health Care Comparative Effectiveness Research Institute as a nonprofit, nongovernmental corporation to conduct research on the effectiveness of health care treatments, including pharmaceuticals, medical devices and procedures, and other therapies. Requires the Institute to: (1) identify national priorities for comparative clinical effectiveness research; (2) establish and update a research project agenda and provide for peer review of research; (3) establish a standing methodology committee for developing the science of comparative effectiveness research; and (4) disseminate research findings. Amends the Internal Revenue Code to establish in the Treasury the Comparative Effectiveness Research Trust Fund. Provides revenues for the Trust Fund by: (1) transferring amounts from certain appropriations for comparative effectiveness research, from the General Fund, and from the Medicare Federal Hospital Insurance and Federal Supplementary Medical Insurance Trust Funds; and (2) imposing a fee on certain accident or health insurance policies and self-insured health plans. Requires the Comptroller General to review financial audits of the Institute and assess the adequacy and use of funding. Terminates all funding for the Trust Fund after FY2020.

Amends the Whale Conservation and Protection Study Act to rename it as the International Whale Conservation and Protection Act of 2009. Requires the Secretary of Commerce (Secretary), in cooperation with the Secretary of State, to: (1) restate strong U.S. opposition to commercial whaling and to refuse to engage in any negotiation or reinterpretation of the International Convention for the Regulation of Whaling that would weaken the moratorium on commercial whaling, create new categories of whaling, condone lethal scientific whaling, or weaken whale conservation and protection; and (2) support subsistence whaling and the development of the Aboriginal Whaling Management Scheme. Sets forth provisions concerning the International Whaling Commission. Requires the Secretary, in cooperation with the United States Coast Guard, to: (1) pursue the establishment of guidelines for minimizing the introduction of incidental noise from commercial shipping operations into marine environments to reduce the potential adverse affects on whales and other marine life; and (2) promote the use of areas to be avoided by commercial vessels and other navigational measures to minimize the threat of injury to whales. Requires the Secretary, in cooperation with the Secretary of the Interior, to encourage nations that hold any reservations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora to the great whales listed in Appendix I to withdraw such reservations and terminate commercial trade in whale meat and products. Provides for international cooperation and compliance with regulations governing trade in or takings of whales. Requires the Secretary to: (1) negotiate with the government of Canada with the goal of concluding a North Atlantic Whale Conservation Agreement within 18 months; (2) develop international action plans to reduce threats to whales and other cetaceans through the establishment of new International Marine Protected Areas (IMAs) and IMA networks; and (3) establish whale research initiatives to enhance whale conservation efforts. Requires the Secretary and the Secretary of State to support efforts to study and reduce the adverse effects of anthropogenic noise on whales and other marine life.

Healthy Families Act - Requires certain employers, who employ 15 or more employees for each working day during 20 or more workweeks a year, to permit each employee to earn at least one hour of paid sick time for every 30 hours worked. Declares that an employer shall not be required to permit an employee to earn more than 56 hours of paid sick time in a calendar year, unless the employer chooses to set a higher limit. Allows employees to use such time to: (1) meet their own medical needs; (2) care for the medical needs of certain family members; or (3) seek medical attention, assist a related person, take legal action, or engage in other specified activities relating to domestic violence, sexual assault, or stalking. Prohibits an employer from interfering with an employee's exercise of such rights. Directs the Secretary of Labor to exercise certain investigative and enforcement authority for employees covered by the Family and Medical Leave Act of 1993 or the Government Employee Rights Act of 1991. Grants the same authority, for employees under their jurisdiction, to the Librarian of Congress, the Comptroller General, the Board of Directors of the congressional Office of Compliance, and the Merit Systems Protection Board. Authorizes civil actions by employees, individuals, or their representatives for damages or equitable relief against employers who violate this Act. Waives a state's sovereign immunity with respect to a suit brought by an employee of a federally-assisted state program or activity for relief authorized under this Act. Requires the Commissioner of Labor Statistics annually to compile information annually on paid sick time, and the Comptroller General to study related matters. Declares that nothing in this Act shall be construed to discourage employers from adopting or retaining more generous leave policies.

Scleroderma Research and Awareness Act - Requires the Director of the National Institute of Arthritis and Musculoskeletal and Skin Diseases to expand, intensify, and coordinate the research and training activities with respect to scleroderma. Directs the Centers for Disease Control and Prevention (CDC) to carry out an educational campaign to increase public awareness of scleroderma.

