Expresses the sorrow of Congress for the death and injuries suffered by first responders as they tried to save innocent people in the aftermath of the terrorist attacks on the World Trade Center and the Pentagon on September 11, 2001. Honors and commends the first responders who participated in evacuating and rescuing the innocent people in the World Trade Center and the Pentagon after the terrorist attacks. Encourages all levels of government to continue to work together to coordinate emergency preparedness effectively by providing the infrastructure, funding, and interagency communication and cooperation necessary to ensure that when another terrorist attack occurs, first responders will be as prepared as possible to respond to the attack effectively.

Sound Science for Endangered Species Act Planning Act of 2001 - Amends the Endangered Species Act of 1973 to direct the Secretary of the Interior to: (1) give greater weight to scientific and commercial data that is empirical or that has been field-tested or peer-reviewed in determining that a species is an endangered or threatened species; and (2) promulgate regulations that establish criteria for data to be used as the basis of such a determination. Prohibits the Secretary from determining that a species is endangered or threatened unless the determination is supported by data obtained by observation of the species in the field. Requires the Secretary to accept, acknowledge receipt of, and include in the rulemaking record of such a determination data collected by landowners through observation of the species on the land. Requires the Secretary to publish with the notice of a proposed regulation a description of additional scientific and commercial data that would assist in the preparation of a recovery plan, invite any person to submit such data, and describe the steps for acquiring additional data. Directs the Secretary: (1) to solicit recommendations from the National Academy of Sciences and develop a list of qualified reviewers to participate in independent scientific review actions; (2) before any proposed action becomes final, to appoint from such list three individuals who shall report on the scientific information and analyses on which such action is based; and (3) to include such report in the official record of the proposed action. Requires the Secretary, in consulting with each Federal agency and the affected States to insure that any agency action is not likely to jeopardize any endangered or threatened species or destroy the species' habitat, to: (1) consider information provided by such States; and (2) provide any person who has sought authorization or funding from a Federal agency for an action the opportunity to submit, discuss, and receive information relevant to the draft biological opinion.

Breast Cancer Research Stamp Act of 2001 - Amends Federal postal law to provide that any limitation in the Semipostal Authorization Act relating to whether more than one semipostal (a postage stamp issued by the U.S. Postal Service, at a premium, in order to help provide funding for a national public interest) may be offered for sale at the same time, shall not apply to the breast cancer research special stamps issued by the U.S. Postal Service. Extends the Service's authority to issue such stamps through July 29, 2008. Revises the differential amount of the special rate of postage for the breast cancer research stamp to not less than 15 percent of the regular first-class rate (currently, not to exceed 25 percent of first-class). Requires the special rate to be evenly divisible by five.

Individual Tax Freedom Act of 2001 - Repeals the income, estate, gift, and certain excise tax provisions of the Internal Revenue Code. Amends the Internal Revenue Code to impose a 15 percent tax on the use, consumption or enjoyment in the U.S. of any property or service produced or rendered within or without of the United States. Prohibits, subject to exception, imposing a tax on any property or service purchased for: (1) a business purpose in an active trade or business; or (2) export from the United States for use or consumption outside of the Unites States, provided that the purchaser provided the seller with either an intermediate sales certificate or an export sales certificate. Sets forth provisions concerning credits and refunds. Allows for general credits against the tax, including: (1) a used property credit; (2) a business use conversion credit; (3) an administration credit; (4) a compliance equipment cost credit; (5) a bad debt credit; (6) an insurance proceeds credit; and (7) a transition inventory credit. Provides for installment payments of the tax on the purchase of a principal residence. Allows an eligible family unit to receive a sales tax rebate. Directs an administering State to administer, collect, and remit to the U.S. Treasury the tax on gross payments for the use, consumption or enjoyment of taxable property or services within the State. Prohibits the authorizing of any appropriations for the Internal Revenue Service after FY 2005. Establishes in the Treasury: (1) an Excise Tax Bureau to administer any excise taxes not repealed by this Act; and (2) a Sales Tax Bureau to administer the national sales tax. Authorizes the Social Security Administration to collect and administer self-employment income and employment taxes. Requires a supermajority in the House of Representatives or the Senate to raise rates.

