Commends and congratulates Daw Aung San Suu Kyi on the tenth anniversary of her receiving the Nobel Peace Prize. Recognizes her contributions and work toward bringing peace and democracy to Burma. Expresses the sense of Congress that: (1) the President and Secretary of State should continue to encourage the Government of Burma to restore basic human rights to the Burmese people, to eliminate the practice of human trafficking, to address the manufacture of heroin and methamphetamine, to continue releasing political prisoners, to recognize the results of the 1990 democratic elections, and to allow Daw Aung San Suu Kyi and the National League for Democracy to enjoy unfettered freedom of speech and freedom of movement; and (2) Daw Aung San Suu Kyi should be invited to address a joint meeting of Congress.

Employment Non-Discrimination Act of 2001 - Prohibits employment discrimination on the basis of sexual orientation by covered entities (including employment agencies, labor organizations, and training programs). Prohibits related retaliation and coercion. Declares this Act inapplicable to the provision of employee benefits for the benefit of an employee's domestic partner. Prohibits the Equal Employment Opportunity Commission from: (1) collecting statistics on sexual orientation from covered entities; and (2) compelling covered entities to collect such statistics. Prohibits: (1) quotas and preferential treatment; and (2) an order or consent decree for a violation of this Act that includes a quota or preferential treatment. Declares that this Act is inapplicable to: (1) religious organizations; (2) the relationship between the United States and members of the armed forces; or (3) laws creating special rights or preferences for veterans. Prohibits the imposition of affirmative action for a violation of this Act. Disallows State immunity. Makes the United States or a State liable for remedies to the same extent as under the Civil Rights Act of 1964.

Shark Protection Act of 2001 - Amends the Magnuson-Stevens Fishery Conservation and Management Act to prohibit the sale, offer for sale, or purchase in interstate or foreign commerce of any shark fin that was removed, held in custody, controlled, or landed in violation of that Act.

Rural Telecommunications Enhancement Act - Authorizes the Secretary of Agriculture to make loans and grants to eligible (non-federal public or private) entities to finance the improvement, expansion, construction, acquisition, and operation of facilities to furnish or improve broadband transmission service in rural areas.

Commends and congratulates the people of Ukraine on the tenth anniversary of Ukrainian independence. Expresses the sense of Congress that: (1) the Ukrainian President and Parliament should continue efforts to maintain the balance of powers between the executive and legislative branches of government and ensure that their cooperation is aimed at furthering democratic reforms and strengthening civil society based on the rule of law; and (2) the United States should continue to assist in building an independent Ukraine through encouraging and supporting democratic and market-economy transformations.

Posthumous Citizenship Restoration Act of 2001 - Amends the Immigration and Nationality Act to extend until two years after the later of the date of enactment of this Act or the date of the person's death the deadline for the Attorney General to approve a request to grant posthumous citizenship to individuals who die while on active-duty military service.

Declares that Congress mourns the loss of life caused by several days of civil unrest in July 2001 in Kingston, Jamaica. Urges the Government of Jamaica to encourage a process of reconciliation to help resolve the crisis and to conduct an investigation of the events leading up to the civil unrest that is fair, open, timely, and transparent and that provides every segment of the Jamaican population an opportunity to be heard. Urges the President to: (1) provide, upon the request of the Jamaican Government, technical advice that would help such Government in its investigation of the events leading up to the unrest; (2) continue to cooperate with such Government to halt the illegal transport of firearms and ammunition from the United States to Jamaica; and (3) support the continuation of the democratic process and rule of law in Jamaica.

