Recognizes: (1) that the United States has an affirmative duty to care for the men and women who have so served; and (2) the efforts of the National Association of State Veterans Homes in providing veterans with high-quality care. Commends efforts made by state veterans homes for the past 120 years in ensuring that veterans receive the highest quality of care worthy of their sacrifices.

Small Business Energy Emergency Relief Act of 2008 - Amends the Small Business Act to authorize the Small Business Administration to make disaster loans to assist small businesses that have suffered or are likely to suffer substantial economic injury as the result of a significant increase in the price of heating fuel occurring on or after October 1, 2007. Prohibits such loan from being made if the total amount outstanding and committed to the borrower would exceed $1.5 million, unless the borrower is a major source of employment in its surrounding area. Amends the Consolidated Farm and Rural Development Act to authorize the Secretary of Agriculture to make loans to farm operations that qualify as a small business and that have or are likely to suffer substantial economic injury on or after October 1, 2007, as the result of a significant increase in energy costs in connection with an energy emergency declared by the President or the Secretary.

Mental Health for Heroes' Families Act of 2008 - Removes the requirement that, in order for family members of a veteran being treated in a Department of Veterans Affairs (VA) hospital for a non-service-connected disability to be eligible for counseling, training, and mental health services in connection with the veteran's treatment: (1) such services must have been initiated during the veteran's hospitalization; and (2) the continued provision of such services on an outpatient basis is essential to permit the veteran's discharge from the hospital.

Renewable Energy Jobs and Security Act - Amends the Federal Power Act to direct the Federal Energy Regulatory Commission (FERC) to propose rules establishing standards for the physical connection between specified types of renewable energy facilities and transmission facilities of transmitting utilities subject to FERC jurisdiction. Requires such standards to: (1) include separate expedited procedures for interconnecting 10-kilowatt maximum renewable energy facilities and for expediting interconnection for 2000-kilowatt maximum facilities; and (2) address safety, reliability, performance, cost, and network upgrades. Allows FERC to consider a clustering approach that allows concurrent interconnection of facilities where requests are placed within succeeding six-month periods. Amends the the Public Utility Regulatory Policies Act of 1978 to require each electric utility to: (1) adopt standards for interconnection with renewable energy facilities as are necessary to ensure that renewable energy facilities are given priority interconnection and priority access to available capacity on the utility's transmission and distribution system over non-renewable energy facilities; and (2) permit any renewable energy facility to apply to the state regulatory authority for an order requiring the interconnection of such facility with the system of the utility. Requires the Secretary of Energy to transmit to Congress and to the Commission a report that spatially maps national renewable energy resources and conducts cost assessments for renewable energy facility development with respect to all available technologies. Requires FERC to prescribe rules to encourage the purchase of electric energy by public utilities from renewable energy facilities on a priority basis, under a standard contract, and at rates established on a uniform national basis by FERC. Provides procedures for the setting and adjusting of such rates and for application of net metering. Requires reports concerning interconnection of renewable energy facilities by utilities to the Energy Information Administration and by the Secretary to Congress and the public. Requires FERC to design a regional cost redistribution mechanism consisting of a system benefits charge payable by every end-use consumer of an electric utility to the utility, to be transferred to a national renewable energy corporation for reimbursement of the costs associated with this Act's interconnection and power purchase requirements.

Medical Device Safety Act of 2008 - Amends the Federal Food, Drug, and Cosmetic Act to provide that provisions preempting state and local requirements for medical devices intended for human use shall not be construed to modify or otherwise affect any action for damages or the liability of any person under state law. Makes this Act effective as if it were included in the Medical Device Amendments of 1976 and applicable to any civil action pending or filed on or after the date of enactment of this Act.

