Schools Empowered to Respond Act - Amends the Homeland Security Act of 2002 to establish within the Office of the Secretary of Homeland Security an Office of National School Preparedness and Response. Gives the Director of that office primary responsibility within the Department of Homeland Security (DHS) for the support of statewide, regional, and national efforts to enhance the collective response to acts of terrorism and other disasters at schools, including by: (1) serving as the principal advisor to the Secretary on the needs of schools and children in response to emergency situations; (2) ensuring that DHS policies, programs, and activities appropriately consider the needs of and impact upon schools and children; (3) creating an Internet clearinghouse that identifies resources available to schools; and (4) ensuring that education officials have input with the Government Coordinating Council. Permits the use of funds under the Urban Area Security Initiative and State Homeland Security Grant Program to enhance school preparedness. Directs the Secretary to condition the receipt of grants on a state including in each state homeland security decision-making body that has authority to determine how grants will be used a representative selected by the state education authority who has an understanding of the emergency planning needs of local schools. Expresses the sense of Congress: (1) promoting the adoption of voluntary national standards in schools to prepare for and enable a collective response to acts of terrorism and other disasters; and (2) regarding what plans for responding should be included to ensure school participation in such collective response.

Emergency Extended Unemployment Compensation Act of 2008 - Provides for federal-state agreements under which a state will make emergency unemployment compensation payments to individuals who: (1) have exhausted all rights to regular compensation under state or federal law with respect to a benefit year (excluding any benefit year that ended before May 1, 2007); (2) have no rights to regular compensation or extended compensation with respect to a week under such law or any other state or federal unemployment compensation law; and (3) are not receiving compensation for such week under the unemployment compensation law of Canada. Requires federal payments to states to cover 100% of such emergency unemployment compensation payments. Provides for handling of fraud and overpayments of such compensation.

Post-9/11 Veterans Educational Assistance Act of 2008 - Amends federal veterans' benefits provisions to entitle to educational assistance under the Montgomery GI Bill individuals in certain length-of-service categories who, commencing on or after September 11, 2001, serve on active duty in the Armed Forces. Establishes the duration of such assistance (in most cases 36 months) and assistance amounts. Requires programs of education pursued with such assistance to be approved by the Secretary of Veterans Affairs. Allows for the pursuit of an approved program of education while on active duty. Allows, under such assistance, for the pursuit of: (1) programs on less than a half-time basis; (2) apprenticeship or other on-job training; (3) correspondence courses; (4) flight training; (5) tutorial assistance; and (6) licensure and certification tests. Makes individuals entitled to assistance under this Act also eligible for supplemental educational assistance for additional active duty service. Requires the Secretary to carry out a program, to be known as the "Yellow Ribbon G.I. Education Enhancement Program," under which colleges and universities may enter into an agreement with the Secretary to cover, for certain individuals, a portion of established charges not otherwise covered and match contributions toward such costs. Requires educational assistance under this Act to be used within 15 years of the individual's discharge or release from active duty (with exceptions). Allows individuals currently under the Montgomery GI Bill educational assistance program to elect to participate in the post-9/11 educational assistance program with respect to any unused entitlement.

Taxpayer Assistance and Simplification Act of 2008 - Amends the Internal Revenue Code to: (1) modify penalty provisions for tax return preparers who take an unreasonable position in the preparation of a tax return causing an underpayment of tax; (2) eliminate certain restrictions on the tax deduction for employee use of cellular telephones; (3) exempt recipients of home care services from liability for employment taxes for payments made to home care service providers; (4) authorize the Secretary of the Treasury to make grants for volunteer income tax assistance programs; (5) require written notice to taxpayers of eligibility for the earned income tax credit; (6) place restrictions on information relating to refund anticipation loans; (7) require the Secretary to notify a taxpayer of any unauthorized use of such taxpayer's identity (suspected identity theft) uncovered during an tax investigation; (8) repeal the authority of the Internal Revenue Service (IRS) to enter into private debt collection contracts; (9) extend the period during which the IRS may return property seized in a wrongful tax levy; and (10) increase penalties for failures to provide correct tax information and to file partnership or S corporation tax returns. Delays until 2012 the 3% withholding requirement on government payments to contractors providing goods and services. Directs the Secretary of the Treasury to conduct a feasibility study on alternative means of delivering tax refunds. Expands the prohibitions against the misuse of Department of the Treasury names and symbols to include misuse on an Internet domain address.

