Amends the Patient Protection and Affordable Care Act to declare that nothing in such Act or amendments made by such Act shall be construed to affect: (1) any authority under title 38 of the United States Code (veterans' benefits); (2) any authority under chapter 55 of title 10 of the United States Code (medical and dental care for members of the uniformed services); or (3) any health care or health care benefits program provided under the TRICARE program or by the Secretary of Veterans Affairs. Declares that the term "minimum essential coverage" includes coverage provided to members of the uniformed services and eligibility for health care provided by the Secretary of Veterans Affairs.

Prohibits the Committee on Rules from reporting a rule or order that provides for disposition of the Senate amendments to H.R. 3590 (the Patient Protection and Affordable Care Act [PPACA]) unless it provides for: (1) at least one hour of debate, equally divided and controlled by the majority leader and the minority leader; and (2) a requirement that the Speaker put the question on disposition of the Senate amendments and that the yeas and nays be considered as ordered thereon.

Requires the total budget resources for expenditures from the Harbor Maintenance Trust Fund for harbor maintenance programs to equal the level of receipts plus interest credited to such Fund for that fiscal year. Limits the use of such resources to such programs only. Declares that it shall be out of order in the House of Representatives or the Senate to consider any bill, joint resolution, amendment, motion, or conference report that would cause total budget resources for the Fund in a fiscal year for harbor maintenance programs to be less than the level of receipts plus interest credited to the Fund for that fiscal year.

Repeals: (1) provisions in the Economic Growth and Tax Relief Reconciliation Act of 2001 terminating tax reductions made by such Act after December 31, 2010; and (2) the provision in the Jobs and Growth Tax Relief Reconciliation Act of 2003 terminating after 2008 reductions in tax rates on dividends and net capital gain. Amends the Internal Revenue Code to make permanent: (1) the tax deductions for state and local sales taxes and for tuition and related expenses; and (2) the increased expensing allowance (i.e., $125,000) for depreciable business assets.

Military Spouse Job Continuity Act of 2010 - Amends the Internal Revenue Code to allow the spouse of a member of the Armed Forces (military spouse) who moves with such member to another state under a permanent change of station order a tax credit for up to $500 of qualified relicensing costs incurred by such spouse. Defines "qualified relicensing costs" as costs for a state license or certification to engage in the profession that such military spouse engaged in while residing in the former state.

Travel Restriction Reform and Export Enhancement Act - Prohibits the President from: (1) regulating or prohibiting travel to or from Cuba by U.S. citizens or lawful permanent residents or any transactions incident to such travel; and (2) restricting direct transfers from a Cuban financial institution to a U.S. financial institution executed in payment for a product authorized for sale under the Trade Sanctions Reform and Export Enhancement Act of 2000. States that: (1) any regulation restricting or prohibiting such Cuban travel shall have no effect; and (2) such prohibition shall not apply in time of war or armed hostilities between the United States and Cuba, or of imminent danger to the public health or the physical safety of U.S. citizens or legal residents. Amends the Trade Sanctions Reform and Export Enhancement Act of 2000 to define "payment of cash in advance" as the payment by the purchaser of an agricultural commodity or product and the receipt of such payment by the seller prior to: (1) the transfer of title of such commodity or product to the purchaser; and (2) the release of control of such commodity or product to the purchaser.

Accurate Accounting of Fannie Mae and Freddie Mac Act - Requires the receipts and disbursements of the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) to be counted as new budget authority, outlays, receipts, or deficit or surplus for purposes of: (1) the federal budget submitted by the President; (2) the congressional budget; or (3) the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act). Requires the costs of purchases of mortgages, and mortgage-backed securities issued, by Fannie Mae and Freddie Mac to be calculated by adjusting a specified discount rate for market risks under the Credit Reform Act of 1990. Subjects to the statutory public debt limit the face amount of obligations issued by Fannie Mae and Freddie Mac and outstanding at one time.

Healthy Start Act - Amends the Richard B. Russell National School Lunch Act to direct the Secretary of Agriculture to deliver commodity assistance to states for their school breakfast programs. (Currently, commodity assistance is delivered to states for their school lunch programs.) Sets forth the formula for determining the amount of such assistance to be provided to each state for its school breakfast program.