Recognizes the essential role played by Landing Ship Tanks (LSTs) during World War II, the Korean war, the Vietnam war, Operation Desert Shield, Operation Desert Storm, and many other military and humanitarian operations. Honors the service of the Navy and Coast Guard sailors who served their country aboard the LSTs. Acknowledges the debt modern amphibious operations owe to the LST sailors and ships. Commends the many volunteers of the USS LST Ship Memorial who have preserved the LST 325 as a living memorial in honor and remembrance of the ships and veterans in their service.

Recognizes that respect for human rights is a fundamental value and that the bilateral relationship between the United States and Egypt should be a platform for promoting the rule of law and fundamental freedoms. Calls on the Egyptian government to: (1) respect human rights, minority rights, and freedoms of religion and expression; and (2) release Ayman Nour and all political activists. Welcomes Egypt's efforts to secure the border with Gaza and fight smuggling. Urges the President and the Secretary of State to put human rights and religious freedom developments in Egypt very high on the U.S. government's agenda during meetings with Egyptian officials.

Responsive Government Act of 2008 - Amends the federal judicial code to authorize the chief judge of a district or court of appeals to delay, toll, or otherwise grant relief from time deadlines applicable to pending civil and criminal cases in the event of a natural disaster or other emergency situation requiring the closure of courts or rendering it impracticable to comply with such deadlines. Grants the Director of the United States Patent and Trademark Office authority to: (1) waive statutory provisions governing the filing, processing, renewal, and maintenance of patents, trademark registrations, and patent and trademark applications in certain emergencies; and (2) accept late application filings for patent extensions in certain cases of unintentional delay. Prescribes filing fees for patent extensions, including: (1) $65 million for an anticoagulant drug intended for use in humans; and (2) a formula for other items.

Establishes in the Executive Office of the President the position of White House Coordinator for Iraqi Refugees and Internally Displaced Persons who shall: (1) develop and implement U.S. policies, and coordinate federal functions, to address the protection, resettlement, and assistance needs of Iraqi refugees and displaced persons; (2) monitor the development and implementation of assistance strategies to countries in the Middle East hosting Iraqi refugees; (3) ensure that the President's budget requests to Congress are sufficient to meet the needs of such persons, including providing assistance for international efforts on behalf of such persons; (4) serve as principal liaison with the government of Iraq and the international community and organizations that are assisting such persons; and (5) ensure that the U.S. government will encourage refugee returns only when conditions permit safe and voluntary returns.

Energy Markets Anti-Manipulation and Integrity Restoration Act - Amends the Commodity Exchange Act to give the Commodity Futures Trading Commission (CFTC) jurisdiction over energy derivatives traded on or through a board of trade, exchange, or market, either domestic or foreign.

Prevent Unfair Manipulation of Prices Act of 2008 - Amends the Commodity Exchange Act (CEA) to extend the regulatory authority of the Commodity Futures Trading Commission (CFTC) to certain transactions in derivatives involving specified energy commodities ("included energy transactions"), including those on foreign boards of trade. Defines "included energy transaction" as a contract, agreement, or transaction in an energy commodity for future delivery that: (1) provides for a delivery point in the United States; or (2) is transacted on a computer terminal located in the United States. Prohibits the CFTC from exempting from regulation any "included energy transaction" unless certain notice to Congress and public comment requirements are met. Declares null and void any CFTC "no-action letter" exemptions from CEA requirements for "included energy transactions." Requires the CFTC to establish uniform limits on the aggregate number of positions with respect to "included energy transactions" which may be held by any person for the prompt month, for each month, and for all months in all markets subject to CFTC jurisdiction. Excludes swaps involving "included energy transactions" from any CEA exemption for bona fide hedging transactions. Defines "bilateral included energy transaction" as an included energy transaction executed or traded other than on or through a trading facility. Exempts such transactions from the requirement that transactions be made on or through a designated contract market. Applies to "bilateral included energy transactions" certain reporting and recordkeeping requirements. Instructs the CFTC to publish monthly on its website: (1) the aggregate number and value of long and short positions held by a person in any portfolio constructed to match or track the components of an index of all commodities; and (2) the portion of the positions that are net long positions in "included energy transactions." Amends the Natural Gas Act and the Federal Power Act to set forth enforcement powers of the Federal Energy Regulatory Commission (FERC), including cease-and-desist proceedings, temporary orders, and general implementation authority.