Housing Assistance Tax Act of 2008 - Amends the Internal Revenue Code relating to the low-income housing tax credit, tax-exempt housing bonds, real estate investment trusts (REITs) and to provide assistance to first-time home buyers and home owners. Increases in 2008 and 2009 the state allocation limits on low-income housing tax credits. Modifies certain rules relating to the low-income housing tax credit, tax-exempt housing bonds, and the rehabilitation of government-leased buildings. Allows: (1) first-time home buyers a refundable tax credit for 10% of the purchase price of a principal residence, up to $7,500; and (2) individual taxpayers who claim the standard deduction an additional deduction from gross income for state and local real property taxes. Authorizes: (1) an additional $10 billion in the volume cap for issuing tax-qualified bonds for certain residential rental projects; and (2) use of mortgage bond proceeds to refinance certain subprime residential mortgage loans. Exempts from the alternative minimum tax (AMT) tax-exempt interest on certain housing bonds. Allows low-income housing and rehabilitation tax credit amounts to offset AMT liability. Allows certain municipal bonds that are guaranteed by federal home loan banks to qualify as tax-exempt bonds. Modifies rules relating to REITs to: (1) treat passive foreign exchange gains attributable to overseas real estate investment as qualifying REIT income; (2) increase from 20 to 25% the the maximum value of an REIT's total assets that may be represented by securities of one or more taxable REIT subsidiaries; (3) revise safe harbor rules for the excise tax penalty on certain REIT sales activities; and (4) treat rental payments made by a health care facility to an REIT as qualifying REIT income. Requires brokers who sell publicly-traded securities to report the customer's adjusted basis in such securities. Delays until after 2009 the taxpayer election to allocate interest expense between U.S. and foreign sources for purposes of the foreign tax credit limitation.

Government Accountability Office Act of 2008 - Requires specified minimum percentage pay increases and lump sum back payments for certain Government Accountability Office (GAO) officers and employees. Establishes an Office of the Inspector General in GAO, who shall report semiannually to the Comptroller General. Requires the Comptroller General's annual report to Congress to assess the overall degree of federal agency cooperation with GAO audits. Requires any executive agency (or component) that prepares an audited financial statement to reimburse GAO the cost of any GAO audit of such statement. Amends the Ethics in Government Act of 1978 to revise the coverage of certain GAO officers and employees under its financial disclosure requirements. Revises the highest basic pay rate for GAO personnel from GS-15 to Executive Level III. Increases from 15 to 20 the number of experts and consultants whose services the Comptroller General may procure for renewable three-year terms at rates up to level IV of the Executive Schedule. Makes funds appropriated to GAO for salaries and expenses also available for recruitment-related meals and entertainment. Revises provisions governing GAO voluntary separation incentive payments.

Entitles federal employees who satisfy age and service requirements for immediate or early retirement under the Federal Employees' Retirement System or the Foreign Service Pension System and who are separated from service or transferred to a position not subject to either of those retirement systems to a lump-sum payment for 15% of the amount of their accumulated sick leave exceeding 500 hours. Prohibits such a payment from exceeding $10,000. Excludes hours of sick leave that are creditable in the computation of any other compensation or benefit.

