Conservation Reserve Enhancement Program Improvement Act of 2023 This bill revises the Conservation Reserve Enhancement Program (CREP), which is a component of the Farm Service Agency's (FSA's) Conservation Reserve Program (CRP). CREP is a public-private partnership program which allows states, tribal governments, and nonprofit and private entities to partner with FSA to implement CRP practices. CRP is a land conservation program that provides an annual rental payment to farmers in exchange for removing environmentally sensitive land from agricultural production and planting species that will improve environmental health and quality. The bill specifies that dryland agricultural uses and grazing are included as appropriate practices under CREP. The bill also allows a land owner or operator to elect to determine the annual payment amount allocated for each year of a CREP agreement, instead of a fixed payment per year for the contract period. For drought and water conservation agreements that include the permanent retirement of water rights, annual payment rates must be equal to the irrigated acre payment rates determined by the Department of Agriculture (USDA). In the case of an agreement that permits dryland agricultural uses, the annual payment rates must be equal to the difference between the irrigated acre payment rates and the dryland acre payment rates determined by USDA. The payment formula is retroactive for certain existing drought and water conservation agreements. Further, the bill exempts CREP payments from the $50,000 annual payment limitation under CRP.

Space Resources Institute Act This bill directs the National Aeronautics and Space Administration (NASA) and the Department of Commerce to submit a report on the merits of, and options for, establishing an institute related to space resources in order to advance the objectives of NASA and Commerce for maintaining U.S. preeminence in space.

National Construction Safety Team Enhancement Act of 2023 This bill expands the authority of the National Institute of Standards and Technology (NIST) to investigate structural failures other than those involving buildings and to recommend related improvements to engineering standards and practices. Specifically, the bill expands the investigative authority of NIST's National Construction Safety Teams. Currently, these teams are authorized to investigate the structural failure of a building that has resulted in substantial loss of life or that had the significant potential to cause a substantial loss of life. These teams must (1) identify the likely cause of the failure, (2) evaluate the technical aspects of evacuation and response procedures, and (3) recommend ways to improve building standards, codes, and practices and other related actions based on their findings. The bill expands this authority beyond buildings to include other types of structures and related engineering standards and practices.

Advancing Automation Research and Development in Agriculture Act This bill directs the Department of Agriculture (USDA) to establish within USDA a stand-alone competitive research and extension grant program to increase the competitiveness of specialty crops in the United States through the advancement and acceleration of mechanization and automation. Specialty crops are fruits and vegetables, tree nuts, dried fruits, and horticulture and nursery crops (including floriculture). The bill provides specified funds for FY2024 and each succeeding year to carry out the program. The grant program includes projects that create or improve cost-effective technologies to reduce a specialty crop grower's manual labor requirements and increase the efficiency of crop production, resource management, harvesting, processing, post-harvest technologies, and packaging; increase adoption of mechanization and automation technologies; and accelerate automation and mechanization through prototype development, in-field trial testing, ongoing industry engagement, and rapid commercialization. Entities eligible for the grant program are federal agencies, national laboratories, colleges and universities, research institutions and organizations, private organizations and corporations, state agricultural experiment stations, individuals, and organizations representing specialty crop growers.

Federal Labs Modernization Act of 2023 This bill requires certain agencies to report on the state of research infrastructure at federal laboratories and other facilities. Specifically, the bill requires the Office of Science and Technology Policy to include in a report to Congress a description of the deficiencies in funding for research infrastructure in research facilities and major instrumentation located at federal laboratories and certain facilities of academic institutions. In addition, the Government Accountability Office must submit a report to Congress on the research infrastructure of federal facilities, including the current state of facilities and equipment and any needed repairs and associated costs.

American Dream and Promise Act of 2023 This bill provides certain non-U.S. nationals ( aliens under federal law) with a path to receive permanent resident status and contains other immigration-related provisions. The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying individual who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants. The bill imposes various qualifying requirements, such as the individual being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs. DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed. Furthermore, DHS and DOJ shall provide lawful permanent resident status to certain individuals who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such individuals must meet certain requirements and apply for such status within three years of this bill's enactment. DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes. This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented individuals unless those benefits are available to all U.S. nationals without regard to residency in the state.

