Unborn Child Pain Awareness Act of 2005 - Amends the Public Health Service Act to require an abortion provider, before beginning any abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks after fertilization), to: (1) make a specified statement to the pregnant woman that Congress has determined that there is substantial evidence that the process will cause the unborn child pain, and that the mother has the option of having pain-reducing drugs administered directly to the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt) or information on accessing such brochure on the Internet; (3) provide to the woman an Unborn Child Pain Awareness Decision Form; and (4) obtain on the form the woman's signature and her explicit request for or refusal of the administration of drugs to the child. Creates an exception for certified medical emergencies. Establishes penalties for willfully failing to comply with this Act, including civil penalties, medical license suspension, or both. Authorizes: (1) specified officials to bring suit in Federal court; and (2) private rights of action by a parent or guardian of a woman who is an unemancipated minor. Requires each State and State medical licensing authority to promulgate procedures for the revocation or suspension of a provider's license upon a court finding that the provider has violated this Act. Subjects a State that fails to implement such procedures to loss of Medicaid funding.

Breast Cancer Research Stamp Reauthorization Act - Amends Federal postal law to extend through December 31, 2007, the U.S. Postal Service's authority to issue special postage stamps to help fund breast cancer research.

Retired Pay Restoration Act of 2005 - Expresses the sense of Congress that military retired pay should not be reduced because a military retiree is also eligible for veterans' disability compensation awarded for a service-connected disability. Allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability (currently, only a disability rated at 50 percent or more). Repeals provisions phasing in the full concurrent receipt of such pay through December 31, 2013. Makes eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay those individuals who were retired or separated from military service due to a service-connected disability.

Expresses the sense of Congress that: (1) the people of the United States should observe the 60th anniversary of the liberation of Auschwitz, a Nazi death camp during World War II, and honor all of the victims of the Holocaust; (2) the American people should express their gratitude to the Allied soldiers whose service and sacrifice helped to defeat Adolf Hitler and destroy the genocidal Nazi regime; and (3) U.S. teachers should educate their students about what happened at Auschwitz and stress the importance of the collective responsibility of humanity to ensure that what happened at Auschwitz and other Nazi death camps is never allowed to happen again.

Iran Freedom Support Act - States that: (1) U.S. sanctions, controls, and regulations relating to weapons of mass destruction with respect to Iran shall remain in effect until the President certifies to the appropriate congressional committees that Iran has permanently and verifiably dismantled its weapons of mass destruction programs and has committed to combating such weapons' proliferation; and (2) such certification shall have no effect on other sanctions relating to Iranian support of international terrorism. Amends the Iran and Libya Sanctions Act of 1996 to: (1) eliminate mandatory sanction provisions respecting Libya; (2) impose mandatory sanctions on a person or entity that aids Iran acquire or develop weapons of mass destruction or destabilizing types and numbers of conventional weapons; (3) revise multilateral regime reporting requirements, including provisions respecting sanctions on individuals aiding Iranian petroleum development; (4) enlarge the scope of sanctionable entities; and (5) eliminate the sunset provision. Authorizes the President to provide financial and political assistance to eligible foreign and domestic individuals and groups that support democracy in Iran and that are opposed to the Government of Iran. Expresses the sense of Congress that: (1) the President should appoint a special assistant on Iranian matters; (2) contacts should be expanded with democratic Iranian opposition groups; and (3) the President should designate at least one such eligible group within 90 days of enactment of this Act.

First Responders Funding Reform Act of 2005 - Amends the USA PATRIOT Act to require: (1) that each State be allocated in each fiscal year not less than .5 percent (currently, .75 percent) of the total amount appropriated for domestic preparedness grants; (2) such grants to be awarded based on a quantitative risk assessment for threat, vulnerability, and consequences; and (3) the Office for State and Local Domestic Preparedness Support of the Office of Justice Programs, by March 1 of each year, to submit that assessment to Congress.

