Mobile Teachers' Retirement Assistance Act - Establishes a Federal-State program to permit teachers to perform out-of- State educational service without loss of retirement benefits for such service. Entitles a qualified State retirement system, which credits a teacher for out-of-State service to Federal aid of 50 percent of the total cost to the system of such out-of-State credit. Specifies the requirements which a State retirement system must meet in order to qualify for Federal aid under this program. Limits the amount of the Federal aid to a State retirement system to an amount providing not more than ten years of out-of-State service credit. Directs the Commissioner of Education to make a grant to each qualified State retirement system of an amount equal to two percent of such system's Federal aid received under this Act for the costs of administration.

Rural Housing Act

Rural Housing Act - Amends the Housing Act of 1949 to extend the availability of refinancing of indebtedness for rural housing assistance to elderly or handicapped families. Defines elderly or handicapped families for purposes of this Act. Directs the Secretary of Agriculture to establish a system of escrow accounts to enable borrowers to make periodic payment for taxes, insurance, and other necessary expenses. Authorizes and directs the Secretary to conduct specified programs of research, study and analysis of rural housing. Authorizes the Secretary to make expenditures from the Rural Housing Insurance Fund in order to correct construction defects or to pay claims of the owner of property arising from such defects. Empowers the Secretary to foreclose on mortgages only if the borrower has been given prior notice and consideration of the availability of the moratorium on payments. Makes changes with respect to the Secretary's power to make rules and regulations. Authorizes increases in assistance to specified rural housing programs for fiscal years 1978 and 1979. Extends rural housing loans for elderly and handicapped facilities to include congregate housing facilities for families who require some supervision and central services. Requires that at least 60 percent of insured rural housing loans shall benefit persons of low income. Makes changes in the guaranteed housing loan program and with respect to homeownership subsidy for low and moderate income persons. Makes it mandatory for the Secretary to provide rural rental assistance. Amends the Housing Act of 1949 to direct the Secretary to withhold assistance for specified programs from any otherwise eligible borrower who fails to incorporate energy conservation features into any structure commenced by such borrower after January 1, 1978. Permits the payment of reasonable attorney's fees for the representation of persons and organizations seeking to enforce rights under Title V of the Housing Act of 1949 from the Rural Housing Insurance Fund.

Emergency Amendments to the Marine Mammal Protection Act - Amends the Marine Mammal Protection Act of 1972 to declare that a duty of due care should be imposed on the tuna fishing industry in connection with purse-seine tuna fishing in order to reduce porpoise mortality to insignificant levels approaching zero, while still allowing for accidental porpoise mortality. Revises the definition of "take" under the Act in the case of purse-seine setting on porpoises for the purpose of tuna fishing to mean to kill or attempt to kill any marine mammal. Requires the Secretary of the Interior or the Secretary of the Department in which the National Oceanic and Atmospheric Administration is operating to achieve the purposes of the Act by establishing progressively lower quotas for the incidental taking of certain species and populations of marine mammals. Requires the Secretary of the Treasury to ban the importation of commercial fish and fish products from any foreign country having jurisdiction over fishing vessels which cause the incidental killing of or serious injury to marine mammals in excess of standards set by this Act. Authorizes the Secretary of the Interior or the Secretary of the Department in which the National Oceanic and Atmospheric Administration is operating to issue permits for the taking of the eastern stock of spinner dolphin incidental to commercial fishing for yellowfin tuna. Restricts the transfer or repair of any commercial fishing vessel, operated pursuant to a permit under this Act authorizing the taking of marine mammals incidental to commercial purse-seine fishing for yellowfin tuna, to any person for operation under the jurisdiction of a foreign country. Authorizes the Secretary to deny permits under the Act, and to modify, suspend, or revoke any permit if the Secretary finds, on the basis of observer reports, that the permittee has not exercised due care in complying with the conditions of the Act with respect to reducing the incidental killing of marine mammals. Establishes the basis upon which fees for permits shall be calculated. Requires the Secretary, upon a determination that a reasonable probability exists that certain fishing vessels will engage in the incidental taking of marine mammals, to direct agents to board such vessels for the purpose of monitoring compliance with this Act.

