Policyholder Protection Act of 2015

Policyholder Protection Act of 2015 This bill amends the Federal Deposit Insurance Act to declare that any action of the Federal Deposit Insurance Corporation (FDIC) that requires a bank holding company to provide funds or other assets to a subsidiary depository institution is neither effective nor enforceable with respect to a savings and loan holding company that is also an insurance company, an affiliate of an insured depository institution that is an insurance company, or any other company that is an insurance company and directly or indirectly controls an insured depository institution (entities) if: such funds or assets are to be provided by the entity, and the relevant state insurance authority determines that such an action would have a materially adverse effect on the entity's financial condition. The bill declares that requiring a bank holding company that is an insurance company to serve as a source of financial strength shall be deemed the kind of action of the Board of Governors of the Federal Reserve System that requires a bank holding company to provide funds or other assets to a subsidiary depository institution for specified purposes of the Bank Holding Company Act of 1956. The Dodd-Frank Wall Street Reform and Consumer Protection Act is amended, with respect to systemic risk determination and the treatment of insurance companies and their subsidiaries, to authorize the FDIC to stand in the place of the appropriate regulatory agency and file a judicial action to place such companies into orderly rehabilitation under state law if the appropriate regulatory agency has not done so. The FDIC, when funding the orderly liquidation of an insurance company or its subsidiary, shall notify the relevant state insurance authority promptly of its intention to take a lien on the company's assets. The FDIC may not take such a lien, however, if the state insurance authority informs it that doing so would have a materially adverse effect upon the insurance company's policyholders.

Reducing Federal Mandates on School Lunch Act

Reducing Federal Mandates on School Lunch Act This bill prohibits the Department of Agriculture (USDA) from implementing, administering, or enforcing a specified regulation, or promulgating or enforcing any new rule or regulation, establishing a maximum calorie limit or quantity of grains, meat, or meat alternatives for the school lunch program. USDA may not implement, administer, or enforce specified rules and regulations with respect to any school food authority that certifies to its state that it: (1) has calculated the costs of complying with such rules and regulations; and (2) has determined, in a manner consistent with school district operational procedures, that it cannot operate a food service program without incurring increased costs for complying with those rules and regulations. Those rules and regulations are: the rule entitled "National School Lunch Program and School Breakfast Program: Nutrition Standards for All Foods Sold in School as Required by the Healthy, Hunger-Free Kids Act of 2010"; any new rule regarding foods sold in schools that are not foods provided under the school lunch or breakfast programs; a specified regulation and any new rule or regulation regarding school lunch price increases; and a specified regulation and any new rule or regulation which establishes new food-based meal patterns, nutrition standards, or meal planning approaches for the school breakfast program. USDA may not define the phrase "costs of complying" or establish or suggest how a school food authority is to calculate those costs or increased costs for complying. The prohibitions will remain in effect until a law is enacted that extends by at least five fiscal years the authorization or duration of one or more school lunch or breakfast programs. The bill amends the Richard B. Russell National School Lunch Act to prohibit USDA from implementing any regulation that would require a reduction in the quantity of sodium contained in federally reimbursed meals, foods, and snacks sold in schools below specified July 2014 maximum levels allowed in school breakfasts for school year 2014-2015. With respect to grain contents, USDA shall only require that half of all grains in such food items are whole grain-rich. School food authorities must comply with the applicable grain component or standard with respect to the school lunch or school breakfast program in effect before July 1, 2014.