Mother's Day Centennial Commemorative Coin Act - Instructs the Secretary of the Treasury to mint and issue not more than 400,000 $1 coins emblematic of the 100th anniversary of President Wilson's proclamation designating the second Sunday in May as Mother's Day. Authorizes the Secretary to issue such coins beginning January 1, 2014, except that the Secretary may initiate sales of such coins, without issuance, before such date. Terminates such minting authority after December 31, 2014. Requires coin sales to include a $10 surcharge per coin, with distribution of such surcharges to the Susan G. Komen for the Cure and the National Osteoporosis Foundation for the purpose of furthering research.

Informed Consumer Choices in Health Care Act of 2009 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS) to: (1) develop standards for health insurance issuers in providing information to group health plans, for forms used in connection with group health insurance coverage, for quality assurance, for marketing of group health insurance coverage, and for the accuracy and clarity of coverage for out-of-network providers; (2) undertake activities to promote accountability of health insurance issuers in meeting federal health insurance requirements; (3) provide grants to Departments of Insurance in states to assist in enforcement of federal health insurance requirements governing health insurance issuers operating in such states; (4) undertake activities to promote transparency in costs, market practices, and other factors for health insurance coverage; and (5) establish within HHS an Office of Health Insurance Oversight to promote accountability and transparency in health insurance and provide for assistance to consumers in selecting health care coverage. Directs the Secretaries of Labor and the Treasury to establish standards and accountability and transparency initiatives for group health plans comparable to the standards established by the HHS Secretary under this Act.

Amends the Internal Revenue Code to allow a taxpayer election to increase the tax credit for research expenditures by 20% for qualified energy research expenses incurred in 2009 or 2010. Defines "qualified energy research expenses" to include research expenses related to fuel cell and battery technology, renewable energy, energy conservation technology, electric transmission and distribution, and carbon capture and sequestration.

Expresses support for: (1) the goals and ideals of Mental Health Month; and (2) the finding of the President's Commission on Mental Health that the nation's failure to prioritize mental health is a national tragedy. Recognizes that mental well-being is as important as physical well-being for people, the economy, and the country. Applauds the coalescing of national and community organizations in working to promote public awareness of mental health and in providing critical information and support to the people and families affected by mental illness. Encourages all organizations and health practitioners to use Mental Health Month as an opportunity to promote mental well-being and awareness, ensure access to appropriate services, and support overall quality of life for those living with mental illness.

Recognizes the importance of: (1) culturally and linguistically competent services as a core element in reducing HIV/AIDS rates in Asian American and Pacific Islander communities; and (2) addressing the gaps in research and data in order to fully understand the HIV/AIDS epidemic in such communities. Recognizes the people across the United States infected and affected by HIV/AIDS who are commemorating this day and who work to reduce the impact of HIV/AIDS on Asian American and Pacific Islander communities.

Nurse and Health Care Worker Protection Act of 2009 - Requires the Secretary of Labor to propose a standard on safe patient handling and injury prevention to prevent musculoskeletal disorders for direct-care registered nurses and all other health care workers that requires the use of engineering controls to lift patients and the elimination of manual lifting of patients through the use of mechanical devices, except where patient care may be compromised. Requires health care employers to: (1) develop and implement a safe patient handling and injury prevention plan; (2) provide their workers with training on safe patient handling and injury prevention; and (3) post a uniform notice that explains the standard and the procedures to report patient handling-related injuries. Requires the Secretary to conduct unscheduled inspections to ensure compliance with safety standards. Allows health care workers to: (1) refuse to accept an assignment in a health care facility that violates safety standards or for which such worker has not received required training; and (2) file complaints against employers who violate this Act. Prohibits employers from taking adverse actions against any health care worker who in good faith reports a violation, participates in an investigation or proceeding, or discusses violations. Authorizes health care workers who have been discharged, discriminated, or retaliated against in violation of this Act to bring legal action for reinstatement, reimbursement of lost compensation, attorneys' fees, court costs, and other damages. Requires the Secretary of Health and Human Services (HHS) to establish a grant program for purchasing safe patient handling and injury prevention equipment for health care facilities.