Earthquake Hazard Reduction Act - Directs the President to establish (1) a coordinated National Earthquake Hazard Reduction Program, (2) an Office of Earthquake Hazard Reduction, (3) a National Advisory Committee on Earthquake Hazard Reduction and (4) an Earthquake Prediction Evaluation Board. Specifies the duties of the Office of Earthquake Hazard Reduction, including developing and maintaining an Earthquake Hazard Reduction Program plan and staffing and assisting the National Advisory Committee. Directs the National Advisory Committee to review and advise the Office of Earthquake Hazard Reduction regarding the progress, implementation, and coordination of the Earthquake Hazard Reduction Program. Details the elements of the Program, including physical studies; structural studies; social, legal and economic research; and practical application of knowledge concerning earthquakes. Directs the Earthquake Prediction Evaluation Board to evaluate individual earthquake prediction, compile and maintain a public record of the performance of prediction methods, and issue authenticated earthquake predictions if and when earthquake prediction becomes a sufficiently reliable science. Authorizes appropriations to carry out the purposes of this Act.

Amends the Consolidated Farm and Rural Development Act to increase from 50 to 90 the percentage of the cost of a water or waste project which the Department of Agriculture may fund by a grant to a local association. Requires that such a grant be in an amount that will leave the average domestic user payment rate in the area served by the project at no more than: (1) one percent of the median family income of the area if such income fails in the lowest 25 percentile of the national median income; (2) one-and-one-half percent, if the median income falls in the 26 to 49 percentile; (3) two percent, if the median income falls in the 50 to 74 percentile; or (4) two-and- one-half percent, if the median income is above the 75 percentile of the national median income. Requires the Secretary of Agriculture to seek State and Federal assistance if the maximum amount of a grant will be insufficient to result in the applicable user cost limitation prescribed. Specifies conditions under which the Secretary may increase the amount of a grant. Revises the priorities for recipients of such grants to accord the highest priority to specified municipalities or public agencies which have a hazardous public health situation (currently, such priority is accorded to municipalities or public agencies which already have community water supply or waste disposal systems, when due to unanticipated occurrences such systems are suddenly inadequate to serve the community needs).

Agricultural Solar Energy Research, Development, and Demonstration Act - Title I: Existing Programs - Amends the Bankhead-Jones Act of 1935 to direct the Secretary of Agriculture to conduct and to stimulate research and development relating to uses of solar energy with respect to farm buildings, farm homes and farm machinery. Authorizes the appropriation of $25,000,000 each fiscal year to carry out such research and development. Includes the agricultural uses of solar energy in the agricultural extension programs. Directs that loans, under the Consolidated Farm and Rural Development Act, be made for the purchase of farm equipment which utilizes solar energy and for the acquisition and installation of any qualified solar energy thermal conversion system in any residential structure located on a family farm. Title II: Solar Demonstration Farms - Establishes within the Department of Agriculture the Research and Demonstration Planning Committee which shall be responsible for compiling a list of solar energy research projects and for meeting with regional representatives of the State departments of agriculture to determine which projects will be useful and beneficial to the several States. Requires each State department of agriculture to establish one large model farm and within one year to establish not less than ten demonstrations of solar energy research projects using the most efficient or practicable research projects demonstrated on such model farm. Stipulates the terms of any agreement entered into between selected farmowners and the State departments of agriculture for the establishment of such demonstration projects. Authorizes the appropriation of $20,000,000 for the purposes of this title, of which 80 percent is to be used by State departments of agriculture for the model farm and demonstration projects.

