Constitutional Amendment - Prohibits outlays for a fiscal year (except those for repayment of debt principal) from exceeding total receipts for that fiscal year (except those derived from borrowing) unless Congress, by a three-fifths roll call vote of each House, authorizes a specific excess of outlays over receipts. Requires a three-fifths roll call vote of each House to increase the public debt limit. Directs the President to submit a balanced budget to Congress. Prohibits any bill to increase revenue from becoming law unless approved by a majority of each House. Authorizes waivers of these provisions when a declaration of war is in effect or under other specified circumstances involving military conflict.

Clergy Housing Allowance Clarification Act of 2002 - Amends the Internal Revenue Code to specify that the parsonage allowance exclusion from gross income cannot exceed the fair rental value of the home, including furnishings and appurtenances such as a garage, plus the cost of utilities.

Combat Pay for Combat Risk Act of 2002 - Dictates that a member of the Armed Forces of the United States who is entitled to special pay for being subject to hostile fire or imminent danger as part of Operation Enduring Freedom (or any successor operation) shall be treated in the same manner as if the individual were in a combat zone for the following provisions of the Internal Revenue Code: (1) those relating to the special rule where a deceased spouse was missing in action; (2) those pertaining to exclusion of certain combat pay for soldiers; (3) those relating to income taxes of members of the Armed Forces upon death; (4) those pertaining to members of the Armed Forces dying in combat zone or by reason of wounds suffered in the combat zone; (5) those defining wages relating to combat pay (to apply to remuneration paid after the passage of the Act); (6) those dealing with taxation of phone service for soldiers from a combat zone; (7) those pertaining to a joint tax return where an individual is missing in action; and (8) those relating to time for performing certain acts postponed due to service in a combat zone.

Declares that Congress expresses its deepest gratitude for the service of the District of Columbia Army National Guard in protecting Congress and increasing security around the Capitol complex. Congratulates the National Guard and Capitol Police on the fine work they have done to increase security around the Capitol grounds since the terrorist attacks of September 11, 2001.

Directs the Secretary of the military department concerned to establish a program under which leave accrued by a member of that military department may be voluntarily transferred to another member of the same department who requires additional leave due to a qualifying emergency. Requires transfer approval by the commanding officers of both the donor and recipient. Defines a qualifying emergency as one which is likely to require prolonged absence and is the result of: (1) a medical condition of an immediate family member; or (2) any other hardship that such Secretary determines appropriate.

Ten Commandments Defense Act of 2002 - Declares reserved to the States the power to display the Ten Commandments on State or local government property. Declares that expressions of religious faith by individual persons upon State property are: (1) protected against Federal laws or regulations respecting an establishment of religion or prohibiting the free exercise of religion; and (2) among those liberties of which no State may deprive any person without due process of law made in pursuance of powers reserved to the States. Requires the courts established by the Congress to exercise judicial power in accordance with such declarations.

Schoolchildren's Health Protection Act - Amends the General Education Provisions Act to prohibit Federal education funding (from programs for which the Secretary or Department of Education has administrative responsibility) to any State or local educational agency that provides to an unemancipated minor, at an elementary or secondary school, postcoital emergency contraception (e.g. the "morning-after pill") or a prescription for such contraception.

Immediate Helping Hand Prescription Drug Assistance Act of 2002 - Amends the Social Security Act (SSA) to establish an outpatient prescription drug assistance entitlement program for low-income Medicare (SSA title XVIII ) beneficiaries under a new title XXII (Outpatient Prescription Drug Assistance Program). Allows States, in lieu of using the funding provided under this new title, to provide assistance to such beneficiaries through a State plan under SSA title XIX (Medicaid) or through Medicare part C (Medicare+Choice). Amends SSA title XIX to provide for expanded coverage of low-income Medicare beneficiaries under Medicaid. Amends SSA title XVIII to provide for: (1) coverage of low-income Medicare beneficiaries in Medicare+Choice; and (2) low-income Medicare beneficiaries to elect to suspend Medicare supplemental (Medigap) insurance.

