Black Maternal Health Momnibus Act

United States · United States Congress · 15 May 2023

Black Maternal Health Momnibus Act This bill directs multi-agency efforts to improve maternal health with a particular focus on racial and ethnic minority groups, veterans, and other vulnerable populations. The Department of Health and Human Services (HHS) must address the social determinants of maternal health (i.e., child care, housing, and other nonmedical factors that affect health outcomes). HHS and other departments must also carry out other actions to increase access to maternal health care and otherwise improve maternal health, such as growing and diversifying the maternal health workforce; establishing various grants and other programs, including ones related to maternal health disparities and maternal behavioral health; testing alternative payment models for perinatal care in Medicaid and the Children's Health Insurance Program (CHIP); addressing maternal health during public health emergencies; and supporting training, technology, and telehealth initiatives. The bill further provides for extended postpartum and breastfeeding eligibility for the Special Supplemental Nutrition Program for Women, Infants, and Children; increased research and data collection on maternal health indicators; activities to mitigate adverse maternal health outcomes associated with climate change; and expanded public education to improve maternal vaccination rates. The bill also addresses maternal health for incarcerated populations. For example, it (1) requires the Bureau of Prisons and the Department of Justice to establish programs to improve maternity care; and (2) reduces grants for criminal justice activities unless the recipient state or territory has a law to limit the use of restraints during pregnancy for incarcerated populations.

Unfunded Mandates Accountability and Transparency Act of 2023

United States · United States Congress · 11 May 2023

Unfunded Mandates Accountability and Transparency Act This bill revises rulemaking requirements with respect to unfunded mandates. Specifically, the bill requires federal agencies to prepare and publish in the Federal Register an initial and final regulatory impact analysis prior to promulgating any proposed or final major rule. The analysis must include regulatory alternatives to the rule. Major rule means a rule that the Office of Information and Regulatory Affairs determines is likely to cause an annual effect on the economy of $100 million or more; a major increase in costs or prices for consumers, individual industries, federal, state, local, or tribal government agencies, or geographic regions; or significant adverse effects on competition, employment, investment, productivity, innovation, public health and safety, or the ability of U.S.-based enterprises to compete with foreign-based enterprises in domestic and export markets. Before promulgating any proposed or final major rule, an agency shall select the regulatory alternative that maximizes net benefits, taking into consideration only the costs and benefits that arise within the scope of the statutory provision that authorizes the rulemaking, with exceptions. The bill prohibits Congress from considering a bill that increases private sector costs more than a certain amount unless certain conditions are met.

To authorize the immediate expulsion of inadmissible aliens attempting to enter the United States by fraud or without a necessary entry document, and for other purposes.

United States · United States Congress · 11 May 2023

This bill requires the immediate expulsion of certain inadmissible non-U.S. nationals ( aliens under federal law) who arrive at or along the U.S.-Mexico border subject to certain limits. Specifically, during the two years starting from this bill's enactment, such a non-U.S. national must be immediately expelled without further hearing or review if the individual lacks proper documentation or committed fraud to gain admission. (Currently, such individuals are typically subject to expedited removal, which includes a chance to request asylum.) Such an individual must be expelled to Mexico unless Mexico's government is unwilling to accept the individual or expulsion to Mexico is contrary to U.S. national interest. In such a case, the individual shall be expelled to the country (1) where the individual is a citizen, subject, or national; (2) where the individual was born or has a residence; or (3) that will accept the individual. An individual may not be expelled to a country where (1) the individual's life or freedom would be threatened due to certain characteristics, such as race or religion; or (2) there are substantial grounds for believing the individual would be subject to torture. However, this protection shall not apply to an individual convicted of a particularly serious crime or involved with terrorist activities. An individual who claims that they be subject to such dangers in a country must meet the burden of proof similar to the burden faced by an asylum seeker in a credible fear determination.

United States · United States Congress · 26 April 2023

Secure and Fair Enforcement Banking Act of 2023 or the SAFE Banking Act of 2023 This bill provides protections for federally regulated financial institutions that serve state-sanctioned marijuana businesses. Currently, many financial institutions do not provide services to state-sanctioned marijuana businesses due to the federal classification of marijuana as a Schedule I controlled substance. Under the bill, a federal banking regulator may not penalize a depository institution for providing banking services to a state-sanctioned marijuana business. For example, regulators may not terminate or limit the deposit or share insurance of a depository institution solely because the institution provides financial services to a state-sanctioned marijuana business. The bill also prohibits a federal banking regulator from requesting or ordering a depository institution to terminate a customer account unless (1) the regulator has determined that the depository institution is engaging in an unsafe or unsound practice or is violating a law or regulation, and (2) that determination is not based primarily on reputation risk. Additionally, proceeds from a transaction involving activities of a state-sanctioned marijuana business are no longer considered proceeds from unlawful activity. (Financial institutions that handle proceeds from unlawful activity are subject to anti-money laundering laws. Violators of these laws are subject to fines and imprisonment.) Furthermore, a financial institution, insurer, or federal agency may not be held liable or subject to asset forfeiture under federal law for providing a loan, mortgage, or other financial service to a state-sanctioned marijuana business.

Additionally, governments may not require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining services. The same provisions that apply to abortions before viability also apply to necessary abortions after viability. Additionally, states may authorize post-viability abortions in circumstances beyond those that the bill considers necessary.