Surveillance State Repeal Act Repeals the USA PATRIOT Act and the FISA Amendments Act of 2008 (thereby restoring or reviving provisions amended or repealed by such Acts as if such Acts had not been enacted), except with respect to reports to Congress regarding court orders under the Foreign Intelligence Surveillance Act of 1978 (FISA) and the acquisition of intelligence information concerning an entity not substantially composed of U.S. persons that is engaged in the international proliferation of weapons of mass destruction. Extends from 7 to 10 years the maximum term of FISA judges. Makes such judges eligible for redesignation. Permits FISA courts to appoint special masters to advise on technical issues raised during proceedings. Requires orders approving certain electronic surveillance to direct that, upon request of the applicant, any person or entity must furnish all information, facilities, or technical assistance necessary to accomplish such surveillance in a manner to protect its secrecy and produce a minimum of interference with the services that such carrier, landlord, custodian, or other person is providing the target of such surveillance (thereby retaining the ability to conduct surveillance on such targets regardless of the type of communications methods or devices being used by the subject of the surveillance). Prohibits acquisitions under FISA relating to a U.S. person, or acquisitions under Executive Order 12333 targeting a U.S. person, without a warrant based on probable cause. Requires the Director of National Intelligence and the Department of Justice to destroy any information collected under the repealed Acts, or acquired under Executive Order 12333 without a warrant, if the information concerns a U.S. person that is not related to an investigation that is actively ongoing on the date of enactment of this Act. Prohibits the federal government from requiring manufacturers of electronic devices and related software to build in mechanisms allowing the federal government to bypass encryption or privacy technology. Directs the Government Accountability Office (GAO) to report annually on the federal government's compliance with FISA. Permits an employee of or contractor to an element of the intelligence community with knowledge of FISA-authorized programs and activities to submit a covered complaint to the GAO, to the House or Senate intelligence committees, or in accordance with a process under the National Security Act of 1947 with respect to reports made to the Inspector General of the Intelligence Community. Defines a "covered complaint" as a complaint or information concerning FISA-authorized programs and activities that an employee or contractor reasonably believes is evidence of: (1) a violation of any law, rule, or regulation; or (2) gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety. Prohibits an officer or employee of an element of the intelligence community from taking retaliatory action against an employee or contractor who seeks to disclose, or who discloses, such information.

Repeal of the Obamacare Bay State Boondoogle Act Revises requirements for the non-rural area wage index floor in the formula for the national adjusted diagnosis-related group (DRG) prospective payment rate used in calculating payments under title XVIII (Medicare) of the Social Security Act for each inpatient hospital discharge in a fiscal year involving inpatient hospital services of a subsection (d) hospital. (Generally, a subsection [d] hospital is an acute care hospital, particularly one that receives payments under Medicare's inpatient prospective payment system [IPPS] when providing covered inpatient services to eligible beneficiaries.) Directs the Secretary of Health and Human Services, in the case of discharges occurring on or after April 1, 2015, to apply budget neutrality, under the Balanced Budget Act of 1997 and related regulations, on a state-specific rather than national basis in the calculation of the Medicare hospital wage index floor, including a minimum wage index, for each non-rural area, using a specified methodology as if it had been fully implemented for FY2011 using a 100% state-specific adjustment to the area wage index. Declares that nothing in this Act shall be construed as preventing the Secretary, for discharges occurring on or after April 1, 2015, from modifying related regulations in carrying out budget neutrality requirements. Amends the Patient Protection and Affordable Care Act to end the application of budget neutrality on a national basis in the calculation of the Medicare hospital wage index floor as of April 1, 2015.

Veteran Education Empowerment Act

Veteran Education Empowerment Act Amends the Higher Education Act of 1965 to require the Secretary of Education to award up to 30 four-year grants to institutions of higher education (IHEs) or consortia of IHEs to establish, maintain, and improve Veteran Student Centers. Permits a grantee to use a portion of the grant to provide veteran students with supportive instruction services. Requires a grantee to be an IHE or consortium that: (1) enrolls in undergraduate or graduate courses a significant number or percentage of veterans or members of the Armed Forces, and (2) presents a sustainability plan demonstrating that its Veteran Student Center will be maintained and will continue to operate after the grant ends. Defines a "Veteran Student Center" as a dedicated space on a campus that provides students who are veterans or members of the Armed Forces with: (1) a lounge or meeting space for themselves, their spouses or partners, and veterans in the community; (2) a centralized office for veteran services that is staffed by trained employees and volunteers and serves as a single point of contact to coordinate veterans support services; and (3) comprehensive academic and tutoring services to veterans. Requires that office to provide such students with assistance in: transitioning from the military to student life, transitioning from the military to the civilian workforce, networking with other veteran students and veterans in the community, understanding and obtaining benefits provided by the IHE and federal and state government for which they may be eligible, understanding how to succeed in the IHE, and understanding their disability-related rights and protections under specified federal laws. Requires the Secretary to develop and implement a website for veteran student services at IHEs, which details best practices for serving veteran students at IHEs.

In promulgating a primary or secondary NAAQS for ozone, the EPA must: only consider a county to be a nonattainment area on the basis of direct air quality monitoring (rather than modeling); take into consideration feasibility and cost; and include in the regulatory impact analysis for the proposed and final rule at least one analysis that does not include any calculation of benefits resulting from reducing emissions of any pollutant other than ozone.