Requires the President's annual budget submitted to Congress to include a statement that sets forth the debt of each bank, government-sponsored enterprise (GSE), and publicly traded or privately held company in which the government holds common stock, preferred stock, or warrants to purchase common stock (equity) equaling at least 10% of the company's total outstanding common stock.

Prohibits any funds appropriated or made available to the Department of Justice (DOJ) from being used to commence or continue a prosecution in an Article III court of any individual suspected of involvement in the attacks on the United States and its citizens on September 11, 2001, who is not a citizen of the United States and is subject to the jurisdiction of a military commission.

Fairness for American Students Act - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to make illegal aliens ineligible for any postsecondary education benefit that results from their residence within a state or political subdivision unless every citizen and national of this country is entitled to such benefit regardless of their place of residence or the location of the school from which they graduated. Allows any U.S. citizen or national that is enrolled in a postsecondary school to commence a civil action against a school or state education official to enforce their compliance with this Act's requirement and obtain appropriate relief, including the in-state tuition rate. Prohibits federal agencies from providing financial assistance to postsecondary schools that provide benefits to illegal aliens in contravention of this Act.

Expresses the sense of the House of Representatives that: (1) the use of a basic pilot program (E-verify program) by employers of workers within the United States should be mandatory and that enforcement policies should hold both employers and employees responsible for violations; (2) sustaining the necessary border infrastructure and manpower to secure U.S. borders to prevent the unauthorized passage of persons or contraband is a critical responsibility of the federal government; and (3) immigration reform should not legalize, grant amnesty for, or confer any other legal status condoning the unlawful U.S. entry or presence of any individual.

Amends title XVIII (Medicare) of the Social Security Act to authorize continued use of 2009 Medicare practice expense relative value units for certain cardiology services. Directs the Secretary of Health and Human Services (HHS) to contract with an independent entity to study and report to Congress on the practice expense methodology used to determine relative value units under this Act to determine whether the cost finding, indirect cost allocation, scaling, and budget neutrality methodologies used: (1) are consistent with generally accepted accounting principles; (2) distribute the burden of any necessary budget neutrality adjustments proportionally among all physicians' services; and (3) result in allowances that accurately reflect the relative direct and indirect resources involved in the provision of various physicians' services.

Outpatient Mental Health Modernization Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to allow as partial hospitalization services nutritional planning, meals, and transportation. Directs the Secretary of Heatlh and Human Services (HHS) to convene a Behavioral Health Advisory Committee to address issues relating to: (1) discrimination against the chronically mentally ill, elderly, and U.S. veterans as it relates to receiving treatment for mental illness; and (2) the establishment of conditions of participation for community mental health centers that provide partial hospitalization services under the Medicare program.

Post-9/11 GI Educational Fairness Act of 2009 -Amends the veterans' post-9/11 educational assistance program to remove the requirement that a program of education must be offered by an institution of higher learning in ordered to be approved. States that the purpose of this Act is to allow activities such as apprenticeship or other on-job training, entrepreneurship training, correspondence training, and flight training. Authorizes the Secretary of Veterans Affairs (VA) to approve for such program the pursuit of flight training if: (1) such training is generally accepted as necessary for the attainment of a vocational objective in aviation; (2) the individual possesses a valid private pilot certificate and meets medical requirements necessary for a commercial pilot certificate; and (3) the flight school course meets Federal Aviation Administration (FAA) standards.

Expresses the sense of the House of Representatives that: (1) the guidelines of the United States Preventive Services Task Force would not prohibit an insurer from providing coverage for mammography services in addition to those recommended by the Task Force and should not be used by insurers to deny coverage for services that are not recommended on a routine basis; and (2) the National Cancer Institute should continue to invest and provide leadership regarding research to develop more effective breast cancer screening tools and strategies.

Directs the Secretary of Labor to award capitalization grants to eligible applicants (nonprofit local workforce investment boards, states, political subdivisions of a state, and Indian tribes, or a single national organization) for projects to create jobs and the delivery of self-sustainable social services (i.e., education, training, and career services) to people with barriers to employment. Authorizes the Secretary to evaluate the effectiveness of capitalization in providing workforce development opportunities and training to people with barriers to employment after the grantee has had three years to capitalize and build or expand its programs.

