Veterans Opioid Abuse Prevention Act This bill directs the Department of Veterans Affairs (VA) to enter into a memorandum of understanding with a national network of state-based prescription drug monitoring programs under which VA health care providers shall query such network to support the safe and effective prescribing of controlled substances to patients who: (1) receive a prescription for a controlled substance for a period of 90 days or longer, and (2) are not receiving palliative care or enrolled in hospice care. Under such memorandum of understanding, VA health care providers practicing in: (1) a participating state shall query such network in accordance with the agreement between that state's prescription drug monitoring program and such network, and (2) a nonparticipating state shall query the network through the drug monitoring program of the closest participating state.

Air Ambulance Quality and Accountability Act This bill amends title XVIII (Medicare) of the Social Security Act to modify standards and payment for air-ambulance services under the Medicare Program. The Department of Health and Human Services (HHS) shall establish minimum standards that must be met by air-ambulance suppliers and providers as a condition of their participation in Medicare. These standards must address: (1) scope of practice, training, and clinical capability; (2) medical equipment and vehicle attributes; (3) documentation; (4) medical direction and oversight; (5) reporting of specified events; (6) patient safety and infection control; (7) clinical quality-management and performance-improvement programs; and (8) particular populations. An air-ambulance provider or supplier that is accredited by an HHS-approved organization shall be deemed to be in compliance with these standards. HHS must establish an air-ambulance quality-reporting and performance program under which Medicare payment is determined according to a specified performance-based formula. Performance measures shall address patient safety, clinical quality, and over-triage. An air-ambulance provider or supplier must, subject to suspension of payment under Medicare, annually submit specified cost data to HHS. The Medicare Payment Advisory Commission shall report to Congress on whether changes should be made with regard to reimbursement of air-ambulance providers and suppliers under Medicare.

Save American Workers Act of 2017 This bill amends the Internal Revenue Code to change the definition of "full-time employee" for purposes of the employer mandate to provide minimum essential health care coverage under the Patient Protection and Affordable Care Act from an employee who is employed on average at least 30 hours of service a week to an employee who is employed on average at least 40 hours of service a week.

Reverse Transfer Efficiency Act of 2017 This bill amends the General Education Provisions Act to allow the release of a transfer student's educational records from an institution of postsecondary education where a student earned credit for coursework to an institution of postsecondary education where the student was previously enrolled in order to apply the student's coursework and credits toward completion of a recognized postsecondary credential, such as an associate's degree. (In the case of a student who does not complete a bachelor's degree after transferring to a four-year institution from a two-year institution, the credits earned at the four-year institution may be applied towards a recognized postsecondary credential at the two-year institution.) Specifically, the bill allows the Department of Education to provide funding to an institution of postsecondary education that releases a student's records of postsecondary coursework and credits without the consent of the student or the student's parents if the student provides written consent prior to receiving the credential.

Supports the designation of Pulmonary Fibrosis Awareness Month. (Pulmonary fibrosis is scarring of the lungs that causes breathing problems.) Expresses continued support for: (1) more robust and accelerated research to develop more effective treatments for pulmonary fibrosis and to ultimately find a cure for the disease, (2) federal efforts to ease administrative burdens on those suffering from pulmonary fibrosis and their families and caregivers, and (3) swift and efficient federal evaluation and approval of new treatments for pulmonary fibrosis. Recognizes the ongoing courage and contributions of individuals with pulmonary fibrosis who participate in clinical trials. Commends the dedication of those working to improve the quality of life of individuals with pulmonary fibrosis and the families and caregivers of those individuals.

Educating Medical Professionals and Optimizing Workforce Efficiency and Readiness Act of 2017 or the EMPOWER Act of 2017 This bill amends the Public Health Service Act to reauthorize several Department of Health and Human Services (HHS) programs that provide education and training for health-related professions. The bill also reauthorizes and modifies several HHS grant programs for geriatrics education and training.