Fisheries Recovery Act of 2001 - Amends the Magnuson-Stevens Fishery Conservation and Management Act regarding avoiding and minimizing bycatch and bycatch mortality. Directs the Secretary of Commerce to report on progress made in implementing requirements regarding standardized reporting methodology and bycatch reduction. Requires a fishery management plan to close an area to a gear or practice that has been shown to adversely affect essential fish habitat unless the Regional Fishery Management Council (council) determines that closure is not necessary and the Secretary finds that the gear or practice will have a minimal adverse impact on habitat and minimal bycatch. Requires observers on commercial fishing vessels to collect data necessary for the conservation and management of the fishery, subject to specified requirements Modifies: (1) the definition of "overfishing" and "overfished" to include jeopardizing the ecological integrity and sustainability of marine ecosystems; (2) conservation and management measure requirements; and (3) fishery management plan requirements to add ecosystem considerations. Requires each fishery management plan to have a fishery impact statement. Directs the Secretary to develop at least one pilot fisheries ecosystem plan. Requires each council to prepare and submit to the Secretary a Fisheries Ecosystem Plan for each major marine ecosystem within its jurisdiction. Reauthorizes appropriations to carry out the Act. Amends the Saltonstall-Kennedy Act to earmark specified funds for direct industry assistance grants and for activities of the National Marine Fisheries Service that are directly related to implementation of the Magnuson Act.

Veterans Benefits Act of 2001 - Directs the Secretary of Veterans Affairs to increase, as of December 1, 2001, the rates of veterans' disability compensation, additional compensation for dependents, the clothing allowance for certain disabled adult children, and dependency and indemnity compensation for surviving spouses and children. Includes: (1) diabetes mellitus (type 2) among the diseases presumed to be service-connected, and therefore compensable under veterans' disability compensation, for veterans exposed to certain herbicide agents in the Republic of Vietnam during the Vietnam conflict; and (2) illnesses that cannot be clearly defined within such presumption for disabilities occurring in Persian Gulf War veterans. Preserves the service connection for undiagnosed illnesses occurring in Gulf War veterans to allow their participation in medical research projects. Authorizes the United States Court of Appeals for Veterans Claims to impose registration fees on persons participating in a judicial conference. Authorizes the payment of proceeds to certain alternate beneficiaries under the National Service Life Insurance and United States Government Life Insurance programs. Repeals the Department of Veterans Affairs Health Services Improvement Fund. Extends through December 31, 2005, the Native American veteran housing loan pilot program. Directs the Secretary to conduct a pilot program for expanding the toll-free telephone access to veterans service representatives. Codifies certain recurring provisions in annual Department of Veterans Affairs appropriations Acts.

Economic Revitalization Tax Act of 2001 - Amends Internal Revenue Code provisions concerning investment of earnings in U.S. property to set forth a separate rule governing any foreign corporation which is a controlled foreign corporation and is created or organized under the laws of, or engaged in the active conduct of a trade or business within, the Commonwealth of Puerto Rico or a possession of the United States. Provides that in the case of certain dividends received by a domestic corporation from such a corporation, there shall be allowed as a deduction an amount equal to 85 percent of such dividend. Establishes a safe harbor rule for certain transfers or licenses of intangible property to such a corporation.

Expresses the sense of Congress that the United States should make a complete accounting of all costs associated with the downing of the EP-3 aircraft that was forced to land on Hainan Island, China, on April 1, 2001, and make a formal request to the Chinese Government for reimbursement of such costs. Bars the use of funds made available to any department or agency of the U.S. Government to pay any claim by the Government of the People's Republic of China for reimbursement of the costs associated with the detention of the U.S. Navy EP-3 aircraft crewmembers, or for reimbursement of any costs associated with the return of such aircraft, until the Chinese Government first provides reimbursement to the U.S. Government for the costs associated with the return of the crewmembers and the aircraft to the United States and for the cost of either repairing or replacing the aircraft.

Abusive Tax Shelter Shutdown Act of 2001 - Amends the Internal Revenue Code to set forth general and special rules defining economic substance. Doubles the penalty for certain tax accuracy related underpayments. Penalizes the promoter of tax avoidance strategies which have no economic substance in an amount equal to 100 percent of the gross income derived. Modifies provisions concerning penalties for aiding and abetting understatement of tax liability, including adding provisions directed specifically at individuals who advise, represent, or procure certain tax shelters failing to meet legal requirements. Revises provisions concerning the failure to maintain lists of investors in potentially abusive tax shelters to set the penalty for certain violations at 50 percent of gross proceeds. Creates a new penalty, the penalty for failure to include tax shelter information with a return. Requires the registration of certain tax shelters without corporate participants. Revises provisions concerning the determination of the basis of corporations to state as a general rule that, with respect to property acquired by the issuance of stock or as paid-in surplus and transfers to corporations, if there would be (but for this paragraph) an importation of a net built-in loss, the basis of specified property acquired in such transaction shall be its fair market value immediately after such transaction. Revises provisions concerning partnerships with respect to: (1) the treatment of contributed property with a built-in loss; (2) the adjustment of partnership property on the transfer of a partnership interest if there is a substantial built-in loss; and (3) the adjustment to the basis of undistributed partnership property if there is a substantial basis reduction.

