NIMHD Research Endowment Revitalization Act of 2019 This bill expands research endowments available through the National Institute on Minority Health and Health Disparities to include former centers of excellence at certain historically black colleges and universities and at biomedical and behavioral research institutions with a significant number of minority students.

Wildfires and Hurricanes Indemnity Program Extension Act of 2019 This bill extends the Department of Agriculture 2017 Wildfires and Hurricanes Indemnity Program. (Under current law, the program provides disaster payments to agricultural producers who suffered crop, tree, bush, and vine losses resulting from hurricanes and wildfires that occurred in the 2017 calendar year.) The bill extends the availability of the funding for the program through December 31, 2021, and expands the program to include losses resulting from hurricanes and wildfires occurring in calendar year 2018 or 2019.

Creating Hope Reauthorization Act This bill permanently reauthorizes a Food and Drug Administration program that awards priority review vouchers to manufacturers of drugs that treat rare pediatric diseases. (A priority review voucher entitles the voucher holder to priority review of a single human drug application.)

Support And Value Expectant Moms and Babies Act of 2019 or the SAVE Moms and Babies Act of 2019 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

Shift Back to Society Act of 2019 This bill directs the Department of Justice to establish a pilot program that awards matching grants to historically black colleges and universities to provide educational programs for eligible offenders to facilitate re-entry into the community. An eligible offender is a convicted criminal offender who has been released from incarceration for not longer than one year or who is scheduled to be released from incarceration within one year. The Government Accountability Office must report to Congress on the results of the pilot program.

Jurists United to Stop Trafficking Imitation Child Exploitation Act of 2019 or the JUSTICE Act of 2019 This bill broadens the prohibition on importation or transportation of obscene materials. Specifically, the bill makes it a crime to import, or knowingly use a common carrier or interactive computer service to transport, a child sex doll.

Negro Leagues Baseball Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the 100th anniversary of the establishment of the Negro National League, a professional baseball league that was formed in response to African-American players being banned from baseball's major leagues. The design of the coins shall be emblematic of the Negro Leagues Baseball Museum and its mission to promote tolerance, diversity, and inclusion. All surcharges from sales of these coins shall be paid to the Negro Leagues Baseball Museum to fund educational and outreach programs and exhibits.

Eradicate Crossing of Illegal Tunnels Act of 2019 or the EXIT Act of 2019 This bill authorizes the Department of Homeland Security (DHS) to take various actions to facilitate the search for and remediation of unlawful border crossing tunnels on private land. Specifically, DHS may waive federal, state, or local environmental permits and reviews as necessary to search for or remediate such tunnels. U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement may enter into indefinite delivery, indefinite quantity contracts with two or more sources to facilitate such border tunnel activities. (Indefinite delivery, indefinite quantity contracts provide for an indefinite quantity of services for a fixed time.)

Regulations From the Executive in Need of Scrutiny Act of 2019 This bill revises provisions relating to congressional review of agency rulemaking. Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves of the rule. A major rule is a rule that results in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. In addition, the bill establishes a congressional disapproval process for a nonmajor rule. A nonmajor rule may only take effect if Congress does not disapprove of the rule.

Taxpayer Identity Protection Act This bill requires the Internal Revenue Service to submit to Congress a report on the Taxpayer Identification Number Perfection Program, including an explanation of the extent to which the information could be used to identify individuals receiving wages without work authorization.

Protecting Patients Transportation to Care Act This bill provides statutory authority for the requirement that state Medicaid programs cover nonemergency transportation to medically necessary services. The bill also requires programs, as a condition of federal payment for such transportation services, to have a prior authorization or utilization management requirement for such services.

Maximizing America's Prosperity Act of 2019 This bill establishes annual spending limits that are equal to specified percentages of potential gross domestic product (GDP). Potential GDP generally refers to the GDP that would occur if the economy were at full employment without inflation. The spending limits apply to all budget authority and outlays of the federal government excluding net interest.

Cancer Care Planning and Communications Act of 2019 This bill provides for Medicare coverage and payment of cancer care planning and coordination services for individuals who are diagnosed with or treated for cancer, including the development of treatment plans, follow-up care, and any necessary revisions.

Medical Marijuana Research Act of 2019 This bill establishes a new, separate registration process to facilitate medical marijuana research. Specifically, it directs the Drug Enforcement Administration to register (1) practitioners to conduct medical marijuana research, and (2) manufacturers and distributors to supply marijuana for such research. Additionally, the Department of Health and Human Services must continue to produce marijuana through the National Institute on Drug Abuse Drug Supply Program and offer to sell immature plants and seeds to researchers until manufacturers and distributors can provide a sufficient supply of marijuana for medical research.