Reaffirms the historic commitment of the United States as a nation founded by refugees. Calls on: (1) the Department of State to support the refugee assistance efforts of the United Nations High Commissioner for Refugees and of nongovernmental organizations; (2) the U.S. government to continue its international leadership role in response to the people of the Darfur region of Sudan who have been displaced by Sudan's genocide; and (3) the Department of State and the Department of Homeland Security to facilitate the resettlement of an appropriate number of Darfuris. Urges the parties to the conflicts in and between Chad and Sudan to conclude a cessation of hostilities agreement. Calls upon the Joint African Union-United Nations Special Representative for Darfur to ensure that displaced persons are fairly represented in peace negotiations. Affirms the goals of World Refugee Day and reiterates a strong commitment to protecting the millions of refugees who live without material, social, and legal protections.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.

Amends the Commodity Exchange Act to make it unlawful for a person to enter into or execute an otherwise excluded swap transaction or exempt transaction involving crude oil, heating oil, gasoline, or diesel fuel (specified energy commodity), unless the person has been certified by the Commodities Future Trading Commission (CFTC) as having the capacity of accepting physical delivery of the commodity. Makes it unlawful, as well, for any person to hold a contract or agreement of sale of a specified energy commodity for future delivery, which is otherwise an excluded swap transaction or an exempt transaction, unless the CFTC has certified that the person has the capacity to produce or manufacture the commodity.

Next Steps for Haiti Act of 2008 - Authorizes the Director of Foreign Assistance, in consultation with the government of Haiti and Haitian civil society organizations, to establish the Haiti Professional Exchange Program whose purpose shall be to assign qualified Haitian Americans and others to provide technical assistance to help Haiti improve in areas vital to its growth and development, including education, energy, environment, health care, infrastructure, security, transportation, and disaster preparedness. Requires that the Director establish an outreach program to encourage Exchange Program participation. Sets forth Program provisions. Authorizes appropriations.

Responsible Federal Oil and Gas Lease Act - Prohibits the Secretary of the Interior from authorizing any new lease for exploration or production of oil or natural gas unless the lessee: (1) certifies for each existing lease that the lessee has diligently developed the lands in order to produce oil or natural gas, or is producing oil or natural gas from such lands; or (2) has relinquished all federal oil and gas leases that are not being diligently developed. Instructs the Secretary to promulgate diligent development regulations that: (1) include benchmarks for oil and gas development to ensure that leaseholders produce oil and gas from each lease within the five-year original term of the lease; and (2) require each leaseholder to submit a diligent development plan showing how the lessee will meet the benchmarks. Establishes a civil penalty for noncompliance with this Act. Amends the Outer Continental Shelf Lands Act, the Mineral Leasing Act, and the Mineral Leasing Act for Acquired Lands Act to set forth lease terms for an initial period of five years, renewable for additional one-year periods, subject to specified conditions.

Recognizes the need to promote equality and continue to work toward eliminating racial discrimination in the United States and Brazil. Commends Secretary of State Condoleezza Rice and Brazilian Minister of Racial Integration Edson Santos for signing the "Joint Action Plan Between the Government of the Federative Republic of Brazil and the Government of the United States of America to Eliminate Racial and Ethnic Discrimination and Promote Equality." Supports continued U.S. involvement in the United States-Brazil Joint Action Plan Against Racial Discrimination through funding. Encourages specified U.S. participation in the United States-Brazil Steering Group on Equality of Opportunity. Urges that the private sector, civil society, and experts on race relations and other relevant topics be considered as part of the Steering Group Advisory Board.

