Making Online Banking Initiation Legal and Easy Act of 2016 or the MOBILE Act of 2016 This bill authorizes a financial institution, with an individual's consent, to record personal information from a swipe or copy of an individual's driver's license or personal identification card and store the information electronically for the purpose of verifying the authenticity of the driver's license or identification card, verifying the identity of the individual, or complying with legal requirements. Financial institutions must not sell, rent, transfer, or make the personal information available to another person, other than an affiliate.

Establishes an ad hoc Joint Committee on the Organization of the Congress to make a full and complete study of the organization, operations, functions, and relevant interactions of the Members of Congress and to make recommendations that serve specified objectives. Requires the committee to include in its report to both chambers at the end of a congressional session recommendations for its continuation or designation of a similar entity to continue the pursuit of improvements in the congressional process.

Protect Family Farms and Businesses Act This bill prohibits proposed Internal Revenue Service regulations published on August 4, 2016, relating to restrictions on liquidation of an interest with respect to estate, gift, and generation-skipping transfer taxes from taking effect. The bill prohibits funds from being used to finalize, implement, administer, or enforce the proposed regulations or any substantially similar regulations.

Regulatory Relief for Small Businesses, Schools, and Nonprofits Act This bill postpones from December 1, 2016, until June 1, 2017, the effective date of a final rule of the Department of Labor revising income thresholds for determining overtime pay for executive, administrative, professional, outside sales, and computer ("white collar") employees exempt from regular minimum wage and overtime pay requirements.

Classified Information Protection Act of 2016 This bill amends the federal criminal code to specify that the government need not prove intent to harm the United States when prosecuting a: (1) person entrusted with national defense information who permits the loss or removal of such information through gross negligence; or (2) government employee, contractor, or consultant who commits unauthorized removal and retention of classified material.

Protecting Our Veterans From School Closures Act This bill declares that if, as a result of a permanent school closure, a veteran is forced to discontinue a course or did not receive credit, or lost training time, toward completion of the education program, Department of Veterans Affairs educational assistance payments for such discontinued course or program shall not be: (1) charged against the individual's entitlement to educational assistance, or (2) counted against the aggregate period for which such assistance may be provided. The bill applies to courses and programs of education discontinued after August 1, 2016. Certain reporting fees paid to educational institutions furnishing veterans education or training shall be reduced for the 10-year period beginning on January 1, 2017.

Global War on Terrorism War Memorial Act This bill allows the Global War on Terror Memorial Foundation to establish the National Global War on Terrorism Memorial as a commemorative work on federal land in the District of Columbia to commemorate and honor the members of the Armed Forces who served on active duty in support of the Global War on Terrorism. No federal funds may be used to pay any expense to establish the memorial.

Mark Takai Atomic Veterans Healthcare Parity Act This bill includes veterans who participated in the cleanup of Enewetak Atoll in the Marshall Islands between January 1, 1977, and December 31, 1980, as radiation exposed veterans for purposes of the Department of Veterans Affairs presumption of service-connection for specified cancers.

Improving Transparency and Accuracy in Medicare Part D Spending Act This bill amends title XVIII (Medicare) of the Social Security Act to prohibit Medicare Prescription Drug Plan sponsors from retroactively reducing payment on clean claims submitted by pharmacies. (A "clean claim" is a Medicare claim that is free of defects such as incomplete documentation.)

Dialysis PATIENTS Demonstration Act of 2016 or the Dialysis Patient Access to Integrated-care, Empowerment, Nephrologists, Treatment, and Services Demonstration Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to establish a demonstration program for the provision of integrated care to Medicare beneficiaries with end-stage renal disease (ESRD). Under the voluntary program, eligible participating providers may form organizations to offer ESRD integrated care models and serve as medical homes for program-eligible beneficiaries. Such a model: (1) shall cover medical and hospital services, other than hospice care, under Medicare; (2) must include benefits for transition into palliative care; and (3) may cover prescription drug benefits. An organization must offer at least one open network model but may also offer one or more preferred network models. An organization shall return savings achieved under the models to program-eligible beneficiaries. A beneficiary shall have the opportunity to: (1) opt out of the program, (2) make an assignment change into an open network model offered by a different organization, or (3) elect a preferred network model. The bill establishes requirements regarding: (1) benefits for program-eligible beneficiaries who are also eligible for Medicaid benefits, (2) program quality and reporting, (2) ESRD integrated care strategy, (3) program operation and scope, (4) beneficiary notification, and (5) payment.

