Safe Climate Act of 2006

Safe Climate Act of 2006 - Amends the Clean Air Act to direct the Environmental Protection Agency (EPA) to promulgate: (1) targets for a 2% reduction in greenhouse gas emissions each year from 2010-2050 ; and (2) regulations requiring reductions to meet such targets, including by setting caps on emissions of sources and sectors with the largest emissions or the best opportunities to reduce them, by issuing and authorizing trading of emission allowances, and by imposing penalties for excess emissions. Requires relevant federal agencies to finalize a rule to carry out the National Academies' recommendations for regulatory action needed to reduce atmospheric greenhouse gas concentrations or explain their reasons for declining to act. Requires the President to submit to Congress a plan for the distribution of emission allowances (including through auctions) and the use of proceeds (to be deposited in a Climate Reinvestment Fund) for specified goals, including mitigating the effects of energy cost increases and climate change. Requires the EPA to ensure that emissions and allowances are accurately tracked, reported, and verified. Authorizes the emission reduction regulations to include: (1) additional requirements for any source or sector; and (2) performance standards, best management practices, and technology-based requirements. Requires such regulations to set standards for the reduction of greenhouse emissions from motor vehicles at least as quickly as the standards adopted by the California Air Resources Board at its September 2004 hearing. Requires the EPA to revise such standards in 2014 and every five years thereafter to further reduce emissions. Amends the Public Utility Regulatory Policies Act of 1978 to direct the Secretary of Energy to: (1) require, beginning in 2009, an annual increase in the percentage of electric energy generated from renewable sources that is sold at the retail level in the United States and to require such percentage to be at least 20% of the total electricity sold by 2020; and (2) set end-user savings targets for retail electric-energy and natural gas suppliers. Authorizes DOE to: (1) increase the required percentage of end-user savings for years after 2020; and (2) allow suppliers to achieve the targets through a market-based trading system.

Comprehensive Veterans' Data Protection and Identity Theft Prevention Act of 2006 - Places upon the Secretary of Veterans Affairs an affirmative obligation to protect from any data breach the sensitive personal information of veterans and any other individuals that the Department of Veterans Affairs possesses, creates, or maintains, as well as information or tools (including passwords and encryption keys) used to protect the integrity of such data. Requires the Secretary to: (1) implement and maintain reasonable security policies and procedures to protect such information; and (2) prescribe policies and procedures regarding employee and third party access to, and use of, such information which the Department receives, maintains, or transmits. Directs the Secretary, upon discovery of a data breach, to: (1) notify the United States Secret Service, the Department's Inspector General, the congressional veterans' committees, and the Federal Trade Commission (FTC); (2) notify each individual whose information was acquired or accessed by an unauthorized person; and (3) place a conspicuous notice on the Department's Internet website. Requires the Secretary, upon request of an affected individual, to: (1) include a fraud alert in the file of the individual with each nationwide consumer reporting agency; (2) apply a security freeze to the file of such individual; and (3) provide free damage mitigation services, including credit monitoring and annual copies of consumer credit reports. Establishes within the Department an Ombudsman for Data Security.

Trauma Care Systems Planning and Development Act of 2006 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration (HRSA), to promote the collection and categorization of trauma data in a consistent and standardized manner. Removes authorization for the National Clearinghouse on Trauma Care and Emergency Medical Services. Allows the Secretary to make grants to entities to carry out demonstration projects to improve emergency medical services in rural areas by increasing communication and coordination with state trauma systems. Revises the matching requirements for states to be eligible for grants to improve emergency medical services in rural areas. Prohibits the Secretary from making trauma care grants to a state unless the state's emergency medical services plan coordinates planning for trauma systems with state disaster emergency planning and bioterrorism hospital preparedness planning. Requires the Secretary to update the model plan for the designation of trauma centers and for triage, transfer, and transportation policies. Directs the Secretary to enter into a contract with the Institute of Medicine or another appropriate entity to conduct a study on trauma care and trauma systems research.

Menu Education and Labeling Act or the MEAL Act - Amends the Federal Food, Drug and Cosmetic Act to require restaurants that are a part of a chain with 20 or more locations doing business under the same trade name to disclose: (1) in a statement adjacent to each menu item, the number of calories, grams of saturated fat plus trans fat, and milligrams of sodium in a standard food serving; (2) other information designed to enable the public to understand the significance of the nutrition information provided in the context of a total daily diet; (3) that such information shall be provided in writing upon request; and (4) in a statement adjacent to the name of the food on a menu board, the number of calories in a serving of the food. Exempts condiments, items placed on a table or counter for general use, daily specials, temporary menu items, and irregular menu items from these requirements. Requires restaurants that sell self-serve food, such as through salad bars or buffet lines, to place a sign that lists the number of calories per standard serving adjacent to each food offered. Permits retail food establishments to voluntarily provide, and states to require, additional nutritional information. Requires vending machine operators to provide a conspicuous sign disclosing the number of calories in each item of food offered.

