Haitian Protection Act of 2009 - Requires the Secretary of Homeland Security to designate Haiti as a country whose qualifying nationals may be eligible for temporary protected status. Provides for: (1) an initial 18-month designation period; and (2) authorization for temporary travel abroad.

Federal Prison Bureau Nonviolent Offender Relief Act of 2009- Amends the federal criminal code to direct the Bureau of Prisons, pursuant to a good time policy, to release a prisoner who has served one half or more of his or her term of imprisonment if that prisoner: (1) has attained age 45; (2) has never been convicted of a crime of violence; and (3) has not engaged in any violation, involving violent conduct, of institutional disciplinary regulations.

Community AIDS and Hepatitis Prevention Act - Provides that nothing shall prohibit the use of federal funds to establish or carry out a program of distributing sterile syringes to reduce the transmission of bloodborne pathogens, including the human immunodeficiency virus (HIV) and viral hepatitis.

Requires government contributions for health benefits for an individual who first becomes an annuitant by reason of retirement from employment with the United States Postal Service on or after July 1, 1971, or for a survivor of such an individual or of an individual who died on or after that date while employed by the Postal Service, to be paid first from the Postal Service Retiree Health Benefits Fund up to the amount contained in the Fund, with any remaining amount paid by the Postal Service (current law requires such contributions to be paid by the Postal Service through September 30, 2016).

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation; (2) is job-related with respect to the position in question; and (3) is consistent with business necessity. Avers that such defense shall not apply where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential; and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer has made substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey; (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity; and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Citizens' Commission on Educational Equity Act of 2008 - Establishes the Citizens' Commission on Educational Equity, composed of the Secretary of Education and 14 educational stakeholders appointed by the Comptroller General. Tasks the Commission with conducting a study and reporting to Congress on ways to enable all students to achieve their academic potential, with particular emphasis on: (1) ensuring that schools receive adequate resources; (2) developing methods for assessing students' educational needs; and (3) creating innovative strategies for state and local educational agencies to follow to enable students to achieve their academic potential, and to enable such agencies to participate in school funding reform efforts that result in educational equity. Directs the Commission to conduct outreach programs with communities throughout the nation to engage them in a public dialogue on how to ensure that their schools enable all students to achieve their academic potential.

Life Sustaining Treatment Preferences Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Improvements for Patients and Providers Act of 2008, to extend Medicare coverage to consultations regarding an order for life sustaining treatment for qualified individuals. Directs the Secretary of Health and Human Services to make grants to eligible entities to: (1) establish new programs for orders regarding life sustaining treatment in a state or locality; (2) expand or enhance an existing program; or (3) set up a clearinghouse of information on programs for such orders and consultative services for the development or enhancement of such programs.

Commends the governments of the Caribbean countries and the Caribbean-American community for their efforts to assist the people of the region after the devastation caused by Hurricanes Gustav and Ike and Tropical Storms Fay and Hanna. Supports the Administration's efforts to assist in coordinating international humanitarian assistance to help the people of the Caribbean region and to provide relief to affected communities, particularly in the Dominican Republic, Haiti, Jamaica, the Bahamas, Cuba, and Turks and Caicos.

Preserve Our Neighborhoods Act of 2008 - Cites conditions under which a local government may purchase from the Secretary of the Treasury at the price of $1 per mortgage a group of at least 25 available mortgages, each of which is secured by real property. Requires the Secretary to make available to the public, at 90-day intervals, a list of all parcels of real estate, identified by specific address, that are available for purchase. Authorizes the Secretary to sell such mortgages. Applies the National Historic Preservation Act with respect to the rights in property acquired by local governments as a result of the foreclosure of mortgages purchased under this Act.