Stop Pills That Kill Act This bill increases criminal penalties for offenses relating to the manufacture of fentanyl or counterfeit substances. It also establishes requirements for federal agencies to address the use of counterfeit substances. Specifically, the bill applies an increased criminal penalty for possessing, manufacturing, or distributing certain equipment or materials that are used to illegally manufacture fentanyl, an analogue of fentanyl, or a counterfeit substance (the increased penalty is currently limited to offenses involving methamphetamine). The Drug Enforcement Administration must establish and implement a plan to address counterfeit fentanyl or methamphetamine substances through law enforcement action and education and prevention efforts. In addition, the Department of Justice must annually report on the collection of counterfeit fentanyl or methamphetamine substances by law enforcement and on related prosecutions.

Fair Access to Agriculture Disaster Programs Act This bill waives the adjusted gross income limitations for payments or benefits under specific Department of Agriculture (USDA) disaster assistance programs for a person or legal entity that derives a portion of their income from agriculture. (Currently, a person or entity is not eligible to receive certain benefits during a crop, fiscal, or program year if their average gross income exceeds $900,000.) Specifically, in the case of an excepted payment or benefit, the adjusted gross income limitation is waived if 75% or more of the average adjusted gross income for the person or entity is derived from farming, ranching, or silviculture activities. These activities include agritourism, direct-to-consumer marketing of agricultural products, and the sale of agricultural equipment owned by such person or entity. The bill applies to the USDA Livestock Indemnity Program; Livestock Forage Disaster Program; Emergency Assistance for Livestock, Honey Bees, and Farm-Raised Fish Program; Tree Assistance Program; and Noninsured Crop Disaster Assistance Program.

Safer Response Act of 2023 This bill reauthorizes through FY2028 a grant program that is administered by the Substance Abuse and Mental Health Services Administration to support training and other resources for first responders on opioid overdose reversal drugs (e.g., naloxone).

Comprehensive Addiction Recovery through Effective Employment and Reentry Act of 2023 or the CAREER Act of 2023 This bill reauthorizes through FY2028 the Treatment, Recovery, and Workforce Support Grant Program, which supports the ability of individuals who are in substance-use disorder treatment and recovery to live independently and participate in the workforce. The bill also specifies that the data used to determine which states to prioritize for grants (e.g., overdose mortality rates and unemployment rates) must be based on the five-year period immediately preceding the grant cycle. It also allows grants to be used for transportation services to and from the individual's work, training, or treatment or recovery services.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances the safety of contraception and cannot be achieved through less restrictive means. The bill also specifies that the prohibition preempts inconsistent state and local laws and applies in spite of other federal laws, including the Religious Freedom Restoration Act of 1993. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Food Access and Stability Act of 2023 This bill repeals the sunset of the work requirements exemption for certain Supplemental Nutrition Assistance Program (SNAP) recipients who are able-bodied adults without dependents (ABAWDs). (SNAP recipients who are ABAWDs have work-related requirements in addition to the general SNAP work registration and employment and training requirements.) Under current law, homeless individuals, veterans, and certain foster care individuals (those who are 24 years old or younger and were in foster care on the date of attaining 18 years of age or a higher age) are exempt from the work requirements for ABAWDs. This exemption sunsets at the end of FY2030. The bill repeals the sunset of these exemptions, making them permanent.

Substance Use Disorder Treatment and Recovery Loan Repayment Program Reauthorization Act of 2023 This bill reauthorizes through FY2028 the Substance Use Disorder Treatment and Recovery Loan Repayment Program. Under the program, certain health care providers may receive up to $250,000 in repayment assistance for higher education loans if they provide treatment or recovery services for those with substance use disorders. Providers must work full-time for at least six years at an approved facility that is in a locality with a higher-than-average rate of drug overdose deaths or that is in a mental health professional shortage area.

Disaster Mitigation and Tax Parity Act of 2023 This bill excludes from gross income, for income tax purposes, any qualified catastrophe mitigation payment made under a state-based catastrophe loss mitigation program. A qualified catastrophe mitigation payment means any amount received for making improvements to an individual's property for the sole purpose of reducing the damage that would be done to such property by a windstorm, earthquake, or wildfire.

This bill includes phosphate and potash on the Department of the Interior's final list of critical minerals. (Under current law, Interior and other departments are required to conduct a variety of efforts to ensure a secure and reliable supply chain of critical minerals.) Interior must evaluate current policies relating to permitting and leasing of projects to develop critical minerals and issue recommendations to Congress to support domestic production of such commodities.

