Expresses support for: (1) designation of a National Autism Awareness Month; and (2) devoting new resources to researching the root causes of autism, identifying the best methods of early intervention and treatment, expanding programs for individuals with autism, and promoting understanding of their special needs. Commends parents and relatives for providing for the special needs of children with autism. Stresses the need to begin early intervention services. Expresses the sense of the House of Representatives that: (1) the guidelines of the United States Preventive Services Task Force would not prohibit an insurer from providing coverage for mammography services in addition to those recommended by the Task Force and should not be used by insurers to deny coverage for services that are not recommended on a routine basis; and (2) the National Cancer Institute should continue to invest and provide leadership regarding research to develop more effective breast cancer screening tools and strategies.

Amends the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 to extend, through FY2010, the authority of the Secretary of Education to waive or modify certain requirements relating to maintenance of effort, supplementary use of funds, and matching funds in providing assistance to Louisiana, Mississippi, Alabama, and Texas and, through them, to local educational agencies and non-public elementary and secondary schools serving areas in which a major disaster was declared relating to Hurricane Katrina or Rita.

Control America's Purse-strings to Deliver a Better Tomorrow Act or the CAP the DEBT Act - Amends the Congressional Budget Act of 1974 to make it out of order in the House of Representatives and in the Senate to consider any bill, joint resolution, amendment, or conference report increasing the statutory limit on the public debt if there is any other matter in such measure. Requires a two-thirds recorded vote of Members in the House and a roll call vote of at least two-thirds of the Members of the Senate before legislation increasing the statutory limit on the public debt may be considered as passed or agreed to in either chamber. Permits a successful appeal from the ruling of the Chair in the Senate on such prohibition, but only by an affirmative roll call vote of two-thirds of its Members. Repeals Rule XXVIII (Statutory Limit on Public Debt) of the Rules of the House, and known as the "Gephardt Rule," providing for mandatory adjustment of the statutory limit on the public debt to conform to a budget resolution.

Sustainable Property Grants Act of 2009 - Amends the American Recovery and Reinvestment Tax Act of 2009 to allow real estate investment trusts to qualify for energy property grants under such Act without affecting limitations on dividend payments applicable to such trusts.

Medicaid DSH Integrity Act - Directs the Secretary of Health and Human Services (HHS) to indicate, in appropriate guidance, that the Centers for Medicare & Medicaid Services (CMS) do not intend to enforce any changes in policy related to calculating the limits on the adjustment in payment under title XIX (Medicaid) of the Social Security Act for inpatient hospital services furnished by disproportionate share hospitals (DSH) that were contained in the Medicaid DSH auditing and reporting regulations the CMS issued pursuant to the Medicare Prescription Drug Improvement and Modernization Act of 2003. Requires the Secretary to publish an interim final rule to revise such regulations as necessary to: (1) correct such policy changes; (2) provide appropriate guidance for otherwise implementing those auditing and reporting regulations; and (3) provide for specified regulatory changes to be included in the new interim rule. Requires the CMS, in defining the costs of furnishing services to individuals with no health insurance (or other source of third-party coverage), to permit inclusion of all costs related to services provided to patients with no insurance for the service rendered, even if the patient has insurance that covers other services. Declares that the receipt by a hospital of nominal payments related to a service shall not constitute health insurance or a source of third-party coverage.

Personal Health Record Act of 2009 - Amends the Public Health Service Act to require the National Coordinator for Health Information Technology, in developing a nationwide health information technology infrastructure, to allow individuals to access their individually identifiable health information. Requires the inclusion in the Federal Health IT Strategic Plan objectives, milestones, and metrics related to the interoperability of a personal health record with an electronic health record (EHR). Directs the National Coordinator to develop guidelines for making EHRs interoperable with personal health records for the purpose of improving health care quality, reducing medical errors, and advancing the delivery of patient-centered medical care and health management. Requires the National Coordinator to report to the appropriate congressional committees on: (1) personal health records, including the extent to which the use of personal health records improve communication between individuals and covered entities and improve patient health management; and (2) issues related to an individual's control of the personal health record. Requires the HIT Policy Committee to make recommendations for standards and implementation specifications for the interoperability of personal health records and EHRs. Amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act to establish as an eligibility requirement for an incentive payment for the meaningful use of EHR technology that a health professional, hospital, or Medicaid provider must demonstrate the availability of certified EHR technology to and use of such technology by individuals furnished items and services by such professional, hospital, or provider in the form of electronic and personal health records.