Renewable Energy and Energy Conservation Act

Renewable Energy and Energy Conservation Act - Allows an income tax credit for 30 percent of the expenditures not exceeding $750 which the taxpayer paid or incurred during the taxable year for installation of insulation or energy-conserving components which improve heating plant efficiency in his principal residence. Limits the application of this credit to expenditures paid or incurred for installations made between 1976 and 1982 in pre-existing dwellings. Reduces the allowable credit, on a graduated scale, for individuals with adjusted gross incomes greater than $10,000. Allows an income tax credit for 40 percent of the first $1,500, and a secondary credit for 25 percent of the next $7,600 paid or incurred by the taxpayer during the taxable year for the installation of qualified solar, wind and geothermal energy equipment in his principal residence. Allows an income tax credit for 20 percent of the first $1,500, and a secondary credit for 12.5 percent of the next $7,600 paid or incurred for the installation of wood stove, heat pump, or burner equipment in connection with new solar, wind or geothermal energy equipment which will be the principal source of space heat in the taxpayer's principal residence. Reduces these limitations in subsequent tax years by subtracting the amounts taken into account for these credits in previous tax years. Limits these credits to equipment installed between 1976 and 1982. Prorates each of the above credits for residential improvements among joint owners and cooperative shareholders according to their proportionate interests in the residential property. Provides for the carryover of any allowable credit which exceeds the taxpayer's current income tax liability. Reduces the allowable credits, on a graduated scale for and Conservation Act. persons with adjusted gross incomes greater than $15,000. Allows an investment tax credit for 25 percent of the qualified investment cost of depreciable geothermal, solar or wind energy equipment placed in service. Allows such a credit for 12 percent of the qualified costs of ventilation, heating, water and other components primarily designed to reduce the heat loss or gain of a structure, and origin ally used by the taxpayer. Prohibits these credits for property originally funded with Federal grants, or located in States which take these energy conserving measures into account for property assessment, or which don't enforce the thermal design requirements of the Energy Policy

Stipulates that such studies should be designed to result in the establishment of an information system permitting transfers of unconventional, nonnuclear energy technologies to impoverished areas of the world. Requires that results of such studies and recommendations for cooperative projects be reported to Congress by July 1, 1978. Authorizes the appropriation of $5,000,000 to the Energy Research and Development Administration for fiscal year 1978 for such purposes.

Solar and Energy Conservation Commercialization Act - Amends the National Housing Act to specify additional types of Solar energy systems eligible for financial assistance under such Act. Stipulates that such systems shall include solar heating and cooling and hot water systems, geothermal and wind energy systems, and other energy conservation measures and equipment such as insulation, heat pumps and devices to improve furnace efficiency. Authorizes the Secretary of Housing and Urban Development to make grants and loans to individuals and families to assist in the purchase of solar, renewable source, and energy conservation measures and equipment. Authorizes grants and loans for similar purposes to neighborhood, community, or nonprofit groups. Amends the Small Business Act to authorize the Administrator of the Small Business Administration to make loans to small businesses to assist in the purchase and installation of solar, renewable source, and energy conservation improvements and equipment. Directs the Secretary of Housing and Urban Development, the Administrator of the Small Business Administration, and the Federal Energy Administrator to cooperate in carrying out the provisions of this Act and to jointly submit an annual report to the President and the Congress on activities carried out under this Act. Authorizes appropriations for fiscal years 1978 through 1981.

Ocean Dumping Amendments Act -- Amends the Marine Protection, Research, and Sanctuaries Act of 1972 to authorize the issuance of interim permits through December 31, 1981, for ocean dumping without regard to preexisting criteria. Limits such interim authorizations to persons already engaged in dumping of similar materials prior to the enactment of the Act, and where such person has no feasible alternative for disposal other than ocean dumping. Stipulates that such interim permits shall be reviewable on an annual basis. Requires that holders of interim permits expend adequate funds for research into alternate methods of material disposal, subject to conditions specified by the Administrator of the Environmental Protections Agency. Requires applicants for permits to pay a processing fee for administrative costs directly incurred in the processing of permits. Directs the Administrator to conduct studies to reduce or eliminate the dumping of radiological, chemical, or biological warfare agents or high-level radioactive wastes into ocean waters. Repeals various authorities of the Secretary of Commerce with respect to evaluation of substantive programs of other agencies.

Requires that all Federal buildings be life cycle cost effective and that such determination serve as a basis for the awarding of contracts in the procurement and leasing of new Federal buildings. Directs the Administrator to promote the use of life cycle cost effective methods in all buildings. Directs the Administrator to establish energy performance targets for existing buildings which are compatible with new building performance standards developed by the Secretary of Housing and Urban Development. Requires all Federal agencies to conduct an energy audit of existing buildings within their jurisdiction. Requires that a specified percentage of the gross square footage of building space be selected by each agency for retrofitting with appropriate energy conservation measures. Authorizes the appropriation of $500,000 to the Administrator to perform the functions as authorized or required under this Act. Authorizes the appropriation of additional sums as necessary to carry out this Act.