Expresses the sense of the House of Representatives that the second amendment to the U.S. Constitution guarantees citizens the right to keep and bear arms, and that any United Nations (UN) conference, resolution, or treaty infringing on this right would be a conflict with article six of, and the second amendment to, the U.S. Constitution. Urges the President to reject any decree, proclamation, treaty, or other document adopted by the UN Conference on Small Arms and Light Weapons which would infringe on the right of U.S. citizens under the second amendment to the Constitution.

Congratulates: (1) the people of Peru for the successful completion of free and fair elections on April 8 and June 3, 2001; (2) Alejandro Toledo for his election as President and his commitment to democracy; (3) Valentin Paniagua, the current President, for his commitment to a peaceful transition; and (4) the Organization of American States Electoral Observer Mission for promoting representative democracy by working to ensure free and fair elections in Peru. Call for: (1) the United States to expand its cooperation with the Peruvian Government to promote the strengthening of democratic institutions and the rule of law, economic development, and an improved quality of life for citizens of both countries; and (2) such Governments to act in solidarity to promote democracy and respect for human rights and to enhance cooperation to confront common threats. Expresses: (1) sympathy to the Peruvian people for losses suffered as a result of the June 23, 2001 earthquake and support for their efforts to rebuild; and (2) support for relief and reconstruction assistance to Peru from the international community. Urges the President of the United States to encourage relief entities to expedite assistance.

Energy and Water Development Appropriations Act, 2002 - Makes FY 2002 appropriations to the Department of the Army and its Corps of Engineers for: (1) civil functions relating to rivers and harbors, flood control, beach erosion; (2) river and harbor, flood control, shore protection; (3) certain flood control projects on the Mississippi River and its tributaries; (4) the navigable waters and wetlands regulatory program; and (5) formerly utilized sites remedial action program. Makes FY 2002 appropriations to the Department of the Interior for: (1) the Central Utah Project; (2) the Bureau of Reclamation for water and related resources; (3) the Bureau of Reclamation Loan Program Account; and (4) the Central Valley Project Restoration Fund. Makes FY 2002 appropriations to the Department of Energy (DOE) for: (1) energy supply programs; (2) non-defense environmental management; (3) uranium facilities maintenance and remediation; (4) general DOE science activities; (5) nuclear waste disposal; (6) DOE administration and its Office of the Inspector General; (7) atomic energy defense weapons activities; (8) defense nuclear nonproliferation activities; (9) naval reactors activities; (10) Office of the Administrator of the National Nuclear Security Administration; (11) defense environmental restoration and waste management; (12) defense facilities closure projects; (13) defense environmental management privatization; (14) defense nuclear waste disposal; (15) geographical power marketing administrations of DOE (including hydroelectric facilities at the Falcon and Amistad Dams); and (16) the Federal Energy Regulatory Commission. Places restrictions upon specified fund uses. Makes FY 2002 appropriations to: (1) the Appalachian Regional Commission; (2) the Defense Nuclear Facilities Safety Board; (3) the Nuclear Regulatory Commission and its Office of the Inspector General; and (5) the Nuclear Waste Technical Review Board.

Models of Safety and Health Excellence Act of 2001 - Directs the Secretary of Labor to establish voluntary protection programs to promote and recognize the achievement of worksites that demonstrate excellence in workplace health and safety. Authorizes the Secretary, in limited situations, to alter program application requirements to include nonstandard worksites such as short-term construction sites and mobile worksites. Directs the Secretary to encourage: (1) program participants to share occupational safety and health expertise with other employers; (2) the participation of small business in the programs, through outreach and assistance initiatives and program requirements that address the needs of small businesses. Authorizes the Secretary to provide for development of equivalent programs in State-plan States under the Occupational Safety and Health Act of 1970 (OSHA). Sets forth program requirements for applications, on-site evaluations, information, and reevaluations. Exempts worksites participating in the program from inspections or investigations under OSHA, except inspections or investigations arising from employee complaints, fatalities, catastrophes, or significant toxic releases. Requires decisions regarding acceptance into, and continued participation in, the program to be based on the applicant's superior safety and health performance, as determined by, and in the sole discretion of, the Secretary or the Secretary's authorized representatives.

Softwood Lumber Fair Competition Act - Directs the President to impose quotas, tariff surcharges, negotiated enforceable voluntary export restraint agreements, or other measures on imports of Canadian softwood lumber products to ensure that the volume of such products during any month does not exceed the average volume of such import that was imported monthly during the 24-month period preceding December 1995. Directs the Secretary of the Treasury and the Secretary of Commerce to implement a program for administering and enforcing such import restrictions. Authorizes the President to waive such restrictions provided certain conditions have been met.

