This joint resolution nullifies the rule titled Revised Definition of "Waters of the United States," which was submitted by the U.S. Army Corps of Engineers and the Environmental Protection Agency on January 18, 2023. The rule specifies which bodies of water fall under the scope of the Clean Water Act and are thereby under federal jurisdiction. The 2023 rule replaced a 2020 rule that included a narrower definition of waters of the United States .

Empowering Nonprofits Act This bill reduces cost-sharing requirements for grants directly awarded to certain nonprofit organizations for the five years following the bill's enactment. Eligible nonprofit organizations are those in states or Indian tribes with more than 20% of individuals living below the poverty line. Specifically, the bill requires an executive agency, during that time frame, to reduce any cost-sharing requirement by 25% for grants made directly to an eligible nonprofit.

Guam Excess Land Return Act This bill allows excess federal lands in Guam to be transferred to the original landowners or their heirs if such prior ownership can be verified in the official records maintained by the government of Guam. The government of Guam must establish a process for such transfers.

Ensuring Accurate and Complete Abortion Data Reporting Act of 2023 This bill requires states, as a condition of federal payment under Medicaid for family planning services, to report certain abortion data to the Centers for Disease Control and Prevention (CDC). (Currently, reporting is voluntary.) The CDC must develop standardized questions for states with respect to specified variables (e.g., maternal demographics and methods of abortion).

Holocaust Education and Antisemitism Lessons Act or the HEAL Act This bill directs the U.S. Holocaust Memorial Museum to study and report on Holocaust education efforts in states, local educational agencies (LEAs), and public elementary and secondary schools. Among other elements, the study must (1) determine whether states and LEAs require Holocaust education as part of the curriculum taught in public elementary and secondary schools, (2) identify the standards and requirements relating to Holocaust education, and (3) identify the types of instructional material used to teach students about the Holocaust.

Forgotten Heroes of the Holocaust Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to 60 diplomats posthumously in recognition of their brave and vital service of saving Jews during World War II.

Northern Marianas Population Stabilization Act This bill provides Commonwealth of the Northern Mariana Islands (CNMI) Resident status to certain otherwise qualifying non-U.S. nationals ( aliens under federal law) who do not meet a current requirement of having resided continuously and lawfully in the Northern Mariana Islands from November 28, 2009, through June 25, 2019. Specifically, an individual shall be exempt from this residency requirement if the individual was admitted as a Commonwealth Only Transitional Worker during FY2015 and every subsequent fiscal year before July 24, 2018. To qualify for CNMI Resident status, the individual must meet other existing requirements related to such status. An individual who has resided in the Northern Mariana Islands as an investor and is currently residing as a Northern Mariana Islands-only nonimmigrant may receive CNMI Resident status upon meeting other requirements.

Salvaging American Lumber Via Action with Greater Efficiency Act or the SALVAGE Act This bill provides for certain activities related to salvage operations and certain reforestation activities conducted on National Forest System lands or public lands. The bill categorically excludes salvage operations carried out by the Department of Agriculture (USDA) and the Department of the Interior, on certain National Forest System lands or certain public lands, respectively, from the requirement to prepare an environmental assessment or an environmental impact statement. Each salvage operation covered by the categorical exclusion may not contain treatment units that exceed a total of 10,000 acres. An environmental assessment for a salvage operation or reforestation activity proposed to be conducted on National Forest System lands or public lands that are adversely impacted by a large-scale catastrophic event shall be completed within 60 days after the conclusion of the event. In the case of such reforestation activities USDA and Interior shall, to the maximum extent practicable, achieve reforestation of at least 75% of the impacted lands during the five-year period following the conclusion of the catastrophic event. No later than 60 days after a wildfire is contained on National Forest System lands, USDA shall convert any timber sales on lands impacted by such wildfire to salvage sales. No restraining order, preliminary injunction, or injunction pending appeal shall be issued by any U.S. court respecting any decision to prepare or conduct a salvage operation or reforestation activity in response to a large-scale catastrophic event.

Deliver for Veterans Act This bill authorizes the Department of Veterans Affairs (VA) to pay the total shipping price for the delivery of an automobile or other conveyance to certain disabled veterans or members of the Armed Forces. Currently, the VA may pay the lesser of (1) $24,115 (adjusted annually for inflation), or (2) the full purchase price associated with providing an automobile or other conveyance to such individuals (not including delivery costs).