Help Is on the Way Military Pay Equity Act of 2001 - Prescribes increases in military basic pay rates as of January 1, 2002, of a minimum of 7.3 percent. Waives for FY 2002 any required adjustment in such pay based upon the General Schedule of Compensation for Federal employees.

Tribal Energy Self-Sufficiency Act - Amends the Indian Financing Act of 1974 to authorize appropriations, exempt from certain limitations, for Indian electric energy development, including electric generation, transmission, and distribution. Authorizes the Secretary of the Interior (Secretary) to transfer, upon tribal request, Federal water and power projects on Indian lands to the tribe upon whose land such projects are located. Directs the Secretary to continue trusteeship responsibilities to review agreements entered into between Indian tribes and other parties under: (1) the Federal Oil and Gas Royalty Management Act of 1982; and (2) the Indian Mineral Development Act of 1982. Instructs the Secretary to study and report to Congress on all dams and water impoundments on Indian land to determine their suitability for siting for electrical power projects. Requires the Western Area Power Administration to set up electric power transmission facilities for the development of wind power generation on certain Indian lands. Amends the Energy Policy Act of 1992 and the Department of Energy Organization Act to establish within the Department of Energy the Office of Indian Energy Policy and Programs to assist Indian tribes to meet certain energy needs. Creates the Indian Energy Loan Guaranty Fund to enable the Secretary to guarantee loans made to an Indian tribe for energy development. Amends the Public Utility Regulatory Policies Act of 1978 to make net metering available for renewable energy on Indian reservations. Amends the Federal Power Act to direct the Federal Energy Regulatory Commission, upon tribal application, to order the interconnection and wheeling of transmission or local distribution facilities owned by another person with those of the applicant tribe. Amends the Internal Revenue Code to: (1) extend the credit for electricity produced from certain renewable resources to solar power, non-closed loop biomass, incremental hydropower, geothermal energy, and fuel cells on Indian lands; and (2) allow a tax credit for the production of Indian oil or gas. Amends the Housing and Community Development Act of 1974 to make electricity facilities owned or controlled by an Indian tribe or entity eligible for community development assistance. Directs the Secretaries of Housing and Urban Development and of the Interior to develop energy efficiency and conservation measures in connection with certain housing located on Indian lands. Amends the Rural Electrification Act of 1936 to authorize grants and zero interest loans for energy efficiency purposes, including provision or modernization of electric facilities for an Indian tribe.

Insular Areas Oversight Avoidance Act - Requires the Director of the Office of Management and Budget (OMB) to publish with respect to each covered statement issued by OMB (including executive orders and agreements, presidential proclamations or directives, treaties, and submitted legislation) that does not include any U.S. insular area in any definition of "United States," "United States of America," or "State": (1) an explanation of the reasons for that omission; and (2) a recommendation of whether the definition should include such insular area.

Tohono O'odham Citizenship Act of 2001 - Amends the Immigration and Nationality Act to recognize persons listed on the official membership roll of the Tohono O'odham Nation, a federally recognized American Indian nation located in Arizona, as U.S. citizens as of the date such listing occurs. Provides that the valid membership credential issued to such listed persons shall be considered, for all purposes subject to Federal law, equivalent to: (1) a certificate of citizenship; and (2) a State-issued birth certificate.

Indian and Alaska Native Foster Care and Adoption Services Amendments of 2001 - Amends title IV part E of the Social Security Act (Foster Care and Adoption Assistance) to authorize an Indian tribe or intertribal consortium meeting certain requirements to receive Federal foster care maintenance payments for children placed in its custody. Prescribes procedural guidelines for foster care programs operated by Indian tribal organizations.

