Elementary and Secondary School Library Media Act

Elementary and Secondary School Library Media Act - Amends the Department of Education Organization Act to establish a Division of Elementary and Secondary School Library Media Services within the Office of Educational Research and Improvement. Requires the Director of the Division to award grants to States for acquisition of school library media resources for public elementary and secondary schools. Sets forth requirements for allocation to States, State plans, and State distribution of allocation to local educational agencies. Authorizes appropriations. Requires the Director to award grants for projects that: (1) encourage collaboration between public elementary and secondary library media specialists and teachers to develop instructional units that enable students to use a variety of information resources; and (2) expand students' information-gathering abilities and certain cognitive skills. Authorizes appropriations. Requires the Director to award grants to encourage collaborative elementary and secondary school library media specialist and teacher programs to: (1) expand use of computers and computer networks in the curriculum; and (2) enable elementary and secondary school library media centers to access information from computerized databases. Authorizes the Director to enter into cooperative agreements with the National Science Foundation and other appropriate nonprofit agencies and organizations in carrying out this grants program. Authorizes appropriations. Requires that funds under this Act supplement and not supplant other Federal, State, or local funds.

Brady Handgun Violence Prevention Act

Brady Handgun Violence Prevention Act - Amends the Federal criminal code to prohibit (until the Attorney General certifies that a national instant criminal background check system (System) is established pursuant to this Act) any licensed importer, manufacturer, or dealer from selling, delivering, or transferring a handgun to an unlicensed individual unless: (1) after the most recent proposal of such transfer by the individual, the transferor has received a statement of eligibility from the individual, verified the identity of such individual, provided notice of the contents, and transmitted a copy of the statement to the chief law enforcement officer (chief) of the place of residence of the individual within one day after the individual furnishes the statement; and five business days have elapsed from the date the transferor furnished notice of the contents of the statement to the chief, during which period the transferor has not received information from the chief that receipt or possession of the handgun by the individual would be in violation of Federal, State, or local law or has received notice from the chief that the chief has no information indicating that such receipt or possession would violate such law; (2) the individual has presented to the transferor a statement from the chief, issued in the past ten days, stating that the individual requires a handgun because of a threat to such individual or such individual's family; (3) the individual has presented to the transferor a permit to possess a handgun that has been issued in the past five years by the State in which the transfer is to take place under a State law which requires law enforcement verification of the individual's legal qualification to possess a handgun; (4) State law requires that an authorized government official verifies that the information available to such official does not indicate that possession of a handgun by the purchaser would be unlawful, with exceptions; (5) the Secretary of the Treasury has approved the transfer under provisions of the Internal Revenue Code; or (6) the Secretary has certified, on application of the transferor, that compliance with the notice requirement is impracticable for specified reasons. Directs the Attorney General to: (1) establish the System; (2) expedite the upgrading and indexing of State criminal history records in the Federal criminal records system maintained by the Federal Bureau of Investigation (FBI), the development of hardware and software systems to link State criminal history check systems into the System, and the current revitalization initiatives by the FBI for technologically advanced fingerprint and criminal records identification; and (3) ensure the privacy and security of System information. Amends the Omnibus Crime Control and Safe Streets Act of 1968 to authorize the use of justice system improvement formula grants for the improvement of State record systems and the sharing with the Attorney General of specified records for the purpose of implementing this Act.