Urges: (1) the members of the international community, including the United States, that possess the capability to expeditiously provide the tactical and utility helicopters needed for the United Nations-African Union peacekeeping mission in Darfur to do so as soon as possible; (2) the President to personally ask other heads of state to contribute aircraft and crews for the Darfur mission; and (3) the Department of State to organize a special meeting of the U.N. Security Council, the Friends of UNAMID working group, and the U.N. Department of Peacekeeping Operations to resolve outstanding force and equipment issues.

Trade Reform, Accountability, Development, and Employment Act of 2008, or the TRADE Act of 2008 - Directs the Comptroller General of the United States to: (1) review biennially certain free trade agreements (including Uruguay Round Agreements) between the United States and foreign countries; and (2) report to the Congressional Trade Agreement Review Committee regarding such agreements, including analyses of specified subjects and of each agreement, as well as whether the country has a democratic form of government that respects certain core labor rights and fundamental human rights, protects intellectual property rights, and enforces environmental laws. Declares that implementing bills of new trade agreements shall not be subject to expedited consideration or special procedures limiting amendment,unless such agreements include certain standards with respect to: (1) labor; (2) environment and public safety; (3) food and product health and safety; (4) provision of services; (5) investment; (6) procurement; (7) intellectual property; (8) agriculture; (9) trade remedies and safeguards; (10) rules of origin; (11) dispute resolution and enforcement; (12) technical assistance; (13) national security; and (14) taxation. Requires the President to submit to Congress a plan for the renegotiation of existing trade agreements to bring them into compliance with such standards. Establishes a Congressional Trade Agreement Review Committee. Expresses the sense of Congress that: (1) certain requirements urging the attainment of certain trade goals shall apply to all existing and new trade agreements; and (2) a certain process for U.S. trade negotiations should be followed when Congress considers legislation providing special procedures for implementing bills of trade agreements.

Authorizes the National District Attorneys Association to use the National Advocacy Center in Columbia, South Carolina, for a training program to improve the professional skills of state and local prosecutors and to enhance the ability of federal, state, and local prosecutors to work together. Authorizes the National Advocacy Center to provide comprehensive legal education in trial practice, provide substantive legal updates, and support staff training.

National Silver Alert Act - Directs the Attorney General to: (1) establish a national Silver Alert communications network to assist regional and local search efforts for missing seniors; (2) assign a Department of Justice officer to serve as the Silver Alert Coordinator to coordinate the network with states; and (3) award grants to states for support of Silver Alert plans and the network. Defines "missing senior" as any individual who is reported as missing to or by a law enforcement agency and who meets state requirements for designation as a missing senior. Directs the Coordinator to: (1) establish minimum standards for the issuance of, and the extent of the dissemination of, alerts issued through the network; and (2) make available to states, local governments, law enforcement agencies, and other concerned entities network training and information.

Calls on the governments of the United States and Iraq to work together in easing the suffering of the refugees and internally displaced persons. Suggests that the Iraqi Government significantly augment its contribution to efforts on behalf of this displaced population. Requests that Iraqi Prime Minister al-Maliki propose in his supplemental budgetary request to the Iraqi Parliament in June 2008 that $1 billion be dedicated to meeting the needs of this community. Requests that the Iraqi Parliament accept this budgetary request.

Polar Bear Seas Protection Act - Amends the Outer Continental Shelf Lands Act to prohibit the Secretary of the Interior from offering or approving any new lease, or approving an exploration or development plan, within any area of the Chukchi or Beaufort Sea marine and coastal ecosystems until: (1) the National Research Council reports to Congress on certain missing information regarding the composition, distribution, status, and ecology of the living marine resources in such ecosystems; (2) the polar bear is listed as either an endangered or threatened species under the Endangered Species Act of 1973 and critical habitat is designated for it; (3) the Secretary performs an oil spill response gap analysis for proposed and existing arctic oil operations; and (4) the Secretary makes specified determinations, including that oil and gas exploration and development can be conducted in the Beaufort and Chukchi Sea Planning Areas without posing a risk of substantial adverse impact to wildlife, or wildlife habitat and subsistence.

