FDA Modernization Act of 2021 This bill allows an applicant for market approval for a new drug to use methods other than animal testing to establish the drug's safety and effectiveness. Under this bill, these alternative methods may include cell-based assays, organ chips and microphysiological systems, sophisticated computer modeling, and other human biology-based test methods.

Tax Fairness for Workers Act This bill allows an above-the-line tax deduction for union dues and expenses. (An above-the-line deduction is subtracted from gross income and is available whether or not a taxpayer itemizes other deductions.) The bill also reinstates the miscellaneous itemized tax deduction for unreimbursed expenses attributable to the performance of services as an employee (Under current law, all miscellaneous itemized deductions are suspended through 2025).

Affordable Housing Credit Improvement Act of 2021 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2021 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit local approval and contribution requirements; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, acquisition credits, and foreclosures.

Mental Health for Latinos Act of 2021 This bill requires the Substance Abuse and Mental Health Services Administration to develop and implement an outreach and education strategy regarding behavioral health issues among the Hispanic and Latino populations. The strategy must promote behavioral and mental health and reduce stigma associated with mental health conditions and substance use disorders. The strategy must also address the impact of the COVID-19 pandemic on the mental and behavioral health of those populations.

Khalid Jabara and Heather Heyer National Opposition to Hate, Assault, and Threats to Equality Act of 2021 or the Jabara-Heyer NO HATE Act of 2021 This bill creates grants for state and local governments to combat hate crimes. It also authorizes additional penalties for hate crime offenses. Specifically, it establishes grants for states to create state-run hate crimes reporting hotlines. It also authorizes grants for states and local governments to implement the National Incident-Based Reporting System and to conduct law enforcement activities or crime reduction programs to prevent, address, or respond to hate crimes. Finally, in the case of an individual convicted of a hate crime offense and placed on supervised release, the bill allows a court to order that the individual participate in educational classes or community service as a condition of supervised release.

Voter Empowerment Act of 2021 This bill expands voter registration and voting access. Specifically, the bill expands voter registration by requiring states to (1) make available online voter registration, (2) establish automatic voter registration systems, (3) permit same-day voter registration, and (4) accept voter registration applications from individuals under age 18. Further, the bill limits removing voters from voter rolls and prohibits interference with voter registration or voting. Next, the bill requires states to allow individuals with disabilities to use absentee registration procedures and to vote by absentee ballot in federal elections. The bill also prohibits voter caging (the practice of sending mail to addresses on voter rolls, compiling a list of the undeliverable mail, and using the list to remove registered voters from voter rolls). Next, the bill expands voting access by requiring states to allow early voting and voting by mail without additional conditions. It also requires states to provide secured drop boxes at which individuals may drop off their completed absentee ballots. In addition, the bill declares that the right of a U.S. citizen to vote in any federal election shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. Finally, the bill permanently reauthorizes the Election Assistance Commission (EAC). It also directs the EAC to make grants to states for specified activities, including to implement automatic voter registration systems.

Prohibition of Medicaid Funding for Conversion Therapy Act This bill prohibits state Medicaid programs from covering conversion therapy. The bill defines conversion therapy as any practice or treatment that seeks to change a person's sexual orientation or gender identity in exchange for monetary compensation.

Public Servants Protection and Fairness Act of 2021 This bill establishes an alternative formula to calculate Social Security retirement benefits for those who receive pensions for certain non-covered employment. (The existing formula is known as the windfall elimination provision.) The alternative formula adjusts an individual's total lifetime earnings based on the proportion of covered earnings (i.e., earnings subject to Social Security payroll taxes). It applies to individuals who (1) first become eligible for benefits after 2022, (2) have earnings from non-covered service performed after 1977, and (3) have less than 30 years of coverage (i.e., years in which a beneficiary is considered to have contributed a substantial amount into the Social Security trust funds). Beneficiaries receive the higher benefit amount as calculated under the alternative method or the existing formula. In addition, the bill provides rebates for certain beneficiaries currently impacted by the existing formula. The Social Security Administration must include non-covered earnings in Social Security account statements, and the Government Accountability Office must study the availability of certain information related to retirement plans maintained by state and local governments.

National Science Foundation for the Future Act This bill reauthorizes the National Science Foundation (NSF) through FY2026 and authorizes programs and activities at the NSF. The bill establishes requirements for the NSF, including to enter into a contract with the National Academies of Science, Engineering, and Medicine to assess the status and opportunities for Pre-K through 12 science, technology, engineering, and mathematics, including computer science, (STEM) education research; award grants to establish no fewer than three multidisciplinary Centers for Tranformative Education Research and Translation to support research and development of STEM education innovations; award grants to establish a network of centers for science and technical education; carry out a national initiative to facilitate the development of networks and partnerships to broaden participation in STEM studies and careers of historically underrepresented groups; maintain a Research Security and Policy office to coordinate all research security policy issues across the NSF; award grants to support research to improve our understanding of the climate system and related human and environmental systems; support research to significantly advance our understanding of the food-energy-water system; and award grants to advance knowledge of risk assessment and predictability to improve our ability to predict extreme events and natural hazards, including pandemics. The bill also establishes within the NSF a Directorate for Science and Engineering Solutions to advance research and development solutions to address societal and national challenges.