Authorizes the Secretary of Health and Human Services to make grants to eligible nonprofit community based pregnancy help medical clinics to purchase ultrasound equipment to provide free examinations to pregnant women, under the direction and supervision of a licensed medical physician. Conditions eligibility on a clinic agreeing to provide each examined woman a visual image, the age, and a physical description of the fetus and information on abortion and alternatives.

Employee Retirement Savings Bill of Rights - Amends the Internal Revenue Code to: (1) impose an excise tax on a pension plan failing to provide notice of generally accepted investment principles, including principles of risk management and diversification; (2) impose an excise tax on a pension plan failing to provide notice of any transaction restriction period to each applicable individual to whom the transaction restriction period applies (and to each employee organization representing such applicable individuals); and (3) set forth diversification requirements for plans, including requiring the provision of at least three investment options, other than employer securities, in amounts equivalent to the amounts invested in employer securities.

Expresses the sense of Congress that: (1) the members of American Gold Star Mothers, Inc., and Blue Star Mothers of America, Inc. should be recognized for their sacrifices and for their dedicated and patriotic support of the United States; (2) during the period in which the armed forces are engaged in the war on terrorism, members of the immediate family of individuals serving in the armed forces should be encouraged to display a service flag approved by the Secretary of Defense in the window of their place of residence and to wear a service lapel button approved by the Secretary; and (3) the President should issue a proclamation calling on such members to take such actions.

Cyber Security Enhancement Act of 2001 - Directs the United States Sentencing Commission to amend Federal sentencing guidelines and otherwise address crimes involving fraud in connection with computers and access to protected information, protected computers or restricted data in interstate or foreign commerce or involving a computer used by or for the Federal Government. Includes among exceptions to otherwise criminal conduct emergency disclosures to a governmental entity by an electronic communication service and specified disclosures made in good faith. Increases penalties for violations where the offender knowingly causes or attempts to cause death or serious bodily injury. Directs the Attorney General, acting through the Federal Bureau of Investigation, to establish and maintain a National Infrastructure Protection Center to serve as a national focal point for threat assessment, warning, investigation, and response to attacks on the Nation's critical infrastructure, both physical and cyber. Establishes within the Department of Justice an Office of Science and Technology to work on law enforcement technology issues, addressing safety, effectiveness and improved access by Federal, State, and local law enforcement agencies. Includes investigative and forensic technologies, corrections technologies, and technologies that support the judicial process. Abolishes the Office of Science and Technology of the National Institute of Justice, transferring functions, activities, and funds to the newly formed Office. Requires the Director of the Office to operate and support National Law Enforcement and Corrections Technology Centers.

Health Care Safety Net Improvement Act - Amends the Public Health Service Act (PHSA) to increase the authorization of appropriations for health centers for FY 1997 through FY 2002 and authorize such appropriations as may be necessary for such centers for FY 2003 through FY 2006. Includes within: (1) "required primary health services" appropriate cancer screening (currently, screening for breast and cervical cancer), specialty referral when medically indicated, and specified housing-related services; and (2) "additional health services" behavioral and mental health substance abuse services. Permits grants to health centers for the planning and development of management networks. Rewrites PHSA provisions regarding rural health. Provide grants for expanded delivery of health care services in rural areas, for the planning and implementation of integrated health care networks in rural areas, and for the planning and implementation of small health care provider quality improvement activities. Telehealth Grant Consolidation Act of 2001 - Provides for the establishment: (1) of telehealth network and telehealth resource centers grant programs; and (2) an Office for the Advancement of Telehealth. Provides for grants to eligible entities to enable such entities to provide for improved emergency medical services in rural areas. Reauthorizes and rewrites PHSA provisions regarding the National Health Service Corps program. Prohibits an entity to which a Corps member is assigned from denying requested health services and discriminating in the provision of services because an individual is unable to pay. Provides for a community access demonstration program to improve the effectiveness, efficiency, and coordination of services for uninsured and underinsured individuals. Expands the availability of dental health services.