Legal Workforce Act This bill amends the Immigration and Nationality Act to direct the Department of Homeland Security (DHS) to establish an employment eligibility verification system (EEVS), patterned after the E-Verify system. An employer shall attest, during the verification period and under penalty of perjury, that the employer has verified that an individual is not an unauthorized alien. An individual shall attest that he or she is a U.S. citizen or national, a lawful permanent resident, or an alien authorized to work in the United States. The bill establishes a phased-in EEVS participation deadline for different categories of employers, including agricultural employers. The bill requires reverification of certain groups of workers who have not been verified under E-verify. An employer may voluntarily reverify employees. Employment recruitment and referral are included within the scope of EEVS. The bill sets forth provisions regarding: (1) an employer utilizing a good faith defense, (2) preemption of state or local law, (3) employer penalties, and (4) worker remedies for EEVS errors. DHS shall establish programs to: (1) block the use of misused social security numbers, (2) suspend or limit the use of social security account numbers of identity fraud victims, and (3) permit parents or legal guardians to suspend or limit the use of a minor's social security account number or other identifying information. DHS shall establish at least two Identity Authentication Employment Eligibility Verification pilot programs using distinct technologies to provide employers with identity authentication and employment verification of enrolled new employees.

Military Sexual Assault Victims Empowerment Act or the Military SAVE Act This bill directs the Department of Veterans Affairs (VA), through the Office of Community Care, to carry out a three-year pilot program of hospital care and medical services for eligible veterans at non-VA health care providers to treat physical and psychological injuries or illnesses that, in the judgment of a VA mental health professional, resulted from sexual assault or battery or sexual harassment while the veteran was serving on active duty, active duty for training, or inactive duty training. The program shall be carried out at not more than five locations, at least one of which shall be a rural location, based upon criteria including: (1) distance from a military installation, (2) city size, and (3) rates of sexual assault and rape. An eligible veteran may elect to participate in the pilot program. The VA may not restrict a participant's ability to choose the non-VA health care provider. The bill: (1) sets forth payment provisions for current and new non-VA providers, and (2) provides for program data collection and analysis.

Free File Permanence Act of 2017 This bill requires the Department of the Treasury to continue to operate the Internal Revenue Service (IRS) Free File Program. The program must work with state government agencies to enhance and expand the use of the program, while continuing to: provide free commercial-type online individual income tax preparation and electronic filing services to the lowest 70% of taxpayers by income; provide all taxpayers (regardless of income) with a basic, online electronic fillable forms utility; and work with the private sector to provide the free tax preparation and electronic filing services. Treasury must work with the private sector through the program to identify and implement innovative new program features to improve and simplify the taxpayer's experience with completing and filing individual income tax returns. The IRS and members of the tax software and electronic industry involved in the program must support and promote improvements within the program by mutually testing, piloting, and offering innovative solutions to: simplify the tax system, reduce compliance and reporting burdens, increase tax return accuracy through financial data authentication, strengthen the tax system against fraud through cybersecurity collaboration, avoid duplication, and maximize the use of electronic technology. The Electronic Tax Administration Advisory Committee must report annually to Congress regarding the program, including website statistics, cybersecurity standards, demographic information, marketing and education efforts, simplifications and innovations, and state and local participation.

Securing Our Borders and Wilderness Act This bill amends the Wilderness Act to allow the U.S. Customs and Border Protection to conduct the following activities within a wilderness area for the purpose of securing the international land borders of the United States: access structures, installations, and roads; use motor vehicles and aircraft; deploy temporary infrastructure in response to emergencies; or construct and maintain roads and fences, subject to the approval of the Department of the Interior. Any such activity shall be carried out in a manner that protects the wilderness character of the area.

Border Security for America Act of 2017 This bill directs the Department of Homeland Security (DHS) to: (1) construct and operate infrastructure and technology to deter and detect illegal border activity in high traffic areas, (2) deploy the most practical and effective technology to achieve situational awareness and operational control of the border, (3) deploy additional capabilities to specified border sectors or regions, (4) submit a plan for evaluating and using independent verification and validation resources for border security technology, (5) establish a National Border Security Advisory Committee, (6) submit a southern border threat analysis, (7) implement the Border Security Deployment Program, (8) establish a biometric exit data system, and (9) begin eradicating the carrizo cane plant and any salt cedar along the Rio Grande River. The bill provides for: (1) U.S. Border Patrol personnel increases and infrastructure improvements, including forward base upgrades along the southern border; and (2) National Guard and Department of Defense border assistance. The bill: (1) prohibits federal agency restrictions on U.S. Customs and Border Protection activities on federal land within 100 miles of the border, (2) requires increases in immigration and law enforcement personnel and agricultural specialists, (3) authorizes appropriations for specified immigration purposes, and (4) requires electronic passport screening and biometric matching at airports of entry. The Anti-Border Corruption Act of 2010 is amended to provide for hiring flexibility. Operation Stonegarden is established as a DHS program to provide border security grants. This bill authorizes DHS to construct new ports of entry along the northern and southern borders.

