Truth in Fur Labeling Act of 2009 - Amends the Fur Products Labeling Act to: (1) eliminate the exemption to fur labeling requirements for products containing relatively small amounts of fur; and (2) permit states to enforce more restrictive labeling requirements. Directs the the Federal Trade Commission (FTC), in the Fur Products Name Guide, to replace the term "Raccoon, Asiatic" with "Dog, Raccoon."

Comparative Effectiveness Research Act of 2009 - Amends title XI (General Provisions, Peer Review, and Administrative Simplification) of the Social Security Act to provide for a program of comparative effectiveness research for health care. Defines "comparative effectiveness research" as research evaluating and comparing the implications and outcomes of two or more health care strategies to address a particular medical condition. Establishes the Health Care Comparative Effectiveness Research Institute as a nonprofit, nongovernmental corporation to conduct research on the effectiveness of health care treatments, including pharmaceuticals, medical devices and procedures, and other therapies. Requires the Institute to: (1) identify national priorities for comparative clinical effectiveness research; (2) establish and update a research project agenda and provide for peer review of research; (3) establish a standing methodology committee for developing the science of comparative effectiveness research; and (4) disseminate research findings. Amends the Internal Revenue Code to establish in the Treasury the Comparative Effectiveness Research Trust Fund. Provides revenues for the Trust Fund by: (1) transferring amounts from certain appropriations for comparative effectiveness research, from the General Fund, and from the Medicare Federal Hospital Insurance and Federal Supplementary Medical Insurance Trust Funds; and (2) imposing a fee on certain accident or health insurance policies and self-insured health plans. Requires the Comptroller General to review financial audits of the Institute and assess the adequacy and use of funding. Terminates all funding for the Trust Fund after FY2020.

Net Operating Loss (NOL) Carryback Act - Amends the Internal Revenue Code to allow a five-year carryback of net operating losses, including the operating losses of life insurance companies, incurred in 2008 and 2009. Denies such extended loss carryover period to: (1) taxpayers in whom the federal government acquires an equity interest under the Emergency Economic Stabilization Act of 2008; (2) the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac); and (3) members of certain affiliated groups.

Renewable Fuel Standard Improvement Act - Amends the Clean Air Act to: (1) include the Secretaries of Agriculture and Energy in renewable fuel program activities under such Act; (2) revise the definition of "lifecycle greenhouse gas emissions" to base the measurement of such emissions on recent observable data and consideration of regional differences of renewable fuel production, rather than on indirect land use changes; and (3) expand the definition of "renewable biomass."

Directs the Secretary of Education to award National Classified School Employees of the Year Awards to public school employees within certain occupational specialties who provide exemplary service to students in pre-kindergarten through higher education. Requires the Secretary to choose an awardee each year, out of nominations received from each state, from each of the following occupational specialties: (1) paraprofessionals; (2) clerical and administrative services; (3) transportation services; (4) food and nutrition services; (5) custodial and maintenance services; (6) security services; (7) health and student services; (8) technical services; and (9) skilled trades.

Home Oxygen Patient Protection Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to restore Medicare payment for the rent of oxygen and oxygen equipment. Repeals the limitation of Medicare payment to the supplier for such equipment (including portable oxygen equipment) to 36 months of continuous use.

Small Business Health Options Program Act of 2009 or the SHOP Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to designate an office within the Department of Health and Human Services (HHS) to administer a health insurance program for small businesses and self-employed individuals to purchase health insurance coverage meeting certain requirements. Establishes a Small Business Health Board to monitor the implementation of the program and make recommendations for improvements. Requires the Administrator of the program to: (1) enter into contracts with health insurance issuers to provide health insurance coverage under this Act; and (2) enter into agreements with entities to serve as navigators to provide information about the program, provide referrals to applicable agencies for any grievance, complaint, or question, and assist in enrollment. Requires a participating employer to ensure that each eligible employee has an opportunity to enroll in a plan. Sets forth requirements for health plans offered under this Act. Requires the Administrator to contract with the National Association of Insurance Commissioners to study: (1) the rating requirements that apply to health insurance purchased in the small group markets in the states and to develop recommendations concerning rating requirements; and (2) the administrative procedures that apply to the program and to health insurance purchased in the small group markets in states. Sets forth premium-setting rules for plans under this Act. Allows a state to prohibit participation in this program if the state offers alternative health benefit plans. Amends the Internal Revenue Code to allow a tax credit for small employers for qualified employee health insurance expenses under this Act.