Amends the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 to extend, through FY2010, the authority of the Secretary of Education to waive or modify certain requirements relating to maintenance of effort, supplementary use of funds, and matching funds in providing assistance to Louisiana, Mississippi, Alabama, and Texas and, through them, to local educational agencies and non-public elementary and secondary schools serving areas in which a major disaster was declared relating to Hurricane Katrina or Rita.

Control America's Purse-strings to Deliver a Better Tomorrow Act or the CAP the DEBT Act - Amends the Congressional Budget Act of 1974 to make it out of order in the House of Representatives and in the Senate to consider any bill, joint resolution, amendment, or conference report increasing the statutory limit on the public debt if there is any other matter in such measure. Requires a two-thirds recorded vote of Members in the House and a roll call vote of at least two-thirds of the Members of the Senate before legislation increasing the statutory limit on the public debt may be considered as passed or agreed to in either chamber. Permits a successful appeal from the ruling of the Chair in the Senate on such prohibition, but only by an affirmative roll call vote of two-thirds of its Members. Repeals Rule XXVIII (Statutory Limit on Public Debt) of the Rules of the House, and known as the "Gephardt Rule," providing for mandatory adjustment of the statutory limit on the public debt to conform to a budget resolution.

Stop the Automatic Pay Raise for Members of Congress in Fiscal Year 2011 Act - Declares that no automatic pay adjustment shall be considered to have taken effect in FY2011 in the rates of basic pay for Members of Congress under the General Schedule (thus eliminating the pay adjustment for Members for such fiscal year).

Medicaid DSH Integrity Act - Directs the Secretary of Health and Human Services (HHS) to indicate, in appropriate guidance, that the Centers for Medicare & Medicaid Services (CMS) do not intend to enforce any changes in policy related to calculating the limits on the adjustment in payment under title XIX (Medicaid) of the Social Security Act for inpatient hospital services furnished by disproportionate share hospitals (DSH) that were contained in the Medicaid DSH auditing and reporting regulations the CMS issued pursuant to the Medicare Prescription Drug Improvement and Modernization Act of 2003. Requires the Secretary to publish an interim final rule to revise such regulations as necessary to: (1) correct such policy changes; (2) provide appropriate guidance for otherwise implementing those auditing and reporting regulations; and (3) provide for specified regulatory changes to be included in the new interim rule. Requires the CMS, in defining the costs of furnishing services to individuals with no health insurance (or other source of third-party coverage), to permit inclusion of all costs related to services provided to patients with no insurance for the service rendered, even if the patient has insurance that covers other services. Declares that the receipt by a hospital of nominal payments related to a service shall not constitute health insurance or a source of third-party coverage.

Incentives to Increase Use of Renewable Biomass Act of 2009 - Amends the Farm Security and Rural Investment Act of 2002 to require the Secretary of Agriculture to: (1) establish a program to provide interest-free loans to eligible institutions (i.e., an institution of higher education, an elementary or secondary school, a hospital, a local government building, or a governmental, community, health, or educational building owned or leased and occupied by an Indian tribe, except any building used for gaming) for capital costs for converting existing equipment, or installing new equipment, to use renewable biomass for energy generation, heating, or cooling systems; and (2) ensure that an institution receiving such a loan will use renewable biomass for no less than 75% of the energy generation, heating, or cooling needs of the facility for which the loan is received. Establishes in the Treasury a revolving fund for such program. Requires the Secretary to: (1) deposit amounts received as payment on loans provided under such program into such revolving fund; and (2) make available $100 million of the funds of the Commodity Credit Corporation to such revolving fund.

Healthy Forests Restoration Amendments Act of 2009 - Amends the Healthy Forests Restoration Act of 2003 to expand the purposes of the Act to include providing for the protection, restoration, and enhancement of forest ecosystem components to protect infrastructure in rural communities. Expands federal land areas eligible for hazardous fuel reduction projects. Repeals the total federal land acreage limitation on authorized hazardous fuel reduction projects. Revises requirements regarding the alternative analysis process for authorized hazardous fuel reduction projects in the wildland-urban interface. Bars the Secretary of Agriculture or the Secretary of the Interior from being required to study, develop, or describe more than the proposed agency action and a no action alternative in an environmental assessment or environmental impact statement for specified proposed authorized hazardous fuel reduction projects.

