Dairy Consumers and Producers Protection Act of 2001 - Amends the Agricultural Market Transition Act to include Maryland, New Jersey, New York, and Pennsylvania within the Northeast Interstate Dairy Compact. Eliminates: (1) the Compact's termination date; and (2) certain restrictive authority respecting non-Compact milk. States that only Ohio may join such Compact. Eliminates and revises specified provisions regarding Compact implementation, duration, restricting authority, and Commodity Credit Corporation compensation. States that Congress consents to the Southern Dairy Compact entered into by Alabama, Arkansas, Georgia, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Oklahoma, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia. States that only Florida, Nebraska, and Texas may join such Compact. Limits price regulatory authority to Class I fluid milk unless otherwise consented to by the Congress. Provides for Commodity Credit Corporation compensation. Sets forth the Southern Dairy Compact. States that Congress consents to: (1) the Pacific Northwest Dairy Compact proposed for California, Oregon, and Washington; and (2) the Intermountain Dairy Compact proposed for Colorado, Nevada, and Utah. Limits price regulatory authority to Class I fluid milk. Provides for Corporation compensation. States that such Compacts shall be the same as the Southern Dairy Compact with specified differences.

Free Trade Community Relief Act - Amends the Internal Revenue Code to, among other things: (1) provide for the designation of NAFTA-impacted communities; (2) establish an employment credit for such communities; and (3) provide for job training grants to such communities.

Small Business Liability Reform Act of 2001 - Allows punitive damages to be awarded against a small business only if the claimant establishes by clear and convincing evidence that conduct carried out by the defendant with a conscious, flagrant indifference to the rights or safety of others was the proximate cause of the harm that is the subject of the action. Limits such punitive damages to the lesser of three times the amount awarded for economic and noneconomic losses, or $250,000. Makes such limitation inapplicable if the court finds that the defendant acted with specific intent to cause the type of harm for which the action is brought. Provides liability limitation exceptions. States that in any civil action against a small business: (1) each defendant shall be liable only for the amount of noneconomic loss allocated to that defendant in direct proportion to the percentage of responsibility of that defendant for the harm caused to the plaintiff; and (2) the court shall render a separate judgment against each defendant describing such percentage of responsibility. Excepts from such liability limitations specified misconduct of a defendant. Mandates that, in any product liability action covered by this Act, a product seller other than a manufacturer shall be liable to a claimant only if such claimant establishes that: (1) the product that caused the harm was sold, rented, or leased by the seller, the seller failed to exercise reasonable care with respect to the product, and such failure was the proximate cause of harm to the plaintiff; (2) the seller made an express warranty applicable to such product, the product failed to conform to the warranty, and such failure caused the harm to the plaintiff; or (3) the product seller engaged in intentional wrongdoing, and such wrongdoing caused the harm to the plaintiff.

Small Business Export Enhancement Act of 2001 - Amends the Trade Act of 1974 to establish in the Office of the United States Trade Representative (USTR) the position of Assistant USTR for Small Business to promote the trade interests of small businesses, remove foreign trade barriers that impede small business exporters, and enforce existing trade agreements beneficial to small businesses.

Amends the Harmonized Tariff Schedule of the United States to impose tariff-rate quotas (quantitative import limits) and provide various duty rates on certain casein, caseinates, milk protein concentrate, and other casein derivatives and glues imported into the United States (except imports from Mexico). Authorizes the President to: (1) enter into a trade agreement with a foreign country to grant new concessions as compensation in order to maintain the general level of reciprocal and mutually advantageous concessions; and (2) proclaim any necessary modification or continuance of any existing duty, or continuance of existing duty-free or excise treatment. Sets forth certain limits on the reduction of duties on such products.

Prohibits the Secretary of the Army from contracting for the purchase of berets, authorizing or requiring the wearing of berets, or issuing a beret for use as standard army headgear until the Secretary certifies that any shortfall of army ammunition has been eliminated. Makes the prohibition inapplicable to army specialized units for which the wearing of berets is specifically authorized.

Kidney Patient Daily Dialysis Quality Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services to publish final regulations for equivalent per treatment prospective payment rates for more frequent hemodialysis treatments furnished to qualified individuals at home and in a facility (composite Method I and Method II Cap rates).