Amends the Internal Revenue Code to permit: (1) Federal civilian and military retirees to pay Federal Employees Health Benefits Program and TRICARE supplemental premiums on a pretax basis; and (2) a deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums and enrollment fees.

Protection of Lawful Commerce in Arms Act - Amends the Organic Act to direct the Secretary of Commerce to establish and maintain a list of each person that notifies the Secretary that it is a manufacturer or seller that is: (1) licensed to engage in interstate or foreign commerce of a firearm or ammunition product; or (2) is a trade association representing such manufacturers or sellers. Declares that any lawful conduct carried out by a manufacturer or seller in interstate or foreign commerce of a firearm or ammunition product, or lawful conduct carried out by a trade association in the course of representing such manufacturers or sellers, shall not be the basis for imposing a restriction on such commerce (the award of civil damages, equitable relief, or any other specified limitation) as a result of harm caused by the criminal or other unlawful misuse of such firearm or ammunition product by any other person.

Minor Use and Minor Species Animal Health Act of 2001 - Amends the Federal Food, Drug, and Cosmetic Act to define: "minor species" as animals other than cattle, horses, swine, chickens, turkeys, dogs, and cats; and (2) "minor use" as use on minor species or on other species for a disease or condition that occurs infrequently or in limited geographic areas. Provides for: (1) designation of new animal drugs for minor use; and (2) three-year approval exclusivity. Provides for establishment of an index of unapproved new animal drugs for minor species, and allows marketing of such drugs that evidence no human food safety concern. Authorizes: (1) designation of new animal drugs for minor use or minor species; and (2) grants or contracts for development (and exclusivity) of designated new animal drugs. Modifies new animal drug approval requirements. Amends the Internal Revenue Code to allow a business research tax credit (not applicable to grant or contract funds) for minor use qualified safety and effectiveness testing expenses. Directs the Secretary of Health and Human Services to establish within the Food and Drug Administration an Office of Minor Use and Minor Species Animal Drug Development.

Dairy Consumers and Producers Protection Act of 2001 - Amends the Agricultural Market Transition Act to include Maryland, New Jersey, New York, and Pennsylvania within the Northeast Interstate Dairy Compact. Eliminates: (1) the Compact's termination date; and (2) certain restrictive authority respecting non-Compact milk. States that only Ohio may join such Compact. Eliminates and revises specified provisions regarding Compact implementation, duration, restricting authority, and Commodity Credit Corporation compensation. States that Congress consents to the Southern Dairy Compact entered into by Alabama, Arkansas, Georgia, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Oklahoma, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia. States that only Florida, Nebraska, and Texas may join such Compact. Limits price regulatory authority to Class I fluid milk unless otherwise consented to by the Congress. Provides for Commodity Credit Corporation compensation. Sets forth the Southern Dairy Compact. States that Congress consents to: (1) the Pacific Northwest Dairy Compact proposed for California, Oregon, and Washington; and (2) the Intermountain Dairy Compact proposed for Colorado, Nevada, and Utah. Limits price regulatory authority to Class I fluid milk. Provides for Corporation compensation. States that such Compacts shall be the same as the Southern Dairy Compact with specified differences.

Amends the Harmonized Tariff Schedule of the United States to impose tariff-rate quotas (quantitative import limits) and provide various duty rates on certain casein, caseinates, milk protein concentrate, and other casein derivatives and glues imported into the United States (except imports from Mexico). Authorizes the President to: (1) enter into a trade agreement with a foreign country to grant new concessions as compensation in order to maintain the general level of reciprocal and mutually advantageous concessions; and (2) proclaim any necessary modification or continuance of any existing duty, or continuance of existing duty-free or excise treatment. Sets forth certain limits on the reduction of duties on such products.

Requires the American Battle Monuments Commission to proceed expeditiously with the construction of the National World War II Memorial at the dedicated Rainbow Pool site in the District of Columbia. Declares that: (1) the requirements of the National Environmental Policy Act of 1969, the Commemorative Works Act, and any other law pertaining to the siting and design of the Memorial have been met; and (2) the decision to construct the Memorial at such site, decisions implementing this Act, and decisions about design are final, conclusive, and not subject to administrative or judicial review.