(Sec. 102) Amends the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 to direct the Appraisal Subcommittee to encourage the States to develop reciprocity agreements among themselves so as to readily authorize licensed appraisers in good standing to perform appraisals in sister States. Subtitle B: Impact of Accounting and Capital Issues on Credit Availability - (Secs. 111-113) Amends the FDIA to amend the regulatory scheme with respect to: (1) audits of insured depository institutions; (2) recourse agreements; and (3) market value accounting. (Sec. 114) Requires the Department of the Treasury to report to certain congressional committees on the effect on the national economy resulting from implementation of risk based capital standards (including the Basle international capital standards). Subtitle C: Disincentives to Risk Taking - (Sec. 121) Amends the FDIA and the Federal Credit Union Act with respect to the due process protections accorded the attachment of assets, and the statutory authority to require a depository institution to prohibit a person from alienating property under certain circumstances. Subtitle D: Miscellaneous Credit Availability Provisions - (Sec. 131) Mandates the establishment of a regulatory appeals process within each appropriate Federal banking agency and the National Credit Union Administration. (Secs. 132 and 133) Amends the Federal Reserve Act to modify the aggregate limits on insider lending for specified small banks. Mandates that certain agencies study and report to the Congress on the advisability and budgetary impact of requiring insured depository institutions to maintain sterile reserves. (Sec. 134) Amends the FDIA to prescribe guidelines under which the Federal Deposit Insurance Corporation (FDIC) may, with respect to an undercapitalized insured depository institution, waive its right to repudiate an agreement to sell credit card accounts receivable. (Sec. 135) Amends the Federal Home Loan Bank Act to permit FHLBA banks to: (1) make secured advances upon obtaining a security interest in certain nonresidential real estate-related collateral; and (2) invest surplus funds to purchase participation interests in residential construction loans originated by member institutions. Title II: Regulatory Micromanagement - (Secs. 201-204) Amends the FDIA to modify the regulatory scheme with respect to: (1) safety and soundness standards; (2) paperwork reduction; (3) rules on deposit taking; and (4) a transition period for new regulations. Title III: Unnecessary Cost, Paperwork and Regulation -Subtitle A: General Provisions - (Secs. 301-303) Amends the FDIA with respect to: (1) bank examinations; (2) coordination of State and Federal examinations; and (3) the use of accounting principles. (Secs. 304-306) Prescribes guidelines for the reduction of call report requirements and capital compliance requirements. Excludes automated teller machines and specified bank branches from FDIA branch closure notice requirements. (Sec. 307) Amends Federal law regarding monetary instruments transactions to direct the Secretary of the Treasury to annually: (1) review all regulations pertaining to monetary instruments transaction requirements, seeking public comment; and (2) publish all written rulings interpreting such law, as well as staff commentaries. (Sec. 309) Amends the FRA and the FDIA to cite conditions under which accounts of U.S. banks are shielded from liability to repay] deposits made at foreign branches. Subtitle B: Holding Company Efficiencies - (Secs. 321-325) Amends the Bank Holding Company Act of 1956 to modify the procedures under which bank holding companies: (1) are formed; and (2) acquire interests in nonbanking activities. Reduces the post-approval waiting period for bank holding company acquisition and bank mergers. Title IV: Consumer Inconvenience, Paperwork, and Cost; Other Non-Supervisory Reforms - Subtitle A: Consumer Benefits and Lending Process Improvements - (Sec. 401) Mandates a Federal Reserve study and report to the Congress on ways to streamline the credit-granting process. (Secs. 402-403) Amends the Truth in Lending Act regarding: (1) certain exemptions from credit cost disclosure requirements; (2) modification of waiver of the debtor's rescission rights; and (3) alternative disclosures for adjustable rate mortgages. (Sec. 405) Amends the Truth in Savings Act to exempt business accounts from its purview. Subtitle B: Other Non-Supervisory Reforms - (Secs. 411-413) Amends the Expedited Funds Availability Act regarding: (1) the availability of Treasury checks and local checks; (2) new accounts; and (3) the allocation of risks of loss and liability to the States and political subdivisions. (Secs. 414 and 421) Amends the Electronic Fund Transfer and the Truth in Lending Act to increase the consumer liability limit in specified circumstances of unauthorized electronic fund transfers and unauthorized use of credit cards where the cardholder has substantially contributed to the unauthorized transfer or use. (Sec. 432) Amends the Housing and Urban Development Act of 1968 to reduce the homeownership debt counseling notification requirement to no more than once per year. (Sec. 433) Prohibits a Federal banking agency from imposing data collection requirements upon an institution under its jurisdiction other than the information required under the Home Mortgage Disclosure Act of 1975. (Secs. 441 and 442) Amends the Real Estate Settlement Procedures Act of 1974 to: (1) modify the disclosure guidelines for the servicing of mortgage loans; and (2) exempt certain credit transactions from its purview. Title V: Community Investment - (Sec. 501) Amends the Community Reinvestment Act of 1977 (the Act) with respect to: (1) minimizing the regulatory paperwork costs and burdens associated with compliance; (2) conditions under which an application for a deposit facility shall not be denied on the basis of compliance; (3) granting credit to a financial institution for making investments and loans to either minority and women's depository institutions, or to entities providing benefits to distressed communities; (4) assessments of special purpose banks; and (5) the acceptability of State examinations in lieu of Federal examinations.

