SAVE Act

United States · United States Congress · 3 January 2025

Safeguard American Voter Eligibility Act or the SAVE Act This bill requires individuals to provide documentary proof of U.S. citizenship when registering to vote in federal elections. Specifically, the bill prohibits states from accepting and processing an application to register to vote in a federal election unless the applicant presents documentary proof of U.S. citizenship. The bill specifies what documents are considered acceptable proof of U.S. citizenship, such as identification that complies with the REAL ID Act of 2005 that indicates U.S. citizenship. Further, the bill (1) prohibits states from registering an individual to vote in a federal election unless, at the time the individual applies to register to vote, the individual provides documentary proof of U.S. citizenship; and (2) requires states to establish an alternative process under which an applicant may submit other evidence to demonstrate U.S. citizenship. Each state must take affirmative steps on an ongoing basis to ensure that only U.S. citizens are registered to vote, which shall include establishing a program to identify individuals who are not U.S. citizens using information supplied by certain sources. Additionally, states must remove noncitizens from their official lists of eligible voters. The bill allows for a private right of action against an election official who registers an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship. The bill establishes criminal penalties for certain offenses, including registering an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship.

Restoring Trade Fairness Act

United States · United States Congress · 14 November 2024

Restoring Trade Fairness Act This bill establishes various trade measures related to China, including by revoking China's permanent normal trade relations (PNTR) status and increasing the rates of duty (i.e., tariffs) on Chinese imported goods. The bill prohibits imported goods originating from North Korea, China, Russia, or Iran from receiving de minimis treatment. (Current law allows for U.S. imports under a de minimis threshold of $800 per shipment to enter free of tariffs, fees, and taxes.) Specifically, the bill revokes China's PNTR status. Currently, China's PNTR status allows for Chinese goods to have duty rates set forth in column 1 of the Harmonized Tariff Schedule of the United States (HTS). With the removal of China's PNTR status, the bill generally sets the applicable duty rates on imported Chinese goods at the higher rates listed in column 2 of the HTS, with exceptions. The bill establishes a minimum duty rate of 35% for all Chinese goods, which requires column 2 rates to be at least 35%. However, the bill establishes a minimum duty rate of 100% for a list of specified goods (e.g., various minerals, certain vaccines and drugs, and certain defense-related articles). Duty rates are phased in over five years and adjusted annually for inflation. The bill also authorizes the President to take additional actions related to trade with China,  requires merchandise imported from China to be appraised based on U.S. value, and  establishes a trust fund to compensate U.S. producers for lost revenue resulting from retaliatory actions by China.

United States · United States Congress · 16 September 2024

Federal Acquisition Security Council Improvement Act of 2024 This bill revises the structure and function of the Federal Acquisition Security Council (FASC), including by authorizing FASC to declare certain vendors associated with foreign adversaries ineligible to participate in federal procurement. Specifically, Congress may designate for FASC review vendors (1) that are operating on behalf of, or are subject to the jurisdiction or control of, foreign adversaries; or (2) that pose a risk to national security based on their association with a foreign adversary’s military or intelligence forces. The covered foreign adversaries are China, Iran, North Korea, and Russia. (Currently,  c overed articles include telecommunications equipment and services, information technology and information processing, and other systems or devices that include information technology.) Vendors subject to an exclusion or removal order may submit information in opposition for FASC’s consideration before the order is finalized.  Separately, the bill broadens FASC’s functions related to supply chain risk to include a focus on acquisition security and risks associated with the procurement and use of covered articles.  The bill also reallocates authorized funding for FASC from the Office of Management and Budget to the Office of the National Cyber Director (ONCD), and establishes a FASC program office within ONCD to provide subject matter expertise and administrative and legal support.

To amend the Internal Revenue Code of 1986 to modify the railroad track maintenance credit.

United States · United States Congress · 10 September 2024

This bill increases the annual limit on the tax credit for qualified railroad track maintenance expenses (also referred to as the short line railroad tax credit) and expands eligibility for claiming the credit. Under current law, the tax credit is limited each tax year to $3,500 multiplied by the sum of the number of miles of railroad track owned or leased by the taxpayer (miles owned or leased) and the number of railroad track miles assigned to the taxpayer by a Class II or III railroad (miles assigned). This bill increases the annual limit to $6,100 multiplied by the sum of miles owned or leased and miles assigned. The $6,100 amount used in the calculation of the tax credit limit is adjusted for inflation for tax years beginning after 2025. The bill also expands eligibility for the tax credit to include gross expenses for maintaining railroad tracks owned or leased as of January 1, 2024. Under current law, the tax credit is limited to gross expenses for maintaining railroad tracks owned or leased as of January 1, 2015.
