Keep Infant Formula Safe and On the Shelves Act of 2022 This bill requires the Food and Drug Administration (FDA) to periodically inspect infant formula manufacturing facilities and addresses related issues. The FDA must periodically conduct inspections, including unannounced inspections, of infant formula manufacturer facilities. If the FDA makes a notable regulatory finding at such a facility, the manufacturer must undergo a comprehensive food safety audit that includes a root cause analysis, enhanced testing, and comprehensive environmental samples. A manufacturer of infant formula or essential medical food must notify the FDA no later than five business days after becoming aware of circumstances that could lead to a shortage of the relevant product in the United States. Further, the FDA must create and annually update a list of U.S. manufacturing facilities that could be converted to manufacture infant formula during a shortage. In the event of a shortage, the FDA may require infant formula manufacturers to provide certain information, such as the quantity of formula in a manufacturer's inventory. The bill also establishes under statute that food, including infant formula, is a critical material essential to the national defense and therefore subject to authorities under the Defense Production Act of 1950. (Such authorities authorize the President to take various actions, such as requiring businesses to prioritize certain government contracts and incentivizing the domestic industrial base to expand the production of critical materials.) The Occupational Safety and Health Administration must issue a fact sheet and provide technical assistance to infant formula manufacturers to promote compliance with occupational health and safety standards.

Protecting Our Kids Act This bill makes various changes to federal firearms laws, including to establish new criminal offenses and to expand the types of weapons and devices that are subject to regulation. Among the changes, the bill generally prohibits the sale or transfer of certain semiautomatic firearms to individuals who are under 21 years of age; establishes new federal criminal offenses for gun trafficking and related conduct; establishes a federal statutory framework to regulate ghost guns (i.e., guns without serial numbers); establishes a framework to regulate the storage of firearms on residential premises at the federal, state, and tribal levels; subjects bump stocks to regulation under federal firearms laws; and generally prohibits the import, sale, manufacture, transfer, and possession of large capacity ammunition feeding devices.

Affordability is Access Act This bill establishes several requirements relating to health insurance coverage of, and access to, over-the-counter contraceptives. Specifically, the bill requires the Department of Health and Human Services, the Department of Labor, and the Department of the Treasury to specify that private health insurance plans must cover over-the-counter contraceptives that are approved by the Food and Drug Administration (FDA), even without a prescription. Under current law, private health insurance plans (with some exceptions) must cover FDA-approved prescription contraceptives, without cost-sharing requirements. The bill also prohibits retailers from interfering with an individual's access to oral contraceptives that are meant for routine, daily use and are FDA-approved for use without a prescription.

Competition and Transparency in Digital Advertising Act This bill limits certain large digital advertising companies from owning multiple types of advertising exchanges or brokerages and imposes certain duties with respect to the interests of the customers of such brokerages. Advertising exchanges and brokerages generally facilitate advertisers and publishers in buying and selling advertising inventory through an automated bidding process. Specifically, companies with more than $20 billion in annual digital advertising revenue are prohibited from owning more than one type of service within the digital advertising marketplace. For example, a company, such as Google, may not own a digital advertising exchange and provide software that assists publishers of online advertisements in selling advertising space on their websites. Additionally, companies with more than $5 billion in annual digital advertising revenue that provide brokerage services to buyers or sellers of digital advertisements must act in the best interest of their brokerage customers. The bill also establishes transparency and privacy requirements for such brokerages. The bill provides for enforcement of these requirements by the Department of Justice, state attorneys general, and private right of action.

Justice for Victims of War Crimes Act This bill broadens the scope of individuals who are subject to federal prosecution for war crime offenses. Currently, the federal war crimes statute provides federal jurisdiction over war crime offenses committed anywhere (i.e., inside or outside the United States) if the victim or offender is a member of the Armed Forces or a U.S. national. First, this bill extends federal jurisdiction over war crime offenses committed anywhere to offenses where (1) the victim or offender is an alien lawfully admitted for permanent residence; or (2) the offender is present in the United States, regardless of the nationality of the victim or the offender. Second, the bill expands federal jurisdiction over war crime offenses to include offenses that occur in whole or in part within the United States, regardless of whether the victim or offender is a member of the Armed Forces, a U.S. national, or an alien lawfully admitted for permanent residence.

This resolution supports the goals and ideals of an International Day Against Homophobia, Transphobia, Biphobia, and Intersexphobia. The resolution encourages (1) health care providers to offer culturally and clinically competent care to the lesbian, gay, bisexual, transgender, queer, questioning, intersex, asexual, and agender (LGBTQIA+) community; (2) schools to support the creation of gender and sexuality alliances; (3) individuals to learn about national resources for those who identify as LGBTQIA+; and (4) funding organizations, aid efforts, and governments to prioritize the health and human rights of LGBTQIA+ people.