Expedited Consideration of Proposed Rescissions Act of 1993 - Amends the Congressional Budget and Impoundment Control Act of 1974 to require a special message, in the case of budget authority proposed to be rescinded, to include language amending the law authorizing such programs to allow them to continue to function at the proposed new level of budget authority. Allows the President to transmit to both Houses of the Congress, for expedited consideration, one or more special messages proposing to rescind all or part of any item of budget authority provided in an appropriation bill. Requires that such special message be transmitted not later than three days after the President approves the appropriation bill and be accompanied by a draft bill or joint resolution that would, if enacted, rescind the budget authority proposed to be rescinded. Sets forth House and Senate procedures for the expedited consideration of such a proposal.

Group Health Plan Nondiscrimination Act of 1993 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide that certain retroactive cancellations or reductions of benefits under group health plans constitute discrimination which interferes with rights protected under ERISA. Prohibits any group health plan from discriminating among diseases or medical conditions with respect to levels of lifetime benefit coverage provided to similarly situated participants and beneficiaries under the plan, with specified limitations relating to collective bargaining or special exemption procedures. Requires group health plans to issue notices of any material change in plan terms to each participant and spouse beneficiary. Prohibits the change from taking effect until 60 days after such issuance. Sets forth special requirements for such notices from self-insured group health plans. Revises civil enforcement provisions to make any person who violates the prohibition provisions against interference with rights of any participant or beneficiary under a group health plan liable to such participant or beneficiary for actual damages. Precludes punitive damages, except that, where the violation constitutes willful, fraudulent, or malicious conduct, bad faith, or gross negligence, each such person may, in the court's discretion, be liable for limited exemplary damages. Provides for award of attorney's fees and other legal costs to plaintiffs who prevail or substantially prevail.

Antarctic Environmental Protection Act of 1993

Antarctic Environmental Protection Act of 1993 - Amends the Antarctic Conservation Act of 1978 to revise provisions concerning prohibited acts to make it unlawful for any person (currently, U.S. citizen) to: (1) engage in any taking or harmful interference in Antarctica; (2) introduce into Antarctica any nonnative species; (3) enter any Antarctic specially protected area; or (4) discharge, dispose of, or introduce any waste or pollutant within Antarctica, except as permitted by the Act to Prevent Pollution from Ships. Makes it unlawful for any person to: (1) engage in or provide assistance to any Antarctic mineral resource activity; (2) ship, sell, import, export, or have control of any Antarctic mineral resource that was recovered as a result of such activity; (3) refuse to permit any U.S. official to board a vessel, vehicle, or aircraft for a search or inspection in connection with enforcement; or (4) interfere with a search, arrest, or detention for prohibited acts. Exempts from such prohibition any act committed under emergency circumstances. Revises requirements for the issuance of permits authorizing takings or harmful interferences or introductions of nonnative species in Antarctica. Requires certain regulations prescribed by the Secretary of State to apply to any person's (currently, U.S. citizen's) advance notification of expeditions to, and within, Antarctica. Directs the Secretary to prescribe regulations to require nongovernmental activities in Antarctica for which the United States is required to give advance notice under the Antarctic Treaty to provide for prompt response actions to emergencies and to comply with contingency plans. Requires the Director of the National Science Foundation to prescribe regulations to implement the environmental impact assessment provisions of the Protocol on Environmental Protection to the Antarctic Treaty with respect to governmental activities in Antarctica. Directs the Secretary to prescribe such regulations for nongovernmental activities in Antarctica. Directs the Secretary to designate the U.S. representative to the Committee for Environmental Protection. Expands penalty and enforcement provisions. Repeals the Antarctic Protection Act of 1990. Directs the President to establish an Antarctic Environmental Protection Commission to review the compliance of all U.S. Antarctic Program stations, field camps, and operations with the Antarctic Conservation Act of 1978.

Expresses the sense of the Congress that: (1) the widespread rape and forced pregnancy of women and girls in the former Yugoslavia constitute war crimes; (2) the United Nations (UN) Security Council and UN Human Rights Commission should adopt resolutions explicitly recognizing that rape and forced pregnancy constitute war crimes; (3) such war crimes should be investigated by an international tribunal; (4) such tribunal may be convened by the UN at the highest level and should be provided with clear authority to investigate, prosecute, adjudicate, and punish those responsible for those and other crimes; (5) the UN should appoint a special rapporteur on sex discrimination and violence against women; and (6) the 1993 UN World Conference on Human Rights in June should consider violations of the human rights of women.

