Disaster Assistance Act of 1990

Disaster Assistance Act of 1990 - Title I: Emergency Crop Loss Assistance - Subtitle A: Annual Crops - Extends disaster crop loss assistance through the 1990 crop year for wheat, feed grains, cotton, rice, peanuts, sugar, tobacco, soybeans, and other nonprogram crops. Extends crop quality reduction disaster assistance through the 1990 crop year. Reduces disaster assistance payments in relation to Federal crop insurance payments. Requires producers to obtain Federal crop insurance for 1991 in order to be eligible for disaster payments and other specified assistance for 1990 crop losses. Sets forth exempted circumstances. Requires the Secretary of Agriculture to announce within a specified time the conditions for establishing a 1990 farm yield for forage-use-crops. Limits assistance under this Act to $100,000. Authorizes the substitution of crop insurance program yields for 1990 disaster assistance eligibility purposes. Subtitle B: Orchards - Provides disaster assistance (up to $25,000 or an equivalent value in seedlings) to orchardists who suffered qualifying tree losses as a result of 1990 freeze, earthquake, or related condition. Expresses the sense of the Congress that Federal crop insurance should be made available to all orchard crops. Subtitle C: Forest Crops - Provides disaster assistance (up to $25,000 or an equivalent in seedlings) to commercial tree farmers who suffered qualifying tree seedling losses as a result of 1990 drought, earthquake, or related condition. Subtitle D: Additional Assistance - Prohibits the Secretary from reducing rental payments to an owner or operator who hays or grazes livestock during the 1990 crop year on land subject to a conservation reserve program contract to the extent that such owner or operator carries out and pays for specified additional conservation practices. Subtitle E: Administrative Provisions - Makes a person with qualifying annual gross income (as defined by this Act) in excess of $2,000,000 ineligible for assistance under this Act. Title II: Disaster Credit and Forbearance - Makes producers who suffered 1990 crop losses eligible for emergency loans even if they had crop insurance. Directs the Secretary to make 1991 direct and guaranteed farm operating loans (including funds from the Agricultural Credit Insurance Fund) available to producers who suffered 1990 crop losses due to moisture, freeze, or related condition, and 1989 or 1990 crop losses due to drought or related condition. Title III: Rural Businesses - Directs the Secretary to provide loan guarantees through the Rural Development Insurance Fund to rural business enterprises (including Indian tribes) which have suffered disaster damage in 1989 or 1990. Limits: (1) individual guarantees to the lesser of 90 percent of principal and interest or $2,500,000; and (2) aggregate guarantees to $200,000,000. Title IV: General Provisions - Amends the Disaster Assistance Act of 1989 to base the determination of the 1989 harvestable amount of sugarcane on the quantity of recoverable sugar.