Women Veterans Access to Quality Care Act of 2015 Directs the Department of Veterans Affairs (VA) to: (1) establish standards to ensure that all VA medical facilities have the structural characteristics necessary to adequately meet the gender-specific health care needs of veterans at such facilities, including privacy, safety, and dignity; (2) integrate such standards into its prioritization methodology with respect to requests for funding major medical facility projects and major medical facility leases; and (3) report on such standards, including regarding the facilities that fail to meet such standards and the costs of projects and leases required to meet them. Requires the VA to: (1) use health outcomes for women veterans furnished health care by the the VA in evaluating the performance of VA medical center directors, (2) publish on its website information on such performance and on health outcomes for women veterans for each VA medical facility, (3) ensure that every VA medical center has a full-time obstetrician or gynecologist, and (4) carry out a pilot program to increase the number of residency program positions and graduate medical education positions for obstetricians and gynecologists at VA medical facilities in not less than three Veterans Integrated Service Networks. Directs the VA to develop procedures to share information that includes military service and separation data, personal email addresses and telephone numbers, and mailing addresses of veterans with state veterans agencies in electronic format as a means of facilitating the furnishing of assistance and benefits to such veterans. Allows a veteran to elect to prevent their information from being shared. Directs the Government Accountability Office to carry out an examination of whether VA medical centers are able to meet the health care needs of women veterans.

Directs the Secretary to make the results of the surveys publicly available on the VA's Internet website.

Higher Education Reform and Opportunity Act of 2015 Amends title IV (Student Assistance) of the Higher Education Act of 1965 to make the following entities, programs, and courses eligible for funding under title IV if they are accredited by an authorized accreditation authority in a state that has an alternative accreditation agreement with the Secretary of Education: institutions that provide postsecondary courses; postsecondary apprenticeship programs; and postsecondary education courses or programs provided by institutions of postsecondary education, nonprofit organizations, or for-profit organizations or businesses. Lists the items to be included in a state's alternative accreditation agreement with the Secretary, including the standards those entities, programs, and courses must meet to receive and maintain their accreditation. Requires that agreement to include the state's assurance that only entities, programs, and courses that provide credits toward a postsecondary certification, credential, or degree (as defined by the state in the agreement) will be accredited. Establishes the formula for determining the administrative cost allowance for: (1) the entities, programs, and courses that are accredited through the alternative accreditation system and that administer the Federal Pell Grant, Federal Perkins Loan, Federal Work-Study, and Federal Supplemental Educational Opportunity Grant programs in accordance with the agreement; and (2) states that will administer those programs for such entities, programs, and courses in accordance with the agreement.

Child Welfare Provider Inclusion Act of 2015 Prohibits the federal government, and any state that receives federal funding for any program that provides child welfare services under part B (Child and Family Services) or part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act (SSAct), from discriminating or taking an adverse action against a child welfare service provider that declines to provide, facilitate, or refer for a child welfare service that conflicts with the provider's sincerely held religious beliefs or moral convictions. Bars such prohibition from applying to SSAct requirements that forbid state entities from denying or delaying adoption or foster care placements on the basis of an adoptive parent's or a child's race, color, or national origin. Requires the Department of Health and Human Services to withhold 15% of the federal funds that a state receives for such programs if the state violates this Act. Allows an aggrieved child welfare service provider to assert such an adverse action violation as a claim or defense in a judicial proceeding and to obtain all appropriate relief (including declaratory relief, injunctive relief, compensatory damages, and reasonable attorney's fees and costs).

Improving Veterans Access to Quality Care Act of 2015 Directs the Secretary of Veterans Affairs (VA) to revive, for a three-year period, VA's Intermediate Care Technician Pilot Program that was carried out between January 2013 and February 2014. Requires VA to: (1) expand the pilot program to include at least 250 intermediate care technicians, and (2) give priority in assigning those technicians to VA facilities at which veterans have the longest wait times. Requires the Secretary of Defense (DOD) to transfer credentialing data regarding DOD health care providers that are hired by VA to VA. Authorizes VA to allow a covered nurse to practice to the full scope of the nurse's practice, as defined by the applicable national professional association, under a set of VA-approved privileges, regardless of the state in which VA employs the covered nurse. Defines a "covered nurse" as an advanced practice registered nurse who is employed by VA as: (1) a nurse midwife, (2) a clinical nurse specialist, (3) a nurse practitioner, or (4) a certified registered nurse anesthetist.

Requires such documentation to include Social Security Administration records and validated testimony in the case of the absence of Coast Guard shipping or discharge forms, ship logbooks, documents, or other official employment records. Requires the Secretary, when determining whether to recognize service allegedly performed during such period, to recognize masters of seagoing vessels or other command officers who were authorized to document an individual for purposes of hiring for or discharging from the merchant marine. Considers any service so recognized as active-duty service for purposes of veterans' burial benefits. Makes such veterans eligible for any appropriate military medals, ribbons, and decorations. Requires the Secretary to verify that an individual performed such service under honorable conditions without regard to their sex, age, or disability during the service period.

