Expresses the sense of the House of Representatives that: (1) the reasoning in the Supreme Court decision in Texas v. Johnson was incorrect; (2) the U.S. flag is unique and deserves to be treated with respect; and (3) it is a misinterpretation of the Constitution to suggest that the Congress or the States do not have the power to prohibit the desecration of the U.S. flag.

Expresses the sense of the Congress that: (1) the concurrent budget resolution for FY 1991 should use a flexible freeze on spending in lieu of new taxes; and (2) the freeze should be similar to that proposed for the FY 1990 budget, which allows some programs to be increased while others are reduced.

Emergency Chinese Adjustment of Status Facilitation Act of 1989 - Waives the two-year home country residence requirement for nationals of the People's Republic of China in the United States on a student (J) visa. Continues the legal status of nonimmigrant nationals of the People's Republic of China in the United States for adjustment or change of status purposes.

Spending Control Enhancement Act of 1989 - Adds a title to the Impoundment Control Act of 1974 to authorize the President to rescind all or part of any budget authority provided in an appropriations bill by notifying the Congress of the rescission by a special message within ten calendar days after enactment of the Act in question. Makes such rescission effective unless the Congress, within ten days after receiving the special message, completes action on a bill disapproving the proposal. Describes: (1) information to be included in the President's message; and (2) procedures to govern consideration of rescission disapproval legislation in the Senate and the House of Representatives.

Expresses the concern of the House of Representatives regarding the future security of the Panama Canal. Calls on the President to renegotiate the Panama Canal Treaties to permit: (1) the permanent stationing of U.S. forces in Panama; and (2) the United States to act independently to maintain the security of the Canal and to guarantee its regular operation.

Federal Budget Structure Act of 1989 - Amends Federal law to require that the budget the President submits to the Congress be a unified budget comprising an operating budget and a capital budget, each presented separately for total funds, Federal funds, and trust funds. Restricts the capital budget to the major activities, projects, and programs supporting the acquisition, construction, alteration, and rehabilitation of capital assets. Includes all other items in the operating budget. Directs the Comptroller General to review and report to the Congress, as necessary, on the implementation of this Act. Requires the following reports to the House Committee on Public Works and Transportation and the Senate Committee on Environment and Public Works on capital activities and operating activities associated with: (1) roadways and bridges, airports and airway facilities, and mass transportation systems; (2) waste water treatment and related facilities; (3) water resource projects; and (4) public buildings.

Space Transportation Services Purchase Act of 1989 - Requires the Federal Government to purchase space transportation services from commercial providers, unless on a case-by-case basis: (1) the Secretary of Defense certifies to the National Space Council that national security reasons require otherwise; (2) the Administrator of the National Aeronautics and Space Administration certifies to the Council that the unique capabilities of the space shuttle are required; or (3) the Secretary of Transportation finds that the services required are unavailable at a reasonable cost from commercial providers. Requires the Federal Government to acquire only space transportation vehicles manufactured in the United States of primarily U.S.-made components, and only as required under this Act or by NASA for conducting research and development on space transportation technology. Requires contracts to provide space transportation services to be awarded through the competitive bidding process among U.S. persons. Requires other activities of the Government relating to: (1) commercial payloads on the space shuttle; (2) grants for space transportation services; (3) expenditures for international activities or organizations using space transportation services; and (4) studies on future space transportation services.

Taxpayer and Environment Protection Act of 1989 - Amends the Internal Revenue Code to deny any deduction for loss from abandonment of a nuclear power plant if: (1) the taxpayer constructed or purchased such nuclear power plant which was granted a full power operating license by the Nuclear Regulatory Commission; (2) such taxpayer abandoned the plant; and (3) a State utility regulatory body permits the taxpayer any rate increase directly or indirectly related to such abandonment or sale. Provides that a transitional rule with respect to tax-exempt bond provisions under the Revenue Act of 1987 shall not apply to any bond unless the proceeds from the issuance of such bond are to be used to finance the acquisition of an operating facility.

Southeast Interstate Low-Level Radioactive Waste Compact Amendments Consent Act of 1989 - Grants congressional approval to amendments made by the party States to the Southeast Interstate Low-Level Radioactive Waste Management Compact which provide for: (1) withdrawal from the Compact; and (2) the maximum length of time a party State is required to operate a regional facility.

