Real Education for Healthy Youth Act of 2019 This bill requires the Department of Health and Human Services (HHS), in coordination with certain HHS components, the Centers for Disease Control and Prevention, and the Department of Education, to award grants for comprehensive sex education for adolescents. It also awards grants for comprehensive sex education provided by institutions of higher education and for training faculty and staff to teach comprehensive sex education to adolescents. Comprehensive sex education programs may include, among other things, instruction that addresses the physical, mental, emotional, and social dimensions of human sexuality and approaches designed to motivate and assist students to maintain and improve their sexual health, prevent disease and reduce sexual health-related risk behaviors. Grant funds generally may not be used for specified purposes, including to (1) withhold specified health information related to HIV, (2) provide medically inaccurate information, or (3) promote gender or racial stereotypes. The bill also revises requirements and eliminates prohibitions regarding the content of educational programs funded through the HIV/AIDS prevention program, repeals the prohibition on using funds for materials or programs that promote or encourage sexual activity and contraceptive distribution in school, and repeals the Abstinence Only Until Marriage program.

Youth Access to Sexual Health Services Act of 2019 This bill authorizes the Department of Health and Human Services to award grants to support the access of marginalized youth to sexual health services such as sexual health education and contraception. Marginalized youth are disadvantaged individuals under the age of 26. Grants may be awarded to state or local health or education agencies, public schools, nonprofit organizations, hospitals, Indian tribes, and tribal organizations. Grants may be used to (1) provide sexual health information to marginalized youth, (2) promote effective communication regarding sexual health among marginalized youth, (3) promote and support opportunities for school-age parents, and (3) train individuals who work with marginalized youth to promote sexual health and the development of safe and supportive environments. Grants may not be used to provide access to health services that (1) are medically unsound; (2) withhold sexual health-promoting or lifesaving information; (3) promote gender stereotypes; or (4) are insensitive or unresponsive to the needs of young people, including youth with varying gender identities and sexual orientations, sexually active youth, pregnant or parenting youth, and survivors of sexual abuse or assault. Unobligated funds for abstinence education are transferred and made available for these grants.

This bill specifies that certain Medicare payment rules applicable to imaging services shall apply to dual-energy x-ray absorptiometry services used in bone mass scans beginning in 2019. The Centers for Medicare & Medicaid Services must establish national minimum payment amounts for such services.

Breast Cancer Research Stamp Reauthorization Act of 2019 This bill reauthorizes through December 31, 2027, provisions requiring the U.S. Postal Service to issue a special postage stamp for first-class mail that costs more than the regular first-class stamp to raise funds for breast cancer research.

Renewable Energy Transferability Act This bill allows tax credits for renewable energy to be transferred to project partners. The bill applies to the tax credits for (1) renewable electricity production, and (2) investments in renewable energy property.

Family First Transition and Support Act of 2019 This bill eliminates income-based limitations on a child's eligibility for federal foster care support and makes other changes to funding for, and administration of, grants and programs for child welfare in states and tribes. The bill increases funding for activities including (1) training of child welfare workers, foster parents, and those working in the court system; (2) research on evidence-based practices to prevent child abuse and neglect; and (3) regional partnerships between child welfare agencies and others to address a parent's, or other caregiver's, substance use disorder. The bill's changes to the administration of child welfare programs include, for example, delaying until FY2027 a requirement for states to expend a minimum percentage of funding for child abuse prevention services on only those services that meet certain criteria for effectiveness. In addition, the bill expands the scope of certain grants to include kinship placement services and allows the use of federal funds to address issues that may put a child at risk of entering foster care, such as by providing assistance with housing and utility payments.

Asylum Seeker Protection Act This bill prohibits the use of funds to implement or enforce the Migrant Protection Protocols announced on December 20, 2018. (The protocol generally requires that aliens who are not clearly admissible arriving by land along the U.S.-Mexico border be returned to Mexico while their immigration proceedings are pending, rather than remain in the United States. The protocol applies to aliens seeking asylum but who have been assessed not to be more likely than not to face persecution or torture in Mexico.)