Includes as those lands permitted to be sold, exchanged, or interchanged under such Act: (1) parcels of 40 acres or less which are determined to be physically isolated, to be inaccessible, or to have lost their National Forest character; (2) parcels of 10 acres or less which are not eligible for conveyance under such Act, but which are encroached upon by permanent habitable improvements for which there is no evidence that the encroachment was intentional or negligent; or (3) parcels used as a cemetery, a landfill, or a sewage treatment plant under a special use authorization issued by the USDA. Requires any proceeds under this Act to be deposited in the special fund established under the Sisk Act and made available for: (1) the acquisition of land or interests in land for administrative sites for the NFS in the state from which the amounts were derived; (2) the acquisition of land or interests in land for inclusion in the NFS in that state, including those which enhance opportunities for recreational access; and (3) the performance of deferred maintenance on administrative sites for the NFS in that state or other deferred maintenance activities in that state which enhance opportunities for recreational access.

Amends the Internal Revenue Code to subject to the continuing levy upon property and property rights, for collection of unpaid taxes, any payments made to a Medicaid provider or supplier.

Drone Aircraft Privacy and Transparency Act of 2015 Amends the FAA Modernization and Reform Act of 2012 to direct the Secretary of Transportation to study and identify any potential threats to privacy protections posed by the integration of unmanned aircraft (drone) systems into the national airspace system, including any potential violations of privacy principles. Directs the Secretary to establish certain procedures to allow for civil operation in the national airspace system of small drone systems that do not meet expedited operational authorization requirements. Requires such procedures to ensure that the integration of drone systems into the national airspace system is done in compliance with privacy principles. Prohibits the Secretary from approving, issuing, or awarding any certificate, license, or other grant of authority to operate a drone system in the national airspace system unless the application for it includes a data collection statement, meeting certain requirements, that provides reasonable assurance that the applicant will operate the drone system in accordance with privacy principles. Applies the same privacy principles requirement to any drone system to be operated by a law enforcement agency or a law enforcement agency contractor or subcontractor, except that the application for it shall include a data minimization statement, meeting certain requirements, instead of a data collection statement. Directs the Administrator of the Federal Aviation Administration (FAA) to make any approved certificate, license, or other grant of authority, plus other specified information, available in a searchable format on the public FAA website. Prohibits a governmental entity from using a drone system, or requesting information or data collected by another entity through use of a drone system, for protective activities, or for law enforcement or intelligence purposes, except pursuant to a warrant issued using the procedures described in the Federal Rules of Criminal Procedure (or, in the case of a state court, issued using state warrant procedures) by a court of competent jurisdiction, or as permitted under the Foreign Intelligence Surveillance Act of 1978. Makes an exception to this prohibition in exigent circumstances when a law enforcement entity reasonably believes there is: (1) an imminent danger of death or serious physical injury; or (2) a high risk of an imminent terrorist attack by a specific individual or organization, according to the Secretary of Homeland Security . Makes it unlawful to operate a drone system in a manner that is not in accordance with the terms of a data collection statement or in a manner violating any portion of the final rule for the procedures for civil operation of small drone systems required by this Act. Grants enforcement authority to the Federal Trade Commission . Authorizes a state to bring a civil action on behalf of state residents in state or U.S. district court for injunctive relief against violations of this Act or related regulations if the state attorney general has reason to believe that an interest of state residents has been or is threatened or adversely affected by a prohibited act or practice. Creates a private right of action in state or U.S. district court for persons injured by a prohibited act. Allows a suit against a governmental entity. Requires the FAA to revoke the certificate, license, or other grant of authority to operate a drone system operated in a prohibited manner. Declares that nothing in this Act may be construed to apply to model aircraft flown strictly for hobby or recreational purposes and meeting certain other criteria.

The duties of the Commission include: evaluating HHS programs regarding the utilization of preventive health benefits, identifying current activities and critical gaps in federal efforts to support clinicians in providing integrated care, making recommendations regarding the development and coordination of federally funded clinical practice support tools, recommending clinical pathways for new technologies and treatments, evaluating and expanding education and awareness to health care professionals regarding prevention of diabetes, and reviewing and recommending appropriate methods for outreach and dissemination of educational resources. The Commission must submit an operating plan to HHS and Congress within 90 days of its first meeting.