Consumer Rental Purchase Agreement Act - Amends the Consumer Credit Protection Act to prescribe guidelines for rental-purchase transactions, including: (1) the determination of rental-purchase cost; (2) disclosure requirements; (3) proscriptions against confessions of judgment, wage assignments, and waiver of consumer claims or defenses; (4) furnishing of statements of account; (5) point-of-rental disclosures; and (6) rental-purchase advertising disclosures. Authorizes the Board of Governors of the Federal Reserve System to promulgate implementing regulations. Provides for Federal and State enforcement of this Act.

Human Cloning Prohibition Act of 2001 - Prohibits any person or entity, in or affecting interstate commerce, from: (1) performing or attempting to perform human cloning; (2) participating in such an attempt; (3) shipping or receiving the product of human cloning; or (4) importing such a product. Expresses the sense of Congress that: (1) the Federal Government should advocate for and join an international effort to prohibit human cloning; and (2) the President should commission a study by the National Bioethics Advisory Commission or a successor group of the arguments for and against the use of cloning to produce human embryos solely for research.

Access to Cancer Therapies Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to extend Medicare coverage to all oral drugs prescribed for use as an anticancer agent for a medically accepted indication.

Amends title XVIII (Medicare) of the Social Security Act (SSA) to: (1) mandate a single national average standardized payment amount for inpatient hospital services furnished, regardless of whether in an urban or non-urban area, under the Medicare prospective payment system (PPS) for discharges occurring in FY 2002 and thereafter; and (2) establish a minimum factor of .925 as a floor for area wage adjustment factors used under the PPS for inpatient and outpatient hospital services.

Amends the Internal Revenue Code to suspend, for purposes of determining exclusion of gain from the sale of a principal residence, the five-year determination period for: (1) members of the uniformed services or the Foreign Service serving on qualified extended duty (at least 50 miles from such residence or residing in Government quarters); or (2) an employee serving for more than 90 days on assignment abroad.

Agriculture Education Freedom Act - Amends the Internal Revenue Code to exclude from the gross income of an individual any gain from the sale of any animal raised and sold by such individual as part of his or her participation in the 4-H program under the Cooperative State Research, Education, and Extension Service of the Department of Agriculture, the Future Farmers of America, any tax-exempt similar organization, or any program of a tax-exempt educational organization.

Constitutional Land Acquisition Act - Amends the Land and Water Conservation Act of 1965 to provide protection to real property owners whose property is: (1) within the boundaries of a Federal unit as a consequence of the acquisition of lands for that unit with amounts made available under the Act; or (2) adjacent to Federal lands acquired with such amounts. Specifies property acquisition and congressional, State, and local government notification requirements. Prohibits the use of funds under the Act for property acquisition by condemnation. Prescribes conditions for the use of acquired property for other than public outdoor recreation purposes.

Reforestation Tax Act of 2001 - Amends the Internal Revenue Code to allow a deduction to a taxpayer who has a qualified timber gain in an amount equal to the qualified percentage of such gain. Decreases the amortization period for reforestation expenditures.

Honors the service and sacrifice by members of the U.S. merchant marine. Recognizes: (1) the critical role played by vessels of the U.S. merchant marine fleet in transporting equipment, supplies, and personnel in support of the nation's defense; and (2) the historical significance of May 22 as National Maritime Day, which commemorates the anniversary of the first transoceanic voyage under steam propulsion. Encourages the American people and appropriate government agencies to recognize the services and sacrifices of the U.S. merchant marine through appropriate ceremonies and activities. Requests that all ships under the U.S. flag prominently display the flag on such day.