Rightsizing Pension Premiums Act of 2017 This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to: (1) modify the formula that the Pension Benefit Guaranty Corporation (PBGC) uses to calculate the funded percentage of single-employer pension plans, and (2) reduce single-employer PBGC premiums for pension plans that are sponsored by certain small employers or have specified PBGC funded percentages. The bill also prohibits the budget effects of provisions that change PBGC premiums from being counted for the purposes of determining budget points of order for legislation in the House or the Senate. (The PBGC is a federal agency that insures the benefits of private sector, defined benefit pension plans. The PBGC is financed by insurance premiums paid by sponsors of the plans, investment income, assets from pension plans taken over by the PBGC, and recoveries from the companies formerly responsible for the plans.)

Modernization of Medical Records Access for Veterans Act of 2017 This bill directs the Department of Veterans Affairs (VA) to carry out in at least one Veterans Integrated Services Network a pilot program for at least a 12-month period during which veterans enrolled in the VA's patient enrollment system will use a portable medical records storage system to store and share with VA health care providers and community health care providers records of their individual medical histories. The VA shall seek to enter into a contract, using competitive procedures, with an appropriate entity to furnish such storage system. The bill specifies system requirements, including: (1) the capability to store at least four gigabytes of electronic health records on a physical device no larger than a credit card, and (2) the capability to be used by substantially all electronic health records systems certified by the Office of the National Coordinator for Health IT on or before January 1, 2017.

Increasing Information and Notification to Foster Openness Regarding Highly Automated Vehicle Matters to States Act or the INFORM Act This bill requires the Department of Transportation to establish a publicly available electronic database of exemptions from motor vehicle safety or bumper standards.

Anti-Pyramid Scheme Act of 2017 This bill amends the Federal Trade Commission Act to make it unlawful for any person to establish, operate, or promote a pyramid promotional scheme. "Pyramid promotional scheme" means any plan or operation in which individuals pay consideration for the right to receive compensation that is based upon recruiting other individuals into the plan or operation rather than primarily related to the sale of products or services to ultimate users. Furthermore, any person who establishes, operates, or promotes any plan or operation which sells or solicits the sale of consumer products or services in the home or otherwise outside of a permanent retail establishment, and which sells products or services to independent salespeople, shall have a bona fide inventory repurchase agreement. A violation of the bill shall be treated under the Act as an unfair or deceptive act or practice in, or affecting, commerce.

Designating Each Car's Automation Level Act or the DECAL Act This bill requires the Department of Transportation (DOT) to: complete research to determine the most cost effective method and terminology for informing consumers about the capabilities and limitations of each highly automated vehicle or each vehicle that performs partial driving automation; and determine whether such information includes terminology as defined by SAE International in Recommended Practice Report J3016 (published September 2016) or alternative terminology. After completion of such research, DOT shall initiate a rulemaking proceeding to require manufacturers to inform consumers about such information. The bill defines: (1) a "highly automated vehicle" as a motor vehicle, other than a commercial motor vehicle, that is equipped with an automated driving system; and (2) an "automated driving system" as the hardware and software of a vehicle that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether such system is limited to a specific operational design domain.

Youth Opioid Use Treatment Help Act of 2017 or the YOUTH Act This bill amends the Public Health Service Act to expand the grant program for substance abuse treatment services for children and adolescents to cover young adults. The Agency for Healthcare Research and Quality (AHRQ) must award grants for demonstration programs to: (1) expand access to medication-assisted treatment for opioid use disorders among adolescents and young adults, or (2) create and distribute resources on medication-assisted treatment training and implementation for health care providers of children, adolescents, and young adults. AHRQ must report on the demonstration programs and the availability of medication-assisted treatment for adolescents and young adults. The report must include recommendations for ensuring such treatment is accessible.