Special Diabetes Programs for Indians Reauthorization Act of 2019 This bill reauthorizes through FY2024 the Special Diabetes Program for Indians. The program is administered by the Indian Health Service and provides funds to Indian health programs for diabetes prevention and treatment.

Student Borrower Bankruptcy Relief Act of 2019 This bill permits a borrower to discharge in bankruptcy a nonprofit, government, or private student loan, or an obligation to repay an educational benefit, scholarship, or stipend.

Strength in Diversity Act of 2019 This bill directs the Department of Education to award grants to specified educational agencies to develop or implement plans to improve diversity and reduce or eliminate racial or socioeconomic isolation in publicly funded early childhood education programs, public elementary schools, or public secondary schools.

Buffalo Tract Protection Act This bill withdraws specified Bureau of Land Management (BLM) lands in Placitas, New Mexico, from all forms of mineral development under all laws pertaining to mineral leasing or mineral materials, including locatable minerals. Any disposal of the surface estate of the BLM lands shall be subject to the condition that the mineral estate of those lands shall remain under the ownership of the BLM, subject to the withdrawal under this bill.

Safe Schools Improvement Act of 2019 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit conduct, including bullying and harassment, that is sufficiently severe, persistent, or pervasive to (1) limit students' ability to participate in, or benefit from, school programs; or (2) create a hostile or abusive educational environment that adversely affects students' education. LEAs shall also provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct, and report on, an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics shall collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Improving Training for School Food Service Workers Act This bill adds requirements regarding the availability of training that the Department of Agriculture provides under current law for local food service personnel in schools. The training must be scheduled primarily during regular, paid working hours; offered in-person whenever appropriate; and incorporate hands-on training techniques. If the training is scheduled outside of working hours, food service personnel must be informed about the necessity of scheduling the program and compensated for attending the program. Personnel may not be penalized for failing to attend a program outside of working hours.

Service Member's Occupational and Environmental Transparency Health Act or the OATH Act This bill requires the Department of Defense (DOD) to (1) record service members' exposure to occupational and environmental health hazards while deployed overseas, and (2) make such information available for post-deployment medical examinations and health reassessments. DOD and the Department of Veterans Affairs must update electronic health records with information from the Burn Pit Registry (i.e., a registry designed to track certain airborne hazards). The Government Accountability Office must submit a report evaluating implementation of the above requirements.

Clean Corridors Act of 2019 This bill directs the Department of Transportation to award grants to certain governmental entities and planning organizations to install electric vehicle charging infrastructure and hydrogen fueling infrastructure along designated alternative fuel corridors.

Hardrock Leasing and Reclamation Act of 2019 This bill addresses mineral leasing, exploration, and development on federal land. Among other things, the bill prohibits the issuance of a patent for certain mining or millsite claims; establishes a permitting and leasing system for hardrock mining; establishes a 12.5% royalty on new mining operations and an 8% royalty on existing operations, with an exemption for small miners; protects special places, such as wilderness study areas, roadless areas, and wild and scenic rivers, from hardrock mining activity; requires consultation prior to undertaking any mineral activities that may have a substantial direct impact on the lands or interests of Indian tribes; establishes an environmental standard for mining activities to ensure that mining activities prevent undue degradation of public lands and resources; prescribes requirements for the exploration permit process and for operations permits, including financial assurances; and authorizes the use of amounts in the Hardrock Minerals Reclamation Fund for the reclamation and restoration of land and water resources adversely affected by past hardrock mineral activities and related activities.

Prevent Release Of Toxics Emissions, Contamination, and Transfer Act of 2019 or the PROTECT Act of 2019 This bill requires the Environmental Protection Agency to (1) issue a final rule adding perfluoroalkyl and polyfluoroalkyl substances with at least one fully fluorinated carbon atom to the list of hazardous air pollutants, and (2) revise the list of air pollution sources within 365 days after issuing the rule to include categories and subcategories of major sources and area sources of perfluoroalkyl and polyfluoroalkyl substances.