Comprehensive Alzheimer's Assistance, Research, and Education Act of 1990 (CARE) - Title I: Amendments to the Public Health Service Act - Replaces provisions of the Public Health Service Act authorizing the establishment and operation of Alzheimer's Disease centers with provisions requiring the Director of the National Institute on Aging to make grants and enter into cooperative agreements for planning, establishing, or strengthening at least 15 Alzheimer's Disease Research Centers to support any part of the full range of research and development from very basic to clinical. Requires the Director to award center core grants or enter into cooperative agreements to support shared resources for categorical research. Requires the Director to award grants or enter into cooperative agreements with entities receiving assistance under the Research Centers and center core provisions of this Act to assist in providing high-quality research and services at locations other than the Research Centers. Requires the Director to make grants or enter into cooperative agreements to: (1) attract new or young investigators to careers involving research on biomedical, behavioral, and social aspects of Alzheimer's disease; and (2) develop institutional training programs emphasizing postdoctoral training and training of women and groups underrepresented in such research. Authorizes appropriations for: (1) the grants and cooperative agreements above in this Act; and (2) under existing provisions, awards for leadership and excellence, research on services to individuals with Alzheimer's disease and related dementias and their families, preparation and revision of a plan for certain research related to Alzheimer's disease, and dissemination of research results. Authorizes the Secretary of Health and Human Services, through the Commissioner on Aging, to make grants and enter into contracts for family support demonstration projects. Authorizes the Director to make grants and enter into contracts for long-term care research with regard to Alzheimer's disease and related disorders. Authorizes the Secretary, through the Director of the National Institute of Mental Health, the Administration on Aging, and the National Center for Nursing Research, to make grants and enter into contracts for research on methods for improving the delivery of supportive services to individuals with Alzheimer's disease or related disorders. Authorizes appropriations for family support demonstration projects, long-term care research, and supportive services delivery research. Directs the Secretary to make competitive grants to States for State Alzheimer's disease programs, including medical, legal, educational, health care financing, and other aspects. Requires that 25 to 50 percent of a grant be used in any fiscal year for respite care. Limits grants to: (1) a minimum dollar amount; and (2) one-half of the costs of the research for which the grant is made. Authorizes appropriations. Authorizes the Secretary, through the Director of the National Institutes of Health and the Director of the National Institute of Mental Health (NIMH), to make grants and enter into contracts for basic and clinical research with respect to Alzheimer's disease and related disorders. Authorizes appropriations. Title II: Amendments to the Alzheimer's Disease and Related Dementias Services Research Act of 1986 - Amends the Alzheimer's Disease and Related Dementias Services Research Act of 1986 to require the Council on Alzheimer's Disease to make certain annual reports to the Congress and the public regarding matters related to Alzheimer's disease. Authorizes appropriations for the establishment and operation, under existing provisions, of the Advisory Panel on Alzheimer's Disease. Requires grants under specified existing provisions for Alzheimer's research to focus on specialized care as well as on services. Requires the Director of the NIMH to submit a research plan to the Council annually. Modifies the research to be provided for in the plan. Authorizes appropriations to carry out the responsibilities of the NIMH relating to Alzheimer's disease under the Act. Requires the Administrator of the Agency for Health Care Policy and Research to submit a research plan to the Chairman of the Council annually. Authorizes appropriations to carry out the responsibilities of the Agency under the Act. Replaces provisions requiring education programs for providers of care for individuals with Alzheimer's disease with provisions authorizing the Director of the National Institute on Aging to make grants: (1) on the basis of merit, for training programs and continuing education programs with respect to health care for individuals with Alzheimer's disease or related disorders; and (2) for the development of curricula for the training programs and continuing education programs. Requires the Director to establish the National Alzheimer's Education Program to: (1) provide coordination and leadership in the Federal education and promotion effort; (2) develop and distribute educational materials; (3) encourage and work with the media to provide information; (4) encourage and work with public and private efforts to develop models for education, training, and assistance programs; and (5) provide technical assistance. Authorizes the Director to make grants for programs to educate health care providers and the families of individuals with Alzheimer's disease or related disorders on caring for such individuals, and on the availability of public and private sources of assistance. Authorizes appropriations to carry out educational activities provisions of the Act.

Medicare Physician Regulation Relief Amendments of 1990 - Amends title XVIII (Medicare) of the Social Security Act to require carriers and peer review organizations to release the medical review screen or the associated screening parameter to a physician before notifying such physician that payment for his or her service has been denied. Permits Medicare reimbursement of a patient's regular physician for services provided to such patient by another physician who occasionally covers for the regular physician. Requires Medicare carriers to provide physicians, upon request and without charge, with carrier-generated information which physicians need to submit a payment claim or respond to a carrier inquiry. Allows a medical society or other professional organization representing physicians to represent a group or class of physicians in Medicare payment determinations, reconsiderations, or appeals. Directs the Secretary of Health and Human Services to appoint, based on nominations submitted by national medical organizations representing physicians, a Practicing Physicians Advisory Council with which the Secretary must consult concerning changes in the Medicare program and proposed changes in regulations and carrier operation policies.

Regulated Precursor Chemicals Act of 1990 - Amends the Controlled Substances Act to revise and expand the list of precursor chemicals, including transferring to such list hydriodic acid from the list of essential chemicals. Revises the definition of "regulated transaction" to include transfers of any amount of an essential listed precursor chemical, with exceptions. Requires each regulated person to report to the Attorney General on any regulated transaction involving any quantity of a listed essential chemical. Makes it unlawful for any person to engage in a regulated transaction involving a listed precursor chemical or any other conduct that defines such person as a regulated person for purposes of such Act without a license required under such Act. Requires the Attorney General to establish a program requiring licenses for regulated persons and regulated transactions involving listed precursor chemicals where such requirement will contribute to carrying out the purposes of such Act and to criminal drug law enforcement. Provides for fines and imprisonment of not more than four years for violations of the licensing requirement. Requires the Attorney General to provide for the audit and control of listed precursor chemical inventories of persons possessing a license under this Act. Directs the Attorney General to cooperate with State authorities by providing information regarding regulated transactions in such chemicals that might be useful in the administration of State laws relating to precursor chemicals, controlled substances, and other illegal drugs.