Living Wage Act of 1990 - Title I: Earned Income Tax Credit - Amends Internal Revenue Code provisions governing the earned income tax credit to: (1) increase from $5,714 to $7,000 the amount of earned income subject to the credit; (2) increase the basic credit from 14 percent to 15 percent; and (3) add additional credits to apply to not more than four children of five percent for each dependent school age child between age six and age 16 and ten percent for each preschool age child. Reduces the amount of the credit for taxpayers with adjusted gross income over $40,000. Indexes amounts relating to the credit beginning in 1992. Disallows application of the nonrefundable dependent care income tax credit with respect to a taxpayer's dependents under age 13, unless the child is physically or mentally incapable of self-care. Permits the credit with respect to handicapped children under age 15 only if the taxpayer elects not to include the child within the framework of the earned income credit. Repeals provisions of the Family Support Act of 1988 that revise the way in which the earned income credit is treated in the context of needs analysis for purposes of State plans for aid and services to needy families with children under title IV of the Social Security Act. Title II: Federal Minimum Wage - Amends the Fair Labor Standards Act of 1938 (the Act) to increase the minimum wage per hour from $3.35 in 1989 to: (1) $3.65 in 1990; (2) $3.95 in 1991; and (3) $4.25 in 1992 and thereafter. Increases the tip credit under the Act from 40 percent to 50 percent. (The tip credit deems the amount paid to a tipped employee, for minimum wage purposes, to be increased by an amount determined by the employer, but not by an amount in excess of the specified percentage of the applicable minimum wage rate). Increases the small business exemption by revising the definition of an enterprise engaged in commerce, for purposes of coverage under the Act ("the enterprise test"). Exempts from such coverage enterprises whose annual gross volume of sales or business is less than $500,000 (currently $362,500), effective in 1990. Requires employers who were covered in 1988, but who are exempt under the new threshold, to continue to pay the $3.35 per hour minimum wage. Authorizes employers, in lieu of the minimum wage, to pay a newly hired employee not less than $3.35 an hour and thereafter not less than 80 percent of the increased minimum wage. Applies the rights and protections of the Fair Labor Standards Act of 1938 to employees in the House of Representatives, employees under the Architect of the Capitol, and employing authorities of the House of Representatives. Authorizes employers to employ any employee for periods of not more than ten hours in excess of the 40-hour maximum without paying overtime if during such periods the employee is receiving remedial education.

Amends title VII (Equal Employment Opportunities) of the Civil Rights Act of 1964 to deem a prima facie violation of such title to have been made out by proof that the representation of the protected group is significantly less in the position or among the benefit recipients in question than among the qualified applicants (or likely qualified applicants) for the position, or the eligible persons (or likely eligible persons) for the benefit. Allows a defendant to rebut the showing by proving that each part of the selection process was essential to the performance of the defendant's legitimate functions.

Authorizes the Speaker of the House of Representatives and the President pro tempore of the Senate to present a bronze medal to individuals: (1) who were members of the armed forces and were present in Hawaii on December 7, 1941; and (2) who participated in combat operations that day against Japanese military forces attacking Hawaii. Directs the Secretary of the Treasury to strike such medals. Authorizes the Secretary to provide for the sale of bronze duplicates of the medal. Authorizes appropriations which are to be reimbursed out of the proceeds from sales of the medals.

Fair Housing for Americans of All Ages Act of 1989 - Amends the Fair Housing Act to repeal the prohibitions with respect to familial status-based discrimination. Directs the United States Commission on Civil Rights to: (1) conduct a study of familial status-based housing discrimination; and (2) report the results of such study to the Congress.