Declares that the United States, through the International Whaling Commission, should: (1) use all appropriate measures to end commercial whaling, including scientific, special permit, coastal, and community-based whaling; (2) oppose any initiative that would result in any new, Commission-sanctioned coastal or community-based whaling, even if it is portrayed as noncommercial, including commercial whaling by coastal communities that does not qualify as aboriginal subsistence whaling; and (3) seek to strengthen conservation and management measures.

Amends the Immigration and Nationality Act to include among those aliens not subject to worldwide numerical immigrant limitations persons who have earned a master's or higher degree from a U.S. institution of higher education in science, technology, engineering, or mathematics and who have an employment offer from a U.S. employer in a field related to such degree.

Gas Price Spike Act of 2008 - Amends the Internal Revenue Code to impose a windfall profit tax on crude oil, natural gas, or products of crude oil or natural gas. Defines "windfall profit" as so much of the profit on a sale of crude oil, natural gas, or related products as exceeds a reasonable profit. Establishes the Reasonable Profits Board to determine levels of reasonable profit from the sale of such products. Allows a tax credit for the purchase of certain fuel-efficient, American-made passenger vehicles. Authorizes the Secretary of Transportation to make grants to operators of mass transit systems, including bus and commuter rail systems, to reduce passenger fares on such systems.

Expresses the sense of Congress that in the context of the current global food crisis the nutritional needs of children must be a humanitarian priority. States that Congress: (1) recognizes that we are facing a global food crisis caused by, among other things, rising fuel prices, increased diversion of land to biofuel production, drought, and population increases; and (2) calls for a world forum to be held on the issue of rising food prices and international response and for the United States to play an active role in alleviating the crisis.

Creates, for veterans who were subjected to certain chemical or biological warfare testing involving Project 112 conducted through Deseret Test Center (including the Shipboard Hazard and Defense Project, also known as Project SHAD), a presumption that a disease was incurred in or aggravated by service, notwithstanding that there is no record of evidence of the disease during the period of service, if the disease warrants presumtion of service connection by reason of increased exposure to a biological, chemical, or other toxic agent.

Veterans Disability Benefits Claims Modernization Act of 2008 - Revises or adds provisions relating to the disability compensation system of the Department of Veterans Affairs (VA) to: (1) require a study on adjusting the schedule for rating veterans' disabilities; (2) establish the Advisory Committee on Disability Compensation; (3) require a study on the employee work credit system of the VA's Veterans Benefits Administration (VBA); (4) require a study on the VBA's work management system; (5) require the certification and training of VBA employees responsible for processing claims; (6) require an annual independent assessment of the VBA's quality assurance program; (7) provide for the expedited VBA treatment of fully developed claims and a checklist for individuals submitting incomplete claims; (8) require a study of the VBA's need to employ additional medical professionals to act as a medical reference for employees handling claims; (9) provide for the assignment of partial disability ratings to certain veterans; (10) require a review and revision of VBA use of information technology; and (11) allow a claim beneficiary to be substituted as a claimant in the case of the death of a veteran claimant while a claim is awaiting adjudication or appeal. Requires the Chief Judge of the U.S.Court of Appeals for Veterans Claims to report annually to the congressional veterans' committees on the Court's workload. Revises provisions concerning the jurisdiction and finality of decisions of the Court.

Recognizes: (1) on its 60th anniversary year the Universal Declaration of Human Rights as a singular achievement of the community of nations; and (2) the contribution in the Declaration of Independence and the U.S. Constitution to the development of the Universal Declaration of Human Rights. Urges all U.N. member states to uphold the principles of human dignity enshrined in the Universal Declaration of Human Rights, especially on behalf of the world's most vulnerable persons.