Federal Prison Industries Competition in Contracting Act of 2001 - Amends the Federal criminal code to replace provisions regarding the purchase of prison-made products by Federal departments with provisions establishing a Government-wide procurement policy relating to purchases from Federal Prison Industries (FPI) which shall generally require the use of competitive procedures. Requires FPI to comply with Federal occupational, health, and safety standards regarding its industrial operations. Requires that an analysis of the probable impact of a proposed expansion of inmate-work activities by FPI on private sector firms and their non-inmate workers be made whenever FPI proposes to authorize the sale of a new specific product or service or to expand production of a current product or service. Provides for inmate wages and deductions. Amends the Federal judicial code regarding the Department of Justice Assets Forfeiture Fund to authorize payments to the Bureau of Prisons exclusively for the purpose of providing additional vocational and remedial educational training for inmates. Amends the Federal criminal code to require that not less than 20 percent of the gross profits of the corporation at the end of each fiscal year be allocated to fund vocational training for inmates. Requires the Director of the Bureau to afford to inmates opportunities to participate in programs and activities designed to help prepare such inmates to obtain employment upon release. Authorizes FPI to: (1) locate more than one workshop at a Federal correctional facility; and (2) operate a workshop outside of a correctional facility if all of participating inmates are minimum security inmates.

American Hospital Preservation Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA), as amended by Federal law commonly referred to as the (Medicare, Medicaid, and SCHIP) Benefits Improvement and Protection Act, to: (1) increase (restore the full) market basket update for inpatient prospective payment services hospitals; and (2) maintain the indirect medical education adjustment percentage at 6.5 percent.

Medicare and Medicaid Nursing Services Quality Improvement Act of 2001 - Directs the Secretary of Health and Human Services to conduct a demonstration project under which a resident assistant who lacks certain nurse aide training requirements may perform feeding and hydration for a resident of a skilled nursing facility under the Medicare program under title XVII of the Social Security Act (SSA), or a nursing facility under the Medicaid program under SSA title XIX, in the States of Wisconsin, North Dakota, and not more than six other select States. Directs the Secretary to convene an advisory panel to submit recommendations on the use or improvement of resident assistants in such nursing facilities. Amends SSA titles XVIII and XIX, as amended by the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000, to authorize the use of resident assistants to perform feeding and hydration that would otherwise be performed by a nurse aide for residents of nursing facilities receiving payments under the Medicare or Medicaid program.

Amends the Civilian Health and Medical Program of the Uniformed Services (CHAMPUS) to eliminate the requirement that a covered military dependent obtain a nonavailability-of-health-care statement for the receipt of health care services related to pregnancy. Amends the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 to waive the requirement of such statement in the case of obstetrics and gynecological care related to the pregnancy of a covered beneficiary using TRICARE Extra (a Department of Defense managed health care program).

Social Security Benefits Fairness Act of 2001 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to provide that a monthly OASDI benefit shall be paid for the month in which the recipient dies, subject to a reduction of 50 percent if the recipient dies during the first 15 days of such month.

Amends the Department of Defense Appropriations Act, 1993 to: (1) remove certain exceptions from the prohibition against the use of Department of Defense funds for the procurement of certain items not grown, reprocessed, reused, or produced in the United States; and (2) require the Secretary of the military department concerned to certify that satisfactory quality and sufficient quantity of such an item cannot be procured as and when needed from U.S. suppliers or that an emergency exists and the procurement is vital to national security and the item is grown, reprocessed, reused, or produced in a country that adheres to fair labor practices. Provides that, in determining whether a purchase is for an amount greater than the simplified acquisition threshold, multiple purchases of a similar item in a fiscal year shall be deemed a single purchase. Prohibits Defense Commissary Agency purchases of articles or items in excess of such threshold when not grown, reprocessed, reused, or produced in the United States.

Second Amendment Rights Protection Act of 2001 - Amends the Brady Handgun Violence Prevention Act to prohibit the use of appropriated funds for: (1) any system to implement the Act that does not require and result in the immediate destruction of all information submitted by or on behalf of any person who has been determined not to be prohibited from owning a firearm; and (2) the implementation or collection of any tax or fee by any Federal officer, agent, or employee, or by any State or local officer or agent acting on behalf of the United States, in connection with such implementation. Authorizes any person aggrieved by a violation of this Act to bring an action in Federal district court and, if successful, to receive damages, punitive damages, and such other remedies as the court may determine to be appropriate, including a reasonable attorney's fee.

Military Personnel Recruitment and Retention Enhancement Act of 2001 - Amends the Internal Revenue Code to exclude from the gross income of members of the Armed Forces any "qualified bonus." Defines the term "qualified bonus" to mean an enlistment, accession, reenlistment, retention, or other bonus paid to a member of the Armed Forces of the United States in exchange for the agreement of the member to accept a commission as an officer, extend an active service commitment as an officer, enlist, reenlist, or extend an enlistment as an enlisted member in an active or reserve component, or enter into a reserve affiliation agreement.