Dentist and Optometric Care Access Act of 2019 or the DOC Access Act of 2019 This bill prohibits private health insurance plans from setting rates for items and services provided by a doctor of optometry, of dental surgery, or of dental medicine for which the plan does not pay a substantial amount. Additionally, an agreement between a plan and such a doctor for limited scope dental or vision benefits may last longer than two years only with the prior acceptance of the doctor for each term extension. Plans also may not restrict such a doctor's choice of laboratories or suppliers. The bill establishes a private right of action for a person adversely affected by a violation of this bill. The bill does not supersede state laws regarding health insurers and dental or vision benefit plans.

Recovering America’s Wildlife Act of 2019 This bill provides funding for (1) the conservation or restoration of wildlife and plant species of greatest conservation need; (2) the wildlife conservation strategies of states, Indian tribes, or territories; or (3) wildlife conservation education and recreation projects. The Department of the Interior must use a portion of the funding for a grant program. The grants must be used for innovative recovery efforts for species of greatest conservation need, species listed as endangered or threatened species, or the habitats of such species.

Agricultural Guest Worker Reform Initiative Act of 2019 or the AGRI Act of 2019 This bill revises provisions related to H-2A (temporary agricultural worker) visas, including to eliminate certain requirements to hire U.S. workers, expand the program to include dairy and ranch workers, and shift administrative responsibilities from the Department of Labor to the Department of Agriculture (USDA). The bill establishes a trust fund to be used to (1) administer and enforce the program, (2) collect a portion of guest worker wages to be paid upon a worker's return to the worker's country of origin, and (3) provide emergency medical services for guest workers. The bill eliminates a requirement that, during the first half of the time period of a guest worker contract, certain employers must hire any qualified U.S. employee who applies to perform the job the guest worker was hired to perform. Furthermore, an employer shall not be required to pay a guest worker a wage higher than the highest of federal, state, or local minimum wage rates. The bill places limitations on when guest workers may receive civil legal assistance for low-income individuals. Employer-provided housing shall be governed generally by USDA regulations, where currently such housing must meet applicable federal, state, or local standards. Employers shall not have to provide housing to workers who can reasonably return to their permanent residence within the same day. An employer may file a civil action to recover transportation costs from a guest worker who absconds from a contract.

Laboratory Access for Beneficiaries Act or the LAB Act This bill revises the periods during which laboratories must report clinical diagnostic test information to the Centers for Medicare & Medicaid Services (CMS) for purposes of determining Medicare payment rates. The CMS must also contract with the National Academies of Sciences, Engineering, and Medicine to evaluate the methodology used to determine a specified laboratory fee schedule.

Election Security Assistance Act This bill addresses security threats to federal elections. Specifically, the bill authorizes grants to states for election technology and security, requires election poll books to meet voting system standards, allows for expedited security clearances for certain state election officials and officials with the Election Assistance Commission, requires federal entities to share information with the Department of Homeland Security (DHS) regarding election cybersecurity incidents, and requires DHS to share information with state and local officials regarding election cybersecurity incidents.

Stopping Bad Robocalls Act This bill updates various policies and regulations relating to robocalls. Specifically, the bill requires the Federal Communications Commission (FCC) to protect consumer privacy as it relates to robocalls. The FCC must update regulations involving certain robocalls that are exempt from criminal liability to include specific requirements identifying classes of parties who may make such calls, parties who may be called, and how many times they may be called. Additionally, the bill removes the requirement that a citation be issued prior to a forfeiture penalty being imposed in cases where violations involving illegal robocalls have been intentional and where inaccurate caller identification information has been provided. The bill also implements a three-year statute of limitation for such violations requiring notice, and a four-year statute of limitation where an intentional violation has occurred. The FCC must promulgate regulations to address requirements for effective call authentication technology as well as to establish a process to streamline the ways in which a private entity may voluntarily share with FCC information relating to an illegal call or text or for calls with misleading or inaccurate caller identification information. Finally, the bill requires the FCC to ensure robocall blocking services provided on an opt-out basis are provided free of cost with transparency and redress options for consumers and callers.

Community Cleanup Act This bill expands existing notice and publication requirements related to remedial action plans for Superfund sites (sites contaminated with hazardous substances). Specifically, the bill requires the notice and analysis of a proposed plan to be transmitted to local government officials with jurisdiction over the facility at issue, including any mayor, city council, or the highest ranking official in the area. During the public comment period, written and oral comments may be submitted regarding the use of the facility at issue after the remedial action is taken. Notice of the final remedial action plan must be transmitted to the local government officials with jurisdiction over the facility at issue. Finally, the bill expands the minimum publication requirements for proposed and final plans to include an announcement via a radio or television station in the broadcast area surrounding the facility at issue. Additionally, any publications must be posted to the Environmental Protection Agency website.

