United States · United States Congress · 20 April 2023

Freedom from Government Competition Act of 2023 This bill requires the federal government to procure from the private sector the goods and services necessary for the operations and management of government agencies. Employee Rights Act

United States · United States Congress · 19 April 2023

Employee Rights Act This bill generally addresses employer obligations related to unionized workplaces. This bill provides that an employer may be considered a joint employer in relation to an employee under federal labor law only if such employer directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline. The bill also requires a workplace election to approve or reject a union to be conducted by secret ballot. Further, the bill requires an employer to provide limited employee information to union representatives to facilitate a workplace election. An employer that mishandles or fails to provide such information according to the bill's requirements may be liable for an unfair labor practice (i.e., labor law violation). Additionally, the bill requires an employee to authorize in writing any use of the employee's labor organization dues or other contribution for a purpose other than collective bargaining or contract administration. Such authorization must be made upon 35 days' notice and expires after one year. Finally, the bill exempts Indian Tribes, including Indian Tribe enterprises and institutions, from the collective bargaining rights and related provisions of federal labor law.

Strengthening Medicare for Patients and Providers Act

United States · United States Congress · 3 April 2023

Strengthening Medicare for Patients and Providers Act This bill modifies certain adjustments to payment amounts under the Medicare physician fee schedule. Payment amounts under the Medicare physician fee schedule are based on a service's relative value, a conversion factor, and a geographic adjustment factor. Current law provides for separate conversion factors for physicians that are qualifying participants in advanced alternative payment models (also known as qualifying APM participants) and for other physicians beginning in 2026, with an annual update of 0.75% and 0.25%, respectively. The bill replaces the separate conversion factors for qualifying APM participants and other physicians with a single conversion factor and provides for an update that is equal to the annual percentage increase in the Medicare Economic Index, beginning in 2024. (The Medicare Economic Index is a specialized index that is generally used to determine allowed charges for physician services based on annual price changes.)

United States · United States Congress · 23 March 2023

This bill requires the military departments to ensure that certain military service in a female cultural support team is included in an individual's military service record and in the computation of retired pay. Specifically, the bill addresses service of a member of the Armed Forces who served in a female cultural support team (with the personal development skill identifier of R2J or 5DK) from January 1, 2010, through August 31, 2021. The bill provides that individuals who performed such service (or their survivors) who have previously had a claim for service-connection denied may resubmit a claim for the same condition to be considered by the Department of Veterans Affairs (VA). For purposes of claims for service-connected disability or death, the VA must treat such service as engagement in combat with the enemy in the course of active duty. The VA must determine the effective date of the award by treating the date of the initial claim as the date on which the individual filed the awarded claim. The VA must also improve training and guidance for employees who may process claims for service-connected disability and death for individuals who served in a female cultural support team. Finally, the VA must conduct outreach to inform individuals who performed such service (or survivors of such individuals) that they may submit supplemental claims for service-connected disability or death incurred or aggravated in the course of service.

Unauthorized Spending Accountability Act of 2023

United States · United States Congress · 9 March 2023

Unauthorized Spending Accountability Act of 2023 This bill establishes a three-year budgetary level reduction schedule for unauthorized programs funded through the annual appropriations process. Under the bill, a budgetary level is an allocation provided to the congressional appropriations committees under Section 302(a) of the Congressional Budget Act of 1974 by a congressional budget resolution or a deeming resolution. The schedule applies to programs included in the Congressional Budget Office's annual report listing programs that are funded through the appropriations process and have an authorization of appropriations that has either expired or will expire during the year. For the first year after a program's authorization has expired, the bill requires the budgetary level to be reduced by 10% of the funds appropriated for the program in the expiring fiscal year. The bill then requires reductions of 15% in the second and third years before terminating the program at the end of the third unauthorized year. Programs that are reauthorized during the three-year period are exempt from the budgetary level reductions if the reauthorization contains a sunset provision limiting the authorization of appropriations period to no more than three years. The bill establishes the Spending and Accountability Commission to review all mandatory spending programs and submit to Congress a legislative proposal to establish an authorization cycle for discretionary spending programs. The commission may recommend legislation to replace the budgetary level reductions required by this bill with reductions in mandatory spending. The commission's reauthorization schedule must limit reauthorizations to three years, include the budgetary level reductions established by this bill, and establish a mechanism for replacing the budgetary level reductions with reductions to mandatory spending programs. The House of Representatives must consider the commission's proposal using specified expedited legislative procedures.
