Pre-existing Conditions Protection Act of 2017 This bill sets forth amendments that would take effect in the case of the repeal of the Patient Protection and Affordable Care Act (PPACA) and the health care provisions of the Health Care and Education Reconciliation Act of 2010 and the restoration of the provisions amended by those provisions. If the amendments take effect, the Public Health Service Act, the Employee Retirement Income Security Act of 1974 (ERISA), and Internal Revenue Code are revised to maintain PPACA consumer protections. Specifically, the bill would maintain the: requirement for health insurance to cover preexisting conditions, requirement for health insurers to accept every employer and every individual applying for coverage, prohibition against health insurers discriminating against individuals based on health status factors, prohibition against collecting genetic information in connection with issuing health insurance, and requirements for workplace wellness programs connected to health insurance.

Requires the committee to include in its report to both chambers at the end of a congressional session recommendations for its continuation or for designation of a similar entity to continue the pursuit of improvements in the congressional process.

VA Management Alignment Act of 2017 This bill requires the Department of Veterans Affairs (VA) to submit to the Committees on Veterans' Affairs of the Senate and the House of Representatives a report (including recommendations for appropriate legislation) regarding the roles, responsibility, and accountability of elements and individuals of the VA. In creating such report, the VA shall utilize the results of: the Independent Assessment of the Health Care Delivery Systems and Management Process of the VA established by the Veterans Access, Choice, and Accountability Act of 2014; any study or report by the Commission on Care established by such Act; and other studies or reports, including a report titled "Task Force on Improving Effectiveness of VHA Governance: Report to the VHA Under Secretary for Health," dated February 28, 2015. The VA shall also specify clearly delineated roles and responsibilities to optimize the organizational effectiveness and accountability of each: Administration, staff office, or staff organization and each subordinate organization thereof; and key leader of the VA in relation to any Administration, staff office, or staff organization, Veteran Integrated Service Network, or medical facility.

Flexibility to Promote Reemployment Act

Flexibility to Promote Reemployment Act This bill authorizes the Department of Labor to enter into agreements with 10 states per year (currently, 10 states total) for the purpose of allowing such states to conduct reemployment demonstration projects. In addition to a governor of a state, a designee of a governor may apply for approval of such a project. The allowable project period is extended through December 31, 2021. A demonstration project may include disbursements promoting retention to employers who hire individuals receiving unemployment compensation. Labor must approve completed applications in the order of receipt. Labor may terminate a demonstration project under this bill if it notifies the state in writing with sufficient detail describing the violation and determines that the state has not taken action to correct the violation within 90 days after the notification. The bill directs Labor to evaluate the impact of each demonstration project using existing data sources and methodology appropriate to determine project effects, including the effect on individual skill levels, earnings, and employment retention.

Technologies for Energy Security Act of 2017

Technologies for Energy Security Act of 2017 This bill amends the Internal Revenue Code to extend and modify the tax credits for residential energy efficient property and investments in energy property. The bill modifies the tax credit for residential energy efficient property to extend through 2021 the credits for expenditures for fuel cell property, small wind energy property, and geothermal heat pump property. For each extended credit, the bill phases out the current credit rate of 30% of expenditures by reducing it to 26% or 22%, depending on the date that the property is placed in service. The bill extends the tax credit for investments in energy property for the following property with construction that begins before January 1, 2022: fiber-optic solar energy property, fuel cell property, microturbine property, combined heat and power system property, small wind energy property, and thermal energy property. The bill phases out the current credit rate of 30% for investments in fuel cell property, small wind energy property, and fiber-optic solar energy property by reducing it to 26% or 22%, depending on the date that the property is placed in service.

STOP Act of 2017

Synthetics Trafficking and Overdose Prevention Act of 2017 or the STOP Act of 2017 This bill amends the Tariff Act of 1930 to make the Postmaster General the consignee (i.e., the entity financially responsible for the receipt of a shipment) for merchandise, excluding documents, imported through the mail into the United States. The Postmaster General must designate licensed customs brokers to file required documents or information for such shipments. The bill amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to impose a customs user fee on postal shipments or any other item valued at $2,000 or less arriving at an international mail facility. The bill amends the Trade Act of 2002 to direct the Department of the Treasury to require the Postmaster General to provide for the advanced electronic transmission to the U.S. Customs and Border Protection of certain information for all postal shipments made by the U.S. Postal Service (USPS), including postal shipments it receives from foreign postal operators. The Postmaster General: shall be liable for civil penalties for postal shipment violations committed by a foreign postal operator or the USPS; may be directly or indirectly responsible for discrepancies resulting from omissions made or false information provided by a foreign postal operator or the USPS; and shall ensure that all costs and penalties associated with complying with this bill are recouped from foreign shippers, foreign postal operators, or U.S. ultimate consignees.