Congratulates: (1) the people of Peru for the successful completion of free and fair elections on April 8 and June 3, 2001; (2) Alejandro Toledo for his election as President and his commitment to democracy; (3) Valentin Paniagua, the current President, for his commitment to a peaceful transition; and (4) the Organization of American States Electoral Observer Mission for promoting representative democracy by working to ensure free and fair elections in Peru. Call for: (1) the United States to expand its cooperation with the Peruvian Government to promote the strengthening of democratic institutions and the rule of law, economic development, and an improved quality of life for citizens of both countries; and (2) such Governments to act in solidarity to promote democracy and respect for human rights and to enhance cooperation to confront common threats. Expresses: (1) sympathy to the Peruvian people for losses suffered as a result of the June 23, 2001 earthquake and support for their efforts to rebuild; and (2) support for relief and reconstruction assistance to Peru from the international community. Urges the President of the United States to encourage relief entities to expedite assistance.

Coral Reef and Coastal Marine Conservation Act of 2001 - Amends the Foreign Assistance Act of 1961 to establish in the Department of Treasury the Coral Reef and Other Coastal Marine Resources Facility. Authorizes the President, through the exchange by the Facility of new obligations for outstanding obligations of an eligible Latin American or Caribbean country with a coral reef or other coastal marine resource meeting specified requirements, to reduce the amount owed by the country to the United States that is outstanding as of January 1, 1999, as a result of concessional loans. Authorizes the President to sell, reduce, or cancel such loans in order to facilitate a debt-for-nature swap or a debt buyback with an eligible purchaser or eligible country to support activities to conserve, maintain, and restore the country's coral reefs and other coastal marine resources. Requires each beneficiary country that has entered into a Coral Reef and Other Coastal Marine Resources Agreement with the Secretary of State to establish a Coral Reef and Other Coastal Maine Resources Fund to receive payments of interest on new obligations undertaken by the country to provide grants to certain entities in such country to conserve, maintain, and restore its coral reefs and other coastal marine resources. Requires the Enterprise for the Americas Board to carry out certain duties with respect to implementing this Act.

Directs the Secretary of Education to study and report to Congress on the rate at which Native Americans (including Alaska Natives and Native Hawaiians) and students who reside in American Samoa, the Northern Mariana Islands, and Guam drop out of secondary schools in the United States. Requires recommendations for increasing the numbers of such students who graduate from secondary school. Directs the Secretary of Labor to report to Congress three years after enactment of this Act, describing the Federal programs funded during such period which were designed to decrease or otherwise address the rate at which students cease attending secondary schools in the United States before they have graduated.

Directs the Architect of the Capitol to enter into a contract for the design and construction of a monument, which shall be placed on permanent display in the Capitol rotunda, commemorating the contributions of minority women to women's suffrage and to the participation of women in U.S. public life. Requires the monument to depict African, Hispanic, Asian Pacific, Jewish, and Native American women. Requires use of an advisory committee to make recommendations.

Veterans Life Insurance Improvement Act of 2001 - Amends Federal provisions concerning the National Service Life Insurance and United States Government Life Insurance programs to allow payment of their insurance proceeds to: (1) another beneficiary if the first designated beneficiary has not made a claim to such payment within two years after the death of the insured; and (2) a person designated by the Secretary of Veterans Affairs if no claim has been filed by any designated beneficiary within four years after the insured's death. Requires service-disabled life insurance premium rates, as well as all policy cash, loan, paid-up, and extended values, for months beginning on or after the date of enactment of this Act to be based on the 1980 Commissioners Standard Ordinary Basic Table of Mortality, with five percent annual interest. Increases from $90,000 to $200,000 the maximum amount of veterans' mortgage life insurance coverage. Requires the United States to automatically insure any eligible veteran age 69 or younger (currently, any eligible veteran) for such coverage. Repeals the provision terminating such coverage upon the veteran's 70th birthday.

