Amends the Emergency Economic Stabilization Act of 2008 (EESA) to direct the Secretary of the Treasury, upon notification that a financial institution is prepared to repay specified EESA assistance immediately, either to: (1) accept such repayment; or (2) notify the institution that its financial position does not currently permit such repayment, and detail steps it can take to satisfy the Secretary and the appropriate federal banking agency that it is able to make such repayment.

Workforce Health Improvement Program Act of 2009 - Amends the Internal Revenue Code to exclude from the gross income of employees: (1) the value of any on-premises employer-provided athletic facility; and (2) fees, dues, or membership expenses paid to an athletic or fitness facility by an employer for its employees, but not exceeding $900 per employee per year. Allows employers a tax deduction for fees, dues, or membership expenses paid to an athletic or fitness facility. Limits the amount of such deduction to $900 per employee per year.

Recognizes the 40th anniversary of the National Eye Institute. Expresses support for the designation of the Decade of Vision to maintain a sustained awareness of the public health challenges associated with vision impairment and eye disease and to emphasize the need for federal support for prevention and early detection, access to treatment and rehabilitation, and research. Commends the National Alliance for Eye and Vision Research for its efforts to expand awareness of eye disease through its Decade of Vision 2010-2020 Initiative.

Motor Vehicle Owners Right to Repair Act of 2009 - Requires the manufacturer of a motor vehicle sold, leased, or otherwise introduced into U.S. commerce to: (1) provide to the vehicle owner and service providers all information necessary to diagnose, service, maintain, or repair the vehicle; (2) offer for sale to the vehicle owner and service providers any related tool or equipment; and (3) provide the information that enables aftermarket tool companies to manufacture tools with the same functional characteristics. Exempts trade secrets, so long as the information is not disclosed to authorized dealers or service providers. Authorizes enforcement of this Act by the Federal Trade Commission (FTC) and civil actions by state attorneys general, consumers, and service providers.

Directs the Secretary of Transportation, acting through the Administrator of the Federal Highway Administration (FHWA) and in cooperation with the American Association of State Highway and Transportation Officials, to update the FHWA's research report entitled "Reduced Lighting On Freeways During Periods Of Low Traffic Density," FHWA/RD-86/018, dated August, 1985. Requires the Secretary, based on the updated report, to issue guidance to states on reducing lighting on the federal-aid system during low traffic density periods.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Medicare Patient IVIG Access Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to direct the Secretary of Health and Human Services to collect data on the differences, if any, between: (1) payments to physicians for immune globulins using average sales price payment methodology; and (2) costs incurred by physicians for furnishing these products. Requires the Secretary also to review data on the access of eligible individuals to immune globulins. Requires the Secretary, after completion of the review, to provide, if appropriate, an additional payment to such physicians for all items related to the furnishing of immune globulins as part of hospital outpatient services. Provides for Medicare coverage of and payment for intravenous immune globulin (IVIG) administered in the home. Directs the Secretary to contract for the collection of data on the practice of IVIG infusion if the Secretary determines that collection of additional data is necessary. Directs the Secretary to review data collected under such a contract as well as data submitted by members of the medical community related to the current infusion payment codes under part B (SupplementaryMedical Insurance) of SSA title XVIII. Requires the Secretary, upon completion of any data collection and review, to: (1) notify the appropriate Medicare administrative contractors regarding which existing infusion codes shall be used for purposes of part B IVIG reimbursement; or (2) report to Congress and the RBRVS Update Committee (RUC) on why an additional infusion payment code is necessary. Extends the meaning of durable medical equipment to include a disposable pump prescribed, instead of a non-disposable external infusion pump, for administration of a drug used as part of a chemotherapy regimen for treatment of colorectal cancer, if a non-disposable external infusion pump would have been covered to administer the same drug for the same indication as of July 1, 2008.