United States-Commonwealth of the Northern Marianas Human Dignity Act - Prohibits the affixation of the "Made in the USA" label to a product (including a textile fiber product) leaving the Northern Mariana Islands for shipment to any place in the United States or abroad unless: (1) each worker producing such product was paid a minimum wage equal to or greater than the wage set by the Fair Labor Standards Act of 1938; (2) the product was manufactured in compliance with all federal laws relating to labor rights and working conditions; and (3) the factory or other business producing the product does not employ individuals under conditions of indentured servitude. Applies to the Northern Mariana Islands: (1) the minimum wage provisions of the Fair Labor Standards Act of 1938; and (2) the Immigration and Nationality Act. Prohibits any product of the Northern Mariana Islands from entering U.S. customs territory duty-free or quota-free as a product of an insular possession, unless specified requirements relating to fair labor practices and country of origin are met. Amends the Tariff Act of 1930 to authorize inspection by the Customs Service of any vessel from a foreign port or from a place in any U.S. territory or possession arriving at a port or place in the Northern Mariana Islands. Prohibits the use of federal assistance for public buildings or public works projects in the Northern Mariana Islands which involve the employment of mechanics or laborers unless the project is subject to a contract containing specified provisions on the rate of wages for such laborers and mechanics. Directs the Secretary of the Interior to develop technical assistance programs for economic diversification, job creation, and job training in the Northern Mariana Islands. Requires studies of: (1) the extent of human and labor rights violations in the Northern Mariana Islands; and (2) security and immigration vulnerabilities there.

Preserve Historic America Act of 2006 - Amends the Internal Revenue Code to modify the tax credit for rehabilitation of older and historic buildings by: (1) increasing from 20 to 25% the tax credit rate for certified historic structure rehabilitation expenditures; (2) permitting a building at least 50 years old to qualify for the rehabilitation tax credit (currently, a building must have been placed in service before 1936); (3) permitting qualified rehabilitated buildings to be used for lodging purposes; (4) limiting to 50% the basis reduction for buildings qualifying for the low-income housing and rehabilitation tax credits; (5) allowing an increased rehabilitation tax credit for certain buildings in difficult development areas or which qualify as small rehabilitation projects; (6) exempting tax credits for rehabilitation of certified historic structures from the calculation of the passive activity credit; and (7) permitting the assignment of rehabilitation tax credits. Allows a new tax credit for 20% of the cost of rehabilitating a qualified historic home. Defines "qualified historic home" as a certified historic structure which has been substantially rehabilitated and which is owned by the taxpayer and is or will be used as the taxpayer's principal residence.

Directs the President to ensure that: (1) all electronic surveillance of persons in the United States is conducted within those exclusive means; and (2) the procedures for applying for an order for electronic surveillance under FISA continue to be adequate for the timely and efficient electronic surveillance of appropriate targets. Requires: (1) the President to report to the congressional intelligence and judiciary committees upon a determination that such procedures are inadequate; and (2) the report to contain findings and recommendations with respect to emergency or routine applications for such orders. Authorizes appropriations to the National Security Agency (NSA) and the Department of Justice (DOJ) for activities of the Office of Intelligence Policy and Review to ensure the timely and efficient processing of applications to the Foreign Intelligence Surveillance Court.

Repeals provisions of the Energy Policy Act of 2005 relating to: (1) oil and gas royalties in-kind; (2) marginal property production incentives; (3) incentives for natural gas production in the Gulf of Mexico; (4) royalty suspension for deep water production; (5) the inventory of Outer Continental Shelf oil and natural gas resources; (6) the ultra-deepwater and unconventional natural gas and other petroleum resources program; (7) Alaska offshore royalty suspension; (8) accelerated depreciation of electric transmission property, natural gas distribution lines, and natural gas gathering lines and expensing of liquid fuel refinery property; (9) the exemption of small oil refiners from limitations on the oil depletion allowance; and (10) two-year amortization of geological and geophysical expenditures. Requires certain large integrated oil companies to revalue their LIFO inventories of crude oil, natural gas, or other petroleum productions using a specified formula. Limits or denies the foreign tax credit and tax deferrals for dual capacity taxpayers (taxpayers receiving economic and tax benefits from certain foreign jurisdictions), foreign oil and gas income, and foreign oil and gas extraction income.