Access to Baby Formula Act of 2022 This bill authorizes the Department of Agriculture (USDA) to take certain actions to address emergencies, disasters, and supply chain disruptions (particularly the shortage of infant formula in the United States) affecting participants of the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). The bill directs USDA to require each infant formula cost containment contract to include remedies in the event of an infant formula recall, including how an infant formula manufacturer would protect against disruption to WIC participants in the state. USDA must, within 30 days, ensure there is a memorandum of understanding with the Department of Health and Human Services that includes procedures for coordination and information sharing regarding any supply chain disruption, including a supplemental food recall. The bill also authorizes USDA to waive or modify any WIC qualified administrative requirement during emergencies, disasters, and supply chain disruptions. Specifically, USDA may waive or modify such a requirement for one or more state agencies if (1) the requirement cannot be met by state agencies during the emergency, disaster, or disruption; and (2) the modification or waiver is necessary to provide assistance to WIC participants and does not substantially weaken the nutritional quality of supplemental foods. For example, USDA may waive the maximum monthly allowance for infant formula. The bill establishes notification requirements for USDA and state agencies related to supply chain disruptions.

Price Gouging Prevention Act of 2022 This bill generally makes it unlawful to sell or offer for sale a good or service at an unconscionably excessive price during an exceptional market shock. The bill also provides additional funding to the Federal Trade Commission.

Wage Theft Prevention and Wage Recovery Act This bill requires employers to make initial and modified disclosures to employees of the terms of their employment, provide such employees with regular paystubs, and make a final payment to an employee for uncompensated work hours within 14 days of the employee's termination. Employers must also allow employees access to wage records. An employer must compensate an employee at the rate specified in an employment contract, including a collective bargaining agreement, that specifies a rate of pay higher than the minimum wage rate. The bill makes all of such unpaid wages recoverable through civil enforcement. The bill establishes new and increased civil and criminal penalties for violations of overtime or minimum wage requirements, including referral to the Department of Justice for criminal prosecution of employers who engage in wage theft, falsification of wage records, or retaliation against employees. The Wage and Hour Division of the Department of Labor must provide grants to specified organizations, including nonprofits and educational institutions, to enhance the enforcement of wage and hour laws. The Government Accountability Office must study and report on successful grant programs.

Consumer Fuel Price Gouging Prevention Act This bill prohibits any person from selling, during a proclaimed energy emergency, a consumer fuel at a price that (1) is unconscionably excessive, and (2) indicates that the seller is exploiting the emergency to increase prices unreasonably. The President may issue a proclamation of such an emergency that specifies the consumer fuel and geographic area covered and how long the proclamation applies. The bill provides for enforcement of these provisions by the Federal Trade Commission and state attorneys general. Civil penalties collected by the commission through such enforcement must be used to provide assistance under the Low Income Home Energy Assistance Program.

International Press Freedom Act of 2022 This bill establishes programs to address international threats to press freedom and allows qualifying threatened journalists to be admitted into the United States. The bill establishes an Office on International Press Freedom within the Department of State. The office's duties shall include (1) advocating for freedom of the press and freedom of expression abroad, (2) advising on U.S. policy on advancing such freedoms abroad, and (3) representing the United States in matters relating to such freedoms. The bill also establishes the At-Risk Journalists Fund. The State Department shall use the fund to support journalists operating in restrictive environments and provide emergency assistance to journalists who have been threatened. If the assistance provided through the fund is insufficient to protect the safety of an alien journalist who has been threatened, the journalist may receive a foreign media nonimmigrant visa upon meeting certain qualifications. The State Department must prioritize the review of a visa application for such a threatened journalist. Similarly, the Department of Homeland Security must consider providing humanitarian parole to threatened journalists and provide an admission preference to certain threatened journalists (generally if the journalist's life or safety is at risk and if paroling the journalist would further U.S. foreign policy or national security interests). The Department of Justice must provide training to all officials adjudicating refugee cases about issues involving freedom of the press. The State Department must also provide training on such issues to certain Foreign Service officers working overseas.

Pride in Mental Health Act This bill expands programs that prevent and treat child abuse and neglect to address issues facing youth who are lesbian, gay, bisexual, transgender, queer or questioning, nonbinary, or gender-variant members of indigenous communities (e.g., Two Spirit). Specifically, these programs include (1) research and reporting requirements, (2) providing technical assistance, (3) grants to states and local agencies to train child-welfare personnel, and (4) community-based prevention-service grants. The bill also establishes a grant program to provide mental and behavioral health resources for such youth, including trauma-informed care.

Childhood Cancer Survivorship, Treatment, Access, and Research Reauthorization Act of 2022 or the Childhood Cancer STAR Reauthorization Act This bill reauthorizes through FY2028 and modifies pediatric cancer research and related programs, including to expand collection of and access to relevant biospecimens and to support the transition of pediatric cancer survivors to primary care.

