Overdraft Protection Act of 2021

United States · United States Congress · 30 June 2021

Overdraft Protection Act of 2021 This bill prohibits a financial institution from engaging in unfair or deceptive acts in connection with overdraft coverage. Each financial institution that offers overdraft coverage for accounts must disclose overdraft coverage fees. It must also disclose that the consumer's transaction may be declined if there are insufficient funds in the related account, and the consumer will not be charged a fee if such transaction is declined. A financial institution must provide certain other disclosures regarding its overdraft protection program, including prompt notification of the account's overdraft status. The bill limits the number of overdraft fees a consumer may be charged each month and year, and provides that such fees must be reasonable. The bill prohibits an overdraft coverage fee if the overdraft results solely from a debit hold amount that exceeds the actual dollar amount of the transaction. The bill also prohibits a financial institution from charging a non-sufficient fund fee for any automated teller machine or debit card transaction, or reporting negative information regarding consumer use of overdraft coverage to any consumer reporting agency when the overdraft amounts and coverage fees are paid under the terms of an overdraft coverage program.

Saving America's Pollinators Act of 2021 This bill addresses the use of certain pesticides and the health and status of native bees and other pollinators. First, the bill requires the Environmental Protection Agency (EPA) to establish a Pollinator Protection Board to develop an independent review process for pesticides that pose a threat to pollinators and their habitats. All active ingredients and pesticide products that contain one or more specified neonicotinoid pesticides must be deemed to generally cause unreasonable adverse effects to the environment. Under the bill, the registration of all uses of neonicotinoid pesticides must be immediately and permanently canceled. The EPA must revoke any tolerance or exemption that allows the presence of a neonicotinoid pesticide, or any pesticide chemical residue that results from neonicotinoid pesticide use, in or on food. The continued sale or use of existing stocks of neonicotinoid pesticides is prohibited, and the EPA may not register any such pesticides under the Federal Insecticide, Fungicide and Rodenticide Act. The bill requires the Department of the Interior, the EPA, and the Department of Agriculture to coordinate monitoring activities and report on the health and population status of native bees and other pollinators. Finally, a state or federal agency may be granted an exemption to use neonicotinoid pesticides if the board votes that use of the pesticide is warranted (1) in an emergency situation to avert significant risk to threatened or endangered species, (2) to quarantine invasive species, or (3) to protect public health.

Clean Water Standards for PFAS Act of 2021 This bill directs the Environmental Protection Agency (EPA) to develop requirements and incentives to limit the discharge of perfluoroalkyl and polyfluoroalkyl substances (PFAS) into certain waters of the United States. PFAS are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing. The water quality criteria must determine how much of these substances can be present in water before it is likely to harm human health. Within four years, the EPA must publish a final rule that establishes, for each priority industry category specified in the bill, effluent limitations guidelines and standards for the discharge of each measurable perfluoroalkyl substance, polyfluoroalkyl substance, and class of PFAS. Under the Clean Water Act, effluent limitations restrict the quantities, rates, and concentrations of chemical, physical, biological, and other constituents which are discharged from point sources (e.g., a discernible source such as a pipe) into navigable waters, the ocean, or other specified waters. Conrad State 30 and Physician Access Reauthorization Act

United States · United States Congress · 25 May 2021

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program for three years from this bill's enactment. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.
