Servicemember Family Protection Act - Amends the Servicemembers Civil Relief Act to provide that if a court renders a temporary order for custodial responsibility for a child based solely on a deployment or anticipated deployment of a parent-servicemember, then the court shall require that upon the return of that servicemember from deployment the custody order that was in effect preceding such deployment shall be reinstated, unless the court finds that reinstatement in not in the child's best interest. Prohibits a servicemember's deployment or possible deployment from being considered in the determination of a child's best interest in a motion seeking a permanent order to modify custody. Provides that under a temporary custody order, if a state law provides a higher standard of protection to the deploying parent-servicemember, then the appropriate court shall apply the higher standard.

Insurance Fairness for Amputees Act - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to require a group health plan that provides medical and surgical benefits and also provides benefits for prosthetics and custom orthotics to offer such prosthetics and custom orthotics in the same manner as applicable to medical and surgical benefits. Prohibits separate financial requirements or more restrictive treatment limitations. Requires a health plan that does not provide coverage for benefits outside of a network to ensure that such provider network is adequate to ensure enrollee access to prosthetic and custom orthotic devices and related services provided by appropriately credentialed practitioners and accredited suppliers. Limits coverage for required benefits for prosthetics and custom orthotics to the most appropriate device or component that adequately meets the medical requirements of the patient. Requires benefits to include repair and replacement due to normal wear and tear, irreparable damage, a change in the condition of the patient, or as otherwise determined appropriate by the treating physician. Prohibits any annual or lifetime dollar limitation on benefits for prosthetics and custom orthotics unless such limitation applies in the aggregate to all benefits. Directs the Comptroller General (GAO) to study the effects of the implementation of this Act.

Chesapeake Bay Program Reauthorization and Improvement Act

Chesapeake Bay Program Reauthorization and Improvement Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act or CWA) to establish: (1) financial reporting requirements for restoration activities in the Chesapeake Bay watershed and (2) the Independent Evaluation and Technical Advisory Committee to review and report on restoration activities in the Bay ecosystem and to provide recommendations to the Administrator of the Environmental Protection Agency (EPA) and the Secretary of the Department of Agriculture (USDA) on such activities. Authorizes appropriations for FY2013-FY2018. Requires the Administrator to: (1) complete an economic analysis of each EPA statement (i.e., guidance, policy, memorandum, regulation, or statement of general applicability and future effect that is designed to implement, interpret, or prescribe law or policy relating to water quality in the Bay); and (2) establish technical guidelines to be used by the Chesapeake Bay Nutrient and Sediment Trading Commission in establishing a voluntary interstate nitrogen, phosphorus, and sediment trading program for the Bay. Prohibits such guidelines from applying to agricultural nonpoint sources or nonindustrial private forest lands except to the extent that such guidelines consist of guidelines issued under the Food Security Act of 1985 concerning environmental service markets. Requires a total maximum daily load (TMDL) for nitrogen, phosphorus, or sediment for a segment of the Bay and its tributaries to use timeframes other than daily (such as annual, monthly, or seasonal) for certain economic sectors, including agriculture, in which a nondaily timeframe is appropriate. Authorizes a point source to meet National Pollutant Discharge Elimination System (NPDES) permit limits on nitrogen, phosphorus, or sediment through trade administered by the Chesapeake Bay Nutrient and Sediment Trading Commission. Provides that powers are reserved solely to states to implement a total maximum daily nutrient or sediment load in the Bay. Authorizes, in Bay states that have developed TMDL plans that reduce loading through an iterative process that employs adaptive management principles, NPDES permits to be issued for new or existing point source discharges that include wasteload allocations consistent with such plan and that demonstrate progress towards achieving the wasteload allocation specified in such plan by treatment, trading or other means. Authorizes individuals or entities undertaking land development activities to be permitted to meet requirements for managing stormwater by offsetting such activities through the establishment of equivalent stormwater management practices off-site within the Bay ecosystem. Authorizes Bay states to use funds made available under the nonpoint source management program for activities related to reducing losses of nitrogen, phosphorus, or sediment from agricultural or nonindustrial private forest land through a watershed partnership developed under the Food and Security Act of 1985. Establishes an independent Chesapeake Bay Nutrient and Sediment Trading Commission in the Office of the Chesapeake Bay Program to: (1) administer the nitrogen, phosphorus, and sediment trading program for Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia, and the District of Columbia to ensure that credits are generated to attract market participants and facilitate trading mechanisms among and within such jurisdictions to meet water quality goals; (2) operate a registry for interstate water quality trading; and (3) develop a system to allow for trading to occur between point source and non-point source dischargers and any combination thereof among and within Bay states. Terminates the Commission on September 30, 2018. Amends the Food Security Act of 1985 to require the Secretary to enter into a memorandum of understanding with the chief executive of a Bay state upon such executive's request to establish a watershed partnership. Authorizes each partnership to establish a watershed strategy for demonstrating aggregate reductions in losses of nitrogen, phosphorus, and sediment, on a basin or subbasin scale in the Bay watershed, from agricultural or nonindustrial private forest land in the state. Requires such strategies to establish an assurance process in which qualified producers or owners of non-industrial forest land may participate. Requires the Secretary to: (1) provide conservation technical assistance to educate agricultural and private forest landowners in the Bay regarding water quality requirements, (2) publish a list of eligible agricultural and forestry activities that result in environmental service benefits, and (3) establish a pilot program for the Bay watershed for the facilitation of creating environmental service markets.