Systemic Risk Designation Improvement Act of 2017 This bill amends the Dodd-Frank Wall Street Reform and Consumer Protection Act to allow the Federal Reserve Board (FRB) to subject a bank holding company to enhanced supervision if: (1) the company has been identified as a global systemically important company; or (2) the risk of the company's financial distress, or the nature of the company's activities, could pose a threat to the financial stability of the United States. Currently, companies are subject to this type of oversight if they possess at least $50 billion in assets or are a nonbank financial company under the FRB's supervision. The Financial Stability Oversight Council must approve of any metrics used by the FRB in determining by regulation that a category of bank holding companies is subject to enhanced supervision. Under this bill, companies subject to enhanced supervision may be required to limit mergers and acquisitions, restrict products offered, or maintain a certain debt ratio. The FRB must publish the list of companies that have been identified as requiring enhanced supervision.

Protecting Access to Diabetes Supplies Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to modify provisions relating to Medicare's competitive acquisition program (through which rates are set through a competitive bidding program rather than by an established fee schedule) with respect to diabetic testing strips. Specifically, the bill requires the Centers for Medicare & Medicaid Services (CMS) to: use specified data to determine whether a bid satisfies certain requirements related to volume of coverage with respect to such products, reject a bid if the bidder does not demonstrate its ability to furnish such products in a manner consistent with its bid, and establish a process to monitor the extent to which an entity continues to cover the product types included in its bid. The CMS may terminate a contract if it determines that an entity, for reasons other than product discontinuation or market-wide shortage, fails to maintain ready access to such products included its bid. In addition, the bill specifies that an entity furnishing such products to beneficiaries under the program: (1) must furnish to each beneficiary a brand of strips that is compatible with the beneficiary's home blood glucose monitor, (2) may not attempt to influence or incentivize a beneficiary to switch the brand of either type of product, and (3) must contact and receive a request from a beneficiary no more than 14 days prior to dispensing a refill to the beneficiary.

President John F. Kennedy Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 500,000 $1 silver coins in commemoration of President John F. Kennedy. The bill requires all sales of such coins to include a surcharge of $10 per coin, which shall be paid by Treasury to the John F. Kennedy Library Foundation to support the John F. Kennedy Presidential Library and Museum.

Transparency and Honesty in Energy Regulations Act of 2017 This bill prohibits the Department of Energy, the Environmental Protection Agency (EPA), the Department of the Interior, and the Council on Environmental Quality from considering the social cost of carbon, methane, or nitrous oxide as part of any cost benefit analysis in the rule making process, unless a federal law is enacted authorizing such consideration. They may also consider those social costs if they use an estimate that: (1) complies with the requirements of the Office of Management and Budget's "Circular A-4" document; (2) uses the discount rates of three and seven percent specified in that document; (3) considers only the domestic costs and benefits of the activity; and (4) uses only the most up to date and empirically estimated equilibrium climate sensitivity distributions, and realistic time horizons. The EPA must report on the number of proposed and final rulemakings, guidance documents, and agency actions since January 2009 that use those social costs, including as part of any cost benefit analysis required under Executive Order 12866 or other relevant authority.

This bill amends the Clean Air Act to provide that a modification of a stationary source results in an increase in air pollution only when the maximum achievable hourly emissions rate from the source is higher than: (1) the rate of the source as it was originally designed, and (2) the rate that was actually achieved during the 10 years before the change.

Supplemental Nutrition Assistance Program Reform Act of 2017 This bill amends the Food and Nutrition Act of 2008 to modify the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program) work requirements that apply to able-bodied adults without dependents (ABAWDs). The bill modifies the work requirements to: terminate the authority of the Department of Agriculture to waive the requirements, upon the request of a state agency, for individuals residing in an area that has an unemployment rate of over 10% or does not have a sufficient number of jobs to provide employment for the individuals; shorten from three months to one month the time limit for receiving benefits in a three-year period without meeting the requirements; decrease from 15% to 5% the portion of ABAWDs that a state may exempt from the requirements; allow participation in a supervised job search to satisfy the requirements; require states receiving SNAP funds to provide ABAWDs with opportunities to participate in a work program, a workfare program, or a supervised job search; and reduce SNAP allotments for states that fail to comply with requirements regarding eligibility disqualifications. The bill also modifies the congressional declaration of policy to specify that the purpose of SNAP is to increase employment, to encourage healthy marriage, and to promote prosperous self-sufficiency (maintaining an income above the poverty level without services and benefits from the federal government).