Pathogen Research, Emergency Preparedness and Response Efforts Act of 2001 (PREPARE Act) - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to encourage the development and manufacture of new products or new uses for products which can identify, prevent, or treat biological agents. Permits a limited antitrust exemption for the cooperative efforts of the pharmaceutical, biotechnical, medical device, and research industries when working to develop and bring such countermeasure products to market. Authorizes the Secretary to enter into contracts and provide assistance for product development, including good manufacturing practices and facility security. Requires the Secretary to ensure that medical supplies from the National Pharmaceutical Stockpile are located in appropriate proximity to the site of special events. Amends the Federal Food, Drug, and Cosmetic Act to permit: (1) fast-track designation and priority review for unapproved countermeasure products; and (2) the use of animal trials for drugs useful against lethal or disabling agents. Requires the Secretary to: (1) prohibit the unauthorized transportation of biological agents; (2) establish and maintain a list of each biological agent and toxin potentially threatening to public health and another list of those agents and toxins potentially threatening to national security; and (3) establish safety procedures for the transfer of such agents and toxins. Requires the Secretaries of Health and Human Services and Defense to coordinate the creation of a government-owned, contractor-operated vaccine production facility on a military installation.

Stroke Treatment and Ongoing Prevention Act of 2001 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to carry out a national education and information campaign promoting stroke prevention and immediate treatment. Directs the Secretary to: (1) maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse, including conducting and/or making available research concerning best practices for prevention, treatment, and rehabilitation; (2) make grants to States to establish statewide stroke prevention, treatment, and rehabilitation systems; and (3) develop a model curriculum for training emergency medical services personnel. Sets forth requirements for the State grant program, including matching funds, standards for care and facilities, central data reporting and analysis, special consideration for geographic areas with high rates of disability from stroke or significant need, and technical assistance. Authorizes the Secretary to make grants to develop and implement education programs for appropriate medical personnel with regard to newly developed diagnostics, technologies, and therapies for stroke prevention and treatment.

Extends the tax benefits available under the Internal Revenue Code for services performed in a combat zone to duty performed by a member of the U.S. armed forces in the Republic of Korea from July 1 to December 31, 2000, during which such member was entitled to hardship duty pay.

Cyber Security Research and Development Act - Authorizes appropriations, to the National Science Foundation (NSF) and to the Secretary of Commerce for the National Institute of Standards and Technology (NIST), to establish new programs and to increase funding for certain current programs for computer and network security research and development and research fellowships. Requires the NSF Director to award grants for computer and network security through the following: (1) basic research in innovative approaches to the structure of their hardware and software; (2) multidisciplinary research centers, through institutions of higher education (IHEs) or their consortia which may partner with government laboratories or for-profit institutions; (3) undergraduate and master's degree programs, as well as education-related grants under the Scientific and Advanced Technology Act of 1992; (4) graduate traineeships; and (5) graduate research fellowships. Amends the National Science Foundation Act of 1950 to include among NSF functions leading in supporting research and education activities to improve networked information systems' security. Amends the National Institute of Standards and Technology Act to require the NIST Director to establish a program of assistance to IHEs that enter into partnerships (which may include government laboratories) with for-profit entities to support research to improve the security of computer systems. Requires such program to include: (1) multidisciplinary, long-term, high-risk research; (2) research directed toward addressing needs identified through computer security review, public meeting, and information activities of the Computer System Security and Privacy Advisory Board (with special funds authorized by this Act); and (3) support for graduate students, post-doctoral researchers, and senior researchers. Requires NIST to carry out specified types of intramural computer security research. Requires the NIST Director to arrange with the National Research Council of the National Academy of Sciences to study and report to Congress on critical infrastructure weaknesses.