Requires the Secretary of Energy, acting through the Assistant Secretary of Energy Efficiency and Renewable Energy, to assemble a team of technical, policy, and financial experts to address the energy needs of Puerto Rico, Guam, American Samoa, the Northern Mariana Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, the Republic of Palau, and the U.S. Virgin Islands to: (1) reduce reliance and expenditures on imported fossil fuels; (2) increase the use of indigenous, nonfossil fuel energy sources; (3) improve the performance of energy infrastructure through projects to improve the energy efficiency of power generation, transmission, and distribution and increase consumer energy efficiency; (4) improve the performance of energy infrastructure through enhanced planning, education, and training; (5) adopt research-based and public-private partnership-based approaches; (6) stimulate economic development and job creation; and (7) enhance the engagement by the federal government in international efforts to address such energy needs. Requires the team to provide assistance to each utility of each island and to each island's government to develop and implement an energy Action Plan to reduce reliance on imported fossil fuels through increased efficiency and use of indigenous clean-energy resources. Requires the Secretary to consider including regional utility organizations in the establishment of the team and providing assistance through regional utility organizations.

Amends the Energy Policy Act of 2005 to: (1) make states (including American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands) that represent or provide pollution reduction or educational services to persons or organizations that own or operate diesel fleets, or that have the promotion of transportation or air quality as their principal purpose, eligible for grants and loans for diesel emission reductions; and (2) require the Administrator of the Environmental Protection Agency (EPA) to allocate to American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands funding for a grant and loan program that is designed to achieve significant reductions in diesel emissions if such states have an approved application for such program.

Strategies to Address Antimicrobial Resistance Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to establish the Antimicrobial Resistance Office. Requires the Secretary to establish the Public Health Antimicrobial Advisory Board to advise the Director of the Office (Director). Requires the Director to update the Public Health Action Plan to Combat Antimicrobial Resistance within 18 months. Requires the Secretary, acting through the Director, the Director of the Centers for Disease Control and Prevention (CDC), and the Director of the National Institutes of Health (NIH), to: (1) develop an antimicrobial resistance strategic research plan; and (2) establish at least ten Antimicrobial Resistance Surveillance and Research Network sites. Amends the Federal Food, Drug, and Cosmetic Act to direct the Secretary to require each sponsor of an approved human antimicrobial drug product sold or distributed in the United States to submit antimicrobial drug sales and distribution data. Requires that an application for a new animal drug contain information to ensure that reported data is comparable and reliable. Requires (currently, permits) the Secretary to share information reported in a new animal drug application with the Antimicrobial Resistance Task Force. Sets forth provisions for the Secretary to secure reliable and comparable animal and human antimicrobial drug consumption data. Requires the Under Secretary for Health of the Department of Veterans Affairs (VA), the Administrator of the Centers for Medicare & Medicaid Services, and the Director to work together to identify and report upon interventions that prevent and control the development of antimicrobial resistance.