Pesticide Export Reform Act of 1990

Pesticide Export Reform Act of 1990 - Title I: Exported Pesticides - Amends the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to require pesticide producers operating registered establishments to inform the Administrator of the Environmental Protection Agency of: (1) the types and quantities of pesticides and active ingredients used in producing pesticides for export to a foreign country; and (2) the date of export and quantity of such materials exported to each foreign country to which the producer has exported during the past 360-day period. Provides that specified information on exported pesticides shall not be entitled to confidential trade secret treatment. Makes it unlawful to knowingly or recklessly export a pesticide, device, or active ingredient in violation of FIFRA export requirements. Prohibits the exportation of pesticides, devices, or active ingredients unless: (1) such materials are prepared and packaged according to the specifications of the foreign purchaser and the legal requirements of the country of use; and (2) the producers or exporters meet specified FIFRA requirements. Prohibits the exportation of unregistered pesticides. Waives certain requirements to permit the export of pesticides not meeting FIFRA requirements to prevent or arrest the spread of a communicable disease if the Administrator makes specified determinations. Prohibits the exportation of specified pesticides (including restricted use pesticides and pesticides subject to suspension or cancellation proceedings) unless: (1) the exporter provides specified information on the pesticide to the Administrator; (2) the country of use consents to the import and is included on a list of approved countries; and (3) the pesticide is manufactured, stored, and packaged in accordance with standards of the United Nations Food and Agriculture Organization. Requires the Administrator to maintain a list of approved countries of use. Sets forth labeling requirements for exported pesticides. Permits the export of pesticides for experimental use in foreign countries if specified conditions are met. Requires the Administrator to notify foreign countries and the International Registry of Potentially Toxic Chemicals whenever regulatory action is taken with respect to a pesticide. Directs the Administrator to: (1) convene meetings with foreign governments and other interested parties to promote the implementation of improved research and regulatory programs for pest management and strategies for sustainable agriculture; (2) provide foreign countries with technical assistance to develop pesticide regulatory programs; (3) transmit triennial studies to the Congress on countries that import U.S. pesticides and from which the United States imports agricultural commodities to ascertain such countries' management of pesticides and whether the United States is able to test effectively for pesticide residues; and (4) convene meetings with foreign governments and other interested parties to encourage the adoption of a multilateral convention requiring standard notice and export control measures for pesticides. Title II: Tolerances for Agricultural Commodities - Amends the Federal Food, Drug, and Cosmetic Act to require the Administrator, if registrations for a pesticide chemical under FIFRA have been cancelled, suspended, withdrawn, or modified to eliminate the use of such chemical on a raw agricultural commodity, to publish a notice in the Federal Register announcing: (1) the revocation of any tolerance for an agricultural use; or (2) an exemption for the use of such chemical on such commodity. Provides for temporary waivers from revocations for the purpose of distributing in commerce commodities that contain residues resulting from the application of pesticides before this Act's enactment or residual environmental contamination. Permits the Administrator to issue such waivers only if such waivers do not: (1) pose a dietary health risk; and (2) cause significant economic hardship for domestic producers of a commodity attributable to competition from foreign producers in countries in which the use of the pesticide is permitted. Prohibits, with specified exceptions, the establishment or continuation of a tolerance unless the Administrator determines that a practical method for detecting and measuring pesticide residues exists. Prohibits the importation of food into U.S. customs territory unless the commodity importer files with the Secretary of Health and Human Services and the Secretary of the Treasury a document identifying each pesticide chemical used in connection with the commodity. Requires such importers, if unreported pesticides are detected in such commodities, to submit residue analyses for such pesticides. Waives reporting requirements for unreported pesticides if the presence of such pesticides is attributable to long-term environmental persistence and does not pose a health risk. Amends the Federal Meat Inspection Act, the Poultry Products Inspection Act, and the Egg Products Inspection Act to apply such requirements to importers of meat, poultry, and eggs. Title III: Effective Dates - Sets forth the effective dates for provisions of this Act.