Parental Consent Act of 2005 - Prohibits Federal funds from being used to establish or implement any universal or mandatory mental health screening program. Prohibits Federal education funds from being used to pay any local educational agency or other instrument of government that uses the refusal of a parent or legal guardian to provide consent to mental health screening as the basis of a charge of child abuse or education neglect until the agency or instrument demonstrates that it is no longer using such refusal as a basis of such charge. Defines universal or mandatory mental health screening as any mental health screening program in which a set of individuals is automatically screened without regard to whether there was a prior indication of a need for mental health treatment, including: (1) any program of State incentive grants to implement recommendations in the July 2003 report of the President's New Freedom Commission on Mental Health; and (2) any student mental health screening program that allows mental health screening of individuals under 18 years of age without the express, written, voluntary, informed consent of the parent or legal guardian of the individual involved.

NASA and JPL 50th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury, in commemoration of the 50th anniversary of the establishment of the National Aeronautics and Space Administration (NASA) and the Jet Propulsion Laboratory (JPL) to mint and issue: (1) ten dollar gold coins; (2) five dollar gold coins; (3) one dollar silver coins; and (4) half-dollar silver coins emblematic of the 50 years of exemplary and unparalleled achievements of NASA and JPL. Directs each Federal agency and U.S. instrumentality that has in its possession any craft or any part of a craft that flew in space to: (1) retrieve any gold, silver, copper, and other precious metal that may be used in the production of any coins under this Act from such craft or part; and (2) deposit such metals with the Director of the United States Mint. Requires that all sales of coins minted under this Act include a surcharge of : (1) $75 per coin for the ten dollar coin; (2) $35 per coin for the five dollar coin; (3) $10 per coin for the one dollar coin; and (4) $3 for the half-dollar coin, which shall be paid by the Secretary to the NASA Family Assistance Fund for the purposes of providing financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties.

Illegal Immigration Enforcement and Social Security Protection Act of 2005 - Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to require inclusion of encrypted machine-readable electronic identification strips on Social Security cards. Requires the Commissioner of Social Security to: (1) develop the strip in a manner that enables employers to access the Employment Eligibility Database (EED) established by this Act; and (2) transmit to the Secretary of Homeland Security necessary information from an individual's application for a Social Security card or number (as determined by the Secretary) for inclusion in the EED. Directs the Secretary to establish and maintain the EED. Requires the EED to include data on the citizenship status and work and residency eligibility of noncitizens authorized to work in the United States. Restricts access to EED information. Prohibits individuals from commencing employment with a U.S. employer absent a Social Security card that meets the requirements of this Act and presentation of such card to the employer. Prohibits employers from hiring individuals absent verification of identity and work authorization. Authorizes the Secretary to: (1) assess penalties against employers who knowingly hire unauthorized workers or fail to comply with verification procedures; and (2) bring civil actions against those who fail to pay assessments or otherwise violate this Act. Establishes criminal penalties for such violations. Mandates integration of Border Patrol and Federal Bureau of Investigation fingerprint databases. States that nothing in this Act shall be construed to establish a national identification card.

Smarter Funding for All of America's Homeland Security Act of 2005 - Amends the Homeland Security Act of 2002 to direct the Secretary of Homeland Security to establish a State and Regional First Responder Grant Program under which the Secretary may make grants to States and eligible regional entities on the basis of the threat to a State or region's population and critical infrastructure, as determined by the Under Secretary for Information Analysis and Infrastructure Protection. Requires the Secretary, acting through the Under Secretary, to evaluate and prioritize grant applications, considering factors such as threats to the population, specific economic sectors, major communications nodes and transportation systems, specific elements of the food supply, the water and energy supplies, civic infrastructure and emergency response capabilities, and specific structures of symbolic national importance. Bars the use of grant funds to supplant State or local funds that would otherwise be available for homeland security or first responder projects. Directs the Secretary to: (1) establish the Advisory Council on First Responders, which shall report to the Secretary through the head of the Office of State and Local Government Coordination; and (2) revise the Homeland Security Advisory System to require that any designation of a threat level or other warning be accompanied by a designation of the geographic regions and economic sectors to which it applies. Directs the Under Secretary for Science and Technology to conduct a study of whether there is a need to assign additional bands of frequencies of electromagnetic spectrum to assist first responders.

Freedom From Union Violence Act of 2005 - Amends the Hobbs Act to authorize imposition of a fine of up to $100,000, 20 years imprisonment, or both for: (1) obstructing, delaying, or affecting commerce or the movement of any article or commodity in commerce by robbery or extortion (or attempting or conspiring to do so); and (2) threatening physical violence to any person or property in furtherance of a plan or purpose to interfere with commerce by threats or violence. Makes provisions regarding any such interference inapplicable to conduct that: (1) is incidental to otherwise peaceful picketing during the course of a labor dispute; (2) consists solely of minor bodily injury, or minor damage to property, or threat or fear of such minor injury or damage; and (3) is not part of a pattern of violent conduct or of coordinated violent activity. Subjects such conduct to prosecution only by the appropriate State and local authorities.

