Federal Jobs Act This bill requires federal agencies to develop plans to increase diversity in the workforce. Specifically, the Office of Personnel Management (OPM) and the Office of Management and Budget (OMB) must develop a plan to increase diversity in the executive branch of government that includes specified information, including strategies for agencies to remove barriers to equal employment opportunities. Each executive agency must develop an agency-specific plan to increase diversity, pursuant to OPM and OMB guidance, and annually publish specified data. The legislative and judicial branches of government must also implement these requirements to the greatest extent possible. Additionally, each executive agency, and each prime contractor that is under contract with an executive agency, must annually report information relating to economically and socially disadvantaged businesses.

Resilient Elections During Quarantines and Natural Disasters Act of 2020 This bill requires states and jurisdictions to adopt contingency plans and permit absentee voting in order to prevent the disruption of federal elections due to natural disasters or infectious diseases, including COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill requires each state and jurisdiction to, within 30 days, create and publish a plan to operate their federal elections if a significant number of voters or poll workers are quarantined due to COVID-19. Such plan must (1) permit registered voters to submit online requests for absentee ballots and vote in federal elections by mail, and (2) extend vote-by-mail deadlines if postal service is disrupted as a result of COVID-19. Additionally, when at least 25% of states have declared an emergency due to any single natural disaster or infectious disease, including COVID-19, states must allow registered voters to vote by absentee ballot, permit voters to submit online requests for absentee ballots, allow voters to receive electronic (i.e., print-at-home) ballots, accept absentee-ballot requests up to five days before an election for mailed ballots and one day before the election for print-at-home ballots, and accept ballots postmarked on or before the date of the election. The bill also provides for an emergency voting period if a state governor declares a state of emergency. States and jurisdictions must provide self-sealing return envelopes with prepaid postage for voter registration applications, absentee-ballot applications, and blank absentee ballots. The Election Assistance Commission must reimburse states for the costs of doing so.

The percentage increase in benefits shall be the same as the cost-of-living increase for Social Security recipients.

Data to Save Moms Act of 2020 This bill establishes the Task Force on Maternal Health Data and Quality Measures, and certain grants for maternal mortality review committees, to address maternal mortality and severe maternal morbidity among women in minority populations. Among other activities, the task force must evaluate issues related to maternal health data and provide recommendations to improve maternity care. The Department of Health and Human Services (HHS) may award grants to certain entities that coordinate maternal mortality review committees for purposes of including community representatives on such committees. Additionally, to the extent practicable, the committees must (1) consult with community-based organizations about nonclinical factors that contribute to adverse maternal health outcomes, and (2) review certain cases of severe maternal morbidity in addition to pregnancy-associated and pregnancy-related deaths. In addition, the Indian Health Service and HHS must coordinate studies of maternal mortality and severe maternal morbidity among women in tribal and minority populations, respectively.

Ensuring Emergency Food Security Act This bill expands benefits and eligibility under the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program) which is administered by the Department of Agriculture (USDA). Specifically, the bill prohibits any federal funding (including fees) from being used to decrease program benefits or impact program eligibility under SNAP; temporarily increases the value of SNAP benefits through FY2020; prohibits USDA from reducing the value of the maximum allotments, minimum allotments or consolidated block grants for Puerto Rico and American Samoa below the level in effect for FY2020 as a result of such increase; temporarily suspends work requirements through FY2022 under SNAP, allowing participants who would have lost eligibility due to such requirements to continue to receive SNAP benefits; directs state agencies, beginning on October 1, 2022, to disregard any period during which an individual received SNAP benefits prior to FY2022, for purposes of referring such individual to an employment and training program; and expands the food distribution program on Indian reservations for costs relating to facility improvements and equipment upgrades.