Congratulates the Navy SEALs on the scene for their decisive action that resulted in the rescue of Captain Phillips. Energy Regulatory Public Protection Act - Establishes within the Department of Justice an Office of Public Advocate to represent the interests of members of the general public affected by regulatory matters before the Federal Energy Regulatory Commission (FERC), other FERC-related matters before other federal regulatory agencies, or any court of competent jurisdiction. Makes it the duty of the Office to: (1) receive and assess comments from all interested parties with respect to project applications before FERC; submit such comments to FERC, together with findings and recommendations, regarding the outcome, terms, and conditions of an application for approval; (3) review applicant compliance with FERC orders; (4) seek full compliance with an order through the FERC or a court if the applicant fails to comply and such noncompliance is harmful to the health, safety, and welfare of affected parties; and (5) undertake appeal of any FERC order it deems harmful to the heath, safety, or welfare of affected parties.

Electronic Life Safety and Security Systems Federal Background Check Act of 2009 - Directs the Attorney General to establish a method to permit employers in the electronic life safety and security systems installation and monitoring industry to access criminal history records and other information to conduct background checks of prospective employees.

National Health Service Corps Improvement Act of 2009 - Amends the Public Health Service Act to revise the definition of "primary health services" for purposes of the National Health Service Corps to include optometry health services. Includes optometrists within: (1) the fellowship program for the delivery of primary health services in health professional shortage areas; (2) the National Health Service Corps Scholarship Program; and (3) the National Health Service Corps Loan Repayment Program.

Centennial District Authorization Act of 2009 - Establishes in the City of Philadelphia, Pennsylvania, the Centennial Historic District (District). Authorizes the Secretary of the Interior to make grants to, or enter into cooperative agreements with, state or local government agencies, nonprofit entities, and any leaseholders to administer the District. Directs the Secretary to: (1) prepare a plan for the development of historic, architectural, natural, cultural, recreational, and interpretive resources within the District; and (2) make grants for capital improvement projects in the District.

Safe Teen and Novice Driver Uniform Protection Act of 2009 or the STANDUP Act - Authorizes the Secretary of Transportation to award incentive grants to states with graduated driver licensing laws that include, for novice drivers under age 21, a two-stage licensing process before the grant of an unrestricted driver's license. Requires such laws, at a minimum, to include: (1) a learner's permit stage that commences at age 16 or older, lasts at least six months, prohibits the use of a cellular phone or other communications device in non-emergency situations, prohibits nighttime driving, and is in effect until commencement of the intermediate stage or when the driver attains age 18 or older; (2) an intermediate stage in effect until the driver attains age 18 or older that commences after expiration of the learner's permit stage, lasts at least six months, prohibits more than one non-familial passenger under age of 21 if there is no licensed driver age 21 or older present in the vehicle, prohibits nighttime driving, and prohibits the use of a cellular phone or other communications device in non-emergency situations; and (3) any other requirement that the Secretary may require. Directs the Secretary to withhold a certain percentage of federal-aid highway funds from states that do not comply with the requirements of this Act.

Healthy Workforce Act of 2009 - Amends the Internal Revenue Code to allow employers a 50% tax credit for the costs of providing employees with a qualified wellness program. Defines "qualified wellness program" as a program that is certified by the Secretary of Health and Human Services and that consists of a health awareness and education component, a behavioral change component, and a supportive environment component. Terminates such credit after 2017. Requires the Secretary of the Treasury to institute an outreach program to inform businesses about the availability of such wellness program tax credit.

Water Accountability Tax Efficiency Reinvestment Act of 2009 or the WATER Act of 2009 - Amends the Internal Revenue Code to allow a tax credit for 30% of amounts paid for WaterSense program property certified by the Environmental Protection Agency (EPA). Limits the lifetime dollar amount of such credit to $1,500. Terminates such credit after 2010.

