Mandate Prevention Act of 2010 - Amends the Congressional Budget Act of 1974 (CBA) to make it out of order to consider in either chamber of Congress any legislation that would increase the direct costs of federal private sector mandates by an amount that causes the applicable thresholds to be exceeded, unless the legislation: (1) provides new budget or entitlement authority in the House of Representatives or direct spending authority in the Senate for each fiscal year for such mandates in an amount equal to or exceeding the direct costs of each such mandate; or (2) includes an authorization of appropriations in an amount equal to or exceeding the direct costs of such mandates and makes other specified arrangements for up to 10 years during which each mandate shall be in effect under the legislation. Applies such prohibition to any legislative provision increasing direct costs of a federal private sector mandate (currently, federal intergovernmental mandate only) in any legislation reported by a congressional appropriations committee. Amends Rule XVIII (The Committee of the Whole House on the state of the Union) of the Rules of the House to state that the Committee of the Whole may be precluded from considering an amendment proposing only to strike an unfunded federal private sector mandate from the portion of the bill then open to amendment only by specific terms of a special order of the House. Amends the CBA to equalize the threshold between private sector and intergovernmental mandates.

National Border and Homeland Security Act of 2010 - Amends the Immigration and Nationality Act to give state criminal alien assistance program (SCAAP) funding priority to: (1) northern or southern border states; or (2) state political subdivisions having one of the four largest populations of unlawfully present aliens for the preceding fiscal year. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to direct the Secretary of Homeland Security (DHS) (Secretary) to complete the required 700 mile southwest border fencing by December 31, 2012. Amends the Secure Fence Act of 2006 to direct the Secretary to achieve operational control over U.S. international land and maritime borders by December 31, 2012. Directs the Secretary to: (1) increase the number of full-time, active-duty Border Patrol agents; (2) increase the number of Customs and Border Protection officers at U.S. ports of entry; and (3) ensure the implementaion of the automated entry and exit control system for aliens entering the United States at ports of entry (US-Visit) by December 31, 2011. Prohibits the Secretary of the Interior and the Secretary of Agriculture (USDA) from impeding border security-related activities by the Secretary on U.S. public lands. Sets forth activities that may be taken to increase the number of Operation Streamline prosecutions by the following U.S. district courts: (1) the District of Arizona; (2) the District of New Mexico (3) the Southern District of California (4) the Southern District of Texas; and (5) the Western District of Texas. Increases criminal penalties for improper U.S. entry by an alien. Excludes minimum mandatory prison penalties for an alien who: (1) is under 18 years old; (2) is a parent traveling with a child under 18 years old; or (3) has a life-threatening health condition. Amends the Homeland Security Act of 2002 to direct the Domestic Nuclear Detection Office (of DHS), in protecting the United States from a nuclear, fissile material, or radiological attack, to consider potential smuggling routes in land border areas between ports of entry, railcars entering the United States from Canada or Mexico, and private aircraft or small vessels. Directs the Secretary to procure the number of next generation portable radiation detectors (PRD) and radioactive isotope identification devices (RIID) required by the Border Patrol along the southern and northern U.S. borders by July 1, 2011. Authorizes appropriations for port security grants. Directs the Secretary to develop and implement a strategic plan to detect and interdict biological and chemical weapons entering the United States.

Meaningful End to Defensive Medicine & Aimless Lawsuits (MedMal) Act of 2010 - Sets forth provisions regulating lawsuits for health care liability claims related to the provision of health care goods or services. Sets a statute of limitations of three years after the date of the manifestation of injury or one year after the claimant discovers the injury, with certain exceptions. Caps the amount of noneconomic damages at $350,000 if a claimant rejects a settlement that meets certain criteria. Prohibits a provider of collateral source benefits from recovering any amount from an award in a health care lawsuit involving injury or wrongful death. Makes a benevolent gesture or admission of fault that is made by a health care provider or employee to the claimant or the claimant's relative or representative inadmissible as evidence of an admission of liability or an admission against interest. Makes each party liable only for the amount of damages proportional to such party's percentage of responsibility. Authorizes the award of punitive damages only where: (1) it is otherwise permitted by applicable state or federal law; (2) it is proven by clear and convincing evidence that the defendant acted with malicious intent to injure the claimant or deliberately failed to avoid unnecessary injury the claimant was substantially certain to suffer; and (3) compensatory damages are awarded. Provides for periodic payment of future damages. Prohibits a health care provider from being named as a party to a product liability lawsuit for prescribing or dispensing a Food and Drug Administration (FDA)-approved medical product. Prescribes qualifications for expert witnesses.