This bill amends the Congressional Budget and Impoundment Control Act of 1974 to require the Congressional Budget Office, upon receiving a request from Congress, to determine if legislation would reduce spending outside of the 10-year budget window through the use of preventive health and preventive health services.

Ensuring Access to General Surgery Act of 2017 This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to study access by underserved populations to general surgeons, including: (1) whether the health professional shortage area designation under the National Health Service Corps program accurately assesses adequacy of access and whether another measure would be more accurate, and (2) potential methodologies for designating general surgery shortage areas. HHS must publish data comparing the availability and need of general surgery services in urban, suburban, and rural areas. HHS may establish a methodology for designating general surgery shortage areas and make such designations. HHS must publish a list of general surgery shortage areas.

Promoting Hydropower Development at Existing Nonpowered Dams Act This bill amends the Federal Power Act (FPA) to authorize the Federal Energy Regulatory Commission (FERC) to exempt from FPA license requirements any qualifying facility (a facility that meets criteria specified in this bill). No federal authorization required for a qualifying facility may include any condition or other requirement that results in any material change to the storage, control, withdrawal, diversion, release, or flow operations of the associated qualifying nonpowered dam. Unless FERC determines that its obligations under the National Environmental Policy Act of 1969 for granting exemptions under this bill can be met through a categorical exclusion, its environmental review of a proposed exemption shall be only an environmental assessment.

Respond, Innovate, Succeed, and Empower Act of 2017 or the RISE Act of 2017 This bill amends the Higher Education Act of 1965 to set forth requirements about data collection related to students with disabilities. Specifically, the bill requires institutions of higher education (IHEs) to outline which documents disabled students need to submit in order to ensure they are eligible for student disability support services. IHEs must submit key data related to their undergraduate students with disabilities for inclusion in federal postsecondary institution data collection efforts.

Atomic Veterans Service Medal Act This bill directs the Department of Defense (DOD) to design and produce an Atomic Veterans Service Medal to honor retired and former members of the Armed Forces who are radiation-exposed veterans. DOD may provide for issuance of the Medal to the next-of-kin of a deceased radiation-exposed veteran.

Employee Rights Act This bill amends the National Labor Relations Act to: (1) make it an unlawful labor practice for a labor organization to interfere (currently, restrain or coerce) with the rights of employees to organize and collectively bargain; (2) require union recertification after a turnover in the workforce exceeding 50% of the bargaining unit; (3) require the National Labor Relations Board (NLRB) to give 14 days advance notice before a hearing investigating an election petition; and (4) require an employer to provide the NLRB with a list consisting only of employee names and addresses of all eligible voters within seven days after an NLRB determination of the appropriate bargaining unit or an agreement on eligible voters. The bill: (1) grants union and nonunion employees the right to vote by secret ballot on whether to ratify a collective bargaining agreement or engage in a strike, (2) prohibits the use of union dues for any purpose not directly related to collective bargaining, (3) prohibits a strike without the consent of a majority of all represented employees determined by secret ballot, and (4) prohibits the use or threat of force or violence to obtain the right to represent employees. .

Lawful Purpose and Self Defense Act This bill modifies the definition of "armor piercing ammunition" for purposes of federal firearms provisions to: (1) include a projectile that is designed and intended by the manufacturer or importer for use in a handgun; (2) exclude a projectile that is primarily intended by the manufacturer or importer to be used in a rifle or shotgun and a handgun projectile that is designed for hunting, recreational, or competitive shooting. This bill repeals a prohibition on assembling from imported parts a semiautomatic rifle or shotgun that is identical to one prohibited from importation as not being suitable for or readily adaptable to sporting purposes. This bill repeals the condition that the Attorney General must approve, as suitable for sporting purposes, the shipment of firearms or ammunition to members of the Armed Forces. The following categories of firearms or ammunition may be authorized for importation into the United States by the Attorney General: (1) ammunition that is not armor piercing; (2) a firearm or ammunition that is being brought in for the use of a federal, state, or local government agency; and (3) a firearm or ammunition that is being imported for the purpose of exportation. The definition of "destructive device" for purposes of federal firearms provisions excludes: (1) a shotgun or shotgun shell which the Department of the Treasury finds is generally recognized as particularly suitable for lawful purposes, and (2) an antique or a rifle which the owner intends to use for sporting purposes. The bill authorizes certain temporary interstate transfers of firearms for lawful purposes.