Amends the Federal Power Act and the Natural Gas Act to direct the Federal Energy Regulatory Commission (FERC) to hold at least one public hearing in each affected county and locality before issuing any authorization for action that may affect public or private land use (other than federal land). Requires FERC to hold one additional public hearing after the initial one if the government of such county or locality requests it in order to address an issue not addressed at the initial hearing.

New Alternative Transportation to Give Americans Solutions Act of 2009 - Amends the Internal Revenue Code to: (1) allow an excise tax credit through 2027 for alternative fuels and fuel mixtures involving compressed or liquefied natural gas; (2) allow an income tax credit through 2027 for alternative fuel motor vehicles powered by compressed or liquefied natural gas; (3) modify the tax credit percentage for alternative fuel vehicles fueled by natural gas or liquefied natural gas; (4) allow a new tax credit for the production of vehicles fueled by natural gas or liquefied natural gas; and (5) extend through 2027 the tax credit for alternative fuel vehicle refueling property expenditures for refueling property relating to compressed or liquefied natural gas and allow an increased credit for such property. Requires 50% of all new vehicles purchased or placed in service by the U.S. government by December 31, 2014, to be capable of operating on compressed or liquefied natural gas. Authorizes the Secretary of Energy to make grants to manufacturers of light and heavy duty natural gas vehicles for the development of engines that reduce emissions, improve performance and efficiency, and lower cost.

Children's Hope Act of 2009 - Amends the Internal Revenue Code to allow a tax credit of up to $100 ($200 for joint returns) for charitable contributions to an education investment organization that disburses 90% of its contributions to provide grants to students for elementary and secondary education expenses, if at least 50% of such disbursements go to students who qualify for free or reduced-cost school lunches. Requires a taxpayer claiming such credit, as a condition of eligibility to receive it, to first claim a state qualified scholarship tax credit.

Medicare Patient Access to Physical Therapists Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to authorize qualified physical therapists to provide services for Medicare beneficiaries without the requirement of a physician referral. Provides for treatment of outpatient speech-language pathology services separately from outpatient physical therapy services.

Volunteer Emergency Services Recruitment and Retention Act of 2009 - Amends the Internal Revenue Code to allow sponsors of certain deferred compensation plans to elect to include length of service award plans for bona fide volunteers providing firefighting and fire prevention services, emergency medical services, ambulance services, and emergency rescue services. Directs the Secretary of Labor to issue regulations exempting a length of service award program from treatment as an employee pension benefit plan under the Employee Retirement Income Security Act of 1974 (ERISA).

Breast Cancer Education and Awareness Requires Learning Young Act of 2009 or EARLY Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct a national evidence-based education campaign: (1) to increase public awareness regarding the threats posed by breast cancer to young women, including the particular risks faced by certain ethnic and cultural groups; and (2) focusing on awareness of risk factors and achieving early detection through community-centered informational forums, public service advertisements, and media campaigns. Directs the Secretary to award grants to entities to establish national multimedia campaigns that: (1) will encourage young women to be aware of their personal risk factors, strategies for increasing early detection and self awareness, evidence based preventative lifestyle changes, and other appropriate breast cancer early detection and risk reduction strategies; (2) will encourage young women of specific higher-risk populations to talk to their medical practitioners about those risks and methods for appropriate screening and surveillance; and (3) may include advertising through specified media. Requires the Secretary, acting through the Director, to: (1) establish an advisory committee to assist in creating and conducting the public education campaign; (2) conduct an education campaign to increase awareness among health care professionals; and (3) conduct prevention research. Directs the Secretary to award grants to organizations and institutions to provide to young women diagnosed with breast cancer substantive assistance and health information from credible sources on: (1) education and counseling regarding fertility preservation; (2) social, emotional, psychosocial, financial, lifestyle, and caregiver support; (3) familial risk factors; and (4) risk reduction strategies to reduce recurrence or metastasis.