Requires distribution of the first $5 million to the Director of the United States Marshals Service National Museum, for the preservation, maintenance, and display of artifacts and documents of the U.S. Marshals Service. Requires distribution of: (1) $1 million to the National Center for Missing and Exploited Children; (2) $1 million to the National Law Enforcement Officers Memorial Fund in support of the National Law Enforcement Museum and the National Law Enforcement Officers Memorial; (3) $1 million to the Federal Law Enforcement Officers Association; (4) $500,000 to the William "Bill" Degan Scholarship Fund (provides scholarships for spouses and children of law enforcement officers killed in the line of duty); (5) $500,000 to the Robert D. May Scholarship Fund (provides scholarships for spouses and children of law enforcement officers killed in the line of duty); (6) $500,000 to the Community Oriented Policing Service; and (7) $500,000 to the United States Marshals Service Association. Authorizes the Secretary to strike and sell bronze duplicates of the $5 gold coins.

Digital Goods and Services Tax Fairness Act of 2010 - Prohibits a state or local jurisdiction from imposing multiple or discriminatory taxes on or with respect to the sale or use of digital goods or services delivered or transferred electronically to a customer. Restricts taxation of digital goods and services to the retail sale of such goods and services and by the jurisdiction encompassing a customer's tax address. Prohibits the use of existing regulations or administrative rulings relating to the taxation of tangible personal property or other services to impose any tax on the sale or use of digital goods or services. Prohibits taxation on or with respect to the sale or use of digital medical, education, or energy management services. Provides that if charges for digital goods and services are not separately stated from charges for other goods or services, the charges for digital goods and services may be taxed at the same rate and on the same basis as charges for other goods and services unless the seller can reasonably identify the charges for digital goods and services from its business records. Grants jurisdiction to federal district courts to prevent a violation of this Act. Expresses the sense of Congress that each state shall take reasonable steps to prevent multiple taxation of digital goods and services where a foreign country has imposed a tax on such goods and services.

Property Owners Access to Court Act of 2010 - Amends the federal judicial code to provide that, whenever a district court exercises jurisdiction in civil rights cases in which the operative facts concern the uses of real property, it shall not abstain from exercising such jurisdiction, or relinquish it to a state court, if the party seeking redress does not allege a violation of a state law, right, or privilege, and no parallel proceeding is pending in state court, at the time the action is filed in the district court, that arises out of the same operative facts as the district court proceeding. Declares that in an action in which operative facts concern the uses of real property, the district court shall exercise jurisdiction even if the party seeking redress does not pursue judicial remedies provided by a state or territory. Provides for referral of an unsettled question of state law to the state's highest appellate court. Prohibits the district court from certifying a question of state law unless it is necessary to resolve the merits of the injured party's federal claim, and such question is patently unclear. Declares that any claim or action to redress the deprivation of a property right or privilege secured by the Constitution shall be ripe for adjudication by the district courts upon a final decision rendered by any person acting under color of any law, regulation, custom, or usage of any state or U.S. territory that causes actual and concrete injury to the party seeking redress. Declares that any claim founded upon a property right or privilege secured by the Constitution, but allegedly infringed or taken by the United States, shall be ripe for adjudication upon a final decision rendered by the United States which causes actual and concrete injury to the party seeking redress. Amends the Revised Statutes of the United States and the federal judicial code with respect to certain constitutional property rights claims. Provides for the liability of the United States for certain claims, brought under U.S. district court jurisdiction or Court of Federal Claims jurisdiction, where the claim is founded upon a property right or privilege secured by the Constitution. Requires a federal agency, whenever it takes action limiting the use of private property that may be affected by the amendments made by this Act, to give notice to the owners of that property explaining their rights and the procedures for obtaining any compensation that may be due to them under such amendments.

Prevention of Interstate Commerce in Animal Crush Videos Act of 2010 - Amends the federal criminal code to revise provisions prohibiting knowingly creating, selling, or possessing a depiction of animal cruelty to prohibit knowingly and for the purpose of commercial advantage or private financial gain selling or distributing an animal crush video in interstate or foreign commerce. States that such prohibition does not prohibit the sale or distribution of any visual depiction of hunting, trapping, fishing, or customary and normal veterinary or agricultural husbandry practices. Defines "animal crush video" as any obscene photograph, motion-picture film, video recording, or electronic image that depicts actual conduct in which one or more living animals is intentionally crushed, burned, drowned, suffocated, or impaled in a manner that would violate a criminal prohibition on cruelty to animals in the federal or state jurisdiction in which the depiction is created, sold, distributed, or offered for sale or distribution.

Amends the Balanced Budget and Emergency Deficit Control Act of 1985 to require a sequestration of federal spending equivalent to the estimated aggregate amount designated by taxpayers under this Act to reduce the public debt. Prohibits any reduction in social security retirement benefits, veterans benefits, or interest payments on federal debt as a result of any such sequestration.