Directs the Secretary of Agriculture, through the Chief of the Forest Service, to require Forest Service personnel, in the implementation of off-road vehicle management under the Forest Service Travel Management Rule, to endeavor to accommodate individuals with mobility disabilities who would need to use a power-driven mobility device for access to such lands. Requires Forest Service personnel to provide an individual with mobility disabilities who uses a power-driven mobility device to access specific National Forest System lands, who seeks permission to access such lands, and who is denied such access, with an explanation for the denial of access to such lands.

Patient Health and Real Medication Access Cost Savings Act of 2009 or the PHARMACY Bill - Declares that a consumer shall have the right to choose to purchase prescription drugs from any domestic pharmacy that meets all applicable federal and state license and permit requirements. Directs the Secretary of Health and Human Services (HHS) to issue regulations that: (1) prohibit a pharmacy benefit manager (PBM) from providing incentives to, encouraging, or requiring pharmacy benefit plan enrollees to use certain pharmacies or from excluding an eligible pharmacy from a plan's pharmacy network; (2) require a PBM to ensure that pharmacy benefit plan enrollees pay a specified copayment for brand name drugs; (3) require a PBM to reimburse a pharmacy in the network of a pharmacy benefit plan that is federally funded, at specified rates, for brand-name drugs, generic drugs, and additional professional services; (4) require a PBM to be reimbursed by a pharmacy benefit plan sponsor for adjudicating and processing claims; (5) limit the amount that a PBM charges a pharmacy benefit plan sponsor for a drug that is dispensed to enrollees to the amount the PBM paid the pharmacy for such drug; (6) require a manufacturer of prescription drugs to pay all rebates directly to the pharmacy benefit plan sponsor and not to a PBM; and (7) require a pharmacy benefit plan sponsor to provide a list of the wholesale acquisition costs of the top 500 most frequently prescribed drugs to physicians in a plan any insurance-related charge of which is underwritten by a federal, state, or local government. Amends title XVIII (Medicare) of the Social Security Act to include pharmacist services as "medical and other health services" under Medicare. Directs the Secretary, by January 1, 2011, to establish a pharmaceutical access program to provide affordable prescription drugs to individuals who receive drug benefits under federal programs (except Medicaid). Requires: (1) a pharmacy that dispenses prescription drugs in the United States to remit to the Secretary 50 cents for each brand name prescription and $1.00 for generic drug prescription dispensed; and (2) the sponsor of a pharmacy benefit plan that is not federally funded to increase the professional dispensing fee paid to pharmacies by the same amounts. Requires the use of funds generated from such fees to provide affordable access to prescription drugs to low-income individuals who have enrolled in the program.

Calls on the President to: (1) not enter into or extend any arms control agreement with the Russian Federation that may jeopardize the ability of the United States to ensure a credible strategic deterrent with regard to the People's Republic of China (PRC) or other countries that are deemed capable of deploying a strategic nuclear arsenal; (2) report to Congress on any plans or steps taken to enter into any bilateral arms control agreement with the Russian Federation; (3) report to Congress on the PRC's capabilities and intentions regarding the future deployment of a major strategic nuclear arsenal; and (4) refuse to enter into any strategic nuclear arms agreement with the Russian Federation or any other country that would require the United States to limit or suspend its efforts to create missile defense systems for itself and its allies. Urges the President to refrain from negotiating any follow-on agreement to START I until the Nuclear Posture Review is completed and the President, Congress, and all relevant U.S. government departments and agencies have had an opportunity to evaluate the Nuclear Posture Review.

Agricultural Disaster Assistance Act of 2009 - Directs the Secretary of Agriculture to: (1) make a supplemental direct commodity payment to eligible producers that previously received such a payment; (2) make grants to states to assist eligible specialty crop producers for losses associated with drought or excessive rainfall during 2009; (3) provide supplemental assistance to eligible producers and first-handlers of the 2009 crop of cottonseed in disaster counties; (4) continue to carry out the 2002 livestock compensation program and provide assistance to any applicant that conducts a livestock operation located in a disaster county or produces fish classified within the family Ictaluridae (catfish); and (5) make payments to eligible producers for livestock losses occurring in a disaster county.