Small Business Penalty Relief Act of 2009 - Amends the Internal Revenue Code to limit the penalty for failure to disclose a reportable transaction (a transaction determined by the Internal Revenue Service (IRS) as having a potential for tax avoidance or evasion) to 75% of the decrease in tax resulting from such transaction. Sets forth a maximum penalty for failure to report a reportable transaction and a minimum and maximum penalty for failure to report a listed transaction (a transaction specifically identified by the IRS as a tax avoidance transaction). Requires the Commissioner of Internal Revenue to report by June 1, 2010, and then annually, to Congress on penalties relating to tax shelters and reportable transactions.

Common Sense Health Care Reform and Affordability Act - Requires each state to mitigate the cost of high risk individuals in the state through: (1) a state reinsurance program; or (2) a state high risk pool. Prohibits a health insurance issuer from applying an annual or lifetime aggregate spending cap on any health insurance coverage or plan offered by such issuer. Requires the Secretary of Health and Human Services (HHS) to pay awards to states for reducing the premiums in the small group market or the individual market or reducing the percentage of uninsured, nonelderly residents in a state. Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for establishment and governance of association health plans, which are group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations and which meet certain ERISA certification requirements. Amends ERISA, the Public Health Service Act, and the Internal Revenue Code to require group health plans that provide dependent coverage of children to continue to treat an individual as a dependent until at least 25 years of age. Prohibits a state from establishing a law that prevents an employer from instituting auto-enrollment for coverage under a group health plan, so long as the participant or beneficiary has the option of declining such coverage. Directs that the laws of the state designated by a health insurance issuer (primary state) shall apply to individual health insurance coverage offered by that issuer in the primary state and in any other state (secondary state), but only if the coverage and issuer comply with conditions of this Act. Revises provisions related to health savings accounts (HSAs), including to allow the payment of premiums for high deductible health plans from HSA accounts. Sets conditions for lawsuits arising from health care liability claims regarding health care goods or services or any medical product affecting interstate commerce. Establishes a statute of limitations and limits noneconomic and punitive damages. Declares that nothing in this Act shall be construed to interfere with the doctor-patient relationship or the practice of medicine. Repeals provisions establishing the Federal Coordinating Council for Comparative Effectiveness Research. Permits a group health plan to vary premiums and cost-sharing by up to 50% of the benefits based on participation (or lack of participation) in a wellness program. Prohibits funds authorized or appropriated by federal law and funds in any trust fund to which funds are authorized or appropriated by federal law from being expended for any abortion. Allows a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product).

Directs the Secretary of Health and Human Services (HHS), with respect to a state in the calculation for it of the Federal Medical Assistance Percentage (FMAP), to substitute the state's average historical per capita income for a year in any instance for which the Secretary would use the state's per capita income for such year if: (1) in such year the state's per capita income exceeds the average historical per capita income by at least 8%; and (2) during such year or any of the two previous years a major disaster was declared in the state by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.

Gulf Oyster Protection Act of 2009 - Prohibits the use of federal funds to establish or implement any requirement for the control of Vibrio vulnificus applicable to the post-harvest processing of oysters that is in addition to federal requirements applicable to such processing as of the date of enactment of this Act.

Homebuyer Tax Credit Improvement Act of 2009 - Amends the Internal Revenue Code, with respect to the first-time homebuyer tax credit, to: (1) deny such credit to taxpayers under the age of 18; (2) require a taxpayer claiming such credit to attach to their returns a properly executed copy of the settlement statement used to purchase their residence; and (3) prohibit a credit for residences acquired from a spouse. Requires tax return preparers to file tax returns electronically unless they reasonably expect to file 100 or fewer individual income returns in a calendar year.

Nutria Eradication and Control Act of 2009 - Establishes a nutria eradication program under which the Secretary of the Interior may provide financial assistance to Maryland, Louisiana, Delaware, Oregon, Virginia, and Washington to eradicate or control nutria and restore nutria-damaged wetland. Requires that the Maryland program consist of management, research, and public education activities carried out in accordance with the United States Fish and Wildlife Service's document "Eradication Strategies for Nutria in the Chesapeake and Delaware Bay Watersheds."

Amends Rule XI (Procedures of Committees and Unfinished Business) of the Rules of the House of Representatives to require the chair of a committee, within 24 hours after commencing a meeting to consider a measure or matter, to cause its text to be made publicly available in an electronic form. Requires a committee chair to do the same with an amendment to such measure or matter within 24 hours after adopting it. Amends Rule XIII (Calendar and Committee Reports) to prohibit a committee report on a measure or matter from including recommended amendments after it was ordered reported, except technical and conforming changes authorized by the committee to correct section numbers, cross-references, punctuation, grammar, spelling, or to maintain mathematical consistency.