Bureau of Alcohol, Tobacco, Firearms, and Explosives Reform and Firearms Modernization Act of 2009 - Amends the federal criminal code to revise the civil penalties for violations of firearms law and the procedures for assessing such penalties. Requires fines to be based upon the nature and severity of the violation, the size of the firearms business involved, and the prior record of the firearm's licensee. Prohibits consideration of the amount of fines or license revocations imposed by agents of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) in the retention, promotion, or transfer of such agents. Revises the definition of "willfully" for purposes of firearms violations and standards for criminal violations of firearms recordkeeping requirements. Requires the Attorney General to: (1) make preliminary determinations on firearms license applications and notify applicants in writing of a proposed denial; and (2) establish guidelines for ATF inspections, examinations, or investigations of possible firearms violations. Permits an owner of a firearms business whose license is expired, surrendered, or revoked 60 days to liquidate inventory. Allows purchasers of existing firearms businesses the right to cure firearms violations attributable to such businesses. Allows the transfer, possession, and importation of machineguns for industry testing, research and training, national security services, and motion picture or television production. Eliminates the requirement of written permission for the use of a handgun for lawful purposes by a minor (under age 18) where a parent or legal guardian is present at all times during such use. Prohibits the Attorney General from electronically retrieving inactive firearms licensee information by name or personal identification code. Directs the Attorney General to authorize the importation of all frames or receivers of rifles, or barrels for firearms other than handguns, if the importation is for repair or replacement purposes.

New Frontier Congressional Gold Medal Act - Authorizes the President to present gold medals, on behalf of Congress, to: (1) the astronauts of the Apollo 11 mission to the surface of the moon, Neil A. Armstrong (the first human to walk on the moon), Edwin E. "Buzz" Aldrin Jr. (pilot of the lunar module Eagle and second person to walk on the moon), and Michael Collins (pilot of their command module Columbia) in recognition of the first lunar landing, on July 20, 1969; and (2) John Herschel Glenn, the first American to orbit the Earth, on February 20, 1962.

Iran Refined Petroleum Sanctions Act of 2009 - Expresses the sense of Congress that: (1) diplomatic efforts to address Iran's illicit nuclear efforts, unconventional and ballistic missile development programs, and support for international terrorism are more likely to be effective if the President is empowered with explicit authority to impose additional sanctions on the government of Iran; (2) U.S. concerns regarding Iran are strictly the result of that government’s actions; and (3) the people of the United States have feelings of friendship for the people of Iran and regret that developments in recent decades have created impediments to that friendship. States that it should be U.S. policy to: (1) support international diplomatic efforts to end Iran's uranium enrichment program and its nuclear weapons program; (2) encourage foreign governments to direct state-owned and private entities to cease all investment in, and support of, Iran's energy sector and all exports of refined petroleum products to Iran; (3) impose sanctions on the Central Bank of Iran and any other Iranian financial institution engaged in proliferation activities or support of terrorist groups; and (4) work with allies to protect the international financial system from deceptive and illicit practices by Iranian financial institutions involved in proliferation activities or support of terrorist groups. Amends the Iran Sanctions Act of 1996 to direct the President to impose two or more current sanctions under such Act if a person has, with actual knowledge, made an investment of $20 million or more (or any combination of investments of at least $5 million which in the aggregate equals or exceeds $20 million in any 12-month period) that directly and significantly contributed to Iran's ability to develop its petroleum resources. (Under current law the sanction thresholds are $40 million, $10 million, and $40 million, respectively.) Directs the President to impose: (1) sanctions established under this Act (in addition to any current sanctions imposed under the Iran Sanctions Act of 1996) if a person has, with actual knowledge, sold, leased, or provided to Iran any goods, services, technology, information, or support that would allow Iran to maintain or expand its domestic production of refined petroleum resources, including any assistance in refinery construction, modernization, or repair; and (2) sanctions established under this Act if a person has, with actual knowledge, provided Iran with refined petroleum resources or engaged in any activity that could contribute to Iran's ability to import refined petroleum resources, including providing shipping, insurance, or financing services for such activity. Establishes additional sanctions prohibiting specified foreign exchange, banking, and property transactions. Includes references to refined petroleum resources in a presidential report to Congress requesting waiver of sanctions for purposes of national interest. Requires that the President immediately investigate a person upon receipt of credible information that such person is engaged in prohibited investment or other activity. Defines "credible information" as public or classified information or reporting supported by other substantiating evidence. Includes among the exceptions to the imposition of sanctions a situation in which the President determines in writing that the person to which the sanctions would otherwise be applied is: (1) a citizen or resident of a country that is a participant in the Proliferation Security Initiative; or (2) a foreign person organized under the laws of such country and is a subsidiary of a U.S. person. Directs the President to report to the appropriate congressional committees every six months regarding any person who has: (1) provided Iran with refined petroleum resources; (2) sold, leased, or provided to Iran any goods, services, or technology that would allow Iran to maintain or expand its domestic production of refined petroleum resources; or (3) engaged in any activity that could contribute to the enhancement of Iran's ability to import refined petroleum resources. States that the term "petroleum resources" includes petroleum, petroleum by-products, oil or liquefied natural gas, oil or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or compressed or liquefied natural gas. (Under current law the definition of the term "petroleum resources" is limited to petroleum and natural gas resources.) Defines "petroleum by-products" as gasoline, kerosene, distillates, propane or butane gas, diesel fuel, residual fuel oil, and other goods classified in headings 2709 and 2710 of the Harmonized Tariff Schedule of the United States.