Black Maternal Health Momnibus Act of 2020 This bill directs the Department of Health and Human Services (HHS) and other agencies to address maternal health outcomes among minority populations. HHS must (1) establish task forces to address social determinants of health, maternal mental and behavioral health, and other topics; and (2) award grants for maternal mortality review committees, innovative maternity care models, and other purposes. The Centers for Medicare & Medicaid Services must establish a perinatal payment demonstration project. The Department of Housing and Urban Development and the Department of Transportation must report on the impact of housing and transportation during prenatal and postpartum periods, respectively. The Department of Veterans Affairs must submit a plan for maternity care coordination for women veterans, and the Bureau of Prisons must establish programs and award grants to certain prisons and jails to improve maternal health outcomes among incarcerated individuals. The Government Accountability Office must report on the perinatal health workforce, maternity care compliance offices, and maternal health outcomes among veterans and incarcerated individuals. The National Academies of Sciences, Engineering, and Medicine must report on specified topics, including training programs to reduce bias, racism, and discrimination. The Medicaid and CHIP Payment Access Commission must report on the impact of Medicaid ineligibility on pregnant and postpartum individuals who are incarcerated. The bill also (1) expands eligibility for certain nutrition programs by increasing the postpartum and breastfeeding periods, and (2) reduces certain funding to states without laws restricting the use of restraints on pregnant women who are incarcerated.

Paid Sick Days for Public Health Emergencies and Personal and Family Care Act This bill expands the availability of paid sick time by requiring employers with at least one employee to provide a minimum amount of accrued paid sick time per work week and additional paid sick time in the event of a public-health emergency such as the coronavirus (i.e., the virus that causes COVID-19). Specifically, the bill requires employers to grant at least 1 hour of accrued paid sick time to each employee for every 30 hours worked, up to a minimum of 56 hours, or 7 days, of paid sick time per year. Accrued paid sick time may be used for, among other reasons, an absence from work that is taken (1) due to a medical condition or illness or for the diagnosis, care, or prevention thereof; (2) to care for a child, spouse, domestic partner, parent, or other close relative with a medical condition or illness, or for the diagnosis or prevention thereof; (3) during a public-health emergency when the employee's workplace has been closed or the employee has been exposed to a communicable disease and may pose a risk to others; or (4) to care for a child or close relative during such public-health emergency, if such relative has been exposed to a communicable disease or the child's school has been closed. Further, employees are immediately entitled to up to 14 days of additional paid sick time if a public-health emergency is declared. This additional paid sick time may be used during the public-health emergency for the same purposes as accrued paid sick time.

The National Academies of Sciences, Engineering, and Medicine must study issues related to the training programs, and the Government Accountability Office must study the implementation and impact of the compliance offices.

The Department of Labor shall determine the prevailing rates and in determining such rates shall take into account any applicable existing collective bargaining agreements in the locality. In no case shall a prevailing rate established pursuant to this bill supersede a worker's wages and benefits agreed to in a collective bargaining agreement.

Border Health Security Act of 2020

Border Health Security Act of 2020 This bill modifies the duties and activities of the United States-Mexico Border Health Commission and the Canada-United States Pan-Border Public Health Preparedness Council, and makes other changes to address health issues along the U.S. border. Specifically, the commission must cooperate with the council where appropriate, and members of the commission may provide advice or recommendations to the Department of Health and Human Services (HHS) or Congress without authorization or a request. Both the commission and the council must develop strategic plans, work plans, evaluations, and reports concerning their activities. HHS must award grants to (1) eligible entities in border areas to address recommendations of the commission and the council to improve the health of border area residents; and (2) trauma centers, public health entities, and state, local, or tribal entities for infectious disease surveillance activities in border areas. In addition, the Office of the Assistant Secretary for Preparedness and Response may coordinate with the Department of Homeland Security in establishing a system that alerts clinicians and public health officials to emerging health threats in border areas. The Government Accountability Office must evaluate commission and council activities every two years.