Calls on: the President to apply U.S. antidumping and countervailing duty laws against nonmarket economy countries, the President to retain the status of any country currently designated as a nonmarket economy country until it meets certain criteria for treatment as a market economy country, nonmarket economy countries to eliminate all direct and indirect subsidies and other market-distorting government policies benefitting the production and export of goods to the United States, and such countries to enter into binding and enforceable agreements for removing excess production capacity and withdrawing state intervention in and control over their economies.

Match Veterans to Student Loan Protections Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify the federal student loan discharge process for a veteran who has a total and permanent disability. Specifically, it directs the Department of Education (ED) and the Department of Veterans Affairs (VA) to implement a computer matching program for ED to identify the borrowers who have been assigned a service-connected disability rating of 100% by the VA. ED must notify such borrowers of their eligibility for federal student loan discharge and provide simple instructions for applying.

Resettlement Accountability National Security Prioritization Act of 2016 This bill prohibits the admission of covered aliens into the United States for four years unless Congress passes a joint resolution giving the Department of Homeland Security authority to admit them. No covered alien may be admitted into the United States after such four-year period. "Covered alien" means an alien applying for refugee admission to the United States who: (1) is a national of Afghanistan, Iraq, Libya, Somalia, Syria, or Yemen; or (2) has no nationality and whose last habitual residence was in Afghanistan, Iraq, Libya, Somalia, Syria, or Yemen. The Government Accountability Office shall report on: (1) the national security impact of refugee admissions; and (2) specified costs of providing refugees with benefits under Medicare, Medicaid, disability insurance under title II of the Social Security Act, the supplemental nutrition assistance program (SNAP, formerly the food stamp program), and section 8 rental assistance.

Stop Dangerous Sanctuary Cities Act This bill prohibits a sanctuary jurisdiction from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program. A sanctuary jurisdiction is a state or political subdivision that has a statute, policy, or practice in effect that prohibits or restricts: (1) information sharing about an individual's immigration status, or (2) compliance with a lawfully issued detainer request or notification of release request. A state or political subdivision that complies with a detainer is deemed to be an agent of the Department of Homeland Security and is authorized to take actions to comply with the detainer. The bill limits the liability of a state or political subdivision, or an officer or employee of such state or political subdivision, for actions in compliance with the detainer.

Transparency and Honesty in Energy Regulations Act of 2016 This bill prohibits the Department of Energy and the Environmental Protection Agency (EPA) from considering the social cost of carbon or methane as part of any cost benefit analysis, unless a federal law is enacted authorizing such consideration. The EPA must report on the number of proposed and final rulemakings, guidance documents, and agency actions since January 2009 that use either of those social costs, including as part of any cost benefit analysis required under Executive Order 12866 and other relevant authorities.

Timber Innovation Act of 2016 This bill directs the Department of Agriculture (USDA) to establish a performance-driven research and development program to advance tall wood building construction in the United States. "Tall wood building" means a building designed to be over 85 feet high and constructed with large panelized wood construction (mass timber), including cross-laminated timber, nail laminated timber, glue laminated timber, laminated strand lumber, and laminated veneer lumber. USDA shall for FY2017-FY2021 carry out an annual competition for a tall wood building design in accordance with the requirements for prize competitions carried out under the Stevenson-Wydler Technology Innovation Act of 1980. In carrying out a wood innovation grant program, USDA may make a wood innovation grant to one or more specified eligible entities in order to accelerate the adoption of emerging technologies in the development of innovative wood products for tall wood building construction. USDA shall give priority to grant proposals which include the use or retrofitting (or both) of existing sawmill facilities in counties where the average annual unemployment rate exceeded the national average by more than 1% in the previous year. USDA shall carry out a program of education and technical assistance for mass timber applications. USDA shall collaborate and partner with one or more nonfederal entities, including governments of other countries, to: enhance tall wood building commercialization of the United States, develop technical assistance related to tall wood building commercialization, and carry out the program.