Oil and Gas Industry Antitrust Act of 2006 - Amends the Clayton Act to make it unlawful for any person to refuse to sell, or to export or divert, existing supplies of petroleum, gasoline, or other fuel derived from petroleum, or natural gas, with the primary intention of increasing prices or creating a shortage in a geographic market. Directs the Attorney General (AG) and the Chairman of the Federal Trade Commission (FTC) to study whether section 7 of the Clayton Act (prohibiting certain mergers or acquisitions) should be amended to modify how that section applies to persons engaged in the business of exploring for, producing, refining, or otherwise processing, storing, marketing, selling, or otherwise making available petroleum, gasoline or other fuel derived from petroleum, or natural gas. Requires the Comptroller General to study the effectiveness of divestitures required under certain prior oil and gas industry consent decrees. Directs the AG and FTC Chairman to establish a joint federal-state task force to investigate information sharing among persons in the oil and gas industry. No Oil Producing and Exporting Cartels Act of 2006 or NOPEC - Amends the Sherman Act to make it illegal for any foreign state or instrumentality thereof to act collectively with any other foreign state or instrumentality to: (1) limit oil production or distribution; (2) set or maintain the price of oil; or (3) take any other action in restraint of trade for oil, natural gas, or any petroleum product.

Network Neutrality Act of 2006 - States that it is the policy of the United States to, among other things, maintain the freedom to use broadband telecommunications networks, including the Internet, without interference from network operators. Outlines specified duties of broadband network providers to ensure broadband network neutrality, including the duty to: (1) enable users to utilize their broadband service to access all lawful content, applications, and services available over broadband networks, including the Internet; and (2) not block, impair, degrade, discriminate against, or interfere with the ability of any person to utilize their broadband service for lawful purposes. Provides exceptions for providers, including implementing reasonable measures to manage its networks and protect network security. Provides for implementation and enforcement of this Act through the Federal Communications Commission (FCC).

Prevent Unfair Manipulation of Prices Act of 2006 - Amends the Commodity Exchange Act to extend its jurisdiction to certain: (1) "included energy transactions" traded on an electronic trading facility; and (2) energy commodities involved in over-the-counter transactions. Sets forth reporting and recordkeeping requirements for: (1) certain contract participants that enter into or execute "included energy transactions;" and (2) electronic trading facilities for energy commodities. Extends prohibitions against fraudulent transactions to: (1) filling an order by offset against the other person's order; and (2) knowingly and willfully becoming the buyer in respect to another person's selling order, or the seller in respect to another person's buying order, without the other person's prior consent. Empowers the Commodities Futures Trading Commission to impose civil and criminal penalties for price manipulation and other violations of such Act.

Oil Subsidy Elimination Act of 2006 - Requires oil companies with annual gross receipts of $1 billion or more and average daily crude oil production levels of at least 500,000 barrels (defined as large integrated oil companies) to revalue, according to a specified formula, their 2005 LIFO inventories of crude oil, natural gas, or other petroleum products. Amends the Internal Revenue Code to deny large integrated oil companies: (1) amortization of geological and geophysical expenditures; and (2) foreign tax credits for certain payments made to foreign countries. Repeals provisions of the Energy Policy Act of 2005 relating to: (1) expensing of crude oil refinery property; (2) exemptions from limitations on oil depletion deductions for certain small crude oil refiners; and (3) amortization of geological and geophysical expenditures.

Early Hearing Detection and Intervention Act of 2006 - Amends the Public Health Service Act to expand the newborns and infants hearing loss program to: (1) provide services for young children (currently, limited to infants and newborns); and (2) include diagnostic services among services provided. Requires the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration (HRSA), to assist in the recruitment, retention, education, and training of qualified personnel and health care providers. Includes within the purposes of such program: (1) developing efficient models to ensure that newborns, infants, and young children who are identified with a hearing loss through screening are not lost to follow-up by a qualified health care provider; and (2) ensuring an adequate supply of qualified personnel to meet the screening, evaluation, and early intervention needs of children. Requires the Director of the National Institutes of Health (NIH), acting through the Director of the National Institute on Deafness and Other Communication Disorders, to establish a postdoctoral fellowship program to foster research and development in the area of early hearing detection and intervention. Amends the definition of "early intervention" to require that families be given the opportunity to obtain the full range of early intervention services, educational and program placements, and other options for their child from highly qualified providers.