Expanding and Promoting Expertise in Review of Rare Treatments Act of 2012 or EXPERRT Act of 2012 - Amends the Federal Food, Drug, and Cosmetic Act to direct the Secretary of Health and Human Services (HHS) to establish a program for consultation with external experts to inform and strengthen the Food and Drug Administration's (FDA's) review of drugs and biologic products for rare diseases and drugs and biologic products that are genetically targeted. Requires, under such program, each review division within the Center for Drug Evaluation and Research and the Center for Biologics Evaluation and Research to seek the opinion of external experts on topics that may include: (1) rare diseases; (2) the severity of rare diseases; (3) the unmet medical need associated with rare diseases; (4) the willingness and ability of individuals with a rare disease to participate in clinical trials; (5) an assessment of the benefits and risks, including side effects, of current and investigational therapies; (6) the design of clinical trials for rare disease populations and subpopulations; and (7) demographics and the clinical description of patient populations. Allows external experts to request the opportunity to meet with a review division regarding any such topic. Authorizes the Secretary to determine the timing of each consultation, which may occur prior to, or following, the filing of an investigational new drug application, a new drug application, or a biologies license application. Requires the experts consulted to be considered special government employees.

Rejects any U.S. policy that would rely on efforts to contain a nuclear weapons-capable Iran. Urges the President to reaffirm the unacceptability of an Iran with nuclear-weapons capability and oppose any policy that would rely on containment as an option in response to the Iranian nuclear threat.

Prohibits National Heritage Areas from being: (1) considered to be units of the National Park System, or (2) subject to the authorities applicable to such units. Specifies the criteria that the Secretary shall apply to determine the suitability and feasibility of designating proposed National Heritage Areas. States that designation of a National Heritage Area shall be by Act of Congress and contingent on the prior completion of a management plan and an affirmative determination by the Secretary that the area meets such criteria. Sets forth requirements for National Heritage Area management plans.