Joint Ventures for Bird Habitat Conservation Act of 2009 - Directs the Secretary of the Interior to conduct, through the U.S. Fish and Wildlife Service, a Joint Ventures Program to develop a framework for the approval and establishment of Joint Ventures that: (1) provide financial and technical assistance to support regional migratory bird conservation partnerships; (2) implement plans for the protection and enhancement of migratory bird populations; (3) complement and support activities by the Secretary and the Director of the U.S. Fish and Wildlife Service to fulfill obligations under specified migratory bird and conservation Acts; and (4) support the goals and objectives of the North American Waterfowl Management Plan and other specified Conservation Plans, treaties, conventions, and agreements that promote the conservation of migratory bird populations and their habitats. Defines a "Joint Venture" as a self-directed, voluntary partnership. Authorizes the Director to enter into agreements with eligible partners to establish Joint Ventures to: (1) promote, primarily, sustainable migratory bird populations, and secondarily, the fish and wildlife species associated with their habitats; (2) encourage stakeholder and government partnerships; and (3) establish, implement, and improve science-based migratory bird conservation plans and promote broader landscape-level conservation of fish and wildlife habitat. Specifies that eligible partners include: (1) federal and state agencies; (2) affected regional, local, and tribal governments, private landowners, land managers, and other private stakeholders; (3) certain nongovernmental organizations; and (4) other relevant stakeholders. Authorizes the Director to award grants of financial assistance for the implementation of Joint Ventures.

Grassroots Rural Water Systems Act - Calls for the Environmental Protection Agency (EPA) to prioritize the type of technical assistance that small communities find is the most beneficial. Amends the Safe Drinking Water Act to authorize: (1) increased appropriations to the Administrator of EPA for FY2010-FY2015 for technical assistance to enable small public water systems to comply with national primary drinking water regulations; and (2) the Administrator to provide technical assistance to organizations providing on-site technical assistance, circuit-rider technical assistance programs, on-site and regional training, assistance with implementing source water protection plans, and assistance with implementation monitoring plans, rules, regulations, and water security enhancements and to give preference to nonprofit organizations determined to be qualified, effective, and to have the majority of support from small community water systems in the states.

Government Efficiency, Effectiveness, and Performance Improvement Act of 2009 - Expresses the sense of Congress that each federal agency head should consult with the congressional committees with jurisdiction over the agency each fiscal year regarding the agency's performance plan. Requires each agency head, in collaboration with the Director of the Office of Management and Budget (OMB), to conduct an assessment of each agency program at least once every five fiscal years, assessing the program's purpose, strategic plan and objectives, organizational design, management, efficiency, and effectiveness in achieving its performance objectives and identifying strengths and weaknesses and factors affecting program success. Requires the Director to: (1) make available, by May 1 of each year, a list of programs to be assessed and the criteria and methodology that will be used; (2) submit in a report to Congress, at the same time the President submits the annual federal budget, assessment results, including an identification of program best practices for allocating resources and recommendations for modifications focusing on opportunities for consolidation and integration of programs and authorities; and (3) develop an improvement plan, which the agency head shall implement, that responds to the assessment report and identifies follow-up actions to improve program performance. Changes: (1) the date by which the heads of each federal agency are required to submit strategic plans for program activities to September 30 of each year following a presidential election; and (2) the period of coverage for strategic plans from five to four years. Provides for: (1) designation of agency performance improvement officers to supervise an agency's performance management activities; and (2) establishment of a Performance Improvement Council to make recommendations concerning, and to monitor, performance management and evaluation of program performance.