Relieving Economic Strain to Enhance American Resilience and Competitiveness in Higher Education and Research Act or the RESEARCHER Act This bill requires executive guidance and policy changes with respect to the compensation and benefits afforded to graduate and postdoctoral researchers. Specifically, the White House's Office of Science and Technology Policy must develop a set of policy guidelines for federal agencies to address the financial instability of graduate and postdoctoral researchers. The guidelines must address certain issues, including stipends that are appropriately indexed to cost-of-living adjustments, health care benefits, and affordable housing and child care. Federal agencies must develop policies that are consistent with such guidelines within six months of the guidelines' issuance. Additionally, the National Science Foundation must (1) provide awards to institutions of higher education or nonprofits to collect data on the financial instability of graduate and postdoctoral researchers, and (2) contract with the National Academies of Sciences, Engineering, and Medicine to report on stipends for graduate and postdoctoral researchers relative to their cost-of-living expenses. The Government Accountability Office must report on the implementation of relevant policy changes.

Providing for Unhoused People with Pets Act of 2023 or the PUPP Act of 2023 This bill permits the Department of Agriculture to award grants for interim and permanent housing that accommodates individuals (or families) who are homeless and have pets. Entities eligible for the grant include local governments, nonprofits, and entities that house or shelter homeless individuals. Additionally, grant recipients must make available supportive services and basic veterinary care.

Resources for Victims of Gun Violence Act of 2023 This bill establishes the Advisory Council to Support Victims of Gun Violence. Among other things, the advisory council must assess the needs of victims of gun violence and disseminate information about helpful resources.

Jackie Walorski Enhancing Necessary Data on Illegal School Bus Passing Act This bill addresses various issues related to illegal passing of stopped school buses. For example, the bill requires the National Highway Traffic Safety Administration to establish a grant program for demonstration projects to monitor and collect data on illegal passing of stopped school buses, produce and distribute a national public safety messaging campaign concerning the dangers of illegal passing of stopped school buses, and modify certain educational materials to include more information on the dangers of illegal passing of stopped school buses and the importance of enforcing laws against it. The bill also requires the Department of Transportation, in consultation with the National Conference of State Legislatures, to develop model legislation to address incidents of illegal passing of stopped school buses.

LGBTQ I+ Data Inclusion Act This bill addresses federal data collection of voluntary, self-disclosed information on sexual orientation, gender identity, and variations in sex characteristics. Specifically, the bill requires federal agencies that collect information through a survey for statistical purposes that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to review existing data sets to determine which data sets do not include information about sexual orientation, gender identity, and variations in sex characteristics. Such agencies must assess needed changes in survey methods related to asking questions on such matters. Agencies that publish reports relying on survey demographic data must include information on sexual orientation, gender identity, and variations in sex characteristics. Agencies may waive this publication requirement on a case-by-case basis if the confidentiality of the information cannot be maintained or if adding such information to the survey would impair the agency's ability to preserve the utility, accuracy, or objectivity of the survey while also generating relevant evidence about the LGBTQI+ community. The Government Accountability Office must report to Congress on the implementation of this bill's requirements by agencies.

Neighborhood Homes Investment Act This bill allows a business-related tax credit for certain development costs for the acquisition, rehabilitation, or remediation of qualified real property (i.e., real property affixed on a permanent foundation and comprised of four or fewer residential units, a condominium unit, or a house or apartment owned by a cooperative housing corporation). The bill also provides for the exclusion from gross income, for income tax purposes, of the value of any subsidy provided to a taxpayer by any state energy office for purposes of improvements made to a qualified residence.

Screening for Communities to Receive Early and Equitable Needed Services for Cancer Act of 2023 or the SCREENS for Cancer Act of 2023 This bill reauthorizes through FY2028 and makes changes to the National Breast and Cervical Cancer Early Detection Program. This program provides funding to states for breast and cervical cancer screening, diagnostic, and treatment services for individuals who have low incomes, are uninsured, or otherwise lack access to such services. Changes to the program include (1) expanding its scope to include addressing disparities and ensuring equitable access to screening and diagnostic services, and (2) eliminating requirements for states to expend a specified percentage of funding on screening and referral services.

Crop Insurance for Future Farmers Act This bill amends the federal crop insurance program (FCIP) to increase the premium assistance rate for beginning and veteran farmers or ranchers. Specifically, the bill amends the amount of percentage points that are added to the premium assistance rate for beginning and veteran farmers or ranchers for an applicable insurance policy or plan (currently 10 percentage points) to provide 15 percentage points in each of the 1st and 2nd reinsurance years, 13 percentage points in the 3rd year, 11 percentage points in the 4th year, and 10 percentage points in each of the 5th through the 10th reinsurance years. The bill also amends the FCIP definition of beginning farmer or rancher to include a farmer or rancher who has not actively operated and managed a farm or ranch for more than 10 crop years (currently more than 5 crop years).