States that the property interest of Iran in: (1) a blocked asset shall include an interest in property of any nature whatsoever, including any direct or indirect interest in securities or other financial assets immobilized or in any other manner held in book entry form and credited to a securities account in the United States, or in any funds transfers held in a U.S. financial institution; (2) securities or other financial assets immobilized or in any other manner held in book entry form and credited to a securities account in the United States shall be deemed to exist at every tier of securities intermediary necessary to hold an interest in any such securities or other financial assets; and (3) a funds transfer shall exist at any intermediary bank necessary to complete such funds transfer. States that property of Iran shall be deemed to be property in the United States of Iran if that property is: (1) an interest, held for Iran's benefit or for the benefit of any securities intermediary that directly or indirectly holds the interest for Iran's benefit, in securities or other financial assets that are represented by certificates or are in other physical form and are immobilized, custodized, or held for safekeeping or any other reason in the United States; or (2) an interest in securities or other financial assets held in book entry form or otherwise, and credited to a securities account in the United States by any securities intermediary directly or indirectly for Iran's benefit or for the benefit of any other securities intermediary that directly or indirectly holds the interest for Iran's benefit. States that: (1) an interest in securities or other financial assets is held and credited to a securities account in the United States by a securities intermediary if the securities intermediary is located in the United States; and (2) ownership by Iran, or its central bank or monetary authority, of any property shall be deemed to be commercial activity in the United States and that property, including any interest in that property, shall be deemed not to be held for the central bank's or monetary authority's own account. Revises provisions regarding exceptions to the immunity from attachment or execution of a foreign state's property in the United States.

Public Safety Officers' Benefits Improvements Act of 2012 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to revise provisions concerning public safety officer death or disability benefits, including by: (1) modifying the list of recipients of death benefits payable when a public safety officer has died as the direct and proximate result of a personal injury sustained in the line of duty to include as an eligible individual, if there is no other individual meeting existing eligibility requirements, the surviving individual (or individuals, in equal shares) who would qualify as an eligible "child" but for age; (2) providing that disability benefits shall be payable when an officer has become permanently and totally disabled as the direct and proximate result of a personal injury (currently, as the direct result of a catastrophic injury) sustained in the line of duty; (3) eliminating the $5,000,000 limit on total annual disability benefits paid; (4) providing that death or disability benefits shall not be in addition to payments under the September 11th Victim Compensation Fund of 2001; (5) revising the criteria for death resulting from a heart attack, stroke, or vascular rupture suffered by a public safety officer while on duty; (6) including within the definitions of "member of a rescue squad or ambulance crew" and "public safety officer" an officially recognized or designated employee or volunteer member of a rescue squad or ambulance crew that is a public agency or a nonprofit entity serving the public that is officially authorized or licensed to engage in rescue activity or to provide emergency medical services and that is officially designated as a prehospital emergency medical response agency; and (7) making those who have sustained a catastrophic injury in the line of duty eligible for peer support and counseling programs. Makes funds available for appeals from final determinations (currently, decisions) of the Bureau of Justice Assistance, and for expenses of representation of hearing examiners, with respect to public safety officer's death benefits under specified circumstances. Provides that no appeal shall bring a final determination of the Bureau before any court for review unless notice of appeal is filed within 90 days after the date on which the Bureau serves notice of the final determination. Defines a "hearing examiner" under such Act to include any medical or claims examiner.

Jeremy Bell Act of 2011 - Amends the federal criminal code to prohibit an employer from directing, causing, persuading, inducing, or enticing the travel of an employee in one state to employment in another state if the employer knows that the employee engaged in sexual conduct with a person under age 18 that would constitute a felony where such conduct occurred during the course of employment. Sets penalties for violations. Amends the Elementary and Secondary Education Act of 1965 to authorize a private or public elementary or secondary school, a local educational agency, or a state educational agency to receive funds under such Act only if it has in effect a policy that ensures that every individual employed by it has undergone a fingerprint-based check of the national crime information databases and, where possible, of state criminal history databases. Conditions a state's receipt of funds under such Act on enforcement of a state law and policy that ensures that: (1) individuals employed at a school located in the state report to law enforcement officials any incidents of sexual conduct involving a minor and an individual employed at any school in the state; (2) employees who fail to report such incidents are penalized; (3) the state makes available in an interstate clearinghouse to schools, local educational agencies, and state educational agencies the identity of any individual who was so reported and whose employment was terminated as a result; and (4) such information is only made available to schools, local educational agencies, and state educational agencies, not the general public.