Botanical Sciences and Native Plant Materials Research, Restoration, and Promotion Act This bill directs the Bureau of Land Management (BLM), the U.S. Geological Survey, the U.S. Fish and Wildlife Service (USFWS), the National Park Service, and other appropriate entities to support a program of intramural and extramural botanical science research to support the land management responsibilities of the Department of the Interior. Interior may hire additional personnel to augment its expertise in the botanical sciences. Interior's land management agencies, the Forest Service, and the Department of Defense shall give preference to using locally adapted native plant materials when undertaking land management activities on lands under their respective jurisdictions. A state shall maximize the use of such plant materials when carrying out environmental mitigation efforts and environmental restoration and pollution abatement activities authorized under the surface transportation block grant program. Sponsors of development or redevelopment projects involving certain federal facilities shall establish, maintain, or restore use of such plant materials on all natural spaces. Specified federal agencies shall collaborate regarding land use responsibility when undertaking specified activities related to native plant materials. The bill authorizes the BLM to undertake specified activities for the development and use of native plant materials. The National Fish and Wildlife Foundation shall ensure that a program of activities which is focused on conservation and protection of native plants is incorporated into its existing programs and activities. The USFWS shall support a program of collaborative grants to: (1) prevent rare plants from becoming endangered, and (2) encourage the recovery of endangered plants.

Concrete Masonry Products Research, Education, and Promotion Act of 2017 This bill directs the Department of Commerce to issue orders applicable to U.S. manufacturers of concrete masonry products. Any such order must provide for the establishment of a Concrete Masonry Products Board to carry out a program of generic promotion, research, and education regarding concrete masonry products. An order must also provide that assessments be paid by concrete masonry product manufacturers for concrete masonry products manufactured and marketed in the United States. At least 50% of the assessments paid by a manufacturer must be used to support research, education, and generic promotion programs and projects in support of the geographic region of the manufacturer. During the 60-day period preceding the proposed effective date of an order, Commerce shall conduct a referendum for order approval among manufacturers. The bill allows petition and review of an order, and order enforcement through U.S. district courts. The bill requires a study and a report by: (1) the Government Accountability Office on how the board spends assessments collected, the impact of board activities, and other matters relating to the demand for concrete masonry products; and (2) Commerce on the appropriateness and effectiveness of applying the commodity check-off program model to a nonagricultural industry.

Firefighter Cancer Registry Act of 2018

Firefighter Cancer Registry Act of 2017 This bill requires the Centers for Disease Control and Prevention (CDC) to develop and maintain a voluntary registry of firefighters to collect history and occupational information that can be linked to existing data in state cancer registries. The registry must be used to improve monitoring of cancer among firefighters and to collect and publish epidemiological information regarding cancer among firefighters. The CDC should seek to include specified information in the registry, including the number and type of fire incidents attended by an individual. To collect information for the registry, the CDC may incorporate questions into existing public health surveys, questionnaires, and other databases. The CDC must: (1) develop a strategy to maximize participation in the registry; (2) develop guidance for states and firefighting agencies regarding the registry; (3) encourage inclusion in the registry of data on minority, female, and volunteer firefighters; and (4) seek feedback on the registry from nonfederal experts. The CDC must develop a process for making registry data available for research without a fee if findings or publications from the research are made public or available to stakeholders.

Law Enforcement Officers Equity Act This bill expands the definition of "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) federal employees not otherwise covered whose duties include the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. The bill deems service performed by an incumbent law enforcement officer on or after the enactment date of this bill to be service performed as a law enforcement officer for retirement purposes. The past service of such incumbents shall be treated as service performed by a law enforcement officer for retirement purposes only if a written election is submitted to the Office of Personnel Management within five years after the enactment of this bill or before separation from government service, whichever is earlier. An incumbent who makes an election before the enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. A law enforcement officer shall not be subject to mandatory separation during the three-year period beginning on the enactment of this bill.

This bill amends the Internal Revenue Code to permit the tax-exempt financing of certain government-owned buildings by expanding the definition of "exempt facility bond" to include bonds used for qualified government buildings. A qualified government building is a government-owned building or facility that consists of one or more of the following: an elementary or secondary school; facilities of a state college or university used for educational purposes; a public library; a court; hospital, health care, laboratory, or research facilities; public safety facilities; or offices for government employees. The bill excludes buildings or facilities that include specified recreational equipment or are used for the primary purpose of providing retail food and beverage services, recreation, or entertainment. The bill establishes: (1) a $5 billion limit on the amount of tax-exempt financing which may be provided for government buildings, and (2) procedures for allocating and applying for the financing. The bill exempts the bonds for government buildings from the volume cap on private activity bonds.