Dam Rehabilitation and Repair Act of 2009 - Amends the National Dam Safety Program Act to require the Federal Emergency Management Agency (FEMA) to establish a program to provide grant assistance to states for use in rehabilitating publicly-owned dams that fail to meet minimum safety standards and pose an unacceptable risk to the public (deficient dams). Sets forth provisions regarding procedures for grant awards and fund allocation. Requires: (1) a state receiving a grant under this Act to comply with requirements applicable to contributions of federal funds under the Robert T. Stafford Disaster Relief and Emergency Assistance Act; and (2) FEMA to develop a risk-based priority system for identifying deficient dams for which such grants may be made. Limits the federal share of rehabilitation costs to 65%. Prohibits funds from being used to: (1) rehabilitate a federal dam; (2) perform routine operation or maintenance; (3) modify a dam to produce hydroelectric power; (4) increase water supply storage capacity; or (5) make any other modification that does not also improve safety. Conditions the receipt of grants by states upon compliance with specified requirements regarding contracts for architectural and engineering services. Provides that such contracts shall not be considered to confer a proprietary interest upon the United States.

Amends the Elementary and Secondary Education Act of 1965 to include family therapists among the professionals authorized to provide services under the Safe and Drug-Free Schools and Communities program and the Elementary and Secondary School Counseling programs. Includes family therapists as pupil services personnel authorized to provide services as part of a comprehensive program to meet student needs.

Ending the Medicare Disability Waiting Period Act of 2009 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act (SSA) to: (1) phase out the waiting period for disabled individuals to become eligible for benefits under SSA title XVIII (Medicare); and (2) eliminate the waiting period for individuals with life-threatening conditions to become eligible for such benefits. Directs the Secretary of Health and Human Services to request the Institute of Medicine of the National Academy of Sciences to study the range of disability conditions that can be delayed or prevented if individuals receive access to health care services and coverage before a condition reaches disability levels.

Breast Cancer Patient Protect Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides medical and surgical benefits to ensure that inpatient (and in the case of a lumpectomy, outpatient) coverage and radiation therapy are provided for breast cancer treatment. Prohibits such a plan from: (1) restricting benefits for any hospital length of stay to less than 48 hours in connection with a mastectomy or breast conserving surgery or 24 hours in connection with a lymph node dissection, insofar as the attending physician, in consultation with the patient, determines such stay to be medically necessary; or (2) requiring that a provider obtain authorization from the plan or issuer for prescribing any such length of stay. Requires such a plan or issuer to: (1) provide notice to each participant and beneficiary regarding the coverage required under this Act; and (2) ensure that coverage is provided for secondary consultations. Prohibits a group health plan from taking specified actions to avoid the requirements of this Act. Applies such requirements to health insurance issuers offering coverage in the individual market. Allows a health insurance issuer that provides individual health insurance coverage to nonrenew or discontinue an individual's coverage based on the intentional concealment of material facts regarding a health condition related to the condition for which coverage is being claimed.

Bridge Life Extension Act of 2009 - Requires a state, as a condition of receiving federal-aid highway funding, to develop and implement a highway bridge management system that meets certain requirements. Requires a state, in developing and implementing such a system, to: (1) identify corrosion mitigation and prevention methods to preserve its highway bridges; (2) establish a project maintenance program to extend the life of such bridges; (3) ensure that all highway bridge designers, inspectors, and maintenance workers implementing the system are trained and certified in corrosion mitigation and prevention techniques; and (4) research current inspection technologies and techniques for highway bridges.