Expanding Childcare in Rural America Act of 2023 This bill requires the Department of Agriculture (USDA) to establish the Expanding Childcare in Rural America Initiative to prioritize certain loans and grants that address childcare in agricultural and rural communities. Under the bill, childcare includes eligible programs that provide quality care and early education for young children who are in kindergarten or have not yet entered kindergarten. Under the initiative, USDA must give priority to applicants that propose to use certain loans or grants to address the availability, quality, or costs of childcare in an agricultural or rural community. In addition, USDA must prioritize communities in farming-dependent counties and ensure a balanced geographical distribution of the benefits. USDA must conduct a comprehensive quantitative and qualitative evaluation of the projects carried out under the initiative and submit a report to Congress.

Access to Genetic Counselor Services Act of 2023 This bill provides for coverage under Medicare of genetic counseling services that are furnished by genetic counselors. Covered services include those services, as well as incidental services and supplies, that would otherwise be covered under Medicare if provided by a physician.

Preventing Maternal Deaths Reauthorization Act of 2023 This bill reauthorizes through FY2028 and otherwise modifies federal support for state-based efforts to improve maternal mortality review committees; enhance surveillance of pregnancy-associated and -related deaths; and otherwise improve, and reduce disparities in, maternal health outcomes. The bill also requires the Centers for Disease Control and Prevention to annually disseminate best practices for preventing maternal mortality and morbidity to hospitals, professional societies, and perinatal quality collaboratives (i.e., networks of perinatal care providers and public health professionals that work to improve pregnancy outcomes through continuous quality improvement).

Securing Unhoused Peoples' Program for Outreach Resources and Transportation For SNAP Act or the SUPPORT For SNAP Act This bill directs the Department of Agriculture (USDA) to establish a pilot program to raise awareness among and provide support for homeless individuals eligible for the Supplemental Nutrition Assistance Program (SNAP). Under the program, USDA must award grants to eligible entities (e.g., state and local agencies, nonprofit and community-based organizations, and community action agencies) to (1) raise awareness among homeless individuals of the availability, eligibility requirements, application procedures, and benefits of SNAP; (2) support homeless individuals in enrolling in SNAP; and (3) train outreach workers, caseworkers, and others on SNAP application and program requirements. The bill specifies that a grant recipient may only use program funding to supplement (and not supplant) the level of state or local funds that would be available in the absence of the grant funds.

Pride in Mental Health Act of 2023 This bill establishes grants and reporting requirements concerning the mental and behavioral health of youth who are lesbian, gay, bisexual, queer or questioning, nonbinary, intersex, or Two Spirit (gender-variant members of indigenous communities). Specifically, the Substance Abuse and Mental Health Services Administration (SAMHSA) must award grants to assess and improve mental health and substance abuse outcomes for those youth. Recipients may use grants for providing mental and behavioral health resources for such youth (including training for caregivers and school-based interventions) and collecting data. Recipients may not use grants for any practice or treatment that seeks to change another individual's sexual orientation or gender (i.e., conversion therapy). Additionally, the Department of Health and Human Services (HHS) must (1) conduct a survey to measure issues related to mental health and health care among such youth; and (2) report about the mental health and related care of such youth who are in foster care and otherwise participate in federal social services programs. HHS must also review existing publications on SAMHSA's website that focus on lesbian, gay, bisexual, transgender, queer or questioning, nonbinary, intersex, and Two Spirit individuals and update or commission new publications to fill information gaps related to the mental and behavioral health of those individuals.

Truth in Buffalo Labeling Act of 2023 This bill prohibits the sale of food that contains water buffalo and is labeled as buffalo unless the specific term used in the labeling is water buffalo .

Trucker Bathroom Access Act This bill expands access to restroom facilities for certain commercial truck drivers, including drayage truck operators. Drayage truck operator means the driver of any in-use on-road vehicle with a gross vehicle weight rating of greater than 33,000 pounds operating on or transgressing through port or intermodal rail yard property for the purpose of loading, unloading, or transporting cargo, including containerized, bulk, or break-bulk goods. Specifically, the bill requires certain retailers, warehouses, and other establishments to give commercial truck drivers access to existing restroom facilities when they are loading or delivering cargo, or waiting to load or transport cargo. Further, operators of marine terminals, including port authorities, must provide drayage truck operators with (1) access to existing restrooms, (2) additional restrooms if necessary, and (3) parking while accessing such restrooms.