Advancing Equity Through the Arts and Humanities Act of 2022 This bill establishes an Advancing Equity Through the Arts and Humanities Program to increase engagement with public and nonprofit entities (including faith-based and community-based organizations that serve and are led by people of color) in supporting arts and humanities projects that directly combat systemic racism through the arts and humanities. The National Endowment for the Arts and the National Endowment for the Humanities shall carry out this program. The bill also provides for a competitive grant program for the creation and expansion of programs to support public and nonprofit arts and humanities organizations that directly combat systemic racism through the arts and humanities.

Oil and Gas Industry Antitrust Act This bill requires the Federal Trade Commission to investigate and report on whether the price of gasoline is being manipulated by reducing refinery capacity or by any other form of market manipulation. The report must include a long-term strategy for the commission and Congress to address manipulation of oil and gas markets during times of national or international crisis or emergency.

Help for Healing Communities Act This bill establishes a program through which the Substance Abuse and Mental Health Services Administration may award grants to support mental and behavioral health services for survivors of active shooter events and incidents of targeted violence. Eligible grant recipients include state, tribal, territorial, and local governments and nonprofits located in or serving a community that experienced an active shooter event or incident of targeted violence in the preceding fiscal year.

Safe Workplaces Act This bill requires the Occupational Safety and Health Administration (OSHA) to promulgate an occupational safety and health standard on reducing the threat of workplace violence, including firearm violence. Additionally, the National Institute for Occupational Safety and Health must study and make recommendations about ways to reduce workplace violence. OSHA must consider those recommendations when promulgating the workplace safety and health standard.

Targeting Resources for Equitable Access to Treatment for Long COVID Act or the TREAT Long COVID Act This bill requires the Department of Health and Human Services to award competitive grants to create or expand the capacity of clinics that treat patients with persistent, long-term symptoms following recovery from acute COVID-19 (i.e., Long COVID). Eligible recipients include federally qualified health centers, rural health clinics, urban Indian health centers, and state and local health departments.

Educators Expense Deduction Modernization Act of 2022 This bill increases the tax deduction for the expenses of eligible educators from $250 to $1,000, An eligible educator is, with respect to any taxable year, an individual who is a kindergarten through grade 12 teacher, instructor, counselor, principal, or aide in a school for at least 900 hours during a school year.

This bill prohibits using federal funds to support or facilitate (1) Russia's participation in a Group of Seven (G-7) proceeding, or (2) a reconstituted Group of Eight (G-8) that includes Russia. (The G-7 is an informal group consisting of seven of the world's largest advanced economies. In 2014, the G-8 became the G-7 when Russia 's membership was suspended following Russia's annexation of the Crimea region of Ukraine.)

Children's Act for Responsible Employment and Farm Safety of 2022 or the CARE Act of 20 22 This bill revises labor provisions for protecting child workers, including those employed in agriculture, and increases the civil penalties for violations of such provisions and imposes new criminal penalties for violations resulting in the death or serious injury or illness of a child worker. Specifically, the bill revises the definition of oppressive child labor to prohibit the employment of children under 14 years of age and imposes new employer reporting requirements for work-related injuries or deaths of agricultural employees under the age of 18. The Department of Labor must analyze, collect, and report on data concerning children under the age of 18 who are employed in agriculture and each work-related injury, illness, or death of any such child. Labor must also revise regulations to prohibit the employment of a child under the age of 18 as a pesticide handler.

Equitable Community Access to Pharmacist Services Act This bill expands Medicare coverage to permanently include services provided by a pharmacist, including incidental services and supplies, related to testing, drug regimens, and vaccines for COVID-19, influenza, and certain other illnesses. Specifically, the bill provides for continued coverage of pharmacist services relating to testing and vaccines for COVID-19 and influenza, as well as coverage of testing for respiratory syncytial virus and streptococcal pharyngitis (i.e., strep throat) and the initiation of drug regimens that are used to treat COVID-19, influenza, or strep throat. It also generally provides for coverage of pharmacist services during a public health emergency or to address health equity. A pharmacist, or the facility with which the pharmacist is contracted or employed, may present a claim for reimbursement of 85% (or 100% during a declared emergency) of the applicable amount. A pharmacist may not bill an individual for such a service other than for the applicable deductible or coinsurance amounts.

Federal Contracting for Peace and Security Act This bill requires executive agencies to terminate their contracts with companies conducting business operations in Russia. This requirement ends when Russia takes steps to restore the safety, sovereignty, and condition of Ukraine. The bill shall not apply to the procurement of products or services for (1) the benefit, either directly or through the efforts of regional allies, of Ukraine; or (2) humanitarian purposes to meet basic human needs. The bill provides for a waiver where in the national interest of the United States.