Fiscal Honesty and Accountability Act of 2009 - Amends the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) to extend Pay-As-You-Go (PAYGO) requirements through FY2014 and enforcement mechanisms through FY2018. Requires the Directors of the Congressional Budget Office (CBO) and of the Office of Management and Budget (OMB) each to report to the House Committee on the Budget on how to broaden the PAYGO sequestration base and make it more fair and equitable. Extends through FY2013 the spending limits (spending caps) for the discretionary categories in new budget authority and outlays. Amends the Congressional Budget and Impoundment Control Act of 1974 to address issues of emergency spending by requiring: (1) Committee on the Budget guidelines; (2) a separate House vote on an emergency designation; and (3) detailed reserve funds for emergencies in the President's budget request to Congress. Prescribes a procedure for adjustments in committee allocations resulting from such spending in joint budget resolutions. Amends the Congressional Budget Act of 1974 (CBA) to prohibit floor amendments to amendments reported by the Committee on the Budget (or from the consideration of which the Committee has been discharged) with respect to legislation for emergency reserve funds for certain military operations. Prohibits consideration of an amendment to a joint budget resolution which changes the amount of budget authority and outlays set forth in the CBA for the emergency reserve fund. Requires reports on legislation which provide new budget, spending, or credit authority, or otherwise provide an increase or decrease in revenues or tax expenditures, to include a CBO projection of the cost of debt servicing (interest). Amends the CBA concerning: (1) CBO cost analysis (scoring) for conference reports; (2) legislation which evades specified budget enforcement mechanisms; and (3) legislation which is unreported by committee (for purposes of budget point of order rules). Amends the Rules of the House of Representatives concerning: (1) budget compliance statements (permitting inclusion of budgetary implications); (2) requirements for budget act waivers (inclusion mandatory for bill consideration); and (3) a separate vote to waive a major budget act point of order.

Star-Spangled Banner Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins in commemoration of the bicentennial of the writing of the Star-Spangled Banner . Requires a coin design emblematic of the War of 1812, and in particular of, the Battle for Baltimore that formed the basis for the Star-Spangled Banner. Limits the period for coin issuance to calendar year 2012. Imposes a surcharge of $35 per coin for the $5 coins and $10 per coin for the $1 coins, which shall be distributed to the Maryland War of 1812 Bicentennial Commission for the purpose of supporting bicentennial activities, educational outreach activities, and preservation and improvement activities pertaining to the sites and structures relating to the War of 1812.

No Child Left Inside Act of 2009 - Amends the Elementary and Secondary Education Act of 1965 to require states, as a prerequisite to receiving implementation grants, to develop environmental literacy plans, approved by the Secretary of Education, for pre-kindergarten through grade 12 that include environmental education standards and teacher training. Directs the Secretary to award Environmental Education Professional Development Grants to states and, through them, competitive subgrants to partnerships that include an LEA and, permissibly, institutions of higher education (IHE), other educational entities, or federal, state, regional, or local natural resource or environmental agencies, for activities involving, among other things, teacher training and the development of more rigorous environmental education curricula that advance the teaching of interdisciplinary courses. Authorizes the Secretary to award competitive matching grants to partnerships that include an LEA and, permissibly, IHEs, other educational entities, federal, state, regional, or local natural resource or environmental agencies, or park and recreation departments, for activities to improve and support environmental education that include: (1) advancing content and achievement standards; (2) developing or disseminating innovations or model programs; and (3) research.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Elder Justice Act - Amends the Social Security Act to establish an Elder Justice program under title XX (Block Grants to States for Social Services). Establishes within the Office of the Secretary of Health and Human Services (HHS) an Elder Justice Coordinating Council (EJCC). Establishes the Advisory Board on Elder Abuse, Neglect, and Exploitation. Directs the Secretary to make grants to eligible entities to establish stationary and mobile forensic centers, to develop forensic expertise regarding, and provide services relating to, elder abuse, neglect, and exploitation. Directs the Secretary to provide incentives for individuals to train for, seek, and maintain employment providing direct care in a long-term care (LTC) facility. Directs the Secretary to make grants to LTC facilities to: (1) offer continuing training and varying levels of certification to employees who provide direct care to LTC facility residents; and (2) provide bonuses or other benefits to employees who achieve certification. Authorizes the Secretary to make grants to assist LTC facilities in offsetting the costs for standardized clinical health care informatics systems designed to improve patient safety and reduce adverse events and health care complications resulting from medication errors. Directs the Secretary to ensure that HHS: (1) provides funding to state and local adult protective services services offices that investigate reports of elder abuse, neglect, and exploitation; and (2) collects and disseminates related data in coordination with the Department of Justice. Establishes a program of annual adult protective services grants to states. Directs the Secretary to make grants to eligible entities to: (1) improve the capacity of state LTC ombudsman programs to respond to and resolve abuse and neglect complaints; and (2) conduct pilot programs with state or local LTC ombudsman offices. Directs the Secretary to establish programs to provide and improve ombudsman training for national organizations and state LTC ombudsman programs. Amends part A of SSA title XI to require each individual owner, operator, employee, manager, agent, or contractor of an LTC facility receiving certain federal support to report to the Secretary and local law enforcement entities any reasonable suspicion of crimes occurring in such facility. Requires the owner or operator of such an LTC facility to notify the Secretary and the appropriate state regulatory agency of a facility's impending closure, as well as a plan for the transfer and adequate relocation of facility residents. Directs the Secretary to study and report to the EJCC and appropriate congressional committees on establishing a national nurse aide registry. Directs the Attorney General to: (1) study, analyze, and report to Congress, the Secretary, and the states on state laws and practices relating to elder abuse, neglect, and exploitation; and (2) develop objectives, priorities, policies, and a long-term plan for elder justice programs and activities. Requires the Comptroller General to review and report to Congress on existing federal programs and initiatives in the federal criminal justice system relevant to elder justice. Authorizes the Attorney General to award victim advocacy grants to eligible entities to study the special needs of victims of elder abuse, neglect, and exploitation. Directs the Attorney General to award grants to provide: (1) training, technical assistance, policy development, multidisciplinary coordination, and other types of support to local and state prosecutors and courts, as well as employees of state Attorneys General and Medicaid Fraud Control Units handling elder justice-related matters; and (3) similar types of support to police, sheriffs, detectives, public safety officers, corrections personnel, and other front line law enforcement responders who handle elder justice matters to fund specially designated elder justice positions or units designed to support front line law enforcement in elder justice matters. Amends the Violent Crime Control and Law Enforcement Act of 1994 to reauthorize the missing Alzheimer's Disease patient alert program. Amends the Internal Revenue Code to provide a long-term care facility worker employment tax credit.