Repeal Existing Policies that Encourage and Allow Legal HIV Discrimination Act of 2020 or the REPEAL HIV Discrimination Act of 2020 This bill concerns the burdens that federal and state laws, policies, and regulations may place upon people living with human immunodeficiency virus (HIV). The bill directs the Department of Justice (DOJ), the Department of Health and Human Services (HHS), and the Department of Defense (DOD) to initiate a national review of federal (including military) and state laws, policies, regulations, and judicial precedents and decisions regarding criminal and related civil commitment cases involving people living with HIV. DOJ must transmit to Congress and make publicly available the results of such review with related recommendations. DOJ and HHS must (1) develop and publicly release guidance and best practice recommendations for states, and (2) establish an integrated monitoring and evaluation system to measure state progress. DOJ, HHS, and DOD must transmit to the President and Congress any proposals necessary to implement adjustments to federal laws, policies, or regulations. This bill shall not be construed to discourage the prosecution of individuals who intentionally transmit or attempt to transmit HIV to another individual.

Environmental Justice For All Act This bill establishes several environmental justice requirements, advisory bodies, and programs to address the disproportionate adverse human health or environmental effects of federal laws or programs on communities of color, low-income communities, or tribal and indigenous communities. Specifically, the bill prohibits disparate impacts on the basis of race, color, or national origin as discrimination. Aggrieved persons may seek legal remedy when faced with such discrimination. In addition, the bill directs agencies to follow certain requirements concerning environmental justice. For example, agencies must prepare community impact reports that assess the potential impacts of their actions on environmental justice communities under certain circumstances. Further, it creates a variety of advisory bodies and positions, such as the Interagency Working Group on Environmental Justice Compliance and Enforcement. Among other things, the group must issue an environmental justice strategy. It also establishes requirements and programs concerning chemicals or toxic ingredients in certain products. For example, the bill (1) requires certain products (e.g., cosmetics) to include a list of ingredients or warnings; and (2) provides grants for research on designing safer alternatives to chemicals in certain consumer, cleaning, toy, or baby products that have an inherent toxicity or that are associated with chronic adverse health effects. Finally, it creates a variety of funding programs, such as a grant program to enhance access to park and recreational opportunities in an urban areas.

Community Solar Consumer Choice Act of 2020 This bill supports the expansion of community solar energy and doubles the allowable time period for a long-term contract between the General Services Administration (GSA) and a public utility. Specifically, the bill requires the Department of Energy (DOE) to establish a program for expanding community solar energy options, including options for low-income and moderate-income individuals. In addition, DOE must expand existing grant, loan, and financing programs to include community solar projects as specified by the bill. Further, the bill revises requirements for electric utilities, including by requiring each electric utility to offer a community solar program. Finally, the bill allows the GSA to make a public utility contract for a period of up to 20 years. Currently, the GSA may make a public utility contract for up to 10 years.

In addition, USDA must transfer amounts from the fund to the National Fish and Wildlife Foundation to implement the Western Monarch Butterfly Conservation Plan, which was prepared by the Western Association of Fish and Wildlife Agencies.

Agriculture Resilience Act This bill addresses national greenhouse gas emission reduction efforts in the U.S. agriculture sector, including a national goal to achieve net-zero emissions by the year 2040. Among other things, the bill expands the purposes of federally supported agricultural research, extension, and education to include accelerating the ability of agriculture and the food system of the United States to first achieve net zero carbon emissions and then go further to be carbon positive by removing additional carbon dioxide from the atmosphere; requires the Department of Agriculture (USDA) to establish a national network of regional hubs for risk adaptation and mitigation to climate change; creates a soil health grant program for state and tribal governments; revises the agricultural conservation easement program to require owners that receive cost-share assistance to have a conservation plan in place that addresses applicable resource concerns for the land subject to the easement, including soil health and greenhouse gas emissions reduction; establishes an alternative manure management program to support non-digester dairy and livestock methane management strategies to effectively reduce greenhouse gas emissions and to maximize environmental benefits; directs USDA to study dual-use renewable energy systems, including an assessment on the compatibility of different species of livestock and crop types with dual-use renewable energy system designs; and provides competitive grants and technical assistance for local educational agencies to implement food waste measurement and reporting, prevention, education, and reduction projects.