Networking and Information Technology Research Advancement Act - Amends the High-Performance Computing Act of 1991 to rename the National High-Performance Computing Program the Networking and Information Technology Research and Development Program, expanding its focus beyond Federal high-performance computing research and coordination to include all Federal networking and information technology activities. Requires such program to address the issues of network information systems security as well as more general research goals, including network stability and the social and economic consequences of such technology. Requires the Director of the Office of Science and Technology Policy's annual report to include a detailed description of the Program Component Areas, including changes and activities contributing to network security improvement. Expands the role of the advisory commission to include program evaluation. Repeals provisions concerning the National Research and Education Network and the Next Generation Internet Program. Revises research activities of the National Science Foundation, the National Aeronautics and Space Administration, the Departments of Energy and Commerce (including the National Institute of Standards and Technology and the National Oceanic and Atmospheric Administration), and the Environmental Protection Agency to incorporate networking and information technology. Requires the Director of the National Science Foundation to: (1) arrange for an assessment of the state of research on networking and information technology in the United States; and (2) continually collect and arrange for the analysis of data on the information technology workforce, including size, occupation category, education, training, compensation, and the role of foreign workers.

Medicare Physician Payment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the conversion factor (update) for payments under the Medicare physician fee schedule for 2002 at 0.9 percent less than the conversion factor for 2001. Declares that this conversion factor and a specified update adjustment factor for a year after 2002 shall be applied as if this Act had not been in effect. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing or modifying the use of the sustainable growth rate as a factor in determining the update for such payments such that the factor used more fully accounts for changes in the unit costs of providing physicians' services.

Amends the Internal Revenue Code to tax lifetime annuity payouts and similar payments of life insurance proceeds at dates later than death at capital gains rates. Excludes amounts received under an eligible deferred compensation plan or under a qualified retirement plan. Includes such gains in the calculation of the maximum rate of tax on net capital gains of noncorporate taxpayers when computing the alternative minimum tax.

Help America Vote Act of 2001 - Directs the Administrator of General Services to establish programs under which the Administrator makes payments to each eligible State or local government to: (1) replace a punch card voting system with a voting system which does not use punch cards; or (2) make technical enhancements to the performance of its punch card voting system. Establishes: (1) an independent Election Assistance Commission to serve as a national clearinghouse and resource for the compilation of information and review of procedures with respect to the administration of Federal elections; and (2) the Election Assistance Commission Standards Board and the Election Assistance Commission Board of Advisors to review any of the voluntary standards for engineering and procedural performance, for maintenance and enhancement of the accessibility and privacy of registration facilities, polling places, and voting methods, and for election management practices recommended by the Commission. Establishes the Technical Standards Development Committee to assist the Executive Director of the Commission by recommending standards to ensure the usability, accuracy, security, accessibility, and integrity of voting systems and voting equipment. Directs the Commission to: (1) provide for the testing, certification, decertification, and recertification of voting system hardware and software by accredited laboratories; (2) make payments to States for voting system improvements, grants to entities for voting equipment and technology research and development, and grants for pilot programs to try out new voting systems and equipment technologies; and (3) develop the Help America Vote College Program to encourage college students to assist State and local governments in election administration. Amends Federal law to create the Help America Vote Foundation as a nonprofit charitable corporation to mobilize secondary school students to participate in the election process in a nonpartisan manner as poll workers or assistants. Outlines minimum standards for State election systems. Sets forth provisions regarding voting rights of military members and overseas citizens. Amends Federal postal service law to replace reduced rates for voter registration purposes with reduced rates for official election mail.

Encourages the people of the United States: (1) to support such personnel through a united effort to be known as Operation Enduring Support; and (2) as part of such Operation, to support military families, stage patriotic send-off and welcome-home rallies and parades; and volunteer and contribute financial assistance to the Red Cross, United Way, and similar organizations.

Spirit of America Commemorative Coin Act of 2001 - Directs the Secretary of the Treasury to mint and issue $50 gold coins, one-dollar silver coins, and half-dollar clad coins emblematic of the tragic events that occurred at the Pentagon, in New York City, and in Pennsylvania, on September 11, 2001. Establishes the Victims of September 11th Fund which shall consist of amounts from surcharges received from the sale of such coins transferred to the Office for Victims of Crime for individuals who were injured, and to the families of individuals who were killed or injured, in the terrorist attacks against the United States on September 11, 2001.