Resources for Victims of Gun Violence Act of 2019 This bill establishes an Advisory Council to Support Victims of Gun Violence. Among other things, the advisory council must assess the needs of victims of gun violence and disseminate information about resources available to help victims of gun violence.

Constitutional Amendment This joint resolution prohibits construction of the Constitution as forbidding Congress or the states from (1) imposing reasonable content-neutral limitations on private campaign contributions or independent election expenditures; or (2) enacting systems of public campaign financing, including those designed to restrict the influence of private wealth by offsetting campaign spending or independent expenditures with increased public funding.

Healthy MOMMIES Act This bill establishes a series of programs and requirements under Medicaid and the Children's Health Insurance Program (CHIP) relating to maternal health. For example, the bill expands eligibility for coverage under Medicaid and CHIP from 60 days to one year after the last day of pregnancy and requires such coverage to include oral health services. The bill also establishes a demonstration program in which states receive grants to implement or expand models for maternity care homes that provide services to Medicaid or CHIP beneficiaries. The Government Accountability Office must report on (1) gaps in coverage under Medicaid and CHIP for pregnant and postpartum women, and (2) the use of telemedicine by state Medicaid programs to increase access to maternity care.

Suicide and Threat Assessment Nationally Dedicated to Universal Prevention Act of 2019 This bill requires state and tribal education agencies that receive grant funding for priority mental-health needs to establish and implement (1) evidence-based suicide awareness and prevention training policies, and (2) school threat assessment teams. School threat assessment teams consist of two or more school personnel who are trained to identify, assess, and respond to threats of suicide and interpersonal violence.

Nurse Staffing Standards for Patient Safety and Quality Care Act of 2019 This bill requires hospitals to implement and submit to the Department of Health and Human Services (HHS) a staffing plan that complies with specified minimum nurse-to-patient ratios by unit. Hospitals must post a notice regarding nurse-to-patient ratios in each unit and maintain records of actual ratios for each shift in each unit. The bill also requires hospitals to follow certain procedures regarding how ratios are determined and other staff are prohibited from performing nurse functions unless specifically authorized within a state's scope of practice rules, among other requirements. HHS must adjust Medicare payments to hospitals to cover additional costs attributable to compliance with these ratios. Nurses may object to, or refuse to participate in, an assignment if it would violate minimum ratios or if they are not prepared by education or experience to fulfill the assignment without compromising the safety of a patient or jeopardizing their nurse's license. Hospitals may not (1) take adverse actions against a nurse based on the nurse's reasonable refusal to accept an assignment; or (2) discriminate against individuals for good faith complaints relating to the care, services, or conditions of the hospital or related facilities. HHS may impose civil monetary penalties on hospitals violating the ratio requirements and must publish the names of such hospitals. The bill provides stipends to the nurse workforce loan repayment and scholarship program and expands the nurse retention grant program to include nurse preceptorship and mentorship projects.

This resolution strongly condemns the government of Cameroon's abuses in the country's Anglophone regions, including the use of violence and violations of press freedoms. It urges the government to initiate dialogues with separatist groups and civil society, follow through on initiatives developed to address various grievances, and comply with international human rights standards. The resolution also urges separatist groups to immediately stop committing human rights abuses and end their incitement of violence and hate speech.

Tribal Heritage and Grizzly Bear Protection Act This bill provides for the management of grizzly bears ( Ursus arctos horribilis ) except for grizzly bears that (1) belong to a population that is listed as a threatened or an endangered species; (2) are taken, possessed, or transported in Alaska; or (3) are taken in self-defense or to save the life of another person in immediate danger. The Department of the Interior may issue a permit for taking (e.g., killing, harming, or capturing), possessing, or transporting grizzly bears, or their parts if such taking, possession, or transportation is for purposes of science, exhibition, tribal religion, agricultural protection, or public safety. Such permits must be compatible with the protection of the grizzly bear species or a population of grizzly bears occupying a geographically distinct area. In addition, Interior must establish (1) a Grizzly Bear Scientific Committee, and (2) a grant program for assisting livestock producers with issues of livestock predation. Finally, the bill provides for the reintroduction of grizzly bears on tribal land.