No Financial Aid for Sex Offenders Act - Amends the Higher Education Act of 1965 to prohibit the award of Pell grants and student loans to individuals subject to an involuntary civil commitment upon completion of a period of incarceration for a sexual offense.

Social Security Fairness Act of 2005 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to repeal: (1) pension offset provisions applicable to husband's and wife's insurance benefits, widow's and widower's insurance benefits, and mother's and father's insurance benefits with respect to OASDI payments; and (2) windfall elimination provisions with respect to computation of the primary insurance amount of an individual.

Senior Citizens Tax Elimination Act - Amends the Internal Revenue Code to repeal the inclusion of any social security or tier I railroad retirement benefits in gross income. Appropriates funds to cover reductions in transfers to the Social Security and Railroad Retirement Trust Funds resulting from the enactment of this Act. Expresses the sense of Congress against using tax increases to provide revenue necessary to carry out this Act.

Tax Reform Action Commission Act of 2005 - Declares that Congress must reform the Internal Revenue Code of 1986 so that the United States has a tax system that is: (1) simple, transparent, and efficient; (2) fair and equitable to all Americans; and (3) neutral between different activities and between current and future consumption. Establishes in the legislative branch a Tax Reform Action Commission (Commission). Requires the Commission to make recommendations for tax reform to meet those objectives to Congress within two years after it is established. Directs the Commission to establish task forces in Federal agencies to assist in the making and compiling of recommendations for tax reform. Sets forth procedures for congressional consideration of the Commission's recommendations.

Amends the Internal Revenue Code to provide that, in the case of an electing individual, no gain (up to a specified amount) shall be recognized on the receipt of a capital gain dividend distributed by a regulated investment company if such capital gain dividend is automatically reinvested in additional shares of the company pursuant to a dividend reinvestment plan.

Belated Thank You to the Merchant Mariners of World War II Act of 2005 - Directs the Secretary of Veterans Affairs to pay a monthly benefit of $1,000 to certain honorably-discharged veterans of the U.S. Merchant Marine who served between December 7, 1941, and December 31, 1946 (or to their survivors). Includes service in the Army Transport Service and the Naval Transport Service. Exempts benefits paid under this Act from taxation. Provides for benefits for World War II Merchant Mariners under title II (Old Age, Survivors, and Disability Insurance) (OASDI) of the Social Security Act.

Stop Counterfeiting in Manufactured Goods Act - Modifies Federal criminal code provisions regarding trafficking in counterfeit goods or services to prohibit trafficking in counterfeit marks. Directs the court: (1) upon a determination by a preponderance of the evidence that any article in a defendant's possession bears or is a counterfeit mark, to order the forfeiture and destruction of such article, regardless of whether the defendant is convicted of an offense; and (2) in imposing sentence, to order a person convicted of, or who pleads guilty or nolo contendre to, a violation to forfeit any property derived from proceeds of, or used in the commission of, the violation. Modifies the definition of "counterfeit mark" to include a spurious mark that is applied to, or consists of, a label, patch or medallion. Provides that nothing in this Act shall entitle the United States to bring a criminal cause of action for the repackaging, without deception, of genuine goods or services.