Financial Institutions Examination Fairness and Reform Act - Amends the Federal Financial Institutions Examination Council Act of 1978 to require a federal financial institutions regulatory agency to make a final examination report to a financial institution within 60 days of the later of: (1) the exit interview for an examination of the institution, or (2) the provision of additional information by the institution relating to the examination. Sets a deadline for the exit interview if a financial institution is not subject to a resident examiner program. Sets forth examination standards for financial institutions. Prohibits federal financial institutions regulatory agencies from requiring a well capitalized financial institution to raise additional capital in lieu of an action prohibited by the examination standards. Establishes in the Federal Financial Institutions Examination Council an Office of Examination Ombudsman. Grants a financial institution the right to appeal a material supervisory determination contained in a final report of examination. Requires the Ombudsman to determine the merits of the appeal on the record, after an opportunity for a hearing before an independent administrative law judge. Declares the decision by the Ombudsman on an appeal to: (1) be the final agency action, and (2) bind the agency whose supervisory determination was the subject of the appeal and the financial institution making the appeal. Amends the Riegle Community Development and Regulatory Improvement Act of 1994 to require: (1) the Consumer Financial Protection Bureau (CFPB) to establish an independent intra-agency appellate process in connection with the regulatory appeals process; and (2) appropriate safeguards to protect an insured depository institution or insured credit union from retaliation by the CFPB, the National Credit Union Administration (NCUA) Board, or any other federal banking agency for exercising its rights.

Achieving a Better Life Experience Act of 2011 or the ABLE Act of 2011 - Amends the Internal Revenue Code to establish tax-exempt ABLE accounts to assist an individual with a disability in building an account to pay for qualified disability expenses. Defines "qualified disability expenses" to include expenses for education, a primary residence, transportation, obtaining and maintaining employment, health and wellness, and other personal support expenses. Treats a qualified ABLE program and an ABLE account in the same manner as a qualified tuition program for income tax purposes (i.e., allowing a tax exemption for such program and an exclusion from gross income of amounts attributable to a contributor to or a beneficiary of a program account). Defines "qualified ABLE program" as a program established and maintained by a state agency under which a person may make contributions to an ABLE account established to pay for qualified disability expenses. Requires amounts in ABLE accounts to be disregarded in determining eligibility for Medicaid and other means-tested federal programs. Suspends the payment of supplemental security income benefits under title XVI (Supplemental Security Income) of the Social Security Act to an individual during any period in which such individual has excess resources attributable to an ABLE account.

Energy Security and Transportation Jobs Act - Amends the Outer Continental Shelf Lands Act to direct the Secretary of the Interior to make available for leasing and to conduct lease sales including: (1) at least 50% of the available unleased acreage within each outer Continental Shelf (OCS) planning area considered to have the largest undiscovered, technically recoverable oil and gas resources (on a total btu basis) based upon the most recent national geologic assessment of the OCS, with an emphasis on offering the most geologically prospective parts of the planning area; and (2) any state subdivision of an OCS planning area that the Governor of such state requests be made available for leasing. Directs the Secretary, in the 2012-2017 5-year oil and gas leasing program, to make available for leasing OCS planning areas that: (1) are estimated to contain more than 2.5 billion barrels of oil; or (2) are estimated to contain more than 7.5 trillion cubic feet of natural gas. Directs the Secretary, in developing a 5-year oil and gas leasing program, to determine a domestic strategic production goal for the development of oil and natural gas. Makes the production goal for the 2012-2017 5-year oil and gas leasing program an increase by 2027 in daily production of at least: (1) 3 million barrels of oil, and (2) 10 billion cubic feet of natural gas. Directs the Secretary to conduct proposed offshore oil and gas Lease Sales 216 and 222 (in the central Gulf of Mexico) and Lease Sale 220 (on the OCS offshore Virginia). Authorizes the Secretary to hold additional lease sales for areas with the greatest potential for new oil and gas development as a result of local support, new seismic findings, or nomination by interested persons. Amends the Tax Relief and Health Care Act of 2006 to repeal the moratorium upon oil and gas leasing, or preleasing, or any related activity in: (1) any area east of the Military Mission Line in the Gulf of Mexico; (2) any area in the Eastern Planning Area that is within 125 miles of the Florida coastline; or (3) specified areas within the Central Planning Area and within 100 miles of the Florida coastline. Amends the Outer Continental Shelf Lands Act to include within the OCS any submerged lands lying within the United States exclusive economic zone and the Continental Shelf adjacent to the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Virgin Islands, American Samoa, Guam, or other territories of the United States. Prescribes requirements for the disposition of new leasing revenues among coastal states.