Brunei Human Rights Act This bill authorizes the President to impose sanctions on any Brunei government officials responsible for implementing certain provisions in Brunei's penal code in a way that constitutes a gross violation of human rights. (Brunei has passed laws that call for the death penalty for offenses such as adultery and consensual same-sex relations.) The Department of State shall report annually to Congress on foreign countries that enforce laws targeting lesbian, gay, bisexual, transgender, and intersex (LGBTI) individuals; women; children; religious minorities; or other vulnerable populations. The State Department shall also report annually to Congress on its efforts to assist refugees from Brunei seeking asylum in other countries. The Department of Homeland Security shall report annually to Congress on the number of Brunei nationals seeking asylum in the United States and the outcome of such requests.

American Indian and Alaska Native Child Abuse Prevention and Treatment Act or AI/AN CAPTA This bill implements requirements concerning child abuse and neglect in Indian tribal communities. Specifically, the bill requires the Government Accountability Office to report on child abuse and neglect in tribal communities for the purpose of making recommendations regarding these issues. Additionally, the Department of Health and Human Services must include Indian tribes and tribal organizations in its equitable distribution of assistance for programs and projects related to child abuse prevention and treatment.

Fostering Undergraduate Talent by Unlocking Resources for Education Act or the FUTURE Act This bill extends through FY2021 and revises mandatory funding programs for historically black colleges and universities and other minority-serving institutions, including by allocating a portion of the funding for grants to predominantly black institutions for programs in (1) science, technology, engineering, or mathematics; (2) health education; (3) internationalization or globalization; (4) teacher preparation; or (5) improving educational outcomes of African-American males.

Protecting the Right to Organize Act of 2019 This bill amends the National Labor Relations Act and related labor laws to extend protections to union workers. Specifically, it revises the definition of "employee" and "supervisor" to prevent employers from classifying employees as exempt from labor law protections, expands unfair labor practices to include prohibitions against replacement of or discrimination against workers who participate in strikes, makes it an unfair labor practice to require or coerce employees to attend employer meetings designed to discourage union membership, permits workers to participate in collective or class action litigation, allows injunctions against employers engaging in unfair labor practices involving discharge or serious economic harm to an employee, expands penalties for labor law violations, including interference with the National Labor Relations Board or causing serious economic harm to an employee, and allows any person to bring a civil action for harm caused by labor law violations or unfair labor practices.

Securing American Nonprofit Organizations Against Terrorism Act of 2019 This bill establishes in the Department of Homeland Security a Nonprofit Security Grant Program, under which the Federal Emergency Management Agency (FEMA) shall make grants to eligible nonprofit organizations (tax-exempt organizations and those determined to be at risk of a terrorist attack) for target hardening and other security enhancements to protect against terrorist attacks.

Tribal Border Crossing Parity Act This bill provides the right to pass the borders of the United States (which includes other privileges pursuant to the Jay Treaty) to an American Indian born in the United States or Canada who is a member, or is eligible to be a member, of a federally recognized Indian tribe in the United States or Canada. Under current law, such right is provided only to an American Indian born in Canada who has at least 50% American Indian blood.

Chemical Poisons Reduction Act of 2019 or Canyon's Law This bill prohibits the use of sodium fluoroacetate (i.e., Compound 1080) and sodium cyanide in a predator control device. It imposes criminal penalties—a fine, a prison term of up to two years, or both—on a violator. A predator control device is a dispenser, livestock collar, or gas cartridge that propels, releases, or emits sodium fluoroacetate or sodium cyanide for wildlife management or animal control purposes.

Roadless Area Conservation Act of 2019 This bill bars the Department of Agriculture from allowing the construction of roads, the reconstruction of roads, or logging in an inventoried roadless area where those activities are prohibited by the Roadless Rule (i.e., certain federal regulations relating to roadless area management).