Regulations From the Executive in Need of Scrutiny Act of 2009 - Rewrites provisions regarding congressional review of agency rulemaking to require congressional approval of major rules of the executive branch before they may take effect (currently, major rules take effect unless Congress passes and the President signs a joint resolution disapproving them). Provides that if a joint resolution of approval of a major rule is not enacted by the end of 90 session days or legislative days after such resolution is introduced, the rule shall be deemed not to be approved and shall not take effect. Permits a major rule to take effect for 90 calendar days without such approval if the President determines such rule is necessary because of an imminent threat to health or safety or other emergency, for the enforcement of criminal laws, for national security, or to implement an international trade agreement. Sets forth procedures of the House of Representatives and the Senate for joint resolutions: (1) approving major rules; and (2) disapproving nonmajor rules.

Disaster Relief and Recovery Development Act of 2009 - Directs the Comptroller General to conduct a study on the ability of existing alert and warning systems to provide information relating to disasters to individuals with limited English proficiency. Requires the President to: (1) review regulations and policies relating to federal disaster assistance to eliminate regulations that are no longer relevant, to harmonize contradictory regulations, and to simplify and expedite disaster recovery and assistance; and (2) issue and implement regulations required under the Robert T. Stafford Disaster Relief and Emergency Assistance Act to provide procedures for estimating the cost of repairing or replacing a facility damaged or destroyed by a major disaster that expedite recovery and reduce the costs and time for completion of recovery projects through the creation of financial and performance incentives. Amends such Act to: (1) prohibit a state or local government from using more than 15% (currently, 10%) of the financial assistance received by it for implementing approved predisaster hazard mitigation measures for a fiscal year under such Act to fund activities to disseminate information regarding cost-effective mitigation technologies; and (2) require the federal coordinating officer of a major disaster area to make an initial appraisal of the recovery assistance needed within one month after the disaster is declared and to coordinate detailed recovery plans with state officials. Directs the President: (1) in carrying out requirements to form federal emergency support teams for major disaster areas, to establish at least three national recovery teams, sufficient regional recovery teams, including Regional Office strike teams, and other teams as necessary to meet incident management responsibilities; (2) to establish a federal interagency disaster recovery task force to maintain a catalogue of, and ensure communications among, federal programs that may be used to assist in disaster recovery efforts; and (3) to notify specified congressional committees before making any contribution in an amount greater than $5 million (currently, $20 million) for the repair, restoration, and replacement of damaged facilities,. Permits the President, upon determining that there is extensive and widespread damage and destruction resulting from a major disaster, to allow a state or local government or a private nonprofit facility to consolidate contributions received as a lump sum payment to repair, restore, reconstruct, or replace more than one public facility.

Wetlands Conservation Investment Act of 2009 - Amends the Internal Revenue Code to treat gain or loss from the sale or exchange of a mitigation bank credit by the sponsor of the mitigation bank (i.e., the wetland, stream, or other aquatic resource area that has been restored, established, enhanced, or preserved for the purpose of providing compensation for unavoidable impacts to aquatic resources) who earned such credit as the sale or exchange of a capital asset held for more than one year (thus allowing preferential tax treatment of such gain or loss).

Defund ACORN Act - Prohibits any federal contract, grant, cooperative agreement, or other form of agreement from being awarded to, any federal funds in any other form from being provided to, or any federal employee or contractor from promoting any organization that: (1) has been indicted for a violation under any federal or state law governing the financing of a campaign for election for public office or any law governing the administration of such an election, including a voter registration law; (2) had its state corporate charter terminated due to its failure to comply with federal or state lobbying disclosure requirements; (3) has filed a fraudulent form with any federal or state regulatory agency; or (4) employs, has under contract, or retains to act on its behalf any individual who has been indicted for a violation under federal or state law relating to an election for federal or state office. Identifies, specifically, the Association of Community Organizations for Reform Now (ACORN) and any affiliate as such an organization. Requires the Federal Acquisition Regulation to be revised to carry out provisions of this Act relating to contracts.

Urges: (1) the President to issue a report clearly outlining the responsibilities, qualifications, and authorities of the special assistants he has appointed (commonly referred to as "czars") and to certify to Congress that such czars will not assert powers other than those granted by statute to a commissioned officer on the President's staff; and (2) Congress to hold hearings on such report and certification within 30 days.