Codifies under Federal armed forces law certain provisions under prior defense appropriations Acts which prohibit funds appropriated or otherwise made available to the Department of Defense from being used to procure the following items if such items are not grown, reprocessed, reused, or produced in the United States: (1) food; (2) clothing; (3) tents, tarpaulins, or covers; (4) cotton and other natural fiber products, silk or silk blends, synthetic fabrics, canvas products, or wool; (5) any equipment manufactured from or containing such fibers, yarns, fabrics, or materials; (6) specialty metals, including stainless steel flatware; and (7) hand or measuring tools. Allows an exception: (1) when the item cannot be procured when needed (after certain congressional notification); (2) for certain procurements outside the United States; (3) for certain specialty metals and chemical warfare protective clothing procured outside the United States; (4) for foods manufactured or processed in the United States; and (5) for small purchases under the defense simplified acquisition threshold. Makes such prohibitions applicable to contracts for the procurement of commercial items under the Office of Federal Procurement Policy Act.

Sustaining Access to Vital Emergency Medical Services Act of 2001 - Amends the Public Health Service Act, as amended by the Children's Health Act of 2000, to direct the Secretary of Health and Human Services to award grants to eligible entities to enable such entities to provide for improved emergency medical services in rural areas. Amends titles XVIII (Medicare) (including part C (Medicare+Choice) of the Medicare program) and XIX (Medicaid) of the Social Security Act to establish a prudent layperson standard for emergency ambulance services under Medicare and Medicaid.

Medicare Geographic Adjustment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000, with respect to decisions of the Medicare Geographic Classification Review Board to reclassify a disproportionate share hospital (DSH) for purposes of the adjustment factor used to adjust the diagnostic related statistical group (DRG) prospective payment rate for area differences in hospital wage levels. Makes any such Board decision to reclassify a DSH for purposes of the adjustment factor for FY 2001 or any subsequent fiscal year apply for purposes of adjusting payments made on a prospective basis for variations in costs attributable to wages and wage-related costs for prospective payment system-reimbursed items and services.

Fair Care for the Uninsured Act of 2001- Amends the Internal Revenue Code to allow an individual a tax credit in an amount equal to the amount paid for qualified health insurance, subject to stated limitations. Directs the Secretary of the Treasury to make payments to the provider of an individual's qualified health insurance equal to such individual's qualified health insurance credit advance amount (the Secretary's estimate of the amount of credit allowable) with respect to such provider. Requires each health insurer, health maintenance organization, and health service organization to participate in a health insurance safety net which shall assure the availability of health insurance to uninsurable individuals. Funds such safety nets through assessments against such insurers and organizations. Permits such insurers and organizations to add the costs of such assessments to the costs of its insurance or coverage. Amends the Public Health Service Act to allow health benefits coverage through individual membership associations (IMAs). Sets forth IMA requirements, including that the IMA be an organization operated under the direction of an association and that IMA health benefits coverage only be provided through contracts with health insurance issuers. Requires IMAs to include a minimum of two health insurance coverage options.

Capital Gains Tax Rate Reduction Act of 2001 - Amends the Internal Revenue Code to: (1) reduce the 10 and 20 percent individual capital gains tax rates to 5 and 10 percent respectively; (2) repeal provisions providing for reduced capital gain rates for qualified five year gains; and (3) with respect to the alternative minimum tax, reducing the 10 and 20 percent maximum tax rate on net capital gain for individuals to 5 and 10 percent respectively.

21st Century Montgomery GI Bill Enhancement Act - Increases, for FY 2002 through 2004, the rates of veterans' basic educational assistance. Prohibits any rate increase during such period based on adjustments to the Consumer Price Index.

Motor Vehicle Franchise Contract Arbitration Fairness Act of 2001 - Provides that whenever a motor vehicle franchise contract provides for the use of arbitration to resolve a controversy arising out of or relating to the contract, arbitration may be used to settle the controversy only if both parties consent in writing after such controversy arises. Requires the arbitrator to provide the parties with a written explanation of the factual and legal basis for the award.