Paperwork Reduction for Farmers and H-2A Modernization Act This bill expands the H-2A (temporary agricultural worker) visa program to cover additional types of labor, makes various changes to the program, and provides a safe harbor for errors in nonimmigrant worker visa applications in certain instances. The bill makes H-2A visas available to an alien providing temporary labor that falls within the federal government classification categories for (1) grounds maintenance workers; (2) farming, fishing, and forestry occupations; or (3) forest, conservation, and logging workers. The bill authorizes joint employers to file a joint petition for an H-2A alien. The bill allows (1) employers seeking to rehire an H-2A worker to submit a simplified petition, and (2) employers seeking to hire H-2A workers for different time periods during a fiscal year to submit a single petition for such workers. The Department of Labor shall establish an electronic filing and appeals system for H-2A petitions. U.S. Citizenship and Immigration Services (USCIS) shall communicate electronically with an H-2A employer when USCIS requests evidence from the employer, if the employer asks to do so. An employer who uses a third-party service to apply for a nonimmigrant worker visa shall not be civilly or criminally liable for errors in the application if the employer reasonably believed that the application was accurate and complied with statutory requirements.

VA Mission Telehealth Clarification Act This bill authorizes health professional trainees of the Department of Veterans Affairs (VA) to provide treatment to veterans via telemedicine. To provide such treatment, a trainee must be under the supervision of a VA health care professional who is authorized to provide health care via telemedicine.

Canadian Snowbird Visa Act This bill authorizes the Department of Homeland Security to admit into the United States qualifying Canadian citizens as long-term nonimmigrant visitors. A qualifying Canadian citizen is an individual who (1) is at least 50 years old, (2) maintains a Canadian residence and owns a U.S. residence or has rented a U.S. accommodation for the duration of the individual's stay, (3) is not inadmissible or deportable, (4) will not engage in employment or labor for hire in the United States other than for a non-U.S.-based person or entity by whom the Canadian citizen was employed in Canada or for whom the Canadian citizen performed services in Canada, and (5) will not seek certain forms of assistance or benefits. A qualified individual may be admitted for up to 240 days during any single 365-day period. The spouse of such person may be admitted under the same terms, except that he or she is not required to separately satisfy the requirement for owning or renting a residence in the United States. The bill grants a person so admitted nonresident alien tax status.

Dependency and Indemnity Compensation Improvement Act of 2019 This bill creates an allowance for a deceased veteran's or deceased service member's surviving spouse who is receiving dependency and indemnity compensation (DIC) from the Department of Veterans Affairs. DIC is a monthly payment made to survivors and dependents of (1) certain veterans, and (2) service members killed while on active military duty. The bill provides a formula for calculating the monthly rate of the allowance based on the DIC amount the spouse is entitled to receive. Payment amounts under the Survivor Benefit Plan shall not be affected by the implementation of the DIC allowance.

Pharmacy Benefit Manager Accountability Study Act of 2019 This bill requires the Government Accountability Office to study the role of pharmacy benefit managers (PBMs) with respect to federally facilitated exchanges, including the role of PBMs in pharmaceutical supply chains, the competition among PBMs, and the use of rebates and fees by PBMs in such exchanges.

75th Anniversary of the End of World War II Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 500,000 $1 coins, and 750,000 half-dollar coins in commemoration of the 75th anniversary of the end of World War II. The coins shall be emblematic of the sacrifices made by millions of people of the United States 75 years ago in bringing an end to World War II. The design on each coin shall represent the World War II Victory Medal, which was awarded to all 16 million U.S. military personnel who served from December 7, 1941, to December 31, 1946. The bill requires all sales of such coins include specified surcharges, which shall be paid by Treasury to the congressionally designated National WWII Museum to fund its educational mission of telling the story of the U.S. experience in World War II.

This bill directs the U.S. Postal Service (USPS) to continue to sell the Alzheimer's disease semipostal stamp for an additional six years. The USPS must continue to transfer proceeds from the sale of the stamp to the National Institutes of Health to fund medical research relating to Alzheimer's disease.

Improving Seniors' Timely Access to Care Act of 2019 This bill establishes several prohibitions, requirements, and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, the bill prohibits MA plans from instituting additional prior authorization requirements for surgeries (including related items) that are furnished to a patient during other surgeries for which prior authorization was not required or was already received. Additionally, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

Patient Access to Higher Quality Health Care Act of 2019 This bill repeals specified limitations, for purposes of Medicare participation, on self-referrals by newly constructed or expanded physician-owned hospitals.