Disaster Recovery Improvement Act - Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to authorize the President to increase the maximum total contributions for a major disaster by 5% under such Act if, at the time of a declaration of a major disaster, the affected state has in effect and is actively enforcing an approved building code. Sets forth state building code submission and approval requirements, including use of the nationally recognized model building code as a minimum standard. Directs the President, in making a contribution to a state or local government or a person that owns a nonprofit facility for repair, restoration, and replacement of a damaged facility, to provide not less than 50% of the President's initial estimate of the federal share as an initial payment. Provides for expedited payments. Requires the federal share for debris removal to be increased by 5% for states and local governments that have: (1) a debris management plan approved by the Administrator of the Federal Emergency Management Agency (FEMA); (2) prequalified two or more debris and wreckage removal contractors before the date of declaration of the major disaster; and (3) resubmitted such plan to the Administrator for approval every four years. Allows a recipient of a debris removal grant to: (1) use funds for the costs of recycling debris and wreckage resulting from a major disaster; and (2) retain any financial benefit received from the salvage. Increases the period for appeals of disaster assistance decisions. Directs the Administrator to review, update, and revise the factors considered to measure the severity, magnitude, and impact of a disaster. Authorizes the President to provide emergency assistance to pets and animals and their owners.

Death Tax Repeal Permanency Act of 2009 - Makes permanent the provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) that repeal the estate and generation skipping transfer taxes and that make reductions in the gift tax.

Healthy Savings Act of 2009 - Amends Internal Revenue Code provisions relating to health savings accounts (HSAs) to allow: (1) spouses to make increased catch-up contributions to a single HSA; (2) Medicare Part A beneficiaries to establish and contribute to an HSA; (3) veterans eligible for service-connected disability benefits and individuals eligible for Indian health service assistance to establish an HSA; (4) HSAs to incorporate flexible spending and health reimbursement arrangements; (5) the use of HSAs to purchase health insurance; (6) payment of certain medical expenses incurred before the establishment of an HSA; and (7) payments from an HSA for prescription and over-the-counter drugs that aid in the prevention and management of chronic diseases. Allows Medicare beneficiaries participating in a Medicare Advantage medical savings account (MSA) to exclude from gross income payments made to their MSAs. Treats as medical care for purposes of the tax deduction for medical expenses certain exercise equipment and physical fitness programs and certain nutritional and dietary supplements.

Vessel Repair Enhancement Act of 2009 - Expands, for capital construction fund provisions, the definition of "qualified vessel" to include: (1) a vessel documented under U.S. laws and maintained or repaired in a privately owned shipyard in the United States; and (2) any floating dry dock and related shipyard infrastructure (including marine railways) located in the United States and used to build, maintain, or repair U.S.-documented vessels. Amends federal merchant marine law and the Internal Revenue Code to: (1) allow capital construction funds to be used for maintenance or repair of vessels documented under the laws of the United States; (2) establish the order of withdrawal for purposes of the tax treatment of qualified withdrawals from such funds; and (3) disallow a basis reduction for maintenance or repair withdrawals.

Medicare Patient Safeguards Act of 2009 - Expresses the sense of Congress that: (1) efforts to make the Medicare program financially sustainable, including application of comparative effectiveness research, should not deprive patients of medically necessary care solely due to its cost or limit access to needed health care services due to a patient's age, gender, ethnicity, or disability status; and (2) Congress should protect patients' access to needed care by ensuring that the Administrator of Centers for Medicare and Medicaid Services (CMS) relies on adequate clinical expertise when the Administrator proposes to narrow coverage for a product or service under title XVIII (Medicare) of the Social Security Act. Establishes a process for the issuing of Medicare national coverage determinations by the Administrator. Enumerates prohibitions and conditions.

Amends the Digital Television Transition and Public Safety Act of 2005 to extend through FY2012 (under current law, through FY2010) the requirement that the Assistant Secretary for Communications and Information of the Department of Commerce make payments from the Digital Television Transition and Public Safety Fund for a grant program to assist public safety agencies in the the acquisition of, deployment of, or training for the use of interoperable communications equipment that utilizes reallocated public safety spectrum for radio communication. Allows the Assistant Secretary to extend, on a case-by-case basis, the period of performance for any investment approved under the program for a period not to exceed two years.

Debt Accountability Act - Amends the Congressional Budget Act of 1974 to make it out of order in either chamber to consider any bill, joint resolution, amendment, motion, or conference report that would increase the deficit or decrease the surplus for any fiscal year unless the appropriate chamber, by roll call vote, acknowledges the costs that would be incurred in carrying out such measure, as estimated by the Director of the Congressional Budget Office (CBO), and any effect those costs might have on the national debt.

Condemns the July 2009 attacks in Jakarta and all other terrorist attacks against Indonesian targets. Expresses condolences to the people of Indonesia and to the other countries suffering casualties in the attacks. Supports the government of Indonesia's efforts to investigate and prosecute the attacks and calls upon Indonesia and its neighbors to work together to combat terrorism in Southeast Asia. Reaffirms the commitment of the United States to strengthen democratic institutions and promote peace and ethnic and religious tolerance in Indonesia.