Investment in Kids' Instruction, Development and Support Act, or the Invest in KIDS Act - Amends part B of title IV of the Social Security Act to revise requirements for foster care and adoption assistance and for child welfare services. Authorizes a state foster care and adoption assistance plan, at state option, to include a child and family services component. Eliminates certain income eligibility requirements for foster care and adoption assistance. Authorizes: (1) Indian tribes to receive federal funds for such assistance; and (2) separate standards for foster family homes in which a foster parent is a relative of the foster child that protect the child's safety and provide for criminal records checks. Requires application to all children in state custody of state plan standards for foster family homes and child care institutions. Requires the Secretary of Health and Human Services, acting through the Administration of Children and Families, to make child welfare service quality improvement grants to states. Provides for an increased payment rate to states for short-term training of certain child welfare agency staff and court personnel. Allows state coverage of children in foster care after age 18 and up to age 21. Provides for state-optional kinship guardianship assistance payments for children. Authorizes the Secretary to make family connection grants to states. Extends the adoption incentives program for five years, and increases incentives payments for special needs adoptions and older child adoptions. Requires state plans to provide for siblings removed from their homes to be placed in the same foster care placement, unless contrary to their safety or well-being. Requires a state child welfare services plan to provide for development of a plan for the ongoing oversight and coordination of health care services for any child in a foster care placement. Requires case plans to include a plan for ensuring the educational stability of the child in foster care.

Dorothy I. Height and Whitney M. Young, Jr. Social Work Reinvestment Act - Directs the Secretary of Health and Human Services to establish the Social Work Reinvestment Commission to provide independent counsel to Congress on policy issues associated with the recruitment, retention, research, and reinvestment in the profession of social work. Directs the Commission to study and report to Congress on issues facing the social work profession, including: (1) fair market compensation, high social work educational debt, social work workforce trends, knowledge development, and social work safety; and (2) state-level social work licensure and reciprocity agreements for providing services across state lines. Authorizes the Secretary to award various grants to eligible entities to support demonstration programs and other activities related to research, workplace improvements, education, training, and programs of excellence. Directs the Secretary to: (1) contract with a national social work research entity to serve as a coordinating center and clearinghouse for information on activities under the demonstration program; and (2) develop and issue public service announcements that advertise and promote the social work profession. Expresses the sense of Congress that the President should designate a National Social Work Awareness month.

Renewable Energy and Energy Conservation Tax Act of 2008- Amends Internal Revenue Code provisions relating to renewable energy sources and energy conservation. Extends: (1) the tax credit for production of electricity from renewable resources through 2011; (2) the energy tax credit for solar energy and fuel cell property through 2016; (3) the special rule for treatment of gain from electronic transmission transactions by certain electric utilities through 2009; (4) the tax credit for residential energy efficient property expenditures through 2014; (5) the tax credit for alternative fuel vehicle refueling property expenditures through 2010; (6) the tax credit for biodiesel and renewable diesel used as fuel through 2010; (7) the tax credit for nonbusiness energy property expenditures through 2009; and (8) the tax deduction for energy efficient commercial buildings through 2013. Allows new tax credits for: (1) investment in new clean renewable energy bonds and qualified energy conservation bonds; and (2) the production of plug-in hybrid motor vehicles, cellulosic alcohol fuel, and electricity from marine and hydrokinetic renewable energy sources. Revises the definition of "passenger automobile" for purposes of the limitation on depreciation deductions. Allows a tax exclusion for bicycle commuting reimbursements. Revises certain tax incentives for investment in the New York Liberty Zone. Revises tax credit amounts for certain energy efficient household appliances produced after 2007. Allows a five-year recovery period for the depreciation of qualified energy management devices. Places limits on the tax deduction for income attributable to the domestic production of oil, natural gas, and any related products. Revises tax rules relating to foreign oil and gas extraction income and foreign produced fuel used or sold outside the United States.