Jeanette Acosta Invest in Women's Health Act of 2021 This bill directs the Department of Health and Human Services to establish a series of programs to increase access to cancer screenings for women. These programs include demonstration projects to train certain health care providers to screen for breast and cervical cancer, and increase co-testing of human papillomavirus (HPV) and cervical cancer among populations that have disproportionate rates of cervical cancer.

Resident Physician Shortage Reduction Act of 2021 This bill increases the number of residency positions eligible for graduate medical education payments under Medicare for qualifying hospitals, including hospitals in rural areas and health professional shortage areas. Current law provides for an increase of up to 200 positions per fiscal year beginning in FY2023, with a total increase of 1,000 positions; each hospital may receive up to 25 additional positions. The bill provides for an additional increase of 2,000 positions per fiscal year from FY2023-FY2029; during this period, each hospital may receive up to 75 additional positions in total under the bill and current law. Additionally, one-third of the positions that are made available under the bill must be allocated to hospitals that are already operating above applicable resident limits. The bill also requires the Government Accountability Office to report on strategies to increase the diversity of the health professional workforce, including with respect to representation from rural, low-income, and minority communities.

Equal Access to Abortion Coverage in Health Insurance Act of 2021 or the EACH Act of 2021 This bill requires federal health care programs to provide coverage for abortion services and requires federal facilities to provide access to those services. The bill also permits qualified health plans to use funds attributable to premium tax credits and reduced cost sharing assistance to pay for abortion services.

Emmett Till and Mamie Till-Mobley Congressional Gold Medal Act of 2021 This bill provides for the posthumous presentation of a Congressional Gold Medal in commemoration of Emmett Till and Mamie Till-Mobley. After the award the medal shall be given to the National Museum of African American History and Culture.

Children and Media Research Advancement Act or the CAMRA Act This bill requires the National Institutes of Health to fund research regarding the effects of media on infants, children, and adolescents. Such research must examine the impact of media (e.g., social media, television, video games) on cognitive, physical, and social-emotional development.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Michael Lecik Military Firefighters Protection Act This bill establishes a presumption of service-connection for specified diseases becoming manifest in certain veterans to a degree of disability of 10% or more within 15 years of the veteran's separation from active military, naval, or air service. Under a presumption of service-connection, specific diseases or disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. Veterans addressed by this bill are those who (1) are trained in fire suppression, and (2) served on active duty in a military occupational specialty or career field with a primary responsibility of firefighting or damage control for at least five years in the aggregate.

Student Loan Disclosure Transparency Act of 2021 This bill requires lenders disbursing federal student loans to disclose additional information to borrowers and increase the frequency of such disclosures. Specifically, prior to disbursement, the lender making a loan must disclose (1) the principal amount, interest rate, and number of required monthly payments to be made on the loan; (2) the estimated balance owed by the borrower; and (3) the estimated aggregate amount the borrower will pay. Prior to repayment, the lender must disclose the projected total of interest charges that the borrower will pay on the loan, as well as projections of the borrower's monthly repayment amount. The bill also requires certain disclosures for the life of the loan. In particular, lenders must disclose information about loans on a monthly, rather than periodic, basis. Lenders must also provide borrowers who are not in a repayment status (e.g., a borrower who is in school or in a deferment period) with a monthly statement. The Department of Education must obtain feedback from borrowers and report on the usefulness and effectiveness of such disclosures.

Huntington's Disease Disability Insurance Access Act of 2021 This bill expedites payment of Social Security Disability Insurance (SSDI) benefits and eligibility for Medicare coverage for those with Huntington's disease. This is an inherited disorder that causes brain cells to die, including in areas of the brain that help to control voluntary movement. Specifically, the bill eliminates the 5-month waiting period for SSDI benefits and the subsequent 24-month waiting period for Medicare coverage for individuals with Huntington's disease. Under current law, individuals generally must wait five months after the onset of disability to begin receiving SSDI benefits and an additional 24 months to become eligible for Medicare.

Wise Investment in Children Act of 2021 or the WIC Act of 20 21 This bill expands eligibility for children to receive benefits under the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). Specifically, the bill extends eligibility for the program until the period that ends on the earlier of the sixth birthday of a child or when the child enters kindergarten; extends the certification period under the program for infants to up to two years, instead of the current one year; and increases the certification time under the program for postpartum women to a period of up to two years. The bill also authorizes the Department of Agriculture to grant a waiver to a state, on request, that waives certification deadline requirements for the eligibility extensions if such state demonstrates there are unusual technological barriers to implementation, operational costs are not affordable within the nutrition services and administration grant of the state, or it is in the best interest of the program.