Postal Accountability and Enhancement Act - Amends Federal postal service law to direct the Postal Regulatory Commission (PRC) (established by this Act) to establish a modern system for regulating rates and classes for market-dominant products (all first-class mail, special services, periodicals, standard mail, media mail, library mail, and bound printed matter). Directs the Board of Governors of the U.S. Postal Service to establish rates and classes for products in the competitive category of mail (priority mail, expedited mail, mailgrams, international mail, and parcel post). Authorizes the Postal Service to conduct market tests of experimental products. Directs the PRC to establish rules to ensure that workshare discounts (presorting, barcoding, etc.) do not exceed the cost that the Postal Service avoids as the result of private sector workshare activity. Establishes in the Treasury a revolving Postal Service Competitive Products Fund which shall be available to the Postal Service without fiscal year limitation for the payment of: (1) costs attributable to competitive products; and (2) all other costs incurred by the Postal Service, to the extent allocable to competitive products. Requires the Postal Service to: (1) compute its assumed Federal income tax (which would be the taxable income of a corporation) on competitive products income for such year; and (2) transfer from the Competitive Products Fund to the Postal Service Fund the amount of that assumed tax. Prohibits the Postal Service from: (1) establishing anti-competitive rules or regulations; (2) compelling the disclosure, transfer, or licensing of intellectual property to any third party; or (3) obtaining information from a person that provides any product, and then offering any product or service that uses or is based in whole or in part on such information, without the person's consent. Makes the Secretary of State responsible for foreign policy related to international postal services and other international delivery services. Replaces the Postal Rate Commission with the Postal Regulatory Commission. Directs the Postal Service to report to the President, Congress, and: (1) PRC on universal postal service in the United States; and (2) Postal Service Board of Governors on the postal processing and distribution network. Repeals the authority of the Postal Service to impose fines on air carriers transporting mail beyond U.S. borders for unreasonable or unnecessary delays and other delinquencies. Directs the Postal Service to prescribe regulations for the safe transportation of hazardous materials in the mail. Provides civil penalties, plus cleanup costs, for violations. Revises postal pension funding requirements under the Civil Service Retirement System. Establishes the Postal Service Retiree Health Benefits Fund.

Servicemembers Anti-Predatory Lending Protection Act - Amends the Servicemembers Civil Relief Act to set forth terms for consumer credit extended to a servicemember or servicemember's dependent, including terms of interest with respect to the extension of such credit. Prohibits a creditor from imposing an annual percentage rate greater than 36 percent with respect to the consumer credit extended. Sets forth mandatory loan disclosures, including: (1) a statement of the annual percentage rate applicable to the extension of credit; and (2) a clear description of the payment obligations. Prohibits a creditor from automatically renewing, repaying, refinancing, or consolidating any consumer credit with the proceeds of other credit extended to a servicemember or a servicemember's dependent by the same creditor without: (1) executing new loan documentation signed by the servicemember; and (2) providing the mandatory loan disclosures. Preempts any State or Federal law, rule, or regulation, including any State usury law, to the extent that it is inconsistent with this Act. States that this Act does not preempt any such law, rule, or regulation that provides additional protection. Prescribes criminal penalties for violation of this Act.

Adoption Information Act - Amends the Public Health Service Act to require family planning service projects or programs, as a condition of receiving certain grants or contracts, to assure the Secretary of Health and Human Services that they will provide to each person who inquires about their services a pamphlet containing a comprehensive list of adoption centers in their State. Directs the Secretary to prepare, annually update, and distribute such pamphlets to such projects or programs.

Crossroads of the American Revolution National Heritage Area Act of 2003 (sic) - Establishes the Crossroads of the American Revolution National Heritage Area in New Jersey. Designates the Crossroads of the American Revolution Association, Inc. as the Area's management entity. Directs the Association to submit, and to assist local governments, regional planning organizations, and nonprofit entities in implementing, an area management plan which includes strategies for conservation, funding, management, and development of the Area. Bars the Association from using Federal funds received under this Act to acquire real property, but permits the Association to use any other source of funding, including other Federal funding, intended for the acquisition of real property. Limits Federal funding to 50 percent of any assistance provided. Authorizes the Secretary of the Interior to provide assistance to: (1) the Area to develop and implement the management plan; and (2) State or local government or nonprofit organizations for treatment of historical objects or structures eligible for listing on the National Register of Historic Places. Authorizes the Superintendent of Morristown National Historical Park to provide operational assistance supporting implementation of the management plan to public and private organizations within the Area, including the Association.

Health Insurance Affordability Act of 2005 - Amends the Internal Revenue Code to allow a deduction from gross income for premiums paid under a high deductible health plan by an individual eligible for a deduction for amounts paid into a health savings account, for months when such taxpayer is not covered under any other plan.

Expresses the sense of the House of Representatives that: (1) the Advisory Committee of the Bureau of Labor Statistics should evaluate its current statistical measurements of employment to ensure that all categories and methods of employment in the U.S. economy are accurately reflected, include specified matters in such evaluation, and report to Congress; and (2) the Bureau of Labor Statistics should update its statistical methodologies in accordance with such evaluation's findings, conclusions, and recommendations as expeditiously as possible.