Fallen Heroes of 9/11 Act

Fallen Heroes of 9/11 Act - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of congressional gold medals in honor of the men and women who perished as a result of the September 11, 2001, terrorist attacks on the United States to the Flight 93 National Memorial in Pennsylvania, the National September 11 Memorial and Museum in New York, and the Pentagon Memorial at the Pentagon. Authorizes the Secretary of the Treasury to strike and sell bronze duplicates of such medals, with amounts received from the sale to be deposited in the United States Mint Public Enterprise Fund.

Concrete Masonry Products Research, Education, and Promotion Act of 2011 - Directs the Secretary of Commerce to issue orders applicable to manufacturers of concrete masonry products (concrete) and to concrete importers, if such imports are subject assessment under the orders. Requires any such order to provide for the establishment of a Concrete Masonry Products Board, which shall carry out a program of promotion, research, and information regarding concrete products. Requires any such order to provide that assessments shall be paid by concrete manufacturers with respect to concrete manufactured and marketed in the United States. Allows any such order to provide that assessments shall be paid by concrete products importers. Provides assessment rates. Requires at least 50% of the assessments paid by a manufacturer to be used to support research, education, and promotion plans and projects in support of the geographic region of the manufacturer. Directs the Secretary, during the 60-day period preceding the proposed effective date of an order, to conduct a referendum for order approval among the manufacturers and importers required to pay assessments under the order. Outlines referendum procedures. Provides for petition and review of an order, and order enforcement through U.S. district courts. Authorizes the Secretary to conduct appropriate investigations in order to administer this Act (with power of subpoena). Directs the Secretary to suspend or terminate any order or provision that obstructs or does not tend to effectuate the purposes of this Act, or that is not favored by persons voting in a referendum.

Viral Hepatitis Testing Act of 2011

Viral Hepatitis Testing Act of 2011 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to carry out surveillance, education, and testing programs with respect to hepatitis B (HBV) and hepatitis C (HCV) virus infections. Requires the Secretary to establish a national system with respect to HBV and HCV to: (1) determine the prevalence of such infections, (2) carry out testing programs to increase the number of individuals who are aware of their infection, (3) disseminate public information and education programs for the detection and control of such infections, (4) provide referrals for counseling and medical treatment and ensure the provision of follow-up services, and (5) improve the training of health professionals in the treatment of such infections. Directs the Secretary to determine the populations that are considered at high risk. Requires the Director of the Centers for Disease Control and Prevention (CDC) to complete the revision of CDC guidelines for screening individuals with HCV, taking into account: (1) the effectiveness issues that have been raised with respect to the current CDC guidelines for screening, (2) the importance of responding to the perception that receiving such screening may be stigmatizing, and (3) whether age-based screening would be effective. Requires the Director of the Agency for Healthcare Research and Quality (AHRQ) to: (1) develop HCV screening recommendations, taking into account the guidelines established by CDC and new and improved treatments for HCV; and (2) develop HBV screening recommendations, taking into account the guidelines the CDC recommended in 2008.