Medicare Dialysis Benefit Improvement Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act to provide for: (1) payment under the Medicare Program for four hemodialysis treatments per week for specified patients; and (2) an increased update in the composite payment rate for renal dialysis treatments for FY 2002. Amends the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 to restore a specified exception to renal dialysis composite rate under rate update provisions.

Expresses the sense of Congress that: (1) the status quo on Cyprus must end and the island and its people must be reunited in a bi-zonal, bi-communal federal Cyprus, on the basis of United Nations Security Council resolutions; (2) the accession of Cyprus to the European Union (EU) would act as a catalyst for the solution of the Cyprus problem without such solution being a precondition for accession; (3) membership of Cyprus to the EU should be strongly supported; (4) all Cypriots should be urged to support and encourage efforts to bring Cyprus into the EU; and (5) U.S. agencies should pursue initiatives that will help promote and achieve reunification, reconciliation, stability, and prosperity on Cyprus.

Authorizes the Secretary of the military department concerned to posthumously grant disability retirement for individuals who die in the line of duty while on active duty. Authorizes the payment of disability retirement compensation to the dependent survivors of such individuals under the Survivor Benefit Plan.

Indian School Construction Act of 2001 - Directs the Secretary of the Interior to establish a pilot program under which eligible Indian tribes have the authority to issue tribal school modernization bonds to provide funding for the construction, rehabilitation, or repair of tribal schools, including advance planning and design. Permits a tribe to use amounts received through the issuance of a bond to enter into and make payments under contracts: (1) for the design and engineering of the school; and (2) with financial advisors, underwriters, attorneys, trustees, and other professionals who would be able to provide assistance to the tribe in issuing bonds. Makes any tribal school modernization bond issued by a tribe subject to a trust agreement. Authorizes the Secretary to deposit not more than $30 million each fiscal year into a tribal school modernization escrow account beginning in FY 2002 from amounts made available for school replacement under the construction account of the Bureau of Indian Affairs. Requires the Secretary to use any amounts deposited to make payments to trustees or for advance planning and design. Declares that no bond shall be an obligation of, nor shall payment of the principal be guaranteed by the United States. Provides that any amounts earned through the investment of funds under the control of a trustee shall not be subject to Federal income tax. Amends the Internal Revenue Code to allow a tax credit to individuals who hold such bonds. Permits a separation (including at issuance) of the ownership of such a bond and the entitlement to the credit with respect to such bond.

Russian Democracy Act of 2001 - Declares it shall be U.S. policy to: (1) engage the Government of the Russian Federation to strengthen democratic reform and institutions, and to promote good governance principles based on the internationally recognized norms of transparency in business practices, the rule of law, religious freedom, and human rights; (2) incorporate democratic reforms, independent media, and economic reforms in the broad U.S. agenda with such Government; and (3) encourage such Government to address cross-border issues, including the environment, crime, trafficking, and corruption in a cooperative and transparent manner consistent with internationally recognized principles of the rule of law. Expresses the sense of Congress that the Government of the Russian Federation, as obliged under existing bilateral agreements, should resolve outstanding taxation issues that hinder the deliverance of U.S. assistance programs. Amends the Foreign Assistance Act of 1961 to include among activities eligible for U.S. assistance to the independent states of the former Soviet Union activities for the promotion of democracy, rule of law, human rights, economic reforms, administration of justice, and the development of a free and independent media in Russia. Authorizes the President to carry out specified related activities in providing such assistance to Russia.

Amends the Tropical Forest Conservation Act of 1998 to authorize appropriations through FY 2004 for the cost for the reduction of debt owed by a developing country with a tropical forest to the United States as a result of concessional loans made or credits extended to such country under specified laws.

Increases from $300 to $500 the authorized allowance for burial and funeral expenses for deceased veterans who: (1) at the time of death were in receipt of veterans' disability compensation or veterans' pension benefits; or (2) were veterans of any war or were discharged or released from active military service for a service-connected disability and for whom there is no next of kin or sufficient resources to cover funeral and burial costs. Increases from $300 to $500 the plot allowance for a veteran who dies in a Department of Veterans Affairs facility or a facility providing Department-contracted care.