Diabetes Prevention Access and Care Act - Amends the Public Health Service Act to require the Director of the National Institutes of Health (NIH) to: (1) conduct, coordinate, and support research and other activities with respect to pre-diabetes and diabetes in minority populations; and (2) conduct and support programs to treat diabetes in minority populations. Requires the Director of NIH, through the National Center on Minority Health and Health Disparities, to provide for: (1) health care professionals' mentoring; and (2) minority health professionals' participation in diabetes-focused research programs. Directs the Diabetes Mellitus Interagency Coordinating Committee to develop and implement a federal plan to address diabetes mellitus within communities of color. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) conduct and support research and other activities with respect to diabetes in minority populations; (2) direct the Division of Diabetes Translation to conduct and support programs to educate the public on diabetes in minority populations; and (3) carry out diabetes health promotion and prevention programs for minority populations. Directs the Secretary to carry out: (1) education and awareness programs designed to increase participation of minority populations in clinical trials; and (2) mentorship programs for minority researchers who are conducting research on diabetes in minority populations. Provides for studies on the shortage of adult and pediatric endocrinologists specializing in diabetes and on outcomes of minority children with diabetes compared to non-minority children.

Pet Safety and Protection Act of 2005 - Amends the Animal Welfare Act to list permissible sources of dogs and cats used by research facilities to include dogs and cats obtained: (1) from a licensed dealer; (2) from a publicly owned and operated pound or shelter that meets specified requirements; (3) by donation from a person who bred and raised the dog or cat and owned it for not less than one year; or (4) from a research facility licensed by the Secretary of Agriculture. Sets forth additional monetary penalties for related violations. Revises provisions to prohibit federal facilities from purchasing or otherwise acquiring dogs or cats for exhibition purposes except from: (1) the operator of an auction that comports with legal requirements; or (2) a person holding a valid dealer or exhibitor license. Revises provisions to prohibit dealers from selling or otherwise providing a research facility with random source dogs or cats unless specified certification requirements are met.

Fair and Speedy Treatment (FAST) of Medicare Prescription Drug Claims Act of 2006 - Amends title XVIII (Medicare) of the Social Security Act to require prompt payment of clean claims to pharmacies by prescription drug plans (PDPs) and Medicare Advantage prescription drug plans (MA-PD Plans). Defines prompt payment as within 14 calendar days from submission for claims submitted electronically, and within 30 calendar days for claims submitted otherwise. Requires payment of interest, also, if a payment is not issued, mailed, or otherwise transmitted within the applicable number of calendar days. Makes it unlawful for a PDP sponsor of a prescription drug plan to display on the prescription drug card the name, brand, or trademark (co-branding) of any pharmacy. Requires each PDP sponsor to charge not less than the minimum dispensing fee, $14, adjusted annually for inflation, for generic covered Medicare part D (Voluntary Prescription Drug Benefit Program) drugs. Revises requirements for a covered medication therapy management service, allowing it to be furnished by a health care provider, other than a pharmacist, with advanced training in medication management. Requires the Secretary of Health and Human Services to specify: (1) the population of part D eligible individuals appropriate for services under a medication therapy management program, based on certain characteristics; and (2) a minimum defined package of medication therapy management services that shall be provided to each enrollee. Revises requirements for pharmacy fees. Directs the Secretary to establish: (1) a two-year demonstration program to examine the impact of medication therapy management furnished by a pharmacist in a community-based or ambulatory-based setting on quality of care, spending, and patient health; and (2) a Best Practices Commission to develop a best practices model for medication therapy management.

Afghan Women Empowerment Act of 2006 - Expresses the sense of Congress that the protection of the rights of women and girls in Afghanistan and their full participation in the reestablishment of democracy are essential to Afghanistan's reconstruction, and to achieve such reconstruction the U.S. government must commit resources to advance the rights of women throughout Afghanistan. Amends the Afghan Freedom Support Act of 2002 to revise the provisions respecting assistance to women and girls in Afghanistan. Extends funding authority. Expresses the sense of Congress that the President should: (1) condition the provision of such assistance on the recipient adhering to international standards for women's rights and human rights; and (2) ensure that Afghan women-led nongovernmental organizations with demonstrated experience in delivering services to Afghan women and children receive grants without ethnic, religious, or any other discrimination.