Protecting Officers of the Law In Civilian Establishments Act of 2017 or the POLICE Act of 2017 This bill amends the federal criminal code to modify the restriction on possessing a firearm or other dangerous weapon in a federal facility. Specifically, the prohibition does not apply to the lawful carrying of agency-issued firearms and dangerous weapons by a uniformed law enforcement officer in certain publicly accessible federal facilities.

American Legion 100th Anniversary Commemorative Coin Act This bill requires the Department of the Treasury to mint and issue commemorative coins in recognition and celebration of the 100th anniversary of the American Legion. Surcharges received from the sale of these coins shall be paid to the American Legion for costs related to promoting the importance of: (1) caring for those who have served, and those who are still serving, in the Armed Forces; and (2) maintaining patriotic values, strong families, and assistance for at-risk children.

Quality Systems Certification Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to establish a third-party quality system assessment program to accredit persons to assess whether a medical device manufacturer's quality system can ensure the safety and effectiveness or substantial equivalence of an approved medical device after certain changes, including changes in manufacturing or changes to enhance device safety. Device manufacturers with quality systems that have been certified by an accredited person are allowed to make changes to a device without submitting to the FDA the premarket notification, 30-day notice, or premarket approval supplement that would otherwise be required. An accredited person who assesses a device manufacturer's quality system must submit a summary of their assessment and, as appropriate, a certification of the quality system to the FDA within 30 days of the assessment. An assessment summary and certification is deemed accepted by the FDA 30 days after submission unless the FDA determines that additional information is needed to support certification, the assessment or certification is unwarranted, or an action other than acceptance of the certification is otherwise justified. Device manufacturers who make changes to devices without submitting a premarket notification must describe the changes in an annual summary submitted to the FDA. Changes made without submitting a 30-day notice or a premarket approval supplement must be described in a periodic report. Certifications accepted by the FDA remain in effect for two years. The FDA must report on this quality system assessment program no later than January 31, 2022. The program is terminated at the end of FY2022.

Volunteer Organization Protection Act of 2017 This bill amends the Volunteer Protection Act of 1997 to expand liability protections to volunteer nonprofit organizations for harm caused by an act or omission of a volunteer on behalf of the organization. The bill prohibits such liability protections from applying if the organization: (1) would be liable under laws governing the direct or vicarious liability of organizations, and (2) expressly authorized the specific conduct constituting the act or omission. The bill bars such an organization from liability for harm caused by the organization, or a volunteer acting on its behalf, if the act or omission was at the request of, or pursuant to an authorization by, a state, the United States, or another governmental subdivision, provided that: (1) the requesting or authorizing governmental entity would have been immune either from suit or from liability in damages if it had engaged in the acts or omissions itself or through employees or independent contractors; or (2) the governmental employee, agent, or contractor would have been immune either from suit or from liability in damages by virtue of immunity extended to individual governmental actors. The bill prohibits punitive damages from being awarded against a volunteer nonprofit organization for the actions of a volunteer within the scope of the volunteer's responsibilities to the organization unless the claimant establishes by clear and convincing evidence that the organization itself expressly authorized the volunteer's action with a conscious, flagrant indifference to the rights or safety of the individual harmed.

Michael Davis, Jr. and Danny Oliver in Honor of State and Local Law Enforcement Act This bill amends the Immigration and Nationality Act and related federal law with respect to immigration law enforcement within the United States. The bill authorizes: (1) states and localities to enact and enforce criminal penalties for immigration violations; and (2) state and local law enforcement personnel to investigate, arrest, and transfer aliens to federal custody. The Department of Homeland Security (DHS) shall: (1) make grants to states and localities for equipment, technology, and facilities; (2) construct or acquire additional domestic detention facilities for aliens pending removal; and (3) expand to all states a program that provides for the identification and removal of detained criminal aliens. The bill provides for: (1) federal custody of inadmissible or deportable aliens upon state or local request, and (2) personal liability immunity for state or local personnel enforcing immigration laws. States and localities shall: (1) notify the federal government of inadmissible or removable aliens encountered by law enforcement personnel, and (2) comply with federal law enforcement information requests. Specified federal assistance is denied to a state or locality that prohibits cooperation with federal immigration enforcement. The bill: (1) revises certain terrorism-related requirements and prohibitions with respect to benefits, naturalization and denaturalization, asylum, voluntary departure, and removal; (2) adds new grounds of inadmissibility and deportability; (3) establishes probable cause standards for Immigration and Customs Enforcement (ICE) detainers; (4) provides for increases in immigration enforcement personnel; (5) prescribes visa security provisions; (6) authorizes DHS to designate groups as criminal gangs and makes alien gang members inadmissible or deportable; (7) establishes an ICE Advisory Council; and (8) prescribes criminal alien removal provisions.