Declares that the House of Representations condemns and deplores: (1) the continued detention of Li Shaomin, Gao Zhan, Wu Jianmin, Tan Guangguang, Teng Chunyan, and other scholars detained on false charges by the Government of the People's Republic of China and calls for their immediate and unconditional release; (2) the lack of due process afforded to these detainees and the probable coercion of confessions from some of them; and (3) the ongoing and systematic pattern of human rights violations by the Chinese Government. Urges the Chinese Government to consider: (1) the implications to the broader U.S.-Chinese relationship of detaining and coercing confessions from U.S. citizens and permanent residents on unsubstantiated spying charges or suspicions; and (2) releasing Liu Yaping on humanitarian grounds. Expresses the sense of the House of Representatives that the President should: (1) make the release of the scholars a top priority of U.S. foreign policy with the Chinese Government; (2) make every effort to assist the scholars and their families while discussions of their release continue; (3) make it clear that the detention of U.S. citizens and permanent residents on unsubstantiated spying charges or suspicions of spying and the infliction of human rights violations upon U.S. citizens and residents, is not in the interests of the Chinese Government; and (4) send a special, high ranking representative to reiterate the deep concern of the United States regarding the continued imprisonment of the scholars and to discuss their legal status and immediate humanitarian needs.

Reservist VA Home Loan Fairness Act of 2001 - Prescribes uniform fees for members of the Selected Reserve and veterans eligible through qualifying active duty service for home loans guaranteed, insured, or made through the Department of Veterans Affairs (currently, separate fees apply to active duty veterans and reservists).

Rural Teachers Recruitment Act of 2001 - Authorizes the Secretary of Education to make grants to eligible rural local educational agencies to recruit and retain qualified teachers for elementary and secondary schools. Includes among authorized uses of such teacher incentive program funds: (1) salary increases; (2) reimbursement for teacher certification and relocation expenses; and (3) assistance to pay college and graduate school tuition and training expenses.

End Racial Profiling Act of 2001 - Prohibits any law enforcement agency or agent from engaging in racial profiling. Authorizes the United States, or an individual injured by racial profiling, to bring a civil action for declaratory or injunctive relief to enforce this prohibition. Specifies that proof that the routine investigatory activities of law enforcement agents in a jurisdiction have had a disparate impact on racial or ethnic minorities shall constitute prima facie evidence of a violation. Authorizes the court to allow a prevailing plaintiff, other than the United States, reasonable attorneys' fees as part of the costs, including expert fees. Requires Federal law enforcement agencies to: (1) maintain adequate policies and procedures designed to eliminate racial profiling; and (2) cease existing practices that encourage racial profiling. Directs that any application by a State or governmental unit for funding under a covered program include a certification that such unit and any agency to which it is redistributing program funds: (1) maintains adequate policies and procedures designed to eliminate racial profiling; and (2) has ceased existing practices that encourage racial profiling. Authorizes the Attorney General to make grants to States, law enforcement agencies and other governmental units, Indian tribal governments, or other public and private entities to develop and implement best practice devices and systems to ensure the racially neutral administration of justice. Directs the Attorney General to submit to Congress a report on racial profiling by Federal, State, and local law enforcement agencies.

Authorizes the President to present on behalf of Congress: (1) a gold medal to the family of Andrew Jackson Higgins in recognition of his contributions to the Nation and to the Allied victory in World War II; (2) an identical medal to the D-Day Museum in New Orleans, Louisiana, for public display; and (3) a gold medal to the Museum in honor of the World War II employees of Higgins Industries and in recognition of their contributions to the Nation and to the Allied victory in World War II. Authorizes the Secretary of the Treasury to strike and sell bronze duplicates.

The TRICARE Retirees Opportunity Act of 2001 - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act to: (1) waive the Medicare part B late enrollment penalty for military retirees who enroll by December 31, 2002; and (2) direct the Secretary of Health and Human Services to provide for a special enrollment period in the case of any such individual eligible to enroll, but who is not enrolled, under Medicare part B with such period to end on December 31, 2002.