Strengthening Career and Technical Education for the 21st Century Act This bill reauthorizes through FY2022 the Carl D. Perkins Career and Technical Education Act of 2006, divides career and technical education (CTE) students into CTE concentrators and CTE participants, and revises requirements for within-state funding allocations. The bill also revises requirements for core indicators of performance, including state adjusted levels of performance, to differentiate those for CTE concentrators who graduate from high school and for CTE concentrators at the postsecondary level. The Institute for Education Sciences shall act for the Department of Education (ED) to appoint the independent advisory panel on the evaluation of CTE programs. The bill revises requirements for the contents of an evaluation. ED may award grants to eligible entities, including local educational agencies and area CTE schools, to: create, develop, implement, or take to scale evidence-based, field initiated innovations, including through a pay for success initiative to improve CTE student outcomes; and evaluate such innovations rigorously. The bill reauthorizes through FY2022 grants for tribally controlled CTE institutions, and repeals the authorization for assistance for certain occupational and information activities. State plans shall be for four years instead of six years. The bill revises requirements for: such plans as well as state program improvement plans and state leadership activities; local applications for CTE programs, including a comprehensive CTE needs assessment, and local uses of funds; and state maintenance of efforts, including administrative penalties for failure to meet maintenance requirements. The bill repeals the separate mandate for tech prep education. The Government Accountability Office shall evaluate: the strategies, components, policies, and practices used by eligible agencies or eligible recipients receiving funding to assist successfully all students in pursuing and completing programs of study aligned to high-skill, high-wage occupations, as well as any specific underrepresented subgroup of students; and any challenges associated with replication of such strategies, components, policies, and practices. The Wagner-Peyser Act is amended to revise the duties of a state agency receiving federal assistance for participation in the nationwide employment statistics system of workforce and labor market information.

HBCU Capital Financing Improvement Act This bill amends title III (Institutional Aid) of the Higher Education Act of 1965 to modify the HBCU Capital Financing Program. [The program guarantees low-cost private loans to historically black colleges and universities (HBCUs) to finance infrastructure repairs, maintenance, and construction.] It replaces statutory references to "escrow account" with "bond insurance fund." The bill authorizes the Department of Education to provide financial counseling that prepares an eligible HBCU to qualify for, apply for, and maintain a capital improvement loan. Finally, it revises and expands reporting requirements for the HBCU Capital Financing Advisory Board.

Agency Accountability Act of 2016 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The funds may not be used unless the funding is provided in advance in an appropriations bill. Any amounts deposited during the fiscal year in which this bill is enacted may not be obligated during the fiscal year and must be used for deficit reduction. The bill amends the Congressional Budget Act of 1974 to require offsetting receipts and collections to be treated as revenue. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.) The requirements of the bill do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (USPTO). The Under Secretary of Commerce for Intellectual Property and the Director of the USPTO must submit annually to Congress a report describing any fee, fine, penalty, or proceeds from a settlement collected by the USPTO during the previous year.

This bill prohibits U.S. agency funds from being used until the earlier of the enactment date of an Act authorizing FY2017 appropriations for military activities of the Department of Defense (DOD) or January 1, 2017, for the transfer or release to or within the United States, its territories, or possessions or to any foreign country or entity of an individual detained at Naval Station, Guantanamo Bay, Cuba. "Individual detained at Guantanamo" means an individual located at Guantanamo as of October 1, 2009, who: (1) is not a U.S. national or a member of the Armed Forces, and (2) is in the custody or under the control of DOD or otherwise detained at Guantanamo.

No Impunity for Iranian Aggression at Sea Act of 2016 This bill requires the President to submit a report that includes: a determination of whether, during the June 2016 incident when Iranian forces boarded two U.S. Navy combat vessels and detained the crews at gunpoint, any of the Iranian actions violated the Geneva Convention or the international right to conduct innocent passage; and a certification of whether or not federal funds were paid to Iran to effect the release of the detained crew members or other U.S. citizens. The bill prescribes specified Iranian actions that the President shall consider, including: (1) the stopping, boarding, search, and seizure of the U.S. Navy vessels and the removal and detention of the crews; and (2) the display, videotaping, or photographing of U.S. service members and the subsequent use of those photographs or videos. The President shall: (1) upon a determination that such a violation occurred, submit and make public a list of Iranian government officials or persons acting on behalf of the Iranian government who are responsible for or complicit in any such violation; and (2) prohibit U.S. entry or admission and block property transactions of listed persons.

Title IX Clarification Act of 2016 This bill amends title IX of the Education Amendments of 1972 to define "sex" as the biological sex of an individual for purposes of enforcing the prohibition against discrimination on the basis of sex under education programs or activities receiving federal financial assistance.

Article V Records Transparency Act of 2016 This bill directs the Archivist of the United States to make and transmit to Congress an organized compilation of all applications and rescissions of applications ever made by states under article V of the Constitution to call a convention for proposing amendments to the Constitution. The Archivist: (1) in complying with such requirement, shall use the records contained in the National Archive and Records Administration and attempt to obtain an official copy of any application or rescission that may not be in such records; (2) submit a report on the extent of suspected missing applications or rescissions not included in the compilation; and (3) catalog the applications and rescissions by year of submission and state. The committees on the judiciary in each chamber shall make the applications and rescissions contained in such compilation available on a publicly accessible website and update the compilation as specified. In order to simplify and make uniform the process by which state legislatures make such an application or rescission, Congress recommends that after adoption of an application or rescission by a state legislature, the secretary of state or other state official should submit at least two copies of the measure containing the application or rescission to Congress, one copy addressed to the President of the Senate and one copy to the Speaker of the House of Representatives.