Authorizes the President, if an affirmative determination with respect to such a country is made, to apply special trade treatment to articles that: (1) are products of such country; and (2) are entered or withdrawn from warehouse for consumption in U.S. customs territory in the year following the year such determination was made. Prohibits such special treatment if specified actions under the Narcotics Control Trade Act are in effect with respect to such country. Authorizes the President to provide economic assistance to Bolivia, Colombia, and Peru to promote the production, processing, or marketing of agricultural commodity exports, excluding commodities from which narcotic and psychotropic drugs are derived. Waives provisions of the Foreign Operations, Export Financing, and Related Programs Appropriations Act that prohibit economic assistance for the growth or production in a foreign country of commodities which would compete with similar U.S. commodities with respect to such assistance.

Medicare Supplemental Insurance Reform Act of 1990 - Amends title XVIII (Medicare) of the Social Security Act to prohibit a Medicare supplemental policy from being sold in any State if the policy's premium exceeds its premium for the previous year by a percentage greater than the projected percentage increase in Medicare costs, unless the premium increase has been approved by the State pursuant to a specified process providing for the detailed review of the reasonableness of such increase. Prohibits the sale of a Medicare supplemental policy which has neither been certified by the Secretary of Health and Human Services as meeting NAIC (National Association of Insurance Commissioners) Model Standards and returning a specified percentage of premiums as benefits, nor determined by a State regulatory program to be returning the requisite percentage of premiums as benefits. Increases the percentage of premiums which must be returned to policyholders as benefits. Requires that each State having a Medicare supplemental policy regulatory program maintain and make available to consumers a listing of the most recent year's ratio of benefits provided to, and premiums collected for, each policy sold in the State.

Quality Assurance of Drug Testing Act of 1990 - Amends the Public Health Service Act to prohibit performing toxicological analysis in connection with a drug testing program unless certified. Directs the Secretary of Health and Human Services to establish a program for certifying laboratories for performing drug tests, with annual review of certification criteria. Requires an employer, as a condition of maintaining a drug testing program, to establish a written anti-drug abuse policy and a drug-free awareness program. Declares that nothing in this Act prohibits an employer from requiring a drug test of applicants and, in certain circumstances, employees. Sets forth certain employee protections, including requiring several types of notice and prohibiting: (1) subject to exception, adverse action based on unconfirmed results; and (2) retaliation for exercise of an employee right. Prohibits disclosure of test results, except in specified circumstances. Declares that nothing in this Act prohibits an employer from: (1) taking action necessary to ensure a safe workplace; (2) taking action necessary, including termination, in certain circumstances; (3) requiring certain employees to participate in a treatment program; or (4) refusing to place or reinstate an employee with a confirmed positive test in a sensitive position. Directs the Secretary to establish a program for the certification of laboratories for the performance of toxicological urinalysis conducted for drug testing programs. Requires the certification program to be enforced under the procedures and sanctions in specified provisions relating to the licensing of clinical laboratories. Sets forth procedures for employee complaints of unlawful discharge or discrimination. Directs the Secretary, on a finding of a violation of this Act, to provide relief as the Secretray determines appropriate, including reinstatement, promotion, and the payment of lost wages and benefits. Declares the good faith compliance of an employer with the standards and procedures of this Act to constitute an affirmative defense. Declares that this Act does not require an employer to establish a drug testing program or make employment decisions based on test results. Declares that this Act preempts any State or local law or regulation, but does not prohibit the Secretary of Transportation or the Nuclear Regulatory Commission from issuing regulations on drug and alcohol testing. Allows professional athletes to be treated as sensitive employees, except that they are not covered by provisions prohibiting disclosure of test results.

Expedited Consideration of Proposed Rescissions Act of 1990 - Amends the Congressional Budget and Impoundment Control Act of 1974 to require a special message, in the case of budget authority proposed to be rescinded or reserved, to include language amending the law authorizing such programs to allow them to continue to function at the proposed new level of budget authority. Allows the President to transmit to both Houses of the Congress, for expedited consideration, one or more special messages proposing to rescind all or part of any item of budget authority provided in an appropriation bill. Requires that such special message be transmitted not later than three days after the President approves the appropriation bill and be accompanied by a draft bill or joint resolution that would, if enacted, rescind the budget authority proposed to be rescinded. Sets forth House and Senate procedures for the expedited consideration of such a proposal.