Tribal Nutrition Improvement Act of 201 9 This bill allows an Indian tribe to assume, from a nearby local educational agency (LEA) and in lieu of a state, responsibility for administration of the school breakfast program, the school lunch program, the child and adult care food program, or the summer food service program for children. The Department of Agriculture (USDA) must identify, for optional use in LEAs on or near Indian reservations, alternatives to current program requirements related to the daily counting of meals by category, the use of annual applications to determine program eligibility, and the use of universal meal service. USDA may implement such alternatives, as limited by the bill, as well as further test them in demonstration projects. The bill also requires USDA to increase the amount of administrative funds paid to an Indian tribe that agrees to assume responsibility for the administration of one of the specified food programs.

Tribal Tax and Investment Reform Act of 2019 This bill treats Indian tribal governments as states for purposes of the annual allocation of the tax-exempt bond volume cap. It also repeals provisions that limit an Indian tribal government's eligibility to issue tax-exempt bonds or to be exempt from specified excise taxes to transactions involving the exercise of an essential government function customarily performed by state and local governments. The bill (1) treats employee benefit or pension plans maintained by Indian tribes and domestic relations orders issued pursuant to tribal law in the same manner as plans maintained by states and domestic relations orders issued pursuant to state law; and (2) treats tribal charities and foundations in the same manner as charities and foundations funded and controlled by other governmental entities for purposes of the tax-exempt status of, and deduction for contributions to, such organizations. The bill gives Indian tribes or tribal organizations access to the Federal Parent Locator Service if they are eligible for a grant to operate a child support enforcement program. It makes those tribes and tribal organizations eligible to participate in the program that collects past-due support from individual tax refunds. An Indian tribal government may determine whether a child has special needs for the purpose of the tax credit for the adoption of a child with special needs.

Gold Star Family Tax Relief Act This bill treats certain military survivor benefits that are received by children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the benefits from such tax.

Not Invisible Act of 2019 This bill increases the coordination of efforts to reduce violent crime within Indian lands and against Indians. Specifically, the Department of the Interior must designate an official within the Bureau of Indian Affairs to coordinate prevention efforts, grants, and programs related to missing Indians and the murder and human trafficking of Indians. In addition, Interior and the Department of Justice (DOJ) must (1) establish an advisory committee on violent crime within Indian lands and against Indians, and (2) submit a written response to the recommendations developed by the advisory committee. The advisory committee must make recommendations to Interior and DOJ on actions to combat violent crime against Indians and within Indian lands, including strategies for identifying, reporting, and responding to instances of missing persons, murder, and human trafficking; and develop best practices for tribes and law enforcement officials in close proximity to Indian lands to follow, including practices to address any gaps in services for Indian victims.

Accelerating Veterans Recovery Outdoors Act This bill requires the Department of Veterans Affairs to establish the Task Force on Outdoor Recreation for Veterans to report on and make recommendations regarding the use of public lands or other outdoor spaces for medical treatment and therapy for veterans.

Copyright Alternative in Small-Claims Enforcement Act of 2019 or the CASE Act of 2019 This bill creates the Copyright Claims Board, a body within the U.S. Copyright Office, to decide copyright disputes. Damages awarded by the board are capped at $30,000. Participation in board proceedings is voluntary with an opt-out procedure for defendants, and parties may choose instead to have a dispute heard in court. If the parties agree to have their dispute heard by the board, they shall forego the right to be heard before a court and the right to a jury trial. Board proceedings shall have no effect on class actions. The board shall be authorized to hear copyright infringement claims, actions for a declaration of noninfringement, claims that a party knowingly sent false takedown notices, and related counterclaims. The bill provides for various procedures, including with respect to requests for information from the other party and requests for the board to reconsider a decision. The board may issue monetary awards based on actual or statutory damages. The parties shall bear their own attorneys' fees and costs except where there is bad faith misconduct. A board's final determination precludes relitigating the claims in court or at the board. Parties may challenge a board decision in federal district court only if (1) the decision was a result of fraud, corruption, or other misconduct; (2) the board exceeded its authority or failed to render a final determination; or (3) in a default ruling or failure to prosecute, the default or failure was excusable.