Jobs and Childcare for Military Families Act of 2020 This bill allows an employer a work opportunity tax credit for hiring the spouse or domestic partner of a member of the Armed Forces and requires the creation of programs for service members to pay for childcare on a pretax basis. Specifically, an employer may receive a tax credit equal to 40% of a new employee's first-year wages if the employer hires a service member's spouse or domestic partner (as recognized under state law or by the Armed Forces). Currently, a similar tax credit exists for employers who hire certain disadvantaged individuals, including disadvantaged veterans. The Department of Defense and the Department of Homeland Security (with respect to the Coast Guard) must implement flexible spending arrangements that permit members of the Armed Forces to use basic pay and compensation to pay on a pretax basis for dependent childcare.

Break Free From Plastic Pollution Act of 2020 This bill sets forth requirements related to waste and recycling collection systems for a variety of products and materials, including plastics. The bill makes certain producers of products (e.g., packaging, paper, single-use products, beverage containers, or food service products) fiscally responsible for collecting, managing, and recycling or composting the products after consumer use. In addition, the bill establishes (1) minimum percentages of products that must be reused, recycled, or composted; and (2) an increasing percentage of recycled content that must be contained in beverage containers. Beginning on January 1, 2022, the bill phases out a variety of single-use products, such as plastic utensils. The bill also sets forth provisions to encourage the reduction of single-use products, including by establishing programs to refund consumers for returning beverage containers and by establishing a tax on carryout bags. The bill creates a temporary moratorium on new or expanded permits for facilities that manufacture plastics until regulations are updated to address pollution from the facilities. The Environmental Protection Agency must publish guidelines for a national standardized labeling system for recycling and composting receptacles. Producers must include labels on their products that are easy to read and indicate whether the products are recyclable, compostable, or reusable. Finally, the bill establishes limitations on the export of plastic waste to other countries.

Specifically, the governor must appoint a special prosecutor to present evidence before a judge to determine whether probable cause exists to criminally charge the law enforcement officer. Advancing FASD Research, Prevention, and Services Act This bill reestablishes and expands programs for fetal alcohol spectrum disorders (FASD). The Department of Health and Human Services must establish a research agenda on FASD, facilitate and disseminate findings on public health surveillance and research to prevent FASD, and establish multiple grant programs. Depending on the specific grant program, eligible grantees may include states, tribes and tribal organizations, public and private nonprofits, and educational institutions. Among other purposes, the grants support research on the diagnosis, intervention, and prevention of FASD; expand and coordinate surveillance; and foster collaboration to provide integrated services to individuals with FASD. The bill also directs the Department of Education and the Department of Justice to develop and disseminate trainings and best practices related to FASD.

Transparency in Energy Production Act of 2020 This bill requires certain disclosures by entities seeking a lease or holding a lease to develop renewable energy operations or fossil fuel operations on public lands. The disclosures are those described in the Sustainability Accounting Standard for the Renewable Resources & Alternative Energy Sector or the Extractives & Mineral Processing Sector. Every two years, the Department of the Interior must submit a report to Congress that includes, among other things (1) for fossil fuel operations on public lands, the annual and two-year totals of greenhouse gas emissions, air quality, water management, biodiversity impacts, production, and the number of sites according to the metrics specified in the Sustainability Accounting Standard for Oil & Gas - Exploration & Production; and (2) for renewable energy operations on public lands, greenhouse gas emissions that would result from the production of the same amount of energy using fossil fuels.

TREES Act

The Residential Energy and Economic Savings Act or the TREES Act This bill provides incentives for retail power providers or cities to plant trees to reduce energy costs. Specifically, the Department of Energy (DOE) must establish a program to award grants to retail power providers that partner with nonprofit tree-planting organizations to establish or continue operating tree-planting programs. Under the program, retail power providers must give residential consumers free or discounted trees that provide maximum amounts of shade during the summer or wind protection during the fall and winter. Retail power providers include entities that generate, distribute, or provide retail electricity, natural gas, or fuel oil service. In addition, DOE must annually give an award that designates communities or other areas as the Arbor City of America. The award must recognize communities for superior efforts in increasing tree canopy coverage and assisting residents in reducing energy costs. DOE must give award recipients funding for green infrastructure or green spaces.