Amends title XVIII (Medicare) of the Social Security Act (SSA) to: (1) mandate a single national average standardized payment amount for inpatient hospital services furnished, regardless of whether in an urban or non-urban area, under the Medicare prospective payment system (PPS) for discharges occurring in FY 2002 and thereafter; and (2) establish a minimum factor of .925 as a floor for area wage adjustment factors used under the PPS for inpatient and outpatient hospital services.

Historically Women's Public Colleges or Universities Historic Building Restoration and Preservation Act - Directs the Secretary of the Interior to award grants to historically women's public colleges or universities for the preservation and restoration of historic buildings and structures on their campuses. Specifies eight institutions to receive such grants in FY 2002.

Artists' Contribution to American Heritage Act of 2001 - Amends the Internal Revenue Code to provide a fair market value (determined at time of contribution) deduction for charitable contributions of literary, musical, artistic, scholarly compositions, or the copyright created by a qualifying donor. Exempts certain non-personal letters and memorandum from such treatment. Limits such increased deduction to the donor's artistic adjusted income (as defined by this Act).

Reforestation Tax Act of 2001 - Amends the Internal Revenue Code to allow a deduction to a taxpayer who has a qualified timber gain in an amount equal to the qualified percentage of such gain. Decreases the amortization period for reforestation expenditures.

Federal Prison Industries Competition in Contracting Act of 2001 - Amends the Federal criminal code to replace provisions regarding the purchase of prison-made products by Federal departments with provisions establishing a Government-wide procurement policy relating to purchases from Federal Prison Industries (FPI) which shall generally require the use of competitive procedures. Requires FPI to comply with Federal occupational, health, and safety standards regarding its industrial operations. Requires that an analysis of the probable impact of a proposed expansion of inmate-work activities by FPI on private sector firms and their non-inmate workers be made whenever FPI proposes to authorize the sale of a new specific product or service or to expand production of a current product or service. Provides for inmate wages and deductions. Amends the Federal judicial code regarding the Department of Justice Assets Forfeiture Fund to authorize payments to the Bureau of Prisons exclusively for the purpose of providing additional vocational and remedial educational training for inmates. Amends the Federal criminal code to require that not less than 20 percent of the gross profits of the corporation at the end of each fiscal year be allocated to fund vocational training for inmates. Requires the Director of the Bureau to afford to inmates opportunities to participate in programs and activities designed to help prepare such inmates to obtain employment upon release. Authorizes FPI to: (1) locate more than one workshop at a Federal correctional facility; and (2) operate a workshop outside of a correctional facility if all of participating inmates are minimum security inmates.

Ready to Learn, Ready to Teach Act of 2001 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to revise title III (Technology for Education) part C as Ready-to-Learn Digital Television. Directs the Secretary of Education to award grants, contracts, or cooperative agreements to eligible public telecommunications entities to: (1) develop educational programming, and related support materials and services, for preschool and elementary school children; (2) develop programming and digital content designed for nationwide distribution over public television stations' digital broadcasting channels and the Internet, containing Ready-to-Learn-based children's programming and resources for parents and caregivers; and (3) disseminate and distribute such programs to the widest possible appropriate audience by the most appropriate distribution technologies. Establishes the New Century Program for Distributed Teacher Professional Development. Authorizes the Secretary to make grants to a nonprofit telecommunications entity, or partnership of such entities, for a national telecommunications-based program designed to assist elementary school and secondary school teachers in preparing all students in core curriculum areas to achieve State content standards. Establishes a Digital Education Content Collaborative. Authorizes the Secretary to award competitive matching grants to, or enter into contracts or cooperative agreements with, eligible local public television communications entities to develop, produce, and distribute educational and instructional video programming based on State standards and designed for use by kindergarten through grade 12 schools.