Child Marriage Violates the Human Rights of Girls Act of 2011 - Defines "child marriage" as the marriage of a girl or boy not yet the minimum age for marriage stipulated in law in the country in which the girl or boy is a resident, or where there is no such law, under the age of 18. Expresses the sense of Congress that: (1) child marriage is a violation of human rights and its prevention and elimination should be a U.S. foreign policy goal; and (2) educational opportunities for girls, economic opportunities for women, and reducing maternal and child mortality are critical to U.S. global health and development objectives, including efforts to prevent HIV/AIDS. Directs the Secretary of State, the Administrator of the United States Agency for International Development (USAID), and the heads of other relevant departments and agencies to collect and make available data on the incidence of child marriage in specified countries that receive U.S. foreign or development assistance where the practice of child marriage is prevalent. Amends the Foreign Assistance Act of 1961 to require that Department of State reports on human rights practices for specified countries include a description of the status of child marriage for each country in which child marriage is prevalent.

Marketplace Equity Act of 2011 - Authorizes states to require all sellers making remote sales to collect and remit sales and use taxes with respect to such sales into the state, without regard to the location of the seller, if such states implement a simplified system for administration of sales and use tax collection for remote sellers. Requires such a system to include, at a minimum: (1) an exception for remote sellers with gross annual receipts in the preceding calendar year from remote sales not exceeding $1 million in the United States or not exceeding $100,000 in the state, (2) a single sales and use tax return for use by remote sellers and a single revenue authority within the state with which remote sellers are required to file a tax return, and (3) a uniform tax base throughout the state. Defines "remote sale" as a sale of goods or services attributed to a state with respect to which a seller does not have adequate physical presence to establish a nexus so as to allow such state to require such seller to collect and remit taxes.

Local Flexibility for Transit Assistance Act - Authorizes the Secretary of Transportation (DOT) to make urbanized area formula grants for the operating costs of equipment and facilities for use in public transportation in an urbanized area with a population over 200,000 to a designated recipient, direct recipient, or subrecipient that provides public transportation in the area operating less than 100 buses in fixed-route service in the area during peak service hours. Authorizes a designated recipient or direct recipient that operates at least 100 buses in fixed-route service during peak service hours in an urbanized area with a population of more than 200,000 to use grant funds for the operating costs of public transportation equipment and facilities in such projects if: (1) the recipients are certified by the Secretary as being in a crisis period; and (2) the recipients' percentage of revenue for the operating costs of public transportation equipment and facilities from non-federal sources (excluding system-generated revenue) is equal to the previous fiscal year's revenue, or the revenue is derived from dedicated sources. Specifies percentage limitations on the use of funds for urbanized areas with populations between 200,000 and 500,000, between 500,000 and 1 million, and over 1 million. Defines "crisis period" to mean that: (1) the unemployment rate within the recipients' service area is 7% or higher for the preceding month, or (2) the national average retail price of regular gasoline during a quarter has increased by more than 10%.

Creating Hope Act of 2011 - Amends the Federal Food, Drug, and Cosmetic Act to revise the priority review voucher program for tropical diseases to: (1) include rare pediatric diseases; (2) allow unlimited transfers of vouchers under the program; and (3) require a sponsor intending to use a voucher to notify the Secretary of Health and Human Services (HHS) at least 90 days (currently, 365 days) before submission of the application. Revises provisions regarding the priority review user fee, including to make it payable upon notification of the Secretary of intent to use the voucher. Authorizes the Secretary, upon request of the manufacturer or sponsor of a new drug, to designate that a new drug is: (1) for a rare pediatric disease, and (2) an eligible treatment. Requires the Secretary to deem a rare pediatric disease product application to be incomplete if it does not contain a description of the sponsor's plan to market the product in the United States. Authorizes the Secretary to refuse to issue a priority review voucher upon the approval of a rare pediatric disease application if the Secretary finds that the sponsor lacks a good faith intention to market the product in the United States. Directs the Secretary to issue a guidance document setting forth the evidentiary support necessary to demonstrate such a good faith intention. Requires sponsors of applications under the priority review voucher program to report to the Secretary within five years after the approval of the application on the demand and distribution of the product within the United States.