Expresses the sense of the House of Representatives that American small businesses are entitled to a Small Business Bill of Rights which includes the right to: (1) join together to purchase affordable employee health insurance; (2) tax laws that allow such businesses to survive; and (3) be free from frivolous lawsuits and restrictive regulations and paperwork.

Declares that the House of Representatives: (1) mourns the horrific loss of life caused by the earthquake and tsunamis that occurred on December 26, 2004, in South and Southeast Asia; (2) expresses its deep condolences to the families of the many earthquake and tsunami victims; (3) applauds the prompt humanitarian response to the tsunami tragedy by governments, the United Nations and other international organizations, and nongovernmental organizations; (4) recognizes the generous outpouring of support for relief efforts from private citizens around the world, including in the United States; (5) affirms its commitment to additional generous U.S. support for relief and long-term reconstruction efforts in areas affected by the earthquake and tsunamis; and (6) urges continued attention by donors and relief agencies to the needs of vulnerable populations in the stricken countries, particularly the thousands of children who have been left parentless and homeless by this disaster.

Constitutional Amendment - Marriage Protection Amendment - Declares that marriage in the United States shall consist only of the union of a man and a woman. Prohibits the Constitution or any State constitution from being construed to require that marital status or its legal incidents be conferred upon any union other than that of a man and a woman.

Veterans' Employment Act of 2004 - Amends the Internal Revenue Code to allow employers a business tax credit for employing a veteran as a full-time employee for a three-year period. Sets the amount of such credit at $1,000 and allows the credit to be taken in the taxable year in which the veteran's three-year employment period ends. Allows an inflation adjustment to the credit amount beginning after 2005.

American Heroes Act - Authorizes each State to provide one statue of an individual representing that State to be displayed in the Capitol Visitor Center. Specifies criteria for such statues. Requires the Clerk of the House of Representatives and the Secretary of the Senate to assign jointly to one of their employees the post of the American Hero Administrator to prepare statue guidelines. Requires: (1) a State to establish an American Hero Commission to select the individual to represent that State; and (2) the Architect of the Capitol to procure and install a statue honoring the passengers of United Airlines flight number 93 who died on September 11, 2001, for their heroic role in protecting Washington, D.C. from attack.

United States Court of Federal Claims Termination Act of 2004 - Prohibits the filing of claims in the U.S. Court of Federal Claims (the Court) upon enactment of this Act and terminates the Court effective one year from enactment. Requires the Chief Justice of the United States to promulgate regulations for the orderly transfer of all claims pending before the Court to appropriate U.S. courts. Requires the Director of the Administrative Office of the U.S. Courts to submit a report to Congress containing recommendations for legislation to carry out this Act.

Provides that marriage in the United States shall consist only of the union of a man and a woman. Gives the U.S. Supreme Court original jurisdiction to hear and determine a claim arising under this Act. Prohibits any other Federal court or any State court from having jurisdiction to hear or determine such a claim.

States that the House of Representatives: (1) condemns the Palestinian leadership for failing to carry out its responsibilities under the Roadmap and under other obligations it has assumed, and to bring an end to terrorist attacks directed at Israel; (2) deplores the misuse of the International Court of Justice (ICJ) for the political purpose of advancing the Palestinian position on matters Palestinian authorities have said should be the subject of negotiations, the ICJ's willingness to acquiesce in efforts that are likely to undermine its reputation and interfere with a resolution of the Palestinian-Israeli conflict, and the attempt to infringe upon Israel's right to self defense; (3) commends the President and the Secretary of State for their leadership in marshaling opposition to the misuse of the ICJ; (4) calls on members of the international community to reflect on the steps taken by the Government of Israel to mitigate the impact of the security barrier on Palestinians, including steps it has taken by order of its High Court of Justice; and (5) cautions members of the international community that they risk a strongly negative impact on their relationship with the people and Government of the United States should they use the ICJ's advisory judgment as an excuse to interfere in the Roadmap process and impede efforts to achieve progress toward a negotiated settlement.

Amends the Harmonized Tariff Schedule of the United States to suspend, through December 31, 2006, the duty on certain pimientos (capsicum anuum), prepared or preserved otherwise than by vinegar or acetic acid.