Assure Access to Mammography Act of 2001 - Amends the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 to delay until 2003 the inclusion of payment for screening mammography in the Medicare physician fee schedule. Amends title XVIII (Medicare) of the Social Security Act to provide for a change in the payment amount for screening mammography performed in 2002 under Medicare. Provides that, for cost reporting periods between October 1, 2001, and October 1, 2006, in applying the limitations regarding the total number of full-time equivalent residents in the field of allopathic or osteopathic medicine under Medicare for a hospital, the Secretary of Health and Human Services shall not take into account a maximum of three residents in the field of radiology to the extent the hospital increases the number of radiology residents above the number of such residents for the hospital's most recent cost reporting period ending before October 1, 2001. Amends the Public Health Service Act to revise authorization of appropriations and allocation provisions with regard to interdisciplinary, community-based linkages, with changes establishing a specified authorization of appropriations for FY 2002 and a specified amount to be available for awards of grants and contracts under provisions on allied health and other disciplines. Directs the Comptroller General to study: (1) the relative value units established by the Secretary of Health and Human Services under the Medicare physician fee schedule for physicians' services that are gender-specific; and (2) adjustments to payment amounts under the prospective payment system for inpatient hospital services and for covered skilled nursing facility services that are gender-specific. Directs the Medicare Payment Advisory Commission to study the relative value units established by the Secretary under the such fee schedule for screening services that are reimbursed under it.

Law Enforcement Officers Due Process Act of 2001 - Authorizes the Attorney General to provide grants to law enforcement agencies (agencies) that: (1) have in effect an administrative process or an existing procedure that complies with officer rights requirements; or (2) certify that they will establish, within two years, an administrative process that complies with such requirements. Requires the administrative process to require that an agency that investigates an officer for matters which could reasonably lead to disciplinary action provide recourse for the officer that includes: (1) access to any existing administrative process established by the employing agency prior to disciplinary action; and (2) the right to a hearing before a fair and impartial board or hearing officer, to be represented by an attorney or other officer at such officer's expense, to confront any witness testifying against such officer, and to record all meetings. Permits the immediate suspension with pay of an officer: (1) whose continued presence on the job is considered to be a substantial and immediate threat; (2) who refuses to obey a direct order issued in conformance with the agency's written and disseminated rules and regulations; or (3) who is accused of committing an illegal act. Makes this Act inapplicable to an agency if the Attorney General determines that such agency has in effect an established civil service system, agency review board, grievance procedure, or personnel board which meets or exceeds the minimum standards set forth in this Act.

Amends the Elementary and Secondary Education Act of 1965 to reauthorize and revise provisions for the National Writing Project (NWP). Increases the maximum amount for any one contractor under limits on the Federal share of NWP teacher training programs. Repeals the classroom teacher grants program under NWP. Increases and extends through FY 2006 the authorization of appropriations for NWP.

Constitutional Amendment - Requires that any bill, resolution, or other legislative measure changing the internal revenue laws shall require for final adoption in each House the concurrence of two-thirds of the Members of that House voting and present, unless the bill is determined at the time of adoption, in a reasonable manner prescribed by law, not to increase the internal revenue by more than a de minimis amount. States that for purposes of determining any increase, there shall be excluded any increase resulting from the lowering of an effective rate of any tax. Requires journal entry of any vote. Permits the waiver of such requirement, for up to two years, if there is a declaration of war or if the United States is engaged in a military conflict which causes an imminent and serious threat to national security and is so declared by a joint resolution which becomes law.

Railroad Retirement and Survivors' Improvement Act of 2001 - Amends the Railroad Retirement Act of 1974 to increase benefits to railroad employees and their beneficiaries and to revise financing of the pension part (tier II) of the railroad retirement system. Establishes a Railroad Retirement Trust Fund and a Railroad Retirement Investment Trust to manage and invest Fund assets. Abolishes the Railroad Retirement Supplemental Annuity Account and provides for transfer of its funds to the Fund. Provides for transfer to the Fund of certain portions of the Railroad Retirement Account and of Social Security Equivalent Benefit account funds. Transfers to the disbursing agent from the Dual Benefits Payments Account the amount necessary to make dual benefit payments. Requires the Railroad Retirement Board (RRB) to calculate the ratio of assets to benefits to determine annual tier II tax rates for employers, employee representatives, and employees. Amends the Internal Revenue Code to exempt the Fund from taxation. Repeals a supplemental annuity tax that railroad employers pay to finance a benefit for long-time rail employees. Provides for adjustments to railroad employers, employee representatives, and employee tier II tax rates.

National Right-to-Work Act - Amends the National Labor Relations Act and the Railway Labor Act to repeal those provisions that permit employers, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).

Historically Women's Public Colleges or Universities Historic Building Restoration and Preservation Act - Directs the Secretary of the Interior to award grants to historically women's public colleges or universities (institutions) for the preservation and restoration of historic buildings and structures on their campuses. Specifies seven institutions to receive such grants in FY 2002.