Protecting Girls' Access to Education in Vulnerable Settings Act or the Protecting Girls' Access to Education Act This bill urges the consideration of the educational needs of vulnerable women and girls in designing, implementing, and evaluating U.S. foreign assistance policies and programs. The Department of State and the U.S. Agency for International Development (USAID) may advance programs that: provide safe, primary and secondary education for displaced children; build the capacity of institutions in countries hosting displaced people to prevent displaced children from facing educational discrimination; and help increase the access of displaced children, especially girls, to educational, economic, and entrepreneurial opportunities. The State Department and USAID may: coordinate with multilateral organizations to work with foreign governments to collect relevant data, disaggregated by age and gender, on the ability of displaced people to access education and participate in economic activity; and work with domestic and foreign private sector and civil society organizations to promote safe, primary and secondary education for displaced children.

School-Based Respiratory Health Management Act This bill amends the Public Health Service Act to revise the conditions under which the Department of Health and Human Services, in making asthma-related grants, gives preference to a state. A preference is given to states that require elementary and secondary schools to have: (1) on the premises during operating hours at least one individual trained in the administration of rescue medications for allergies and reversible lower airway disorders, and (2) an allergies and reversible lower airway disorders management program. Currently, this preference is given to states that require schools to have on the premises an individual trained in the administration of epinephrine to a student having a severe allergic reaction. To be eligible for this preference, a state must have civil liability protections for trained individuals who administer rescue medications for allergies and reversible lower airway disorders.

This bill amends the Public Health Service Act, if the American Health Care Act (H.R. 1628) is enacted, to make plans made available by the federal government to Members of Congress and congressional staff subject to state waivers of the Patient Protection and Affordable Care Act (PPACA) requirement for health insurance to cover the essential health benefits and PPACA restrictions on premium variation by age and health status.

Civil Rights Legacy of Medgar Wiley Evers Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the presentation of a Congressional Gold Medal to Myrlie Evers-Williams in recognition of the contributions and sacrifice that she and her husband, assassinated civil rights leader Medgar Wiley Evers, made in the fight for racial equality in the United States. Following its award, the medal shall be given to the Mississippi Civil Rights Museum, where it is to be available for display or for temporary loan to be displayed elsewhere.

Restoring the Patient's Voice Act of 2017 This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to require a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. To warrant an exception to the protocol, at least one of the following circumstances must be met: (1) the treatment is contraindicated, (2) the treatment is expected to be ineffective, (3) the treatment will cause or is likely to cause an adverse reaction to the individual, (4) the treatment is expected to decrease the individual's ability either to perform daily activities or occupational responsibilities or adhere to the treatment plan, or (5) the individual is stable based on the prescription drugs already selected. The bill requires a group health plan to implement a clear process for an individual to request an exception to the protocol. The process shall be readily available on the website of the group health plan and must list the requirements for a request and any necessary forms and contact information. Requests shall be granted no later than three days after receipt of the request. In certain cases where the life, health, and ability of the individual are jeopardized by the protocol, the request shall be granted no later than 24 hours after receipt of the request.

Restoring Integrity to America's Elections Act This bill amends the Federal Election Campaign Act of 1971 with respect to the Federal Election Commission (FEC) to: (1) reduce the number of members of the FEC from eight to five, (2) remove the Secretary of the Senate and Clerk of the House as ex officio members, and (3) permit no more than two members to be affiliated with the same political party. A majority of the FEC members serving at the time shall constitute a quorum, except that three shall constitute a quorum if there are only four members serving. A Blue Ribbon Advisory Panel shall recommend to the President individuals for nomination to the FEC. The President shall appoint the FEC Chair, subject to Senate confirmation as a member of the FEC. The powers of the FEC are revised and distributed between the chair and the other FEC members. Persons who submit written comments regarding requests for advisory opinions must be given an opportunity to appear at FEC hearings on such requests.