American Dream Employment Act of 2021 This bill establishes that, for the purposes of eligibility to be an officer or employee of an office of Congress, an individual shall be treated as a U.S. citizen if that individual has (1) employment authorization under the Deferred Action for Childhood Arrivals program, (2) employment authorization under a grant of deferred enforced departure, or (3) temporary protected status. (Generally, these programs and statuses allow eligible aliens to remain and work in the United States.)

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment of congenital anomalies and birth defects, such as reconstructive services and items. Coverage must include services and items that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician. Coverage limits and cost-sharing requirements for such services and items may not be more restrictive than those applicable to all medical and surgical benefits under the plan.

Harriet Tubman Bicentennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the legacy of Harriet Tubman as an abolitionist. The Secretary may issue coins under this bill only during the period of January 1, 2024, through December 31, 2024. All surcharges received by Treasury from the sale of such coins must be paid equally to the National Underground Railroad Freedom Center in Cincinnati, Ohio, and The Harriet Tubman Home, Inc. in Auburn, New York, for the purpose of accomplishing and advancing their missions.

Assault Weapons Ban of 2021 This bill makes it a crime to knowingly import, sell, manufacture, transfer, or possess a semiautomatic assault weapon (SAW) or large capacity ammunition feeding device (LCAFD). The prohibition does not apply to a firearm that is (1) manually operated by bolt, pump, lever, or slide action; (2) permanently inoperable; (3) an antique; or (4) a rifle or shotgun specifically identified by make and model. The bill also exempts from the prohibition the following, with respect to a SAW or LCAFD: importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments; importation, sale, transfer, or possession related to securing nuclear materials; and possession by a retired law enforcement officer. The bill permits continued possession, sale, or transfer of a grandfathered SAW, which must be securely stored. A licensed gun dealer must conduct a background check prior to the sale or transfer of a grandfathered SAW between private parties. The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD. Newly manufactured LCAFDs must display serial number identification. Newly manufactured SAWs and LCAFDs must display the date of manufacture. The bill also allows a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender a SAW or LCAFD under a buy-back program.

Leading Infrastructure For Tomorrow’s America Act or the LIFT America Act This bill establishes several programs and incentives to modernize the nation's communications, drinking water, energy, transportation, health care, and other related infrastructure. For example, the bill provides incentives to make broadband internet more accessible and affordable. It also establishes grants to implement next generation 9-1-1 services. In addition, it supports drinking water programs, including the drinking water state revolving fund program. Further, it provides grants to treat perfluoroalkyl or polyfluoroalkyl substances (commonly referred to as PFAS) in drinking water and to replace lead service lines. The bill establishes a variety of programs to support clean energy infrastructure and address climate change, including efforts to (1) modernize the electric grid and make it more resilient, efficient, and secure; (2) increase energy efficiency in buildings; and (3) support renewable energy infrastructure. Further, it provides incentives for vehicle infrastructure, such as incentives to develop infrastructure for electric vehicles and grants to reduce air pollution at ports by electrifying port infrastructure. Additionally, the bill establishes grants and programs for health care infrastructure, including by providing support for the Centers for Disease Control and Prevention, laboratories, and state, local, tribal, and territorial health departments. Finally, the bill reauthorizes grant programs to remediate brownfield sites (i.e., sites contaminated with hazardous substances) through FY2026.

Hate Crimes Commission Act of 2021 This bill establishes the United States Commission on Hate Crimes. The commission must investigate and report on whether hate crimes have increased; factors that contributed to an increase in hate crimes, if one is determined to exist; policies or actions by law enforcement agencies to reduce the commission of hate crimes; the impact of underreporting on hate crimes statistics and prevention; and successful community bias prevention responses.

COVID - 19 Hate Crimes Act This bill requires a designated officer or employee of the Department of Justice (DOJ) to facilitate the expedited review of COVID-19 (i.e., coronavirus disease 2019) hate crimes and reports of COVID-19 hate crimes. It defines COVID-19 hate crime as a violent crime that is motivated by two things: (1) the actual or perceived characteristic (e.g., race or ethnicity) of any person, and (2) the actual or perceived relationship to the spread of COVID-19 of any person because of that characteristic. The bill requires DOJ to issue guidance for state and local law enforcement agencies on (1) the establishment of online hate crime reporting processes and the availability of online reporting in multiple languages, and (2) the expansion of culturally competent education campaigns. Additionally, DOJ and the Department of Health and Human Services must issue guidance on best practices for mitigating racially discriminatory language in describing the COVID-19 pandemic.