Protect Medicaid Act This bill prohibits federal payment under Medicaid for the administrative costs of providing health benefits to noncitizens who are ineligible for Medicaid based on their immigration status. The Department of Health and Human Services must report on specified information regarding states that provide health benefits to such individuals.

Historic Tax Credit Growth and Opportunity Act of 2019 This bill increases the rehabilitation tax credit and modifies certain requirements for the credit. The bill increases the rate of the credit to 30% for smaller projects (rehabilitation expenditures not exceeding $3.75 million) and caps the credit for such projects at $750,000 for all taxable years. The bill also allows taxpayers to transfer all or a portion of the credits that are allowable for smaller projects. The bill expands the types of buildings eligible for rehabilitation by decreasing the rehabilitation threshold from 100% to 50% of project expenses. It also eliminates the basis adjustment requirement for the credit and modifies rules relating to the eligibility of tax-exempt use property for the credit.

Physical Therapist Workforce and Patient Access Act of 2019 This bill makes the provision of physical therapy services a profession eligible for the National Health Service Corps (NHSC) Loan Repayment Program. The NHSC Loan Repayment Program assists specified health care professionals to repay eligible student loans in exchange for providing services in areas with limited access to health care.

Nuclear Waste Policy Amendments Act of 2019 This bill addresses the storage and disposal of nuclear waste. Among other things, the bill directs the Department of Energy (DOE) to initiate a program to consolidate and temporarily store commercial spent nuclear fuel during the development, construction, and operation of a permanent nuclear waste repository; addresses federal land withdrawal and related management issues, including the permanent withdrawal of specific federal land for repository use by DOE; updates the Nuclear Regulatory Commission licensing process and conditions for the permanent repository; limits activities relating to developing a separate defense waste repository used for storing high-level radioactive waste and spent nuclear fuel derived from the atomic energy defense activities of DOE; authorizes DOE to enter into agreements to provide benefits to state, local, and tribal governments that might host or be affected by facilities related to storing nuclear waste; revises the method by which DOE funds its nuclear waste management activities though the collection and usage of the Nuclear Waste Fund; creates an Office of Spent Nuclear Fuel within DOE; and requires DOE to establish a Stranded Nuclear Waste Task Force to study existing resources and funding for communities that contain stranded nuclear waste and develop economic adjustment plans for such communities.

Lowering Prescription Drug Costs and Extending Community Health Centers and Other Public Health Priorities Act This bill addresses prescription drugs and extends several health care, research, and workforce programs. Currently, a generic drug manufacturer is awarded 180 days of exclusivity on the market if it is the first applicant to file an application with the Food and Drug Administration (FDA), and the exclusivity period begins upon the first applicant's commercial marketing. The bill authorizes the FDA to approve a subsequent generic drug application prior to the first applicant's first date of commercial marketing if certain conditions are met. The bill prohibits a brand-name, generic, or biosimilar drug manufacturer from entering into certain agreements to resolve or settle a patent infringement claim in connection with the sale of a drug or biological product. Such an agreement, with specified exclusions, is a violation of the bill if the filer of the subsequent generic application receives something of value and agrees to limit or forego research, development, manufacturing, marketing, or sales of the generic drug or biological product. The developer of a drug or biological product, such as a generic or biosimilar version of a drug, may bring a civil action against the license holder of an approved drug if the holder has declined to make available sufficient quantities of the approved drug for the developer's testing. The bill also extends several health care, research, and workforce programs, including the National Health Service Corps, through FY2020.

Purple Heart Freedom to Work Act This bill increases the monthly income limit that is used to determine whether certain Purple Heart recipients are eligible for Social Security Disability Insurance (SSDI) benefits. Specifically, when making such determinations with respect to Purple Heart recipients who are entitled to SSDI benefits based on combat-related injuries, the Social Security Administration must use the limit that applies to individuals who are blind rather than the lower limit that applies to other SSDI recipients. In addition, the bill phases out SSDI benefits for these Purple Heart recipients, with benefits reduced by $1 for every $4 of earnings in excess of the limit.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).

Better Respiration through Expanding Access to Tele-Health Act or the BREATHE Act This bill requires the Centers for Medicare & Medicaid Services to establish a pilot program in which qualifying respiratory therapists may provide telehealth services under Medicare. Specifically, the program must allow respiratory therapists to provide telehealth disease management services (e.g., smoking cessation counseling) for individuals with chronic obstructive pulmonary disease.

Gold Star Family Tax Relief Act This bill treats certain military survivor benefits that are received by children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the benefits from such tax.

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.