Provides that all such recommendations shall take effect automatically unless the Congress enacts a joint resolution disapproving such recommendations within 60 days of their submittal. Sets forth guidelines for congressional consideration of the Commission's recommendations. Title II: Commission on Unfunded Federal Mandates - Establishes the Commission on Unfunded Federal Mandates to: (1) investigate and review the role of unfunded Federal mandates in relations among local, State, and Federal governments; and (2) study and make recommendations to the Congress regarding the termination or suspension of unfunded Federal mandates. Authorizes appropriations. Title III: Integrated Federal Assistance - Community Assistance Improvement Act of 1992 - Provide for payments to local governments of amounts available under a covered Federal assistance program for use in accordance with an integrated assistance plan approved by the Interagency Review Council (establish by this Act). Provides that eligibility for benefits under a covered Federal assistance program included in an approved integrated assistance plan shall be only in accordance with the plan. Details the process for applying for approval of an integrated assistance plan. Specifies application and plan contents. Requires a local government applying for approval of an integrated assistance plan to establish a Community Advisory Committee. Requires the Committee to advise a local government in the development and implementation of its integrated assistance plan. Establishes the Interagency Review Council for the purposes described above. Title IV: Estimation of Legislative Impact on State and Local Governments - Amends the Congressional Budget Act of 1974 to: (1) strike language stating that cost estimates are required only if submitted in a timely manner; (2) require that a cost estimate accompany the conference report of legislation; and (3) require budget reconciliation instructions to direct committees to include in any reconciliation legislation carrying them out a Congressional Budget Office estimate of the total cost of their provision. Title V: Regulatory Flexibility Analysis - Amends the Regulatory Flexibility Act to modify provisions respecting judicial review of agency rules.

Requires the Secretary of Health and Human Services to increase by one percent the fiscal year allotment which would otherwise be made to a State to carry out the Social Services Block Grant Program under title XX of the Social Security Act if such State has, within two years, certified to the Secretary that it has enacted a State law which provides such immunity. Provides for the continuation of such increase based on an annual recertification.

Title II: Manufacturing - Subtitle A: Manufacturing Technology and Extension - Manufacturing Technology and Extension Act of 1993 - (Sec. 204) Amends the Stevenson-Wydler Technology Innovation Act of 1980 to establish the National Technology Outreach Program to assist U.S. manufacturers, especially small and medium-sized firms, to expand the use of technology and modern manufacturing processes. Provides for: (1) a related communications infrastructure; (2) an information clearinghouse; and (3) manufacturing outreach centers. (Sec. 205) Directs the Secretary of Commerce (Secretary) to establish an Advanced Manufacturing Program, whose goal shall be to create programs to develop design and manufacturing technologies and associated applications, including advanced computer integration and electronic networks. (Sec. 207) Amends the National Institute of Standards and Technology Act to authorize the Institute to establish local manufacturing offices. (Sec. 208) Establishes within the Institute a State Technology Extension Program. Subtitle B: National Science Foundation Manufacturing Programs - (Sec. 212) Requires the Director of the National Science Foundation to expand the number of Engineering Research Centers and strengthen the Industry/University Cooperative Research Centers Program. (Secs. 213 and 214) Authorizes the Director to establish: (1) graduate traineeships; (2) a manufacturing managers in the classroom program; and (3) a quality management program. Title III: Critical Technologies - Subtitle A: Benchmarking Science and Technology - (Sec. 301) Amends the Stevenson-Wydler Technology Innovation Act of 1980 to make the Department of Commerce the lead Federal agency in making available information for assessing the comparative strength of U.S. scientific and technological capabilities. Directs: (1) the Secretary to establish within the Technology Administration an Office of Technology Monitoring and Assessment; and (2) such Office to establish a related fellowship program. Subtitle B: Advanced Technology Program - (Secs. 321 and 322) Directs the Secretary to submit to the Congress an expansion plan for the Advanced Technology Program. Authorizes Program support of large-scale joint ventures. Subtitle C: Civilian Technology Loan Program - (Sec. 331) Authorizes the Secretary to make or guarantee loans to qualified small and medium businesses for research, development, or utilization of critical or advanced technologies. Subtitle D: Civilian Technology Development Program - Civilian Technology Development Act of 1993 - (Secs. 343 through 361) Establishes within the Technology Administration: (1) a program to supplement the availability of long-term investment capital for U.S. critical or advanced technology businesses through licensed technology investment companies; and (2) an Office of Technology Financing to administer such program. Establishes a related Civilian Technology Development Advisory Committee. Requires a three-fifths roll call vote of each House to increase the public debt. Directs the President to submit a balanced budget to the Congress. Requires the approval of a majority of each House by roll call vote before any bill to increase revenue may become law. Waives these provisions when a declaration of war is in effect. Waives these provisions when the United States is engaged in a military conflict which poses a threat to national security as declared by a joint resolution adopted by a majority of each House.