Requires that a warning rather than a citation be given for a first instance violation, other than a willful or serious violation, to an employer who has not employed more than 25 employees at any time during the 30 days prior to an inspection or investigation. Prohibits the imposition of a civil penalty against an employer for a nonserious violation if (1) such employer has not previously received a citation for the same violation; and (2) the inspection upon which such citation was based resulted in the issuance of citations for ten or or fewer violations of a nonserious nature.

Department of Energy Organization Act - Title I: Declaration of Purposes - Declares it the purpose of this Act to establish a permanent Department of Energy in the executive branch to assist in the development of a coordinated national energy policy. Title II: Establishment of Department - Establishes a Department of Energy in the executive branch. Establishes an Energy Information Administration and an Economic Regulatory Administration within such Department. Title III: Transfers of Functions - Transfers to the Secretary of Energy all functions now vested in the Federal Energy Administration, the Energy Research and Development Administration, and the Federal Power Commission. Transfers energy-related functions from the Department of the Interior to the new Secretary. Transfers specified functions of the Securities and Exchange Commission, the Secretary of Housing and Urban Development, the Interstate Commerce Commission, the Secretary of the Navy, and the Secretary of Commerce to the new Secretary. Title IV: Board of Hearings and Appeals - Establishes a three-member Board of Hearings and Appeals within the Department to make agency determinations as required by law. Prohibits persons having interests in energy companies from serving as Board members. Title V: Administrative Procedures and Judicial Review - Stipulates that the provisions of the Administrative Procedure Act shall apply to rules and regulations issued by the Secretary or his delegate. Requires that opportunity for oral presentations of viewpoints be afforded where regulations are likely to have a substantial economic impact. Requires hearings on rules which substantially impact on a single geographic area to be held in such geographic area. Stipulate that United States district courts shall have exclusive jurisdiction of cases arising under this Act without regard to amount in controversy, except where otherwise provided in authority transferred to the Secretary. Title VI: Administrative Provisions - Establishes a Leasing Liaison Committee to obtain information and make recommendations on Federal leasing activities conducted by the Secretary of the Interior which relate to energy resources. Requires officers and employees of the Department of Energy to disclose known financial interests in energy companies. Imposes criminal penalties for knowing violations of such disclosure requirements. Authorizes the Secretary to delegate authority to other officers, to create regional officers, and to establish advisory committees. Requires the Secretary to submit annual reports to the President for submission to the Congress. Title VII: Transitional Savings and Conforming Provisions - Stipulates that transfers of personnel as authorized by this Act shall not result in reduction in grade or unemployment for one year after enactment of this Act. Stipulates that orders, rules, and proceedings established or commenced under previous authority shall not be affected by the transfers under this Act. Amends the Federal Energy Administration Act, the Energy Reorganization Act, the Federal Power Act, the Motor Vehicle Information and Cost Savings Act, the Energy Conservation Standards for New Buildings Act, the Public Utility Holding Company Act of 1935, the Rural Electrification Act of 1936, and other provisions of law to conform with the changes made by this Act. Title VIII: Effective Date and Interim Appointments - Stipulates that the provisions of this Act shall take effective no later than 120 days after the Secretary first takes office. Establishes procedures for interim appointments of officers prior to the effective date of this Act.

Ocean Dumping Amendments Act -- Amends the Marine Protection, Research, and Sanctuaries Act of 1972 to authorize the issuance of interim permits through December 31, 1981, for ocean dumping without regard to preexisting criteria. Limits such interim authorizations to persons already engaged in dumping of similar materials prior to the enactment of the Act, and where such person has no feasible alternative for disposal other than ocean dumping. Stipulates that such interim permits shall be reviewable on an annual basis. Requires that holders of interim permits expend adequate funds for research into alternate methods of material disposal, subject to conditions specified by the Administrator of the Environmental Protections Agency. Requires applicants for permits to pay a processing fee for administrative costs directly incurred in the processing of permits. Directs the Administrator to conduct studies to reduce or eliminate the dumping of radiological, chemical, or biological warfare agents or high-level radioactive wastes into ocean waters. Repeals various authorities of the Secretary of Commerce with respect to evaluation of substantive programs of other agencies.