Military Surviving Spouses Equity Act This bill: (1) repeals certain provisions that require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or who would be entitled to retired pay except for being under 60 years of age, (2) prohibits requiring repayment of certain amounts previously paid to SBP recipients in the form of a retired pay refund, and (3) requires (current law authorizes) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. The Secretary concerned shall restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to the surviving child or children of a member.

Childhood Cancer STAR Act

Childhood Cancer Survivorship, Treatment, Access, and Research Act of 2017 or the Childhood Cancer STAR Act This bill amends the Public Health Service Act to authorize the National Institutes of Health (NIH) to provide support to collect the medical specimens and information of children, adolescents, and young adults with selected cancers that have the least effective treatments in order to achieve a better understanding of these cancers and the effects of treatment. The national childhood cancer registry is reauthorized through FY2022 and revised to authorize the Centers for Disease Control and Prevention to award grants to state cancer registries to improve tracking of childhood cancers. The Department of Health and Human Services (HHS) may: (1) support pilot programs to develop or study models for monitoring and caring for childhood cancer survivors throughout their lives, (2) establish a task force to develop and test standards for high-quality childhood cancer survivorship care, and (3) carry out a demonstration project to improve care coordination as childhood cancer survivors transition to adult care. HHS must convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer Survivors. The NIH may support research on: (1) outcomes for, and barriers faced by, pediatric cancer survivors within minority or medically underserved populations; and (2) follow-up care for pediatric cancer survivors, including research on the late effects of cancer treatment and long-term complications. The Government Accountability Office must make recommendations to address barriers to childhood cancer survivors obtaining and paying for adequate medical care.

Common Sense Nutrition Disclosure Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to revise the nutritional information that restaurants and retail food establishments must disclose. The nutrient content disclosure statement on the menu or menu board must include: (1) the number of calories contained in the whole menu item; (2) the number of servings and number of calories per serving; or (3) the number of calories per common unit of the item, such as for a multi-serving item that is typically divided before presentation to the consumer. Nutritional information may be provided solely by a remote-access menu (e.g., an Internet menu) for food establishments where the majority of orders are placed by customers who are off-premises. Establishments with self-serve food may comply with the requirements for restaurants or place signs with nutritional information adjacent to each food item. An establishment's nutrient content disclosures may vary from actual nutrient content if the disclosures comply with current standards for reasonable basis. Establishments with standard menu items that come in different flavors, varieties, or combinations, that are listed as a single menu item may determine and disclose nutritional information using specified methods or methods allowed by the Food and Drug Administration (FDA). Regulations pursuant to this bill or the clause amended by this bill may not take effect earlier than two years after final regulations are promulgated. The FDA may not exempt states from nutrition labeling requirements.

Holocaust Insurance Accountability Act of 2017 This bill allows a beneficiary of a Holocaust-era life, dowry, education, annuity, property, or other insurance policy to bring a civil action in a U.S. district court against the insurer for the covered policy to recover proceeds due or, otherwise, to enforce any rights under the policy. The bill covers any policy that was: (1) in effect at any time from January 31, 1933, to December 31, 1945; and (2) issued to a policy holder domiciled in any area that was occupied or controlled by Nazi Germany, an ally or friendly government, or the territorial jurisdiction of Switzerland. The bill requires the award: (1) to a prevailing beneficiary of the amount of the proceeds due under the policy, plus prejudgment interest at 6% per year, compounded annually, calculated from the date the amount was originally due; and (2) of treble damages against any insurer that acted in bad faith. A civil action under this bill must be filed within 10 years after enactment of this bill. A prior judgment or release entered for any claim arising under a covered policy in any civil action in a federal or state court shall not impair a claim brought under this bill. Any executive agreement between the United States and a foreign government or any executive foreign policy of the U.S. government shall not supercede or preempt any state law or compromise, settle, extinguish, waive, preclude, bar, or foreclose any claim brought under this bill. A claim brought under state law within 10 years after enactment of this bill shall not be deemed untimely on the basis of any state or federal statute of limitations or on the basis of any other legal or equitable rule or doctrine governing timeliness.

Craft Beverage Modernization and Tax Reform Act of 2017 This bill amends the Internal Revenue Code, with respect to the tax treatment of certain alcoholic beverages, to: exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; modify the small wine producer tax credit to increase the amount of the credit, expand the producers that are covered, and specify an adjustment for hard cider; modify the alcohol content limitations that apply to certain wines for tax purposes; specify definitions for "mead" and "low alcohol by volume wine;" modify requirements for records, statements, and returns for certain breweries; and permit the transfer of beer between bonded facilities without payment of tax. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages.

