Supporting Patient Education And Knowledge Act of 2023 or the SPEAK Act of 2023 This bill establishes the Improved Access to Health Care Information Technology for non-English Speakers Task Force. The task force must assess any current barriers that limit the ability of non-English speakers to access telehealth services and recommend improvements (e.g., technological enhancements). The Department of Health and Human Services (HHS) must collect information from relevant stakeholders to inform the task force's assessments and recommendations.  HHS must establish a website with best practices for connecting non-English speakers with telehealth services, based on the task force's final report.

Safe Schools Improvement Act

Safe Schools Improvement Act This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex (including sexual orientation and gender identity), sex characteristics (including intersex traits), disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Federal Retirement Fairness Act

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

Federal Disaster Tax Relief Act of 2023 This bill extends rules for the treatment of certain disaster-related personal casualty losses and provides tax relief for losses due to wildfires and a certain incident involving a train derailment. Specifically, the bill excludes from taxpayer gross income, for income tax purposes, any amount received by an individual taxpayer as compensation for expenses or losses incurred due to a qualified wildfire disaster (a disaster declared after 2014 as a result of a forest or range fire). It also excludes relief payments for losses resulting from the East Palestine, Ohio, train derailment on February 3, 2023.

Transportation Security Screening Modernization Act This bill directs the Transportation Security Administration (TSA) to streamline the process for individuals applying for or renewing enrollment in multiple security threat assessment (STA) programs, in particular the Transportation Worker Identification Credential (TWIC) and the Hazardous Materials Endorsement (HME) programs. Among other things, the TSA must permit an individual to enroll at a TSA-authorized enrollment center once and use the application, as well as information generated by TSA’s vetting, to enroll in any other programs; permit an individual to enroll in more than one STA program at the same time for a single fee that is less than the combined fee for applying to the same programs separately; provide for a streamlined and expeditious renewal process; and provide states the expiration dates for each individual’s STA to ensure commercial driver's licenses include an individual's current HME status. Additionally, the TSA must publish on its website information relating to the streamlining of the enrollment system. If the TSA determines it is necessary to implement these changes through rulemaking, the bill provides for an expedited rulemaking process.

Johanna's Law Reauthorization Act This bill reauthorizes through FY2026 and otherwise revises the Centers for Disease Control and Prevention (CDC) national awareness campaign regarding gynecologic cancers. The CDC must target specified populations of women at higher risk for gynecologic cancers in the campaign. Additionally, the CDC may establish a grant program to evaluate different strategies to increase knowledge and awareness of gynecologic cancers among women and health care providers. In awarding these grants, the CDC must give preference to (1) grantees with expertise in gynecologic cancer education or treatment or expertise in working with groups of women at increased risk of such cancers; and (2) projects that will establish links between health care providers, hospitals, insurance companies, and state health departments.

Uniform Treatment of Custodial Assets Act This bill addresses the accounting treatment of certain assets, including digital assets, at financial institutions. For example, under the bill, federal regulatory entities are prohibited from requiring specified financial institutions to include as a liability on financial statements assets that are held in custody or safekeeping by the institution. This applies to assets associated with a cryptographic key held in custody or safekeeping by the financial institution. However, if cash held by an institution for a third party is commingled with the general assets of the institution, that cash may be treated as a liability.

Tyler Clementi Higher Education Anti-Harassment Act of 2023 This bill addresses harassment at institutions of higher education (IHEs). Specifically, the bill requires each IHE to include in its annual security report a statement of policy regarding harassment on the basis of a student's actual or perceived race, color, national origin, sex (including sexual orientation, gender identity, pregnancy, childbirth, a medical condition related to pregnancy or childbirth, a sex stereotype, and sex characteristics, including intersex traits), disability, or religion. In addition, the Department of Education may award grants to IHEs to initiate, expand, or improve programs to (1) prevent the harassment of students; (2) provide counseling or redress services to students who have been harassed or accused of subjecting other students to harassment; or (3) educate and train students, faculty, or staff to prevent harassment or address harassment if it occurs.

Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service or inactive-duty training during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

Earn to Learn Act This bill directs the Department of Education (ED) to establish a postsecondary education match savings account demonstration grant program, through which ED must award competitive grants to states and nonprofit organizations to provide certain low-income students with postsecondary education match savings accounts (e.g., 529 plans). Further, ED must (1) develop and make available to grant recipients certain tools, including a training platform, a program guide, an online data portal, and certain trainings (e.g., on workforce readiness); (2) ensure that participation in the grant program does not affect student eligibility for Federal Pell Grants; and (3) provide technical assistance. Grant recipients must use funds to (1) select eligible students to participate in the grant program, (2) provide selected students with financial literacy education, (3) establish a postsecondary education match savings account for each participating student and allow such students and their families to deposit funds in their account to save for attendance at an institution of higher education or an area career and technical education school, and (4) reserve matching funds for participating students. Additionally, grant recipients must ensure that participating students are entitled to withdraw funds from their accounts under certain circumstances.

Student Loan Deferment for Sex-Based Harassment Survivors Act This bill allows a borrower who is a victim of sex-based harassment (including sexual harassment, dating violence, domestic violence, stalking, or sexual assault) to defer payment of federal student loans for up to three years. Additionally, the bill authorizes the Department of Education (ED) to waive certain requirements for repayment of grant assistance or federal student loans for a borrower whose attendance was interrupted due to such sex-based harassment. ED must, within five years of this bill's enactment, submit a report to Congress evaluating the effectiveness of the bill's activities.

Helping Ensure Access to Local TeleHealth Act of 2023 or the HEALTH Act of 2023 This bill modifies requirements relating to Medicare coverage of telehealth services, including services that are furnished by federally qualified health centers (FQHCs) and rural health clinics (RHCs). Specifically, the bill expands coverage to include audio-only telehealth services. It also permanently allows FQHCs and RHCs to serve as the distant site (i.e., the location of the health care practitioner) for telehealth services and excludes such services from certain geographic restrictions. Payment must be made in the same manner as for non-telehealth services, rather than in accordance with a separate methodology determined by the Centers for Medicare & Medicaid Services.

Fresh Produce Procurement Reform Act of 2023

Fresh Produce Procurement Reform Act of 2023 This bill directs the Agricultural Marketing Service (AMS) to establish a fresh produce program that serves individuals at risk of food and nutrition insecurity. Specifically, the AMS must enter into contracts with growers, distributors, food hubs, and others to procure U.S.- grown fresh produce (excluding legumes) for distribution to organizations that serve individuals at risk (e.g., nonprofit food banks and pantries, schools, child or senior care centers, and community-based organizations). Under the AMS contracts, the produce must meet specific requirements. For example, the produce must be grown in the United States, include locally grown produce, and include at least seven varieties of fresh produce that are distributed.  The AMS must prioritize contracts with eligible growers, distributors, food hubs, and others that are (or source produce from) beginning farmers; small or mid-sized farms that are structured as family farms; or socially disadvantaged farmers, including women-owned and veteran-owned eligible entities. As part of the program, the AMS must provide (1) information to assist small farmers, beginning farmers, veteran farmers, and socially disadvantaged farmers in obtaining food safety certifications; (2) financial assistance for changes and upgrades to improve food safety; and (3) technical assistance to eligible fresh produce growers, distributors, food hubs, and others.  In addition, the Government Accountability Office must submit a report to Congress that evaluates the effectiveness of the program with respect to, among other things, increasing low-income households' access to a wide variety of fresh produce and increasing the federal government's procurement of fresh produce.