Protecting Immigrants From Legal Exploitation Act of 2019 This bill establishes that certain acts of immigration-related fraud shall be punished by fines, imprisonment, or both. The bill provides for such punishment for a person who knowingly or recklessly executes a scheme or artifice in a matter arising under immigration law to (1) defraud any person; or (2) obtain anything of value from any person through false pretenses, representations, or promises. A person who knowingly and falsely represents that such person is an attorney or accredited representative in any matter arising under immigration law shall be subject to such punishment. The Department of Justice (DOJ) may seek civil injunctions to stop an immigration service provider from further engaging in fraudulent conduct or willfully misrepresenting the provider's authority to provide representation in immigration matters. An alien who left the United States based on erroneous advice from a person engaged in immigration practitioner fraud or the unauthorized practice of law shall not be barred from reentering the country. An alien may withdraw an application for immigration benefits that was prepared or submitted by an individual engaging in immigration practitioner fraud or the unauthorized practice of law, if the alien had no prior knowledge of the individual's fraudulent or unauthorized status. The Department of Homeland Security (DHS), the Department of State, and DOJ shall develop procedures for allowing such an alien to submit corrected filings. DHS and DOJ shall establish a program to provide grants to eligible nonprofit organizations to provide direct legal services to aliens.

Puppy Protection Act of 2019 This bill requires the Department of Agriculture to expand standards that govern the humane handling, care, treatment, and transportation of animals to include new requirements for commercial dog dealers. Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

What You Can Do For Your Country Act This bill revises the Public Service Loan Forgiveness (PSLF) program, including by allowing borrowers with loans under the Federal Family Education Loan program to be eligible for the PSLF program, allowing borrowers to receive loan forgiveness on half of their total loans after satisfying 60 qualifying payment obligations, revising provisions related to loan consolidation, revising the types of payments that count toward qualifying payment obligations, defining full-time employment as 30 hours per week, requiring the Department of Education (ED) to provide certain notices to borrowers, revising the process for certification of employment, requiring ED to establish a database of qualifying employers, providing a process for borrowers to satisfy past monthly payment obligations, requiring lenders to provide to ED necessary borrower repayment history information, and requiring ED to establish a dispute resolution process.

National Museum of the American Latino Act This bill establishes the National Museum of the American Latino in the Smithsonian Institution. The purposes of the museum are to (1) illuminate Latino contributions to the story of the United States; (2) provide for the collection, study, research, publication, and establishment of exhibitions and programs related to Latino life, art, history, and culture; and (3) provide for collaboration with Smithsonian Institution museums and research centers and other museums and educational institutions in the United States and abroad to promote the study and appreciation of Latino life, art, history, culture, and its impact on society in the United States. The bill establishes a Board of Trustees for the museum to advise and assist the Board of Regents of the Smithsonian on all matters related to the administration and preservation of the museum. The Director of the museum shall manage the museum and may carry out educational and liaison programs in support of its goals. The Director of the Institute of Museum and Library Services shall establish and carry out specified grant programs and a scholarship program, including a grant program to promote the understanding of the Latin American diaspora in the United States. The Board of Regents shall designate a site for the museum and is authorized to design and construct it.

Women's Suffrage Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 400,000 $1 silver coins that are emblematic of the women who played a vital role in rallying support for the 19th Amendment to the U.S. Constitution. Such coins may be issued during the period beginning on January 1, 2020, and ending on December 31, 2020. All surcharges received from the sales of such coins shall be paid to the American Women's History Initiative of the Smithsonian Institution.

This bill revises provisions governing the Morris K. Udall and Stewart L. Udall Foundation. Among other things, the foundation (1) provides outreach regarding the environment, public lands, and natural resources; (2) develops resources to train professionals in the environmental field and Native American and Alaska Native professionals in health care and public policy; and (3) supports the United States Institute for Environmental Conflict Resolution. This bill reauthorizes the institute through FY2023 and renames the institute as the John S. McCain III United States Institute for Environmental Conflict Resolution. Finally, the bill requires the Inspector General of the Department of the Interior to audit the foundation.
