Genetic Information Nondiscrimination Act of 2008

Genetic Information Nondiscrimination Act of 2007 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to expand the prohibition against discrimination by group health plans and health insurance issuers in the group and individual markets on the basis of genetic information or services to prohibit: (1) enrollment and premium discrimination based on information about a request for or receipt of genetic services; and (2) requiring genetic testing. Sets forth penalties for violations. Amends title XVIII (Medicare) of the Social Security Act to prohibit issuers of Medicare supplemental policies from discriminating on the basis of genetic information. Extends medical privacy and confidentiality rules to the disclosure of genetic information. Makes it an unlawful employment practice for an employer, employment agency, labor organization, or training program to discriminate against an individual or deprive such individual of employment opportunities because of genetic information. Prohibits the collection and disclosure of genetic information, with certain exceptions. Establishes a Genetic Nondiscrimination Study Commission to review the developing science of genetics and advise Congress on the advisability of providing for a disparate impact cause of action under this Act.

Stroke Treatment and Ongoing Prevention Act

Stroke Treatment and Ongoing Prevention Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to carry out a national education campaign to promote stroke prevention and increase the number of stroke patients who seek immediate treatment. Requires the Secretary, acting through the Centers for Disease Control (CDC), to maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse by collecting specific data points and benchmarks for stroke care analysis and by compiling and disseminating information on state, local, and private care system achievements and problems. Defines "stroke" as an attack in which blood flow to the brain is interrupted or in which a blood vessel or aneurysm in the brain breaks or ruptures. Includes stroke and traumatic injury prevention, diagnosis, and treatment within the grant program for emergency medicine residency training. Authorizes the Secretary, through the Administrator of the Health Resources and Services Administration (HRSA), to make grants to qualified entities for education programs for health care professionals in the use of diagnostic approaches, technologies, and therapies for stroke and traumatic injury prevention, diagnosis, treatment, and rehabilitation. Gives preference to qualified entities that will train professionals that serve areas with a significant incidence of stroke or traumatic injuries. Authorizes the Secretary, through the Director of the Office for the Advancement of Telehealth, to make up to seven grants to states and to consortia of public and private entities in any non-grantee state to conduct a five-year pilot project to improve stroke patient outcomes by coordinating health care through telehealth networks.

Securing America's Future Economy Commission Act, or SAFE Commission Act - Establishes the Securing America's Future Economy (SAFE) Commission to develop legislation designed to address: (1) the unsustainable imbalance between long-term federal spending commitments and projected revenues; (2) increases in net national savings to provide for domestic investment and economic growth; (3) the implications of foreign ownership of federally issued debt instruments; and (4) revision of the budget process to place greater emphasis on long-term fiscal issues. Requires the Commission to: (1) develop one or two methods for estimating the cost of legislation as an alternative to the current Congressional Budget Office (CBO) method; and (2) hold at least one town-hall style public hearing within each federal reserve district. Requires the Commission to submit a legislative proposal to Congress and the President. Authorizes the President to submit to Congress an alternative proposal. Authorizes the Committee on the Budget of either chamber to publish its own alternative proposal in the Congressional Record. Sets forth procedures for consideration of such legislation. Requires CBO to prepare a long-term cost estimate and have it published in the Congressional Record as expeditiously as possible whenever requested to do so by the Commission, the President, or the chairman or ranking minority member of the Committee on the Budget of either chamber.

Sets forth a schedule of additional benefit increases for such beneficiaries (and related beneficiaries), with percentages declining from 55% to 5% keyed to the year an individual became eligible for (early retirement) benefits between 1978 and 1989. Provides for an election to receive such payments in a lump sum.