Meth Mouth Prevention and Community Recovery Act - Requires the Director of the Center for Substance Abuse Prevention to make grants to enable public and private nonprofit entities to determine whether educating youth about meth mouth (oral decay that is commonly associated with methamphetamine use) is an effective strategy for preventing or reducing methamphetamine use. Reserves a portion of appropriated funds for Indian tribes and tribal organizations. Amends the Public Health Service Act to require the Secretary of Health and Human Services to expand and intensify the clinical research, health services research, and public health research on associations between substance use disorders, oral health, and the provision of dental care. Requires the Secretary to study the effect methamphetamine use has on the demand for, and provision of, dental care. Directs the Administrator of the Substance Abuse and Mental Health Services Administration to support training and offer technical assistance to ensure that dentists and allied dental personnel are prepared to: (1) recognize signs of alcohol or drug addiction; (2) discuss the nature of substance abuse as it relates to their area of expertise; (3) understand how certain dental therapies can affect the relapse potential of substance dependent patients; and (4) help those affected by a substance use disorder find appropriate treatment for their conditions. Authorizes the Administrator to collaborate with professional accrediting bodies to develop and support substance abuse training courses for oral health professionals.

Community Choice Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to require state Medicaid plan coverage of community-based attendant services and supports for certain Medicaid-eligible individuals. Outlines requirements for: (1) an enhanced federal medical assistance percentage (FMAP) for ongoing activities of early coverage states that enhance and promote the use of community-based attendant services and supports; and (2) increased federal financial participation for certain expenditures incurred by the state for the provision of such services and supports. Directs the Secretary of Health and Human Services to: (1) award grants to eligible states which have established a Consumer Task Force to assist the state in its development of real choice systems change initiatives; and (2) conduct a demonstration project for the purpose of evaluating service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to dually eligible individuals.

Made in America Act of 2009 - Amends the Internal Revenue Code to: (1) make permanent the tax credit for increasing research activities; (2) increase to 20% the rate of the alternative simplified tax credit for research expenses; (3) make permanent the increased expensing allowance for depreciable business property; and (4) reduce to 30% the maximum income tax rate for corporations. Directs the Comptroller General to conduct studies of: (1) the impact of workplace employee health care facilities on employee health and and productivity; and (2) the best practices for encouraging college graduates from rural areas to return to those areas after graduation.

Fitness Integrated with Teaching Kids Act or the FIT Kids Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to require annual state and local educational agency report cards to include specified information on school health and physical education programs. Includes the promotion of healthy, active lifestyles by students within ESEA grant programs that support school counseling, smaller learning communities, community learning centers, and parental involvement in their childrens' education. Revises the professional development program for teachers and principals to include training for physical and health education teachers, and training on improving students' health habits and participation in physical activities. Directs the Secretary of Education to contract with the National Academy of Sciences (NAS) for a study that: (1) assesses the effect health and physical education have on students' ability to learn; and (2) makes recommendations for improving, and measuring improvements to, their health and physical education in schools.

Preexisting Condition Patient Protection Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to prohibit a group health plan from: (1) imposing any preexisting condition exclusion; or (2) providing for an affiliation period for coverage offered by a health maintenance organization (HMO). Defines an "affiliation period" as a period of time before health insurance coverage becomes effective. Requires each health insurance issuer offering coverage in the group market in a state to accept every employer in the state that applies for such coverage. Prohibits preexisting condition exclusions for individual health insurance coverage. Requires the Secretary of Health and Human Services to report to Congress on the impact of this Act on health benefits coverage. Authorizes the Secretary to request claims data, enrollee data, and other appropriate information from group health plans and health insurance issuers. Directs the Comptroller General to report to Congress on the impact of this Act and other relevant federal laws on the reduction in the number of uninsured and underinsured individuals and on the affordability of coverage.

Pathway for Biosimilars Act - Amends the Public Health Service Act to allow a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product). Requires the Secretary of Health and Human Services to approve the application if: (1) the biological product is biosimilar to the reference product with respect to each condition of use for which the reference product is approved; and (2) the applicant consents to the inspection of the facility that is the subject of the application. Sets forth requirements for a determination by the Secretary that a biological product is interchangeable with a reference product. Prohibits a biological product from being evaluated against more than one reference product. Prohibits licensure under this Act of a biological product containing specified agents or toxins or a schedule I or II controlled substance unless the Secretary determines there would be no increased risk to the security or health of the public from licensing such a biological product. Prohibits the Secretary from making approval of an application under this Act effective until 12 yeas after the date on which the reference product was first licensed. Provides for confidentiality of information received pursuant to this Act. Sets forth provisions governing patent infringement actions related to this Act. Deems as patent infringement the submission of a statement under this Act by the applicant setting forth reasons why the making, use, or sale of the biosimilar product would not infringe the patent, or why the patent is invalid or unenforceable, if the purpose of such submission is to obtain approval to engage in the commercial manufacture, use, or sale before the expiration of such patent.