PPP Extension Act of 2021 This bill extends the Paycheck Protection Program, established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019), through June 30, 2021. Currently, the program is set to expire on March 31, 2021. For the final 30 days of the program (i.e., from June 1 until June 30), the Small Business Administration may only process applications submitted prior to June 1, and it may not accept any new loan applications.

Medicaid Report on Expansion of Access to Coverage for Health Act or the Medicaid REACH Act This bill reduces federal payment for Medicaid administrative expenses incurred by states that have not elected to participate in Medicaid expansion under the Patient Protection and Affordable Care Act (i.e., nonexpansion states) if the state does not comply with specified reporting requirements. The bill requires nonexpansion states to report, among other information, the number of uninsured individuals under the age of 65 and the estimated percentage of such individuals who would be eligible to receive coverage if the state expanded Medicaid.

Funding for Aviation Screeners and Threat Elimination Restoration Act or the FASTER Act This bill repeals the requirement that a portion of aviation security service fees collected from passengers be credited as offsetting receipts and deposited in the general fund of the Treasury. It requires such fees to be deposited into a separate account in the Treasury for expenditure to pay only the costs of activities and services for which the fee is imposed (i.e., aviation security screening).

This resolution recognizes the forthcoming centennial of the Tulsa Race Massacre of 1921. The resolution acknowledges the historical significance of this event as one of the largest single instances of state-sanctioned violence against Black people in American history; honors the lives and legacies of the estimated 300 Black individuals who were killed during the massacre and the nearly 9,000 who were left homeless and penniless; condemns efforts to cover up the truth and shield the white community, especially government officials, from accountability; condemns the continued legacy of racism and white supremacy against Black people in the United States, particularly in the form of police brutality; encourages education about the massacre, the history of white supremacy that fueled the massacre, and subsequent attempts to deny or cover up the massacre, in all elementary and secondary education settings and in institutions of higher education; and recognizes the commitment of Congress to acknowledge and learn from the history of racism and racial violence to reverse the legacy of white supremacy and fight for racial justice.

Violence Against Women Reauthorization Act of 2021 This bill modifies and reauthorizes through FY2026 programs and activities under the Violence Against Women Act that seek to prevent and respond to domestic violence, sexual assault, dating violence, and stalking. The bill also authorizes new programs, makes changes to federal firearms laws, and establishes new protections to promote housing stability and economic security for victims of domestic violence, sexual assault, dating violence, and stalking.

Dr. Lorna Breen Health Care Provider Protection Act This bill establishes grants and requires other activities to improve mental and behavioral health and prevent burnout among health care providers. Specifically, the Department of Health and Human Services (HHS) must award grants to train health care providers on suicide prevention, other behavioral health issues, and strategies to improve well-being; and establish or expand programs to promote mental and behavioral health among health care providers involved with COVID-19 (i.e., coronavirus disease 2019) response efforts. HHS must also study and develop policy recommendations on preventing burnout and improving mental and behavioral health among health care providers, removing barriers to accessing care and treatment, and identifying strategies to promote resiliency. Additionally, the Centers for Disease Control and Prevention must conduct a campaign to encourage health care providers to seek support and treatment for mental and behavioral health concerns.

Capitol Remembrance Act This bill requires the Architect of the Capitol (AOC) to design and install in a prominent location in the U.S. Capitol a permanent exhibit that depicts the January 6, 2021, attack on the Capitol. To the extent possible, the AOC must preserve property that was damaged during the attack and include it in the exhibit. The AOC must also include (1) existing photographic records relating to the attack; and (2) a plaque to honor the U.S. Capitol Police and other law enforcement agencies that protected the Capitol, the individuals who died or sustained injuries to protect the Capitol, and the staff who helped restore the Capitol complex after the attack.

Reporting Efficiently to Proper Officials in Response to Terrorism Act of 2021 or the REPORT Act This bill requires the Department of Homeland Security, in coordination with the Department of Justice and the Federal Bureau of Investigation, whenever an incident of terrorism occurs in the United States, to submit to Congress an unclassified report upon completion of the investigation by the primary U.S. government agency conducting the investigation concerning the incident. Such a report shall contain (1) a statement of the facts of the incident that are known at the time of such report; and (2) any recommendations for changes in practices or law, consistent with the Constitution, with particular attention to changes that could help prevent future incidents of terrorism.

American Dream and Promise Act of 2021 This bill provides certain aliens with a path to receive permanent resident status and contains other immigration-related provisions. The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants. The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs. DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed. Furthermore, DHS and DOJ shall cancel the removal of certain aliens who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such an alien shall receive permanent resident status upon meeting certain requirements and applying for such status within three years of this bill's enactment. DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes. This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented aliens unless those benefits are available to all U.S. nationals without regard to residency in the state.