Amends the Rules of the House of Representatives to add Rule XXIX (Bipartisan Administration of the House) to require: (1) the elected leadership of the majority and minority parties to engage in regular consultations with each other to discuss House scheduling, administration, and operations; and (2) the chair and ranking minority member of each committee and their staffs to have regular meetings with each other. Amends Rule X (Organization of Committees) to require that allocation of amounts provided to a committee under a primary or supplemental expense resolution or during an interim funding period be paid at the ranking minority member's direction. Adds Rule XXX (Regular Order for Legislation) to require legislation to come to the floor, generally, under a procedure that allows open, full, and fair debate consisting of a full amendment process that grants the minority the right to offer its alternatives, including a substitute. Requires Members to have at least 24 hours to examine bill and conference report text before floor consideration. Requires rules governing floor debate to be reported before 10 p.m. for any legislation to be considered the following day. Requires floor votes to be completed within 15 minutes, with the customary two-minute extension to accommodate Members' ability to get to the House chamber to cast their votes. Prohibits votes from being held open in order to manipulate the outcome. Requires: (1) conference committees to hold regular meetings (at least weekly) of all conference committee Members; and (2) all managers appointed to such committee to be informed of its schedule of activities in a timely manner and given ample opportunity for input and debate as decisions are made toward final language for the conference report. Restricts the Suspension Calendar to non-controversial legislation. Makes the ratio of legislation sponsored by members of the minority party on such Calendar the same as their ratio to the membership of the whole House.

Small Business Health Fairness Act of 2007 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for establishment and governance of association health plans (AHPs), which are group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations, and which meet certain ERISA certification requirements. Sets forth rules governing AHPs, including requirements relating to certification, sponsors and boards of trustees, participation and coverage, nondiscrimination, contribution rates, notice of voluntary termination, correction actions, and mandatory termination. Establishes the Association Health Plan Fund to be used by the Secretary of Labor to make payments to an insurer to maintain coverage for a plan if there is a reasonable expectation that, without such payments, claims would not be satisfied by reason of termination of coverage. Requires the Secretary to establish a Solvency Standards Working Group. Allows a state to impose a contribution tax on an association health plan that commenced operations in such state after the enactment of this Act. Preempts any state law that may preclude a health insurance issuer from: (1) offering health insurance coverage in connection with a certified AHP; or (2) offering health insurance coverage of the same policy type to other employers operating in the state that are eligible for coverage under such AHPs, whether or not such other employers are participating employers in such plan.

Authorizes appropriations to the Secretary of Commerce for the following NIST programs: (1) scientific and technical research and services laboratory activities; (2) the Malcolm Baldrige National Quality Award (under the Stevenson-Wydler Technology Innovation Act of 1980); (3) construction and maintenance of facilities; (4) Teacher Science and Technology Enhancement Institute; (5) Manufacturing Extension Partnership (through the Secretary or other appropriate Federal agencies); (6) Collaborative Manufacturing Research Pilot Grants; and (7) Manufacturing Fellowships.

Outlines requirements for determining the annual surplus of the Trust Funds. Prohibits disinvestment of Social Security Trust Fund amounts from public debt obligations, any refraining from making such investments, or any delay in making normal deposits in such Trust Funds for public debt limit-related purposes. Authorizes, with certain conditions, the sale of Social Security Trust Fund public debt obligations for the payment of cash benefits and administrative expenses.

Chesapeake Bay Restoration Enhancement Act of 2007 - Amends the Federal Water Pollution Control Act to revise requirements for implementation and monitoring grants under the Chesapeake Bay Agreement and for reporting on federally-funded projects under such Agreement. Requires federal agencies that carry out activities within the watershed to: (1) participate in planning and restoration programs; and (2) ensure that such activities comply with the Chesapeake Bay Agreement and the Federal Agencies Chesapeake Ecosystem Unified Plan. Requires the President to submit as part of the annual federal budget information regarding each federal agency involved in Chesapeake Bay restoration. Requires the Administrator of the Environmental Protection Agency (EPA) to report on progress in achieving and maintaining nutrient and sediment reduction goals for each tributary basin. Sets forth the baseline for the report and reporting requirements. Requires the states of Delaware, Maryland, New York, Pennsylvania, Virginia, and West Virginia and the District of Columbia to submit to the Administrator information relating to nutrient and sediment reduction for each Chesapeake Bay tributary basin. Prohibits the Administrator from making a grant to any state which fails to provide required information. Requires the Administrator to request the Local Government Advisory Committee to report to EPA on measurable goals for local governments for nutrient and sediment reduction. Requires the Administrator: (1) to establish an implementation assistance program to support tributary strategies and other projects toward achievement of Chesapeake Bay Agreement goals; (2) to assist local governments and nonprofit organizations to implement tributary strategies and other complementary cooperative, locally based protection and restoration programs or projects under the technical assistance and assistance grants program; (3) in cooperation with the Administrator of the National Oceanic and Atmospheric Administration, to provide capacity building assistance to enhance local governments' capabilities to carry out protection and restoration programs or projects within a tributary basin; and (4) to provide grants to implement tributary strategies that accelerate the reduction of nonpoint source nutrient and sediment pollution. Requires specified load allocations to be incorporated into discharge permits until applicable total maximum daily loads are established. Updates reporting deadlines for the study of the Chesapeake Bay Program. Authorizes appropriations through FY2012.