TABLE OF CONTENTS: Title I: Modification of Passive Loss Rules Title II: Provisions Relating to Real Estate Investments By Pension Funds Title III: Discharge of Indebtedness Real Estate Stability and Recovery Amendments Act of 1993 - Title I: Modification of Passive Loss Rules - Amends the Internal Revenue Code to exclude certain rental real estate development activities from treatment as a passive activity for purposes of determining passive activity losses and credits. Title II: Provisions Relating to Real Estate Investments by Pension Funds - Modifies exceptions to the exclusion of real property acquired by a qualified organization from the meaning of acquisition indebtedness. Makes certain exceptions inapplicable to sales out of foreclosure by a financial institution. Applies the meaning of acquisition indebtedness to investments in certain large partnerships where the principal purpose of partnership allocation is not tax avoidance. Repeals the special rule for publicly traded partnerships with respect to the treatment of unrelated business taxable income. Permits a tax-exempt title-holding company to receive unrelated business taxable income of up to ten percent of its gross income, if the income is incidentally derived from the holding of real property. Excludes from unrelated business taxable income: (1) gains from the sale, exchange, or other disposition of real property acquired from financial institutions that are in conservatorship or receivership; (2) amounts received or accrued as consideration for entering into agreements to make loans; and (3) all gains on the lapse or termination of options, written by an organization in connection with its investment activities, to buy or sell real property. Provides for the tax treatment of pension fund investments in real estate investment trusts. Title III: Discharge of Indebtedness - Excludes from gross income, the income from the discharge of qualified real property business indebtedness. Applies the excluded amount to reduce the basis of the depreciable real property. Limits such amount to the amount of outstanding indebtedness over the fair market value of the property, reduced by any other qualified real estate business indebtedness. Excludes qualified farm indebtedness from the definition of "qualified real property business indebtedness."

Hudson River Artists National Historical Park Act of 1993

Hudson River Artists National Historical Park Act of 1993 - Establishes, as a unit of the National Park System, the Thomas Cole National Historic Site, New York. Authorizes the Secretary of the Interior to establish the Hudson River Artists National Historical Park, subject to specified requirements. Specifies that: (1) the Secretary shall take no action with respect to the lands and structures owned by the State within Park boundaries except through cooperative agreements in accordance with this Act; and (2) with regard to lands within the State Forest Preserve, the provisions of such cooperative agreements shall be in strict conformance with the pertinent provisions of the New York State Constitution. Authorizes the Secretary to: (1) provide technical assistance to cooperating entities for the marking, interpretation, restoration, preservation, or interpretation of Site property; and (2) enter into cooperative agreements to plan and coordinate the interpretation of the cultural and natural history of the region, and with the Greene County Historical Society to provide for the establishment of a library and research center at the Site. Directs the Secretary to submit to specified congressional committees a general management plan for the Site and Park. Authorizes appropriations.

Amends the Defense Base Closure and Realignment Act of 1990 to direct the Secretary of Defense, in making recommendations in 1993 and 1995 for the closure or realignment of U.S. military installations, to give the following considerations equal weight with other established criteria in the selection process: (1) equal allocation of the economic burden of such closures and realignments across the United States; (2) the effect on the economic conditions of communities located nearby; and (3) the extent to which additional closures or realignments would exacerbate adverse economic conditions of States and local communities already affected by a closure or realignment.

Establishes a fund in the Treasury which shall be made available to the Commission for the expenses of establishing the memorial.

Northern Ireland Fair Employment Practices Act

Northern Ireland Fair Employment Practices Act - Prohibits an article from being imported into the United States from Northern Ireland unless documentation is presented at the time of entry indicating that the enterprise which manufactured or assembled such article complied at the time of manufacture with certain fair employment principles (such as freedom from religious discrimination). Bases such principles on the MacBride Principles, a nine point set of guidelines for fair employment in Northern Ireland. Requires any U.S. person who has a branch or office in Northern Ireland or who controls an enterprise in Northern Ireland in which more than 20 people are employed to insure implementation of such employment principles and compliance with this Act. Authorizes the President to waive the requirements of this Act in the interest of national security.

