Safe Hydration is an American Right in Energy Development Act of 2023

United States · United States Congress · 20 July 2023

Safe Hydration is an American Right in Energy Development Act of 2023 This bill requires hydraulic fracturing operations to test for and report on underground sources of drinking water that are contaminated by such operations. Hydraulic fracturing, or fracking, is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the geological formation. Specifically, this bill revises requirements governing state underground injection control programs. In order to obtain primary enforcement responsibility for such programs, states must prohibit the underground injection of fluids or propping agents pursuant to hydraulic fracturing operations related to oil, gas, or geothermal production activities unless the hydraulic fracturing operations agree to test for and report on contamination of drinking water. Hydraulic fracturing operations are exempted from those testing and reporting requirements if there is no accessible underground source of drinking water within a radius of one mile of the site where the operations occur. The Environmental Protection Agency must establish and maintain a publicly accessible and searchable database of the testing results.

United States · United States Congress · 19 July 2023

Bring Animals Relief and Kibble Act of 2023 or the BARK Act of 2023 This bill provides civil and criminal liability protections for the donation of pet food and pet supplies under the Bill Emerson Good Samaritan Food Donation Act. (The act shields persons that donate and distribute food to nonprofit organizations from liability for injuries caused by those donated products, with exceptions.)  Specifically, the bill limits liability for persons or gleaners arising from the nature, age, packaging, or condition of food or pet supplies that are donated in good faith by the person or gleaner to a nonprofit organization, state, or local government for direct distribution to pets, service animals, or emotional support animals. Gleaner means a person who harvests for free distribution to the needy, or for donation to a nonprofit organization, an agricultural crop that has been donated by the owner. Further, the bill limits liability for a nonprofit organization, state, or local government arising from donated items received from a person or gleaner in good faith for direct distribution to pets, service animals, or emotional support animals.  The bill also specifies that the existing exception that permits a person, gleaner, or nonprofit organization to be held liable for acts or omissions that constitute gross negligence or intentional misconduct applies to the liability protections established by this bill.

United States · United States Congress · 18 July 2023

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. Expressing the sense of Congress that the article of amendment commonly known as the "Equal Rights Amendment" has been validly ratified and is enforceable as the Twenty-Eighth Amendment to the United States Constitution, and the Archivist of the United States must certify and publish the Equal Rights Amendment as the Twenty-Eighth Amendment without delay.

United States · United States Congress · 14 July 2023

The Equal Rights Amendment was originally proposed to the states in 1972. The original proposal included a deadline for ratification of March 22, 1979; Congress subsequently extended the deadline to June 30, 1982. Although the requisite 38 states have ratified the amendment, three of these states did so after the deadlines, and five states subsequently rescinded their ratifications. United States · United States Congress · 13 July 2023

Additionally, platforms may not (1) employ algorithms or other design features that result in discrimination or similar harms based on demographic or biometric factors, or (2) process information such that it impairs voting rights. Further, users of a platform may not violate civil rights laws using the platform's algorithms. The bill prohibits waivers or other methods that limit rights under the bill; provides whistleblower protections for individuals who report violations; and authorizes enforcement by specified federal agencies, states, and private individuals. The bill also provides funding for an interagency task force to study the discriminatory use of personal information by platforms' algorithms.

Social Security 2100 Act

United States · United States Congress · 12 July 2023

Social Security 2100 Act This bill modifies the Social Security system, particularly with respect to benefit calculations, fund administration, and beneficiary resources. For example, the bill temporarily increases the primary insurance amount for Social Security benefits for all individuals (from 90% of a certain portion of average indexed monthly earnings to 93%). It also modifies benefit calculations for certain individuals, including by temporarily (1) increasing benefits for widows or widowers in two-income households; and (2) allowing children of a deceased, disabled, or retired worker to remain eligible for benefits through age 25 if they are full-time students. Additionally, the bill temporarily eliminates (1) the government pension offset , which reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own; and (2) the windfall elimination provision , which reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes. The bill also modifies the financing and administration of the Social Security trust funds. For example, the bill (1) subjects income over $400,000 to Social Security payroll taxes, and (2) combines the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund into a single Social Security Trust Fund. Finally, the bill establishes requirements relating to Social Security services and resources, including by prohibiting the closure of field offices unless certain conditions are met (e.g., public hearings).

Protecting U.S. Farmland and Sensitive Sites From Foreign Adversaries Act

United States · United States Congress · 12 July 2023

Protecting U.S. Farmland and Sensitive Sites From Foreign Adversaries Act This bill expands the jurisdiction of the Committee on Foreign Investment in the United States (CFIUS) related to agriculture and land transactions. (CFIUS reviews the national security implications of foreign investment in the United States.) Specifically, the bill requires parties to an elevated risk real estate transaction to submit a mandatory declaration to CFIUS. Generally, this requirement applies to a transaction for a purchase or lease of certain real estate (e.g., real estate that is in close proximity to a sensitive site, such as a military installation or airspace) by a foreign adversary entity (e.g., a foreign person subject to the jurisdiction of a foreign adversary, such as China or Russia). Additionally, the bill creates a presumption that an elevated risk real estate transaction presents a risk to national security that cannot be resolved through any agreement or condition unless CFIUS (1) determines, based on clear and convincing evidence, that the risk to national security of the transaction can be resolved in a manner other than by suspending or prohibiting the transaction; and (2) notifies Congress about this determination and its reasoning.  The bill authorizes CFIUS to consider U.S. food security as a factor in its national security reviews.  The bill also expands the membership of CFIUS to include the Secretary of Agriculture on all transactions related to the purchase of agriculture land, agriculture biotechnology, and any other transaction related to the agriculture industry in the United States.