Condemns the decisions by the Venezuelan Supreme Court on March 28, 2017, and March 29, 2017, stripping the opposition legislators of their parliamentary immunity, seizing power from the National Assembly, and nullifying all legislative actions. Recognizes the decision by such court on April 1, 2017, to restore the opposition legislators' parliamentary immunity and the National Assembly's legislative powers. Urges the government of Venezuela to heed the calls of the international community to: (1) hold free, fair, and open elections; (2) release all political prisoners, including U.S. citizens; and (3) immediately accept international humanitarian assistance only through nongovernmental organizations. Calls for Organization of American States (OAS) member states to continue all efforts, including the consideration of a potential suspension of Venezuela from the OAS, if such government fails to take such actions. Encourages the President of the United States to prioritize a resolution of the political, economic, social, and humanitarian crisis in Venezuela, including through bilateral, targeted sanctions against individuals in the Venezuelan government responsible for the deterioration of democratic institutions and the rule of law.

Strengthen Employment And Seasonal Opportunities Now (SEASON) Act This bill amends the Immigration and Nationality Act to provide, effective as if enacted on January 1, 2017, that a returning H-2B visa alien (temporary nonagricultural worker) who has already been counted toward the applicable numerical limitation during a fiscal year: (1) shall not again be counted toward such limitation during each succeeding consecutive fiscal year in which the alien is issued an H-2B visa or otherwise provided such status, but (2) shall be considered a returning worker. "Other temporary service or labor" for H-2B purposes means that an employer's need for labor will not exceed 1 year and is a seasonal (not to exceed 10 months), peak load, or intermittent need, unless it is a one-time occurrence not exceeding 3 years. An H-2B employer shall file an employee petition with the Department of Homeland Security. Additional filings with the Department of Labor are not required. H-2B employer requirements are set forth regarding: (1) petitions, (2) admissions and maximum stay in status, (3) housing, (4) enforcement, (5) transportation, (6) recruitment, (7) U.S. worker protections, and (8) wages. An H-2B worker shall not be entitled to: (1) tax credit assistance for a qualified health plan, and shall be subject to plan rules applicable to individuals not lawfully present in the United States; (2) the child tax credit; and (3) the earned income tax credit.

Good Samaritan Health Professionals Act of 2017 This bill amends the Public Health Service Act to shield a health care professional from liability under federal or state law for harm caused by any act or omission if: (1) the professional is serving as a volunteer in response to a disaster; and (2) the act or omission occurs during the period of the disaster, in the professional's capacity as a volunteer, and in a good faith belief that the individual being treated is in need of health care services. This protection from liability does not apply if: (1) the harm was caused by an act or omission constituting willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious flagrant indifference to the rights or safety of the individual harmed; or (2) the professional rendered the health care services under the influence of alcohol or an intoxicating drug.

Ambulatory Surgical Center Quality and Access Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to: (1) require the payment system for ambulatory surgical center (ASC) services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revise quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) require the Department of Health and Human Services (HHS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, HHS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.)

This bill revises provisions concerning military technicians (dual status), including by: (1) transferring authority to issue regulations regarding the employment, use, and status of such technicians from the Departments of the Army and the Air Force to the Department of Defense (DOD); and (2) requiring that such individuals be outside the competitive service and be appointed and administered by an adjutant general. An individual who becomes employed as such a technician while already a member of a reserve component of the armed forces shall not have to repay any enlistment, reenlistment, or affiliation bonus provided before such employment. The bill: (1) makes such technicians eligible for TRICARE, and (2) sets forth FY2018 end strengths for the Army National Guard and the Air National Guard. The National Defense Authorization Act for Fiscal Year 2016 is amended to reduce from 20% to 4.8% the percentage of technician positions filled in administration, clerical, finance, and office service occupations as of October 1, 2017, that DOD must convert to civilian positions. A governor or the commanding general of the District of Columbia National Guard may order a member of the National Guard to perform active Guard and Reserve duty in support of state missions. The bill modifies personnel management authorities of the Chief of the National Guard Bureau, including by requiring adjutants general to exercise the Chief's authority to employ, administer, and assign certain persons within their jurisdictions.