Amends the Internal Revenue Code to: (1) make permanent the tax credit for increasing research activities; and (2) increase the amount of such credit for taxpayers who earn more than 50% of their gross receipts from domestic production activities.

Securing America's Future Economy Commission Act or SAFE Commission Act - Establishes the Securing America's Future Economy (SAFE) Commission to develop legislation designed to address: (1) the unsustainable imbalance between long-term federal spending commitments and projected revenues; (2) increases in net national savings to provide for domestic investment and economic growth; (3) the implications of foreign ownership of federally issued debt instruments; and (4) revision of the budget process to place greater emphasis on long-term fiscal issues. Requires the Commission to: (1) develop one or two methods for estimating the cost of legislation as an alternative to the current Congressional Budget Office (CBO) method; and (2) hold at least one town-hall style public hearing within each federal reserve district. Requires the Commission to submit a legislative proposal to Congress and the President. Authorizes the President to submit to Congress an alternative proposal. Authorizes the Committee on the Budget of either chamber to publish its own alternative proposal in the Congressional Record. Sets forth procedures for consideration of such legislation. Requires CBO to prepare a long-term cost estimate and have it published in the Congressional Record as expeditiously as possible whenever requested to do so by the Commission, the President, or the chairman or ranking minority member of the Committee on the Budget of either chamber.

Stephanie Tubbs Jones Collegiate Housing and Infrastructure Act of 2009 - Amends the Internal Revenue Code to allow tax-exempt charitable or educational organizations to make collegiate housing and infrastructure improvement grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) which apply such grants to their collegiate housing property.

Amends the Internal Revenue Code to increase in taxable years beginning in 2009, 2010, or 2011: (1) the limit on the tax deduction for trade or business start-up expenditures from $5,000 to $20,000; and (2) the threshold amount for reducing such limit.

Directs the Secretary of the Treasury to transmit to the House of Representatives copies of all Department of the Treasury documents, records, and communications referring or relating to: (1) any negotiation concerning the controlled break-up of the American International Group, Inc. (AIG) into at least three government-controlled divisions; (2) any negotiation concerning any additional assistance under title I of the Emergency Economic Stabilization Act of 2008, or other program administered by the Secretary to such corporation; or (3) any government communication or authorization for payment of any pre-existing bonus contract with any AIG executive.

Cell Tax Fairness Act of 2009 - Prohibits states or local governments from imposing any new discriminatory tax on mobile services, mobile service providers, or mobile service property for five years after the enactment of this Act. Defines "new discriminatory tax" as a tax imposed on mobile services, providers, or property that is not generally imposed on other types of services or property, or that is generally imposed at a lower rate.

Safe and Secure America Act of 2009 - Amends the USA PATRIOT Improvement and Reauthorization Act of 2005 to extend through 2019 provisions which: (1) authorize the use of multipoint or roving wiretaps for national security and intelligence investigations; and (2) allow the Federal Bureau of Investigation (FBI) to apply to the Foreign Intelligence Surveillance Court to grant government access to tangible items (books, records, etc.) in foreign intelligence, international terrorism, and clandestine intelligence cases. Amends the Intelligence Reform and Terrorism Prevention Act of 2004 to extend through 2019 the inclusion of "lone wolf" terrorists as agents of a foreign power, for purposes of the authority to obtain intelligence on non-U.S. persons engaged in international terrorism.