Social Impact Partnerships to Pay for Results Act This bill allows the Department of the Treasury to enter into agreements with state and local governments for social-impact partnership projects for which federal funds shall be awarded only if a project achieves certain agreed-upon outcomes resulting in both social benefit and federal, state, or local savings. In carrying out these agreements, Treasury must consult with the Federal Interagency Council on Social Impact Partnerships and the Commission on Social Impact Partnerships (both newly established by the bill). Treasury may transfer to another federal agency the authority to administer the agreements. At least 50% of all federal payments made under such agreements must be used for initiatives that directly benefit children. The bill also extends funding through 2017 for the Temporary Assistance for Needy Families (TANF) program and specified related grant programs. In addition, the bill provides for specified research and evaluation by the Department of Health and Human Services (HHS), the U.S. Census Bureau, and states with respect to TANF and related programs. HHS, in consultation with the Department of Labor, shall develop a database of projects that have used a proven or promising approach in moving TANF recipients to work.

Terror-Free Skies Act

Terror-Free Skies Act This bill requires the President to report to specified congressional committees every 180 days on the Iranian government's use of commercial aircraft and related services for illicit military or other activities during the past five years. Such report shall describe the extent to which: Iran's government has used commercial aircraft, including Iran Air, or related services to transport illicit cargo to or from Iran, including military goods, weapons, personnel, electronic parts and mechanical equipment, or rocket or missile components; the commercial aviation sector of Iran has provided support to the Islamic Revolutionary Guard Corps, Iran's Ministry of Defense and Armed Forces Logistics, the Bashar al Assad Regime, Hezbollah, Hamas, Kata'ib Hezbollah, or any other foreign terrorist organizations or entities designated on the specially designated national list maintained by the U.S. Department of the Treasury; and foreign governments and persons have facilitated such activities. If the President determines in such a report that any Iranian commercial airliner has used commercial aircraft for illicit military purposes on or after January 16, 2016, the President shall designate such airline as a specially designated national and blocked person. This bill shall cease to be effective 30 days after the President certifies that the Iranian government has ceased providing support for acts of international terrorism.

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide each veteran who submits a claim for VA benefits with an opportunity to permit a covered congressional employee in the office of the veteran's Member of Congress to have read-only access to all of the veteran's records in the Veterans Benefits Administration databases. A Member may designate up to two such covered congressional employees. A covered congressional employee may not be recognized as an agent or attorney with respect to veterans' benefit claims. Funds under this bill may not be used to design or administer any training for covered congressional employees. The bill makes funds available for FY2018 through FY2021 for such congressional employee access program.

Fairness for High-Skilled Immigrants Act of 2017 This bill amends the Immigration and Nationality Act to: (1) eliminate the per-country numerical limitation for employment-based immigrants, and (2) increase the per-country numerical limitation for family-based immigrants from 7% to 15% of the total number of family-sponsored visas. The Chinese Student Protection Act of 1992 is amended to eliminate the provision requiring the reduction of annual Chinese immigrant visas to offset status adjustments under such Act. The bill establishes a transition period during which a percentage of employment-based second and third preference (EB-2 and EB-3) immigrant visas are reserved as follows: for FY2017, 15% of such visas are allotted to natives of countries other than the two countries with the largest aggregate numbers of natives obtaining such visas in FY2011; for FY2018, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2012; and for FY2019, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2015. During the transition period, not more than 25% of the total number of the reserved EB-2 and EB-3 visas shall be allotted to natives of a single country. For FY2015-FY2017, not more than 85% of the unreserved EB-2 and EB-3 visas shall be allotted to natives of a single country. Amendments made by this bill shall apply beginning in FY2017.

Health Care Choice Act of 2017 This bill repeals the health insurance and health coverage expansion requirements of the Patient Protection and Affordable Care Act and related provisions of the Health Care and Education Reconciliation Act of 2010. Provisions of law amended or repealed by those provisions are restored. This bill amends the Public Health Service Act to provide that the laws of a state designated by a health insurer (primary state) apply to individual health insurance coverage offered by that insurer in any state (secondary state) if the coverage, states, and insurer comply with the conditions of this bill. Insurers are exempted from any secondary state's laws that would prohibit or regulate the operation of the insurer in that state. The primary state is given sole jurisdiction to enforce its covered laws in any secondary state. The Government Accountability Office must study the effect of this bill on specified health insurance issues.