Provides that, if the federal medical assistance percentage (FMAP) determined under title XIX (Medicaid) of the Social Security Act without regard to this Act for a state for FY2008 is less than the FMAP as so determined for FY2007, the FY2007 FMAP shall be substituted for the FMAP for the third and fourth calendar quarters of FY2008, before the application of this Act. Provides that, if the FMAP determined without regard to this Act for a state for FY2009 is less than the FMAP as so determined for FY2008, the FY2008 FMAP shall be substituted for the FMAP for the first, second, and third calendar quarters of FY2009, before the application of this Act. Provides that, for each eligible state for the third and fourth calendar quarters of FY2008, and for the first, second, and third calendar quarters of FY2009, the FMAP shall be increased by 2.95 percentage points. Provides for an increase in the cap on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Declares that, only for FMAP computation purposes, any significant disproportionate employer pension or insurance fund contribution shall be disregarded in computing the per capita income of a state, but not in computing the per capita income for the continental United States (and Alaska) and Hawaii.

Credit Cardholders' Bill of Rights Act of 2008 - Amends the Truth in Lending Act to prohibit a creditor from using certain adverse information, including information in a consumer report or any change in a consumer's credit score, as the basis for increasing any annual percentage rate (APR) of interest on the consumer's outstanding balance under an open end consumer credit plan, except for actions or omissions of the consumer directly related to such account. (Thus eliminates the universal default for credit already outstanding.) Bars a creditor from changing any term of the contract or agreement of an open end consumer credit plan until contract renewal, except for specific material reasons already contained in the contract or agreement. Requires advance notice of credit card account rate increases. Authorizes a consumer who receives such notice to: (1) cancel the credit card without penalty or the imposition of any fee; and (2) pay any outstanding balance that accrued before the effective date of the increase at the APR and in the repayment period in effect before notice was received. Prohibits a creditor from imposing interest on credit repaid within the interest-free repayment time period. (Thus prohibits double cycle billing). Prohibits the imposition of fees on any outstanding balance on a credit card account attributable only to accrued interest on previously repaid credit. Requires each periodic statement of account to provide specified information on obtaining the payoff balance. Prohibits a creditor from furnishing information to a consumer reporting agency concerning a newly opened credit card account until the consumer has used or activated the credit card. Details mandatory pro rata payment allocations by a creditor. Authorizes a consumer to opt-out of creditor authorization of over-the-limit transactions if fees are imposed. Restricts the frequency of over-the-limit fees. Specifies the contents of credit card price and availability information the Board of Governors of the Federal Reserve System must collect and make public semiannually. Prescribes a standard for the initial issuance of subprime or "fee harvester" cards (accounts requiring first-year fee payments in excess of 25% of the total amount of credit authorized).

Nursing and Allied Health Education Preservation Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to prohibit the Secretary of Health and Human Services from denying provider-operated status for a nursing and allied education program that substantially meets certain requirements pertaining to the cost of approved activities for such programs, in effect as of October 1, 2006, on the basis of an organizational structure, contractual arrangements, or legal structure of the program, or a change in such a structure or arrangement, so long as a hospital, hospitals, or health system continues to substantially control the nursing or allied program. Prohibits denial of payments for the costs of approved educational activities for a nursing or allied health education program. Requires restoration to a hospital of any recoupment or denial effected for a previous cost reporting year.

Delays until April 1, 2009, implementation of proposed changes to payment rules under title XIX (Medicaid) of the Social Security Act for case management and targeted case management services. Prohibits the Secretary of Health and Human Services, before such date, from taking any action to restrict coverage or payment under Medicaid if such action is more restrictive than the administrative action, policy, or practice that applies to coverage of, or payment for, such services under Medicaid on December 3, 2007. Makes null and void any such action taken by the Secretary between December 4, 2007, and March 31, 2009, that is based in whole or in part on such interim final rule.

Emergency Unemployment Compensation Act of 2008 - Provides for federal-state agreements during a period of rising unemployment under which a state will pay emergency unemployment compensation to individuals who: (1) have exhausted all rights to regular compensation under state or federal law for a benefit year (excluding any benefit year that ended before March 1, 2007); (2) have no rights to regular compensation or extended compensation with respect to a week under such law or any other state unemployment compensation law or to compensation under any other federal law; and (3) are not receiving compensation for such week under the unemployment compensation law of Canada. Requires federal payments to states to cover 100% of such temporary extended unemployment compensation payments. Provides for federal-state agreements for increased regular unemployment compensation payments to certain individuals. Amends the Social Security Act to provide for special transfers to state accounts in the Unemployment Trust Fund for unemployment compensation modernization incentive payments and for administration.