Uranium Enrichment Reorganization Act - Amends the Atomic Energy Act of 1954 to establish the United States Uranium Enrichment Corporation as a wholly-owned Government corporation to conduct uranium marketing and enrichment activities as a commercial, profitable, self-financing enterprise. Provides for a Board of Directors appointed by the President with the advice and consent of the Senate. Prescribes guidelines for: (1) certain property transfers from the Department of Energy; and (2) the Corporation's capital structure, pricing policies, and user charges for decommissioning, decontamination, and remedial activities. Requires the Corporation to prepare an annual status report for the President and the Congress. Prescribes licensing and taxation guidelines for the Corporation. Sets guidelines for payments in lieu of taxes by the Corporation to States and local governments. Directs the Board to make recommendations to the President regarding the transfer of its functions and assets to private ownership. Declares that the Corporation's receipts, proceeds, and recoveries (including deposits in the Uranium Enrichment Decontamination and Decommissioning Fund) shall be available without fiscal year limitations and without further appropriations. Applies Federal environmental and occupational safety and health law to the Corporation as though it were privately owned. Establishes the Uranium Enrichment Decontamination and Decommissioning Fund to cover the Corporation's decommissioning and decontamination expenses.

Directs the Secretary of Defense and the Secretary of Commerce to establish a five-year joint program for collecting operational and reconnaissance data, conducting research, and analyzing data on tropical cyclones to assist the forecast and warning program and increase the understanding of the causes and behavior of tropical cyclones. Sets forth the responsibilities of each Secretary. Directs those Secretaries to jointly develop and submit to the Congress management plans for: (1) the program established by this Act; and (2) continued tropical cyclone surveillance and reconnaissance which will adequately protect the citizens of U.S. coastal areas.

Older Americans' Freedom to Work Act of 1989 - Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to remove the limitation on the amount of outside income which beneficiaries who have attained retirement age may earn without incurring a reduction in benefits.

Women's Business Equity Act - Amends the Small Business Act to establish the Office of Women Business Enterprise (the Office) to promote executive branch programs which facilitate women's business enterprises. Authorizes the Office to develop comprehensive interagency plans and specific program goals for women's business enterprises. Sets forth certification guidelines for such enterprises. Adds to existing goals for participation of small business concerns in Federal procurement contracts the participation of small business concerns owned and controlled by women. Requires the head of each Federal agency to report to the Small Business Administration (SBA) on the extent that small business concerns owned and controlled by women participate in procurement contracts and subcontracts. Declares it to be the policy of the United States that small business concerns owned and controlled by women shall have the maximum opportunity to participate in the performance of contracts and subcontracts let by any Federal agency. Precludes the award of any contract unless the procurement authority determines that the offeror's plan includes the maximum opportunity for participation of small business concerns owned and controlled by women. Requires the SBA to report annually to certain congressional committees on subcontracting plans found acceptable by any Federal agency which the SBA determines do not contain maximum opportunities for small business concerns owned and controlled by women. Requires each Federal agency having procurement powers to: (1) affirmatively solicit offers from small business concerns owned and controlled by women and socially and economically disadvantaged individuals; and (2) include at least one bid from a women-owned business enterprise for specified small purchases of such agency. Imposes penalties for the misrepresentation of a business concern as one owned or controlled by women.

Directs the U.S. Postal Service to establish procedures to provide that, upon a written request of the head of any unit of general local government, ZIP code boundaries do not cross the boundaries of such general local government unit. Declares that ZIP code areas having the same first five digits shall be considered to have the same ZIP code in order to apply this Act to areas using more than five digits.

Constitutional Amendment - Requires the Congress and the President, prior to each fiscal year, to agree on an estimate of total receipts (except those derived from borrowing) for that fiscal year by enactment of a joint single subject resolution. Prohibits outlays for that year (except those for repayment of debt principal) from exceeding this amount unless the Congress, by a three-fifths roll call vote of each House, authorizes a specific excess of outlays over receipts. Requires a three-fifths roll call vote of each House to increase the public debt. Directs the President to submit a balanced budget to the Congress. Requires the approval of a majority of the total membership of each House by roll call vote before any bill to increase revenue may become law. Waives these provisions when a declaration of war is in effect.

Amends the Small Business Act regarding small business participation in Federal procurement activities to require any procuring agency to provide a copy of the proposed procurement to the Small Business Administration (SBA) accompanied by an explanatory statement if it believes that small business participation is unlikely due to the nature of the project. Directs the SBA to provide the procuring agency with recommendations if the SBA believes alternatives exist which would increase small business prime contracting opportunities.