Animal Fighting Prohibition Enforcement Act of 2007 - Amends the federal criminal code to prohibit: (1) sponsoring or exhibiting a bird in a fighting venture in a state where it would not otherwise be in violation of the law, only if the person knew that any bird in the venture was knowingly bought, sold, delivered, transported, or received in interstate or foreign commerce for such purpose; or (2) knowingly sponsoring or exhibiting in an animal fighting venture any other animal that was moved in interstate or foreign commerce. Prohibits knowingly: (1) selling, buying, transporting, delivering, or receiving, for purposes of transportation in interstate or foreign commerce, any dog or other animal to participate in an animal fighting venture; (2) using interstate mail service for commercial speech promoting an animal fighting venture except as performed outside the limits of the states (with an exception for bird fights in states whose laws allow them); or (3) selling, buying, transporting, or delivering in interstate or foreign commerce a knife, gaff, or other sharp instrument to be attached to the leg of a bird for use in an animal fighting venture. Increases the penalties to a fine and up to three years' imprisonment for violations.

Requires a state seeking a grant to carry out its activities through a lead entity to be known as a 2-1-1 Collaborative. Requires grant amounts to be used solely to make available to a state 2-1-1 telephone service for community information and referral on human services to all citizens of that state with phone access, including telephone connections between families and individuals seeking services and the service providers. Requires grant recipients to: (1) abide by the Key Standards for 2-1-1 Centers; and (2) collaborate with human service organizations to provide an exhaustive database of services with which to provide information or referral to individuals utilizing the 2-1-1 service.

Permits the Secretary of Housing and Urban Development to waive rent level limits for up to 9% (currently 5%) of all units subject to restructured mortgages in any fiscal year, based on certain findings of special need. Revises requirements for an approved mortgage restructuring and rental assistance sufficiency plan with respect to modification or forgiveness of all or part of a second mortgage held by the Secretary (debt relief) if the project concerned is acquired by a tenant organization or tenant-endorsed community-based nonprofit or public agency. Sets forth requirements for alternative periods of eligibility for such nonprofit debt relief. Declares disaster-damaged eligible projects eligible without regard to the relationship between rent level for the assisted units and comparable market rents. Requires each mortgage restructuring and rental assistance sufficiency plan to determine adjusted rent levels, according to certain formulae, for units assisted with project-based assistance in eligible multifamily housing projects. States that, with respect to a disaster-damaged eligible project, the owner contribution toward rehabilitation needs shall be determined in accordance with specified requirements.

Terminates application of the sustainable growth rate (SGR), replacing it with a single conversion factor, the Medicare economic index (MEI) minus 1%. Requires the Secretary of Health and Human Services to provide for the selection of quality performance measures (Q-measures) for assessing physician, non-physician practitioner, and supplier services and determining ratings for them. Requires such Q-measures to be developed in conjunction with physician specialty organizations and consensus-building organizations. Eliminates specified limitations on the balance billing of highest income beneficiaries. Revises requirements for the quality improvement program (QIO), including program administration, data disclosure, use of evaluation and competition, quality improvement funding, and qualifications for QIOs under part B (Peer Review) of SSA title XI. Amends SSA title XIX (Medicaid) to permit alternative quality improvement programs under such program. Terminates the availability of funds from the MA Regional Plan Stabilization Fund. Directs the Board of Trustees of the Federal Hospital Insurance Trust Fund and of the Federal Supplementary Medical Insurance Trust Fund to monitor and examine the extent to which the different Medicare funding mechanisms provide an appropriate alignment with the program goals of the respective parts. Provides for a one-year delay in Medicare adjustments in payments for imaging services. Eliminates the three-year phase-in for implementation of the reduction in Medicare part B premium subsidies for higher income beneficiaries (thus requiring immediate application of the reduction adjustment).