Laboratory Surge Capacity Preparedness Act - Directs the Secretary of Homeland Security to award grants to regional biocontainment laboratories for maintaining surge capacity that can be used to respond to acts of bioterrorism or outbreaks of infectious diseases. Authorizes the Secretary to award such a grant only if the laboratory agrees to allow the Secretary and other relevant federal agencies to inspect laboratory facilities. Requires the Secretary to report to Congress on: (1) activities undertaken to integrate the network of regional biocontainment laboratories with the laboratory response network of the Centers for Disease Control and Prevention (CDC); and (2) the extent to which additional Biosafety Level 3 laboratories are needed to fulfill the national's laboratory surge capacity needs.

Calls on the Attorney General to: (1) protect the right to vote of every person in the United States by promptly and thoroughly investigating complaints of violations of the Voting Rights Act of 1965, the National Voter Registration Act of 1993, and the Help America Vote Act of 2002; (2) exercise all the authorities and utilize all the resources provided by Congress to fully enforce voting and civil rights statutes; (3) enjoin any efforts by individuals or organizations to violate federal voting and civil rights statutes by means of intimidation, suppression, or deceptive practices and to ensure that no eligible voter is denied the right to vote on November 4, 2008, including voting by mail and absentee ballots; and (4) prosecute those who violate federal voting and civil rights statutes to the fullest extent of the law.

Federal Death Penalty Abolition Act of 2008- Repeals death penalty provisions for a wide range of homicide-related offenses under the Immigration and Nationality Act, the federal criminal code, the Controlled Substances Act, and other statutes relating to aircraft hijacking, espionage and treason, and offenses punished under the Uniform Code of Military Justice. Prohibits the sentencing to death or execution of any person for any violation of federal law after the enactment of this Act. Commutes death penalties imposed prior to the enactment of this Act to life imprisonment without the possibility of parole.

Home Health Care Planning Improvement Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to revise conditions of and limitations on payment for home health care services. Allows payment for home health services to Medicare beneficiaries by: (1) a nurse practitioner; (2) a clinical nurse specialist working in collaboration with a physician in accordance with state law; (3) a certified nurse-midwife; or (4) a physician assistant under a physician's supervision.

Recognizes the great strides made by the majority of competing countries to increase the participation of women in the Summer Olympic Games and in sports. Applauds countries with policies that enable women's participation in sports to coexist with traditional cultural and religious practices. Urges: (1) the International Olympic Committee to advocate for improved opportunities for women to participate in sports and to work with all countries to provide financial support and adequate facilities for women athletes; and (2) the Committee and all countries to increase efforts to enhance such participation, to strive to make the 2012 Summer Olympic Games the first at which women are on delegations from every participating country, and to ensure a record number of women competitors at the 2012 Games.

Civil Rights Quarter Dollar Coin Act of 2008 - Requires quarter dollars to have designs on the reverse emblematic of prominent civil rights leaders and important events that have advanced civil rights in America. Instructs the Secretary of the Treasury to select such leaders and events. Requires five coin designs in each year of the period of issuance. Instructs the Secretary to strike and make available for sale silver bullion coins that are exact duplicates of such quarter dollars.

Declares that Congress commits to pass, and urges the President sign, within 18 months, legislation that guarantees health care for all and that: (1) recognizes the role of women as health care consumers, caregivers, and providers; (2) guarantees inclusion of benefits essential to achieving and maintaining good health; (3) promotes primary and preventive care; (4) provides a choice of public and private plans and direct access to a choice of doctors and health care providers to ensure continuity of coverage and a delivery system that meets the need of women; (5) eliminates disparities on the basis of gender, culture, race, ethnicity, socioeconomic status, health status, or sexual orientation; (6) shares financing responsibility among employers, individuals, and the government while taking into account small business needs; (7) ensures affordable access to health care; (8) enhances quality and patient safety; (9) ensures a sufficient supply of qualified providers through expanded medical and public health education and adequate reimbursement; and (10) promotes administration efficiency and is easy to utilize.

Recognizes: (1) the important contributions of African-American doctors on the event of the apology of American Medical Association (AMA) to the National Medical Association (NMA) for over a century of racial prejudices and wrongdoings; (2) the efforts of Dr. W. Montague Cobb, former president of the NMA, to break down the racial prejudices at the AMA that led to its full integration; and (3) Shaw University's Leonard Medical School and other historically black colleges and universities for their role in training African-American doctors. Encourages more African-Americans to work in medicine and become doctors, nurses, and researchers.