Josh Miller Helping Everyone Access Responsive Treatment in Schools Act of 2007, or the Josh Miller HEARTS Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to local educational agencies (LEAs) to: (1) purchase automated external defibrillators (AEDs) for use in their schools; and/or (2) provide training to meet the requirement that at least five adult employees or volunteers at each school with an AED successfully complete training in its use and in cardiopulmonary resuscitation (CPR). Requires LEA grant applicants also to demonstrate that: (1) the AEDs are integrated into the schools' medical emergency response procedures; and (2) emergency services personnel are notified of their locations.

Stop Senior Suicide Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to establish an Interagency Geriatric Mental Health Planning Council to coordinate and collaborate on the planning for the delivery of mental health services, to include suicide prevention, to older adults. Amends title XVIII (Medicare) of the Social Security Act to increase, through 2014 (when it will not be limited), payment for the treatment of mental, psychoneurotic, and personality disorders of an individual who is not an inpatient of a hospital at the time such expenses are incurred. Requires the Secretary to award grants or cooperative agreements to eligible entities to develop strategies for addressing suicide among the elderly. Revises provisions requiring centers to provide appropriate information, training, and technical assistance on youth suicide to require such information, training, and assistance on suicide among all ages, particularly for groups that are at a high risk for suicide. Authorizes additional appropriations to carry out such changes.

S Corporation Modernization Act of 2007 - Amends the Internal Revenue Code to revise the tax treatment of S corporations, including by: (1) reducing from 10 to 7 years the period during which S corporation built-in gains are subject to tax; (2) allowing nonresident aliens to qualify as beneficiaries of an electing small business trust (ESBT); (3) repealing mandatory termination of S corporation elections for excessive passive investment income; (4) allowing S corporations to increase passive investment income from 25 to 60% without incurring additional tax; (5) allowing individual retirement accounts to be S corporation shareholders; and (6) allowing ESBTs to claim expanded charitable tax deductions. Directs the Comptroller General to study and report to Congress on entity neutrality under the Internal Revenue Code with respect to S corporations, limited liability companies, and other pass-through entities.

Code Talkers Recognition Act of 2007 - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of gold medals to Native American code talkers of specified Indian tribes. Defines "code talker" as a Native American who served in the Armed Forces during a foreign conflict and who participated in military communications using a native language. Requires the Secretary of the Treasury, in consultation with the Secretary of Defense and Indian tribes, to identify code talkers eligible for a gold medal.

Environmental Justice Access and Implementation Act of 2007 - Requires specified federal agencies to establish an Office of Environmental Justice pursuant to Executive Order 12898 (concerning federal actions to address environmental justice in minority and low-income populations). Defines "environmental justice" as the fair treatment and meaningful involvement of all people regardless of race, color, national origin, educational level, or income in the development, implementation, and enforcement of environmental laws and regulations. Requires the inclusion of minority and low-income populations with health vulnerabilities and exposure to certain environmental conditions in criteria for defining an environmental justice community. Requires federal agencies to integrate the environmental justice strategy developed under Executive Order 12898 into their operations and missions and explicitly address compliance with this Act. Directs the Interagency Federal Working Group on Environmental Justice (Working Group) to coordinate an integrated environmental justice training plan for federal agencies. Requires federal agencies subject to the requirements of this Act to carry out certain outreach activities relating to environmental justice and to report on such activities to the Working Group. Directs federal agencies to fund and establish community technology centers to provide technical assistance and other services in the environmental justice area. Requires the President and the Government Accountability Office (GAO) to provide certain reports to Congress relating to environmental justice.