Extending Limits of U.S. Customs Waters Act This bill extends the customs waters territory of the United States. Under current law, customs waters means waters within four leagues of the coast of the United States. This bill revises the definition to include (1) the territorial sea of the United States to the limits permitted by international law in accordance with Presidential Proclamation 5928, dated December 27, 1988, that extended such limits to 12 nautical miles from the baselines of the United States; and (2) the contiguous zone of the United States to the limits permitted by international law in accordance with Presidential Proclamation 7219, dated September 2, 1999, that extended such limits to 24 nautical miles from the baselines of the United States.

Foreign Adversary Risk Management Act or the FARM Act This bill places the Secretary of Agriculture on the Committee on Foreign Investment in the United States. It also requires the committee to review any investment that could result in foreign control of any U.S. agricultural business. Further, the bill includes agricultural systems and supply chains in the definitions of critical infrastructure and critical technologies for the purposes of reviewing such investments. The Department of Agriculture and the Government Accountability Office must each analyze and report on foreign influence in the U.S. agricultural industry.

Mount Rushmore Protection Act This bill prohibits the use of any federal funds to alter, change, destroy, or remove any name, face, or other feature on the Mount Rushmore National Memorial in South Dakota and designates Mount Rushmore.

Retired Pay Restoration Act This bill allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability. Under current law, only individuals with service-connected disabilities rated at 50% or more receive both without offset. Individuals who were retired or separated after at least 20 years of military service due to a service-connected disability shall be eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay.

Supplemental Security Income Equality Act This bill extends the Supplemental Security Income (SSI) program to Puerto Rico, the U.S. Virgin Islands, Guam, and American Samoa. This is a federal program designed to help aged, blind, and disabled individuals with limited income and resources meet basic needs. When Congress created the SSI program in 1972, it excluded these territories. The Social Security Administration may waive or modify statutory requirements relating to the provision of benefits as necessary to adapt the SSI program to each territory. This bill also eliminates a limit on payments from the Temporary Assistance for Needy Families (TANF) program and other Department of Health and Human Services programs to the territories.

Puerto Rico Nutrition Assistance Fairness Act This bill sets out a process to enable Puerto Rico to participate as a state in the Supplemental Nutrition Assistance Program (SNAP). Under current law, a state receives SNAP funding based on the number of participating households in the state whereas Puerto Rico receives a block grant to fund its nutrition assistance program. The bill requires Puerto Rico to submit to the Department of Agriculture (USDA) a plan of operation to transition away from the consolidated block grant program to SNAP. USDA must provide appropriate training and technical assistance to enable Puerto Rico to formulate such plan.

Social Security Fairness Act of 2023 This bill repeals provisions that reduce Social Security benefits for individuals who receive other benefits, such as a pension from a state or local government. The bill eliminates the government pension offset , which in various instances reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own. The bill also eliminates the windfall elimination provision , which in some instances reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes. These changes are effective for benefits payable after December 2023.

Proven Forest Management Act of 2022 This bill directs the Department of Agriculture (USDA), when conducting a forest management activity on National Forest System land, to coordinate with impacted parties to increase efficiency and maximize the compatibility of management practices across such land. USDA shall conduct such an activity on National Forest System land in a manner that attains multiple ecosystem benefits, including reducing forest fuels and maintaining biological diversity. However, a forest management activity shall not be conducted if the costs associated with attaining such benefits are excessive. Additionally, the USDA shall (1) establish any post-program ground condition criteria for a ground disturbance caused by a forest management activity required by the applicable forest plan, and (2) provide for monitoring to ascertain the attainment of relevant post-program conditions. The bill categorically excludes certain forest management activities for reducing forest fuels from certain environmental impact requirements. USDA or the Department of the Interior, as appropriate, in conjunction with land adjustment programs, may enter into contracts and cooperative agreements with a qualified entity to provide for fuel reduction, erosion control, reforestation, Stream Environment Zone restoration, and similar management activities on federal lands and nonfederal lands within such programs.