Centennial District Authorization Act of 2008 - Establishes in the City of Philadelphia, Pennsylvania, the Centennial Historic District (District). Authorizes the Secretary of the Interior to make grants to, or enter into cooperative agreements with, state or local government agencies, nonprofit entities, and any leaseholders to administer the District. Directs the Secretary to: (1) prepare a plan for the development of historic, architectural, natural, cultural, recreational, and interpretive resources within the District; and (2) make grants for capital improvement projects in the District.

Recognizes that it is imperative that this nation strengthen its public health system to provide all persons with the resources they need to make healthier choices and live healthier lives and to protect people from health threats beyond their control. Commits to creating public health strategies to eliminate health disparities and improve the health of all people in the United States. Expresses support for prioritizing public policies focusing on the prevention of disease and injury and calls for community-based programs to support healthy lifestyles. Urges the expansion of the prevention strategies of daily aspirin therapy, smoking cessation, colorectal cancer screening, annual flu immunizations, and breast cancer screening. Declares that the congressional budget process should reflect the savings associated with investments in the prevention of disease and injury. Encourages the Congressional Budget Office (CBO) to consider the savings associated with a reduced chronic disease burden due to preventive services and programs when formulating its health care cost estimates. Pledges support for increasing the investment in federal public health programs to at least 1% of total federal spending within five years.

Prevention of Equine Cruelty Act of 2008 - Amends the federal criminal code to impose a fine and/or prison term of up to three years for possessing, shipping, transporting, purchasing, selling, delivering, or receiving any horse, horse flesh, or carcass with the intent that it be used for human consumption. Reduces the prison term to one year if the offense involves less than five horses or less than 2,000 pounds of horse flesh or carcass and the offender has no prior conviction for this offense.

Small Business Cooperative for Healthcare Options to Improve Coverage for Employees (CHOICE) Act of 2008 or the Small Business CHOICE Act of 2008 - Provides for the establishment and governance of Fully Funded Small Business Health Insurance cooperatives, which are small businesses that form a captive insurance company chartered in a qualified state to provide excess claims coverage insurance that meets certain qualifications to its members. Directs the Secretary of the Treasury to establish an independent commission on Fully Funded Small Business Health Insurance Cooperatives to: (1) promote the development of such cooperatives; (2) make recommendations to the Secretary regarding minimum capital requirements; and (3) conduct oversight of such cooperatives. Exempts such cooperatives from certain state laws, rules, regulations, or orders, including any that would: (1) prohibit the establishment of a cooperative; (2) impose any material requirements, procedures, or standards on a cooperative that are not generally applicable to other entities engaged in a substantially similar business; or (3) discriminate against a cooperative or any of its members. Preempts any state law that conflicts with, hinders, poses an obstacle to, or frustrates the purpose of this Act. Sets forth provisions governing the provision of claims information, including protected health information, from health insurance issuers to cooperatives. Amends the Internal Revenue Code to establish the small business CHOICE tax credit for small employers for costs related to providing qualified employer-subsidized health coverage for employees and their families. Disallows such a credit unless the employee offers a qualified small business wellness program to covered employees and family members.

Adoption Improvement Act of 2007 - Directs the Secretary of Health and Human Services to carry out a pilot program of grants to child welfare agencies to effect long-range improvements in the adoption process by increasing prospective adoptive parent access to adoption information and strengthening agency responsiveness to prospective adoptive parents. Requires the Secretary also to: (1) research, through grant or contract, the successes and challenges of the programs established under the pilot program grants; and (2) include in the national annual review of child welfare agencies an examination of each state's progress regarding adoption information accessibility and agency responsiveness to prospective adoptive parents.