White House Conference on Small Business Act - Calls upon the President to conduct a National White House Conference on Small Business once every four years to: (1) increase public awareness of the contributions of small business; (2) identify small business problems; (3) examine the status of minority and women small business owners; (4) assist small business in carrying out its role as the Nation's job creator; (5) develop specific recommendations for executive and legislative action; and (6) review the status of recommendations adopted at the preceding Conferences. Directs Federal departments, agencies, and instrumentalities to provide support and assistance to the planning of such Conferences. Requires a final report of each Conference, within six months from the date a Conference is convened, to be submitted to the President and the Congress. Requires the Small Business Administration to report annually to the Congress following the submission of the final report of the Conference. Authorizes appropriations.

Small Business Regulatory Flexibility Analysis Judicial Review Act - Amends the Regulatory Flexibility Act to redefine "rule" to include interpretative rules issued under the Internal Revenue Code, thereby subjecting them to regulatory flexibility analyses under such Act. Directs the Chief Counsel for Advocacy of the Small Business Administration to report annually to specified congressional committees on claims against Federal agencies for failing to comply with the requirements of the Act.

Directs the Chief Counsel for Advocacy of the Small Business Administration to report annually to specified congressional committees on Internal Revenue Service compliance with resulting new requirements.

Limits assessments of underpayments with respect to taxable periods beginning before July 1, 1985, in connection with the annual $250 occupational tax on retail liquor and beer dealers. Abates assessments and refunds overpayments of any post-1987 tax.

Davis-Bacon Reform Act of 1989 - Amends the Davis-Bacon Act to increase from $2,000 to $250,000 the threshold amount subjecting certain contracts to such Act and requiring them to specify the minimum wages to be paid to laborers and mechanics. Directs the Secretary of Labor to establish as the prevailing wage for a class of laborers or mechanics the entire range of wages being paid to a corresponding class of such workers in the particular urban or rural subdivision of the State in which the work is to be performed. Sets out the means for determining such prevailing wage in cases when more than a single wage is being paid to corresponding classes of workers. Excludes from the computation of wages the basic hourly rates of pay for workers on local Federal projects. Establishes a separate classification for helpers of laborers or mechanics, with their prevailing wages to be determined on the basis of the corresponding class of helpers. Prohibits the division of contracts into units of $250,000 or less for purposes of avoiding wage computation under such Act. Provides for administrative enforcement of such prohibition. Applies the increased contract amount threshold for coverage provided in this Act to other related Federal laws which use the Davis-Bacon Act prevailing wage rate determination requirements. Provides that wages found to be due to laborers and mechanics pursuant to the Davis-Bacon Act shall be paid to them directly from accrued payments withheld under the contract, in accordance with specified regulations issued by the Secretary of Labor. (Currently the Comptroller General makes such payments.) Directs the Administrator of General Services (rather than the Comptroller General) to distribute a list to all Federal agencies giving the names of persons or firms that the Secretary of Labor (rather than the Comptroller General) has found to have disregarded their obligations to employees and subcontractors. Amends the Copeland Act to require certain contractors or subcontractors to furnish compliance statements concerning weekly wages at the beginning, midpoint, and conclusion of the period covered by the contract, instead of every week as the wages are paid. Requires such statements at least every three months. Directs the Secretary of Labor and the Comptroller General to submit to the Congress annual reports describing the effects of the Davis-Bacon Act, the Copeland Act, and this Act on local wages and on local and national economies.

De Soto Trail Commission Act of 1989 - Title I: De Soto Expedition Trail Commission - Establishes in the Department of the Interior the De Soto Expedition Trail Commission to assist with the establishment of a commemorative highway route of the De Soto expedition through the States of Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, and Texas. Authorizes appropriations. Title II: Highway Route of the De Soto Expedition - Directs the Secretary of the Interior to designate a vehicular route as the Highway Route of the De Soto Expedition. Authorizes appropriations.

Soybean Promotion, Research, and Consumer Information Act - Authorizes the Secretary of Agriculture to issue an order (subject to producer referendum) creating a soybean promotion, research, and consumer education program. Requires any such order to provide for the establishment of a: (1) United Soybean Board; and (2) Soybean Program Coordinating Committee. Funds such program through producer assessments. Authorizes appropriations.