Combatting Illegal Gambling Reform and Modernization Act - Amends the Federal criminal code to revise provisions regarding interstate gambling. Increases the term of imprisonment for violations. Prohibits (with exceptions) any person engaged in a gambling business from knowingly using a communication facility for the transmission: (1) of bets or wagers, or betting information, in interstate or foreign commerce, within the special maritime and territorial jurisdiction of the United States, or to or from any place outside the jurisdiction of any nation regarding any transmission to or from the United States,; or (2) of a communication in such interstate or foreign commerce which entitles the recipient to receive money or credit as a result of bets or for information assisting in the placing of bets. Prohibits (with exceptions) any person engaged in a gambling business from knowingly accepting credit, an electronic fund transfer, a check, or the proceeds of certain other forms of financial transaction as the Secretary may prescribe in connection with the transmission of such a communication of information assisting the placing of bets. Lists exceptions, including certain: (1) transmissions of information assisting in the placing of bets (such as for use in news reporting); and (2) uses of communication facilities for the transmission of bets (e.g., where a State or Tribe has explicitly authorized such bets). Sets forth remedies for violations. Bars imposition of damages, penalties, or forfeiture against any person or entity for an act done in compliance with notice received from a law enforcement agency.

Disaster Relief Charities Accountability Act - Establishes the Charity Accountability Board which shall: (1) request information from and make recommendations to qualifying charitable organizations regarding the amount of disaster relief funds collected and dispersed by such organizations, administrative costs incurred, and the criteria used in dispersing disaster relief funds; (2) provide information about disaster relief funds to disaster victims and those wishing to contribute to such funds; and (3) report to the President and Congress on the status of such funds.

Military Widows Equity Act - Repeals, as of October 1, 2002, certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military pay or who would be entitled to retired pay except for being under 60 years of age. Provides for the recoupment of certain amounts previously paid to SBP recipients in the form of a retired pay refund.

Water Infrastructure Security and Research Development Act - Directs the Administrator of the Environmental Protection Agency to establish a program of research, development, and demonstration activities to achieve improvements to technologies and related processes for the security of water supply systems. Requires the program to be carried out through grants to, or cooperative agreements with, research organizations to be used for matters including the following: (1) research regarding vulnerability assessment and physical asset and information system protection technologies; (2) dissemination of research results to the public and to managers of water supply systems; (3) demonstration and assessment of upgraded security technologies; (4) development of security standards and procedures; and (5) research and development related to real-time monitoring to protect against, and technologies and processes to address, chemical, biological, and radiological contamination.

Social Security Benefits Guarantee Act of 2001 - Directs the Secretary of the Treasury to issue a benefit guarantee certificate, with an accurate annual cost-of-living adjustment, to each individual determined by the Commissioner of Social Security to be entitled to benefits under title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act.

Terrorist Response Tax Exemption Act - Amends the Internal Revenue Code to exempt from gross income compensation received by a civilian uniformed employee for any month during any part of which such employee provides security, safety, fire management, or medical services in a terrorist attack zone.

Higher Education Relief Opportunities for Students Act of 2001 - Authorizes the Secretary of Education to waive or modify certain requirements of student financial aid programs under title IV of the Higher Education Act of 1965 as the Secretary deems necessary in connection with the national emergency declared by the President with respect to the terrorist attacks of September 11, 2001, or any subsequent national emergency declared by reason of terrorist attacks (the emergency). Authorizes such waiver or modification of requirements in order to provide relief from certain financial and administrative burdens to affected individuals who: (1) are serving on active duty during the emergency; (2) reside or are employed in a disaster area declared by any Federal, State, or local official in connection with the emergency; or (3) suffered direct economic hardship as a direct result of the emergency, as determined under a waiver or modification issued under this Act. Authorizes waiver or modification of certain reporting requirements for institutions of higher education, lenders, guarantee agencies, and other entities participating in such programs, if such entities are located in declared disaster areas connected to the emergency. Expresses the sense of Congress that institutions offering postsecondary education should provide refunds and waivers of certain requirements to students who are members of the Armed Forces serving on active duty during the national emergency.