Expresses support for the goals and ideals of National Night Out. Requests that the President: (1) focus appropriate attention on neighborhood crime prevention, community policing, and reduction of school crime by delivering speeches, convening meetings, and directing the Administration to make crime reduction an important priority; and (2) coordinate the efforts of the Federal Emergency Management Agency (FEMA), the USA Freedom Corps, the Citizen Corps, the National Senior Service Corps, and AmeriCorps to participate by supporting local efforts, neighborhood watches, and local officials, including law enforcement personnel, to provide homeland security and combat terrorism in the United States.

Just and Lasting Peace in Sudan Act of 2008 - Prohibits sanctions imposed against the government of Sudan from being lifted until the President certifies to the appropriate congressional committees that the following conditions have been met for at least one year: (1) the government of Sudan (government) implements the Comprehensive Peace Agreement and the Darfur Peace Agreement; (2) the Abyei Boundary Commission recommendations are implemented and oil revenue shares are paid retroactively; (3) the government hands over to the International Criminal Court (ICC) all indicted individuals; (4) the government ends its atrocities against innocent civilians in Darfur and other parts of Sudan; (5) the government allows the deployment of United Nations African Union Mission in Darfur forces and allows unhindered access to humanitarian workers; (6) the government ends its terrorist ties; and (7) senior government officials are held accountable for crimes committed in the Nuba, South Sudan, Southern Blue Nile, and Eastern Sudan, and for their support for Osama bin Laden and other terrorist groups. Expresses the sense of Congress that the U.S. government should not normalize relations with Sudan until such conditions have been implemented for at least one year.

Prevent Unfair Manipulation of Prices Act of 2008 - Amends the Commodity Exchange Act (CEA) to extend the regulatory authority of the Commodity Futures Trading Commission (CFTC) to certain transactions in derivatives involving specified energy commodities ("included energy transactions"), including those on foreign boards of trade. Defines "included energy transaction" as a contract, agreement, or transaction in an energy commodity for future delivery that: (1) provides for a delivery point in the United States; or (2) is transacted on a computer terminal located in the United States. Prohibits the CFTC from exempting from regulation any "included energy transaction" unless certain notice to Congress and public comment requirements are met. Declares null and void any CFTC "no-action letter" exemptions from CEA requirements for "included energy transactions." Requires the CFTC to establish uniform limits on the aggregate number of positions with respect to "included energy transactions" which may be held by any person for the prompt month, for each month, and for all months in all markets subject to CFTC jurisdiction. Excludes swaps involving "included energy transactions" from any CEA exemption for bona fide hedging transactions. Defines "bilateral included energy transaction" as an included energy transaction executed or traded other than on or through a trading facility. Exempts such transactions from the requirement that transactions be made on or through a designated contract market. Applies to "bilateral included energy transactions" certain reporting and recordkeeping requirements. Instructs the CFTC to publish monthly on its website: (1) the aggregate number and value of long and short positions held by a person in any portfolio constructed to match or track the components of an index of all commodities; and (2) the portion of the positions that are net long positions in "included energy transactions." Amends the Natural Gas Act and the Federal Power Act to set forth enforcement powers of the Federal Energy Regulatory Commission (FERC), including cease-and-desist proceedings, temporary orders, and general implementation authority.

Reaffirms the historic commitment of the United States as a nation founded by refugees. Calls on: (1) the Department of State to support the refugee assistance efforts of the United Nations High Commissioner for Refugees and of nongovernmental organizations; (2) the U.S. government to continue its international leadership role in response to the people of the Darfur region of Sudan who have been displaced by Sudan's genocide; and (3) the Department of State and the Department of Homeland Security to facilitate the resettlement of an appropriate number of Darfuris. Urges the parties to the conflicts in and between Chad and Sudan to conclude a cessation of hostilities agreement. Calls upon the Joint African Union-United Nations Special Representative for Darfur to ensure that displaced persons are fairly represented in peace negotiations. Affirms the goals of World Refugee Day and reiterates a strong commitment to protecting the millions of refugees who live without material, social, and legal protections.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.
