John R. Lewis Voting Rights Advancement Act of 2023 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. Preclearance is the process of receiving preapproval from the Department of Justice (DOJ) or the U.S. District Court for the District of Columbia before making legal changes that would affect voting rights. A state and all of its political subdivisions shall be subject to preclearance of voting practice changes for a 10-year period if, during the previous 25 years: 15 or more voting rights violations occurred in the state; 10 or more violations occurred, at least 1 of which was committed by the state itself; or 3 or more violations occurred and the state administers the elections. A political subdivision as a separate unit shall also be subject to preclearance for a 10-year period if three or more voting rights violations occurred there during the previous 25 years. States and political subdivisions that meet certain thresholds regarding minority groups must preclear covered practices before implementation, such as redistricting. States and political subdivisions must notify the public of changes to voting practices. The bill authorizes DOJ to require states or political subdivisions to provide certain documents or answers to questions for enforcing voting rights. The bill outlines factors courts must consider when hearing challenges to voting practices, such as the extent of any history of official voting discrimination in the state or political subdivision.

Expanding the Voluntary Opportunities for Translations in Elections Act or the Expanding the VOTE Act This bill expands access to voting materials for individuals with limited proficiency in the English language. Section 203 of the Voting Rights Act of 1965 (VRA) requires covered states and political subdivisions to provide voting materials and other language assistance to persons who are American Indian, Asian American, Alaskan Natives, or of Spanish heritage and whose ability to speak or understand English limits electoral participation. A state or political subdivision that is subject to Section 203 is prohibited from providing English-only voting materials in an election. Among other requirements, this bill (1) requires the Department of Justice to issue a notice of prohibition, including the trigger threshold at which the prohibition applies, to certain states and political subdivisions; and (2) requires covered states and political subdivisions to provide written translations of all voting materials, with the consent of any applicable tribal government, to election workers. Additionally, the bill requires the Election Assistance Commission to make incentive grants for states and political subdivisions to provide translated voting materials. The bill also directs the Government Accountability Office to study and report on the impact of (1) reducing the threshold requirement under Section 203 of the VRA, and (2) expanding the definition of language minorities to include native speakers of additional languages.

Working for Immigrant Safety and Empowerment Act of 2023 or the WISE Act of 2023 This bill expands eligibility for U nonimmigrant visas (victims of criminal activity) and addresses related issues. Generally, U visas are for victims of specified crimes (e.g., rape, trafficking, or domestic violence) who assist with the investigation or prosecution of the crime. The bill adds hate crimes, child abuse, and elder abuse as crimes that may qualify a victim for a U visa. Furthermore, the Department of Homeland Security (DHS) must provide work authorization to U visa applicants, whereas currently DHS may grant work authorization but is not required to do so. The bill also eliminates the annual numerical cap on U visas. The bill establishes a rebuttable presumption that certain individuals, including U visa applicants and T visa (victims of human trafficking) applicants, shall not be detained while the application is pending. Additionally, the bill provides immigration-related protections, such as by extending the admission period and providing work authorization, to the spouse or child of a nonimmigrant visa holder who subjected that spouse or child to battery or extreme cruelty. Further, the bill prohibits, with some exceptions for exigent circumstances, U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection from conducting immigration enforcement actions within 1,000 feet of a school, health care facility, place of worship, or other location specified in the bill.

Protect America's Children from Toxic Pesticides Act This bill amends the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for various purposes, including to modify definitions, cancel or limit the registration of certain pesticides and active ingredients, and create a cause of action for individuals for FIFRA violations. The Environmental Protection Agency (EPA) must immediately suspend the registration of any active ingredient or pesticide product that is banned or otherwise prohibited from entering the market by the European Union, one or more countries in the European Union, or Canada. The EPA must not permit the continued sale or use of existing stocks of a pesticide with a suspended or canceled registration or that is vacated or set aside by judicial decree. The bill implements a reporting requirement and other protections related to farmworkers who are exposed to certain pesticide elements (e.g., active ingredients) that result in illness, injury, disability, or death. Among other elements, the bill also creates a process by which an interested person may submit a rulemaking petition to designate an active ingredient or pesticide product as a dangerous pesticide; requires entities that have been granted conditional pesticide registrations to satisfy the conditions of the registration within two years; limits the ability of the EPA to grant emergency exemptions for certain active ingredients or pesticide products; cancels the registration of organophosphates, neonicotinoids, and paraquat; requires the disclosure of inert ingredients in the ingredient statement for pesticide products; and authorizes individuals to bring a civil action against the EPA for alleged failures to comply with provisions under FIFRA.

Fair Access for Individuals to Receive Leave Act or the FAIR Leave Act This bill eliminates a limitation on the amount of leave that spouses working for the same employer may access under the Family and Medical Leave Act (FMLA). Under current law, an eligible individual may access up to 12 weeks of FMLA leave per year, but spouses with the same employer are required to share a total of 12 weeks of FMLA leave per year if the leave is taken for the birth of a child, the placement of a child with the employee for adoption or foster care, or to care for a parent with a serious health condition. The bill repeals this limitation, making each spouse eligible for up to 12 weeks of leave per year in these situations.

Student Loan Interest Elimination Act This bill makes changes to federal student loans, including to interest rates. Specifically, the bill directs the Department of Education (ED) to establish and implement procedures to (1) modify the terms of Federal Direct Loans so that beginning on July 1, 2024, no interest shall accrue on such a loan; and (2) allow a borrower to opt out of this loan modification. Additionally, ED must establish and implement procedures to (1) refinance eligible loans that are not Federal Direct Loans (e.g., privately held Federal Family Education Loans and Perkins Loans), and (2) allow a borrower to opt out of this loan refinancing. The bill outlines the terms and conditions of these refinanced loans, including by prohibiting ED from charging origination fees and specifying that no interest shall accrue on these loans. Next, the bill creates a tiered interest rate (based on the borrower's total adjusted available income) for federal student loans made on or after July 1, 2024. The bill caps this interest rate at 4%. The bill establishes the Education Affordability Trust Fund. ED must deposit all payments made on federal student loans into this trust fund. The Trust Fund Board, as established by this bill, must transfer the profits from investments of this trust fund to ED to pay for the administrative costs of carrying out federal student loan programs.