Preserving Patient Access to Primary Care Act of 2009 - Amends the Higher Education Act of 1965 to authorize the Secretary of Education to award recruitment incentive grants or contracts to graduate medical schools to enable them to improve primary care education and training for medical students. Amends the Public Health Service Act (PHSA) to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to: (1) award grants to critical shortage health facilities to enable them to provide scholarships to individuals who agree to serve as physicians at such facilities after completing a residency in a primary care field; (2) establish an educational loan repayment program for individuals who agree to serve as primary care physicians or primary care providers (including nurse practitioners) in an area that is not a health professional shortage area but has a critical shortage of such physicians or providers; and (3) establish an educational loan repayment program for individuals who agree to serve as physicians in the field of obstetrics and gynecology or as certified nurse midwives in an area that is not a health professional shortage area. Amends the Higher Education Act of 1965 to provide for deferment of education loans during medical residency and internships in a primary care field. Amends the PHSA to direct the Secretary to award grants to eligible state and local government entities for the development of informational materials that promote careers in primary care. Amends the PHSA to extend the authorization of appropriations for training in a family medicine, general internal medicine, general geriatrics, general pediatrics, physician assistance, general dentistry, and pediatric dentistry Authorizes increased appropriations for the national health service corps scholarships and loan repayment programs. Amends title XIX (Medicaid) of the Social Security Act (SSA) to allow the use of Medicaid transformation payments for methods for improving medical assistance under Medicaid and SSA title XXI (Children's Health Insurance Program) (CHIP, formerly known as SCHIP) by encouraging certain medical practices to qualify as patient centered medical homes. Amends SSA title XVIII (Medicare) to: (1) increase budget neutrality limits under the physician fee schedule to account for anticipated savings resulting from payments for certain services and the coordination of beneficiary care; and (2) require a separate Medicare payment for designated primary care services and comprehensive care coordination services. Amends SSA title XVIII to cover patient-centered medical home services. Directs the Secretary to develop a methodology to increase payments for designated evaluation and management services provided by primary and principal care providers. Requires: (1) additional incentive payments for primary care services furnished in health professional shortage areas; (2) permanent extension of the floor on the Medicare work geographic adjustment under the physician fee schedule; and (3) permanent extension of the Medicare incentive payment program for physician scarcity areas. Directs the Secretary to study and report to Congress on the process for determining relative value under the Medicare physician fee schedule. Eliminates cost sharing for preventive benefits and the time restriction for initial preventive physical examination. Directs the Secretary to study and report to Congress on: (1) facilitating the receipt of Medicare preventive services by Medicare beneficiaries; (2) increasing the ability of physicians and primary care providers to assist Medicare beneficiaries in obtaining needed prescriptions under Medicare part D (Voluntary Prescription Drug Benefit Program); and (3) developing and implementing mechanisms to promote and increase interaction between physicians or primary care providers and the families of Medicare beneficiaries, as well as other caregivers who support such beneficiaries, for the purpose of improving patient care under the Medicare program. Requires additional payments to physicians for services to individuals with limited English proficiency (LEP). Requires various specified studies. Directs the Medicare Payment Advisory Commission (MEDPAC) to provide an ongoing assessment of the impact of changes in Medicare payment policies in improving access to and equity of payments to primary care physicians and primary care providers. Authorizes distribution of additional residency positions and the counting of resident time in certain outpatient settings. Establishes rules for counting resident time in a nonhospital setting primarily engaged in furnishing patient care in non-patient care activities, such as didactic and scholarly activities and other activities (but not research not associated with the treatment or diagnosis of a particular patient). Authorizes redistribution of residency slots after a hospital closes or is acquired by another entity with the approval of a bankruptcy court. Directs the Secretary to revise the 9th Statement of Work under the Quality Improvement Program to include a requirement that, in order to be an eligible Quality Improvement Organization (QIO) for the 9th Statement of Work contract cycle, a QIO provide assistance, including technical assistance, to physicians under the Medicare program that seek to acquire the elements necessary to be recognized as a patient centered medical home practice under the National Committee for Quality Assurance's Physician Practice Connections -- PCMH module.

Native Hawaiian Government Reorganization Act of 2009 - Establishes the U.S. Office for Native Hawaiian Relations within the Office of the Secretary of the Interior. Establishes the Native Hawaiian Interagency Coordinating Group. Recognizes the right of the Native Hawaiian people to reorganize the single Native Hawaiian governing entity to provide for their common welfare and to adopt appropriate organic governing documents. Establishes a Commission to: (1) prepare and maintain a roll of the adult members of the Native Hawaiian community who elect to participate in such reorganization; and (2) certify that the adult members of the Native Hawaiian community proposed for inclusion on the roll meet the definition of Native Hawaiian. Outlines the process for the reorganization, which includes forming a Native Hawaiian Interim Governing Council. Reaffirms the special political and legal relationship between the United States and the Native Hawaiian governing entity upon certification required by the Secretary regarding the organic governing documents and the election of the entity's officers. Extends federal recognition to the governing entity as the representative governing body of the Native Hawaiian people. Authorizes the United States, upon the reaffirmation of such political and legal relationship, together with the state of Hawaii, to enter into negotiations with the governing entity to lead to an agreement addressing specified matters, including the transfer of lands, natural resources, and other assets, and the protection of existing rights related to such lands or resources.

Supports related research. Endorses the development of centers on resilience. Encourages increased collaboration across federal funding agencies involved in resilience research. Promotes interdisciplinary partnerships among physicians, mental health practitioners, educators, schools, community leaders, government agencies, and families to ensure adaptation, dissemination, and implementation of culturally relevant, evidence-based treatments that incorporate resilience strategies in community settings for African-American youth, families, and communities.

Eliminating Disparities in Breast Cancer Treatment Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services to establish a breast cancer treatment quality performance system to: (1) assess and disclose publicly, through the use of quality measures, the quality of care provided for the treatment of breast cancer by specified health care providers; and (2) base payment to such providers for such treatment on their performance with respect to such measures. Requires reduced payments to providers that either do not submit data in accordance with the reporting process in the system, or furnish low quality care for treatment of breast cancer.