Air Traffic Controller Hiring Improvement Act of 2016 This bill directs the Federal Aviation Administration (FAA), in appointing air traffic controllers, to give preferential consideration to qualified individuals maintaining 52 consecutive weeks of experience involving the active separation of air traffic after receipt of an air traffic certification or facility rating within 5 years of application while serving at an FAA air traffic control facility, a civilian or military air traffic control facility of the Department of Defense, or a tower operating under contract with the FAA. The FAA shall consider additional applicants by referring an approximately equal number of employees for appointment among two applicant pools. The number referred from each group shall not differ by more than 10%. Pool one shall consist of applicants who: have successfully completed air traffic controller training and graduated from an institution participating in the Collegiate Training Initiative program and have received an appropriate recommendation or endorsement from such institution, are eligible for a veterans recruitment appointment and provide a Certificate of Release or Discharge from Active Duty within 120 days of the announcement closing, are veterans eligible for veterans' benefits who maintain aviation experience obtained in the course of the individual's military experience, or are preference eligible veterans. Pool two shall consist of applicants who apply under a vacancy announcement recruiting from all U.S. citizens. The FAA: (1) may not use a biographical assessment when hiring, (2) must provide an individual who applied in response to a specified 2014 vacancy announcement and was disqualified as the result of a biographical assessment an opportunity to reapply under the revised hiring practices, and (3) must waive any maximum age limit for such reapplying applicants who met such requirement when they applied under such announcement. Otherwise, the maximum age limit for an original appointment as an air traffic controller under this bill shall be 35 years of age. The FAA shall consider directly notifying secondary schools and institutes of higher learning of a vacancy announcement for pool one applicants.

Seller Finance Enhancement Act This bill amends the S.A.F.E. Mortgage Licensing Act of 2008 to exempt from certain licensing and registration requirements any person (other than a depository institution) who: (1) originates not more than 24 residential mortgage loans in a 12-month period, and (2) only originates residential mortgage loans for property owned by that person. For determining whether a residential mortgage loan meets minimum standards, the Truth in Lending Act is amended to prohibit the application to loans originated by such a person certain Consumer Financial Protection Bureau guidelines and regulations relating to ratios of total monthly debt to monthly income. The Department of Housing and Urban Development and the Department of the Treasury shall study: the number of homes bought for under $150,000 or 60% of the median home value in a given community, whichever is lower, in the United States by utilizing seller financing; the number of such homes sold by licensed mortgage brokers; the potential number of such homes which could be sold but are not, because seller financiers are unwilling, or from a practical standpoint unable, to comply with mortgage broker rules; and the potential benefit to home values and wealth creation if more homes are able to be sold utilizing seller finance.

No Bailouts for State, Territory, and Local Governments Act This bill prohibits the use of federal funds to purchase or guarantee obligations of, issue lines of credit to, or provide direct or indirect grants-in-aid to any state (defined to include the District of Columbia and any U.S. territory or possession), municipal, local, or county government that, on or after January 1, 2013, has filed for bankruptcy, has defaulted on its obligations, is at risk of defaulting, or is likely to default, without such federal assistance, if such purchase, guarantee, extension of credit, or grant is made to assist the government in: (1) avoiding defaulting on the payment of principal or interest due on an obligation of the government, or (2) curing such a default. The Departrment of the Treasury is prohibited from using general fund revenues or borrowed funds to purchase or guarantee, for the same purposes, any asset or obligation of any such state, municipal, local, or county government. The Board of Governors of the Federal Reserve System is prohibited from: (1) providing or extending to, or authorizing with respect to, such a state, municipal, local, or county government, or other entity with taxing authority or bonding authority, for the same purposes, any funds, loan guarantees, credits, or any other financial instrument or other authority, including bond purchases; or (2) otherwise assisting such a government entity, for the same purposes, under any Board authority. Such prohibitions shall not apply to federal assistance provided in response to a natural disaster.

Prohibiting the Usurpation of Bathroom Laws through Independent Choice School Act (PUBLIC School Act) of 2016 This bill declares that it shall not be unlawful under federal law for a state or local government to enact or enforce a policy regarding the use of sex-segregated bathrooms or locker rooms of educational institutions on the basis of gender identity. The bill prohibits the reduction or denial of federal financial assistance on the basis that a state or local government enacts or enforces such a policy.