Permitting for Mining Needs Act of 2023 This bill expedites the review of mining projects on federal lands and limits judicial review of mining projects. For example, the bill expands the federal permitting and review processes under the Infrastructure Investment and Jobs Act for critical minerals. Under the act, the Bureau of Land Management (BLM) and the U.S. Forest Service, to the maximum extent practicable, must complete the federal permitting and review processes related to critical mineral mines on federal lands with maximum efficiency and effectiveness. This bill expands this process to include all minerals as defined by the bill, not only critical minerals. The bill also establishes deadlines for completing the review of mining projects under the National Environmental Policy Act of 1969. In addition, the bill also expands the meaning of covered projects under the Fixing America's Surface Transportation (FAST) Act to include (1) certain mineral production projects, and (2) certain actions taken by the Department of Defense. Such projects qualify for expedited environmental review. It also establishes requirements to expedite the review or authorization of certain mineral projects, such as (1) mineral exploration activities with a surface disturbance of no more than five acres of public lands, (2) ancillary mining activities, and (3) uranium projects. Finally, the bill limits judicial review of a permit, license, or approval issued by a lead agency for a mining project by requiring the filing of claims within a certain time period.

Action Versus No Action Act This bill limits the scope of certain environmental assessments or impact statements related to forest management activities on National Forest System lands or public lands suitable for timber production to a consideration only of the effects of the forest management activity and the alternative of no action. Specifically, the bill applies to assessments or impact statements prepared by the Department of Agriculture (USDA), with respect to National Forest System lands, or the Department of the Interior, with respect to public lands, for forest management activities that meet at least one of the criteria specified. In the case of the alternative of no action, USDA or Interior shall consider whether to evaluate the effect of no action on, among other things, forest health, wildfire potential, insect and disease potential, and timber production; and the implications of a resulting decline in forest health, loss of habitat diversity, wildfire, or insect or disease infestation on potential losses of life and property, domestic water supply in the project area, and wildlife habitat loss.

Security First Act This bill reauthorizes the Operation Stonegarden program from FY2024 through FY2027 and addresses other border security issues. (Operation Stonegarden provides grants to enhance the border security capabilities of state, local, and tribal governments.) From FY2024 through FY2027, the money from unreported monetary instruments seized from individuals crossing the U.S.-Mexico border and transferred into the Department of the Treasury general fund shall be made available without further appropriation to the Department of Homeland Security (DHS) to fund Operation Stonegarden. DHS must report to Congress on (1) DHS hiring practices from 2018 to 2021, and (2) whether certain Mexican drug cartels meet the criteria to be designated as foreign terrorist organizations. DHS must also periodically report to Congress about the technology needed to secure the U.S.-Mexico land border.

Stop Human Trafficking in School Zones Act This bill establishes an enhanced penalty—an additional prison term of up to five years—for certain human trafficking offenses and sex offenses involving minors that occur within 1,000 feet of the real property comprising a school, school-sponsored activity, playground, or public housing facility; or within 100 feet of certain other places where children gather (e.g., a youth center or swimming pool). The additional prison term must be served consecutively with the prison term imposed for the underlying offense.

Protecting America's Strategic Petroleum Reserve from China Act This bill prohibits the sale and export of crude oil from the Strategic Petroleum Reserve (SPR) to China. Specifically, the bill prohibits the Department of Energy (DOE) from selling petroleum products (e.g., crude oil) from the SPR to any entity that is under the ownership, control, or influence of the Chinese Communist Party. Further, DOE must require as a condition of any sale of crude oil from the SPR that the oil not be exported to China.

Concealed Carry Reciprocity Act This bill establishes a federal statutory framework to regulate the carry or possession of concealed firearms across state lines. Specifically, an individual who is eligible to carry a concealed firearm in one state may carry or possess a concealed handgun (other than a machine gun or destructive device) in another state that allows its residents to carry concealed firearms. It sets forth requirements for the lawful concealed carry across state lines. The bill preempts most state and local laws related to concealed carry and establishes a private right of action for a person adversely affected by interference with a concealed-carry right established by this bill.

Prosecutors Need to Prosecute Act This bill requires certain state and local prosecutors to report data on criminal referrals and outcomes of cases involving murder or non-negligent manslaughter, forcible rape, robbery, aggravated assault, burglary, larceny, motor vehicle theft, arson, or any offense involving the illegal use or possession of a firearm. The reporting requirement applies to state and local prosecutors in a jurisdiction with 380,000 or more persons that receives funding under the Edward Byrne Memorial Justice Assistance Grant program. The report must contain data on cases referred for prosecution, cases declined for prosecution, cases resulting in a plea agreement with the defendant, cases initiated against defendants with previous arrests or convictions, and defendants charged who were released or eligible for bail.