Sets forth reconciliation instructions for the House Committees on: (1) Agriculture; (2) Education and Labor: (3) Energy and Commerce; (4) Financial Services; (5) the Judiciary; (6) Natural Resources; (7) Oversight and Government Reform; and (8) Ways and Means. Requires the House Committee on the Budget to report a reconciliation bill that slows the growth in mandatory spending and achieves deficit reduction. Requires each House Committees to identify savings amounting to 1% of total mandatory spending under its jurisdiction from activities determined to be wasteful, unnecessary, or lower-priority. Prohibits House legislation that would require advance appropriations, except for certain FY2012-FY2013 programs, projects, activities, or accounts. States that Rule XXVII (Disclosure by Members and Staff of Employment Negotiations) [ sic ] of the Rules of the House of Representatives shall not apply with respect to adoption by Congress of a budget resolution for FY2011. Prescribes requirements for legislation reported out of committee and designated as an emergency requirement. Requires the Joint Committee on Taxation to calculate the impact of any proposal to change federal revenues on Gross Domestic Product (GDP), total domestic employment, and other specified economic variables. Prohibits the chairman of the House Committee on the Budget from taking into account the provisions of any piece of legislation which propose to increase revenue or offsetting collections if the net effect of the bill is to increase the level of revenue or offsetting collections beyond the level assumed in this concurrent resolution. Makes it out of order in the House to consider direct spending legislation increasing a specified on-budget deficit or decreasing an on-budget surplus for any applicable time period. Requires the chairman of the House Committee on the Budget to maintain a Budget Protection Mandatory Account and a Budget Protection Discretionary Account. Requires the Majority Leader to introduce rescission bills quarterly. Prescribes legislative procedures for their floor consideration. Expresses the sense of the House regarding: (1) baseline revenue projections; and (2) long-term budget projections. Sets the number of positions in the hiring pool at zero as of the first day of FY2011, after which the number shall: (1) increase by .50 for each full time-equivalent position in any agency which subsequently becomes vacant; and (2) decrease by 1.0 for each request for a full time-equivalent position that is approved by the President. Authorizes the President to waive this limitation upon determining that such waiver is required by the existence of a state of war, other national security concern, or an extraordinary emergency threatening life, health, safety, or property. Exempts the Department of Defense (DOD), the Department of Homeland Security (DHS), and the Department of Veterans Affairs (VA).

Requires OMB to prepare annually a report to be included in the President's budget for each fiscal year setting forth: (1) the projected level of total federal spending for the current year; (2) the percentage point increase in the CPI over the fiscal year before the current year; (3) the total percentage point increase in population from July 1 of the second preceding fiscal year before the current year and July 1 of the fiscal year before the current year; (4) the sum of such total percentage point increases; and (5) the projected level of total federal spending for the budget year and the amount, if any, by which that spending would exceed the projected level of total federal spending for the current year, as adjusted by the such sum of the total percentage point increases. Prescribes requirements for OMB Preview Reports and OMB Final Sequestration Reports. Requires the President to issue a sequestration order, effective on issuance, if OMB in its Final Sequestration Report estimates that any sequestration is required. Prohibits OMB from including the budgetary effects of an emergency requirement in its estimates. Exempts from any sequestration reduction order: (1) payments for net interest; and (2) federal obligations required to be paid under the U.S. Constitution or legally contractual obligations. Extends indefinitely certain Pay-As-You-Go (PAYGO) enforcement mechanisms.

Unborn Child Pain Awareness Act of 2010 - Amends the Public Health Service Act to require an abortion provider who knowingly performs an abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks or more after fertilization), to first: (1) inform the woman of the probable age of the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt); (3) provide information that pain medicine administered to the mother may not prevent pain in the child, but in some cases anesthesia or pain-reducing drugs can be administered directly to the child; (4) give the woman the provider's best medical judgment of the risks and costs of such anesthesia or analgesic; and (5) obtain the woman's signature on the Unborn Child Pain Awareness Decision Form and her explicit request for or refusal of the administration of drugs to the child. Requires the Secretary of Health and Human Services (HHS) to develop the Unborn Child Pain Awareness Brochure that includes a statement that there is substantial evidence that the process of being killed in an abortion will cause the unborn child pain and that the mother has the option of having pain-reducing drugs administered directly to the child. Creates an exception to save the life of the mother. Establishes civil penalties for willfully failing to comply with this Act. Authorizes: (1) the U.S. Attorney General to bring a civil action under this Act; and (2) private rights of action for violations of this Act.