Emergency Nurse Shortage Relief Act of 1993 - Amends title VIII (Nurse Education) of the Public Health Service Act to authorize the Secretary of Health and Human Services to make grants for programs to: (1) promote nursing as a career, including promotion in public secondary schools; (2) identify and provide internships to students in such schools who show an interest in health care; and (3) recruit nursing students from groups not traditionally well represented in the profession. Authorizes appropriations. Authorizes the Secretary to make grants for programs to: (1) encourage and assist non-practicing nurses to reenter the profession; (2) train nurses as nurse practitioners or nurse midwives or in areas of needed specialized nursing skills; and (3) provide tuition assistance to students in educational programs designed to facilitate reentry. Authorizes appropriations. Authorizes the Secretary to make grants for programs to: (1) increase the attractiveness of nursing as a career through changes in wage structures, employment options and benefits, and the role of nurses in health care facilities; and (2) demonstrate innovative methods of providing for career advancement and encourage nurses and nurse assistants to continue nursing education. Authorizes appropriations. Authorizes the Secretary, subject to appropriations, to establish a program to insure educational loans to individuals with a degree as a registered nurse for educational expenses related to training nurses as nurse practitioners or nurse midwives or in areas of needed specialized nursing skills. Makes provisions of the program of Insured Health Educations Assistance Loans to Graduate Students, established by current law in the Public Health Service Act, apply to this program except as inconsistent. Authorizes the Secretary, subject to appropriations, to enter into agreements with eligible individuals to assist in repaying specified amounts of their eligible educational loans. Sets forth criteria for an individual to be eligible to receive assistance, including a requirement that the individual agree to work full-time as a registered nurse in a nursing crisis area. Sets forth a schedule for loan repayment by the Secretary to the holder of the loans based on the number of years of work completed as agreed. Amends the Internal Revenue Code to allow C corporations a tax credit for 20 percent of the amount paid or incurred as qualified nursing scholarships.

Prisoner-of-War Commemorative Coin Act - Directs the Secretary of the Treasury to issue a specified number of one-dollar coins emblematic of the experience of American prisoners of war. Requires that all sales of such coins include a surcharge of $5 per coin. Requires specified proceeds from such surcharges to be paid to the: (1) Secretary of the Interior for construction of the Andersonville Prisoner-of-War Museum in Andersonville, Georgia; (2) endowment fund established by this Act for the maintenance of such Museum; and (3) Secretary of Veterans Affairs to maintain national cemeteries.

Requires the Secretary of Health and Human Services to report to the Congress on a revision of the AFDC limit on automobiles in order to increase the employability of AFDC recipients. Provides for State agency exclusion from AFDC eligibility determinations of certain resources related to microenterprise initiatives by AFDC recipients towards self-sufficiency. Requires State agencies to ensure that caseworkers advise AFDC recipients of the option for microenterprises. Provides for the inclusion of microenterprise training and activities in the JOBS program under SSA title IV part F (Job Opportunities and Basic Skills Training Program).

Securities Private Enforcement Reform Act - Amends the Securities Exchange Act of 1934 to declare that a defendant may be liable jointly and severally for damages in an implied private action only if the trier of fact specifically determines that the defendant knowingly engaged in securities fraud. Sets forth a liability allocation scheme to determine the percentage of responsibility among the defendants if the trier of fact finds that the defendant did not engage in knowing securities fraud. Prescribes guidelines for the award of reasonable fees and expenses incurred by the prevailing party in any implied private action. Declares that in any implied right of action that is certified as a plaintiff class action: (1) the share that is awarded to the representative plaintiff shall be calculated in the same manner as the share awarded to all other members of the plaintiff class; (2) a party may not be represented by any attorney who owns or has a beneficial interest in the securities that are the subject of the litigation, or who is obligated to pay remuneration to a third party for assistance in obtaining the representation of any party to the action; and (3) funds disgorged as a result of Securities and Exchange Commission action shall not be distributed as payment for attorneys' fees or expenses incurred by private parties seeking distribution of the disgorged funds. Sets a statute of limitations on private rights of action under this Act.