National Digital Reserve Corps Act This bill establishes a National Digital Reserve Corps in the General Services Administration (GSA) to address the digital and cybersecurity needs of executive agencies. The GSA must establish standards for reservist eligibility and must ensure reservists have the necessary resources and security credentials for service. Reservists must agree to serve for three years and for at least 30 days per year as an active reservist, with up to $10,000 in annual compensation; reservists who fail to accept an offered appointment or complete required duties are subject to fines. The GSA may cover the costs of continuing education for reservists to support their service. The Department of Labor must issue regulations that ensure the reemployment, continuation of benefits, and nondiscrimination in reemployment of active reservists. In August 2021, President Joe Biden established the U.S. Digital Corps within the GSA to support the technological needs of executive agencies, including cybersecurity needs. The corps offers entry-level positions through two-year fellowships, with the option to convert to full-time career positions after completion of the fellowship.

Mental Health Workforce and Language Access Act of 2023 This bill requires the Department of Health and Human Services (HHS) to award supplemental grants to certain federally qualified health centers (FQHCs) for recruiting and retaining mental health care providers who are fluent in another language besides English. HHS must award the grants to FQHCs that are already receiving federal assistance to support outpatient primary care for low-income individuals or other underserved populations. Additionally, HHS must give preference to FQHCs where at least 10% of the patients are best served in a language other than English.

Justice for ALS Veterans Act of 2023 This bill extends increased dependency and indemnity compensation to the surviving spouse of a veteran who dies from amyotrophic lateral sclerosis (ALS or Lou Gehrig's disease) regardless of how long the veteran had such disease prior to death. Under current law, such compensation is paid for a service-connected disability that was rated totally disabling for a continuous period of at least eight years immediately preceding death. For purposes of compensation for a surviving spouse of a veteran who dies from ALS, the spouse must have been married to the veteran for a continuous period of eight years or longer prior to the death of the veteran. Additionally, the Department of Veterans Affairs (VA) must report on service-connected disabilities the VA determines should be treated in the same manner as ALS for purposes of dependency and indemnity compensation.

Modernizing Agricultural and Manufacturing Bonds Act This bill modifies provisions relating to qualified small issue bonds for manufacturing purposes by expanding the definition of manufacturing facility to include a facility that (1) is used in the creation or production of intangible property; or (2) is functionally related, subordinate to, and located on the same site as a facility used in the manufacturing or production of tangible or intangible personal property. The bill also increases from $10 million to $30 million the maximum bond size limitation. The bill modifies requirements for private activity bond financing for first-time farmers. The modified provisions (1) increase from $450,000 to $1 million (adjusted annually for inflation) the amount of bond proceeds that may be used by a first-time farmer to acquire land for farming purposes, (2) repeal the separate dollar limitation on the use of bond proceeds for used farm equipment, and (3) revise the definition of substantial farmland to determine farm size by reference to the average (instead of median) size of a farm in the county in which the farm is located.

U.S.-Israel Partnership and Abraham Accords Enhancement Act of 2023 This bill modifies and extends certain authorities related to Israel. For example, the bill extends the authorization for the Department of Defense (DOD) to transfer certain defense items to Israel; extends the authorization to finance cooperative projects among the United States, Israel, and developing countries related to water resources, agriculture, and energy storage; extends energy cooperation and authorizes the Department of Energy to make grants to Israel to support advanced nuclear technologies, as well as for carbon capture, utilization, and storage; requires the U.S. Agency for International Development to ensure that applicants from Abraham Accord countries are eligible for Middle East Regional Cooperation grants; and requires the Department of State to report to Congress on U.S. diplomatic efforts to oppose politically motivated investigations against the United States and Israel at the International Criminal Court.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Save Affordable Housing Act of 2023 This bill revises the low-income housing tax credit to repeal the qualified contract option for a building that received its allocation of housing credit dollar amount before January 1, 2023, or received before that date, a determination from the bond issuer or housing credit agency of its eligibility to receive an allocation of a housing credit dollar amount. Under current law, properties eligible for the low-income housing tax credit are subject to a 30-year affordability period, during which the value of properties is set at a below market rate. The qualified contract option allows property owners, in some cases, to convert to market rate after 15 years.

Feed Hungry Veterans Act of 2023 This bill expands eligibility for the Supplemental Nutrition Assistance Program (SNAP) for certain disabled veterans, including those determined to be catastrophically disabled.