Commends the crew of the Maersk Alabama and Captain Richard Phillips, who selflessly placed himself in harm's way to protect his crew. Recognizes the U.S. Navy, the crews of the USS Bainbridge, Boxer, Halyburton, and Patrol Squadron (VP) 8 for their role in the rescue. Congratulates the Navy SEALs on the scene for their decisive action that resulted in the rescue of Captain Phillips. Joins all Americans in expressing great relief that the crew has returned home safely.

Water Accountability Tax Efficiency Reinvestment Act of 2009 or the WATER Act of 2009 - Amends the Internal Revenue Code to allow a tax credit for 30% of amounts paid for WaterSense program property certified by the Environmental Protection Agency (EPA). Limits the lifetime dollar amount of such credit to $1,500. Terminates such credit after 2010.

New Alternative Transportation to Give Americans Solutions Act of 2009 - Amends the Internal Revenue Code to: (1) allow an excise tax credit through 2027 for alternative fuels and fuel mixtures involving compressed or liquefied natural gas; (2) allow an income tax credit through 2027 for alternative fuel motor vehicles powered by compressed or liquefied natural gas; (3) modify the tax credit percentage for alternative fuel vehicles fueled by natural gas or liquefied natural gas; (4) allow a new tax credit for the production of vehicles fueled by natural gas or liquefied natural gas; and (5) extend through 2027 the tax credit for alternative fuel vehicle refueling property expenditures for refueling property relating to compressed or liquefied natural gas and allow an increased credit for such property. Requires 50% of all new vehicles purchased or placed in service by the U.S. government by December 31, 2014, to be capable of operating on compressed or liquefied natural gas. Authorizes the Secretary of Energy to make grants to manufacturers of light and heavy duty natural gas vehicles for the development of engines that reduce emissions, improve performance and efficiency, and lower cost.

Conservation Easement Incentive Act of 2009 - Amends the Internal Revenue Code to make permanent the tax deduction for charitable contributions by individuals and corporations of real property interests for conservation purposes.

Fair Elections Now Act - Amends the Federal Election Campaign Act of 1971 (FECA) with respect to: (1) eligibility and qualifying contribution requirements and benefits of fair elections financing of House of Representatives election campaigns; (2) establishment of a Fair Elections Fund; (3) eligibility for Fund allocations; (4) contribution and expenditure requirements; (5) a public debate requirement; (6) certification of whether or not a federal election candidate is a participating candidate; (7) benefits for participating candidates; (8) matching payments for qualified small dollar contributions; (9) political advertising vouchers; (10) establishment of a Fair Elections Oversight Board; (11) civil penalties for violation of contribution and expenditure requirements; (12) prohibition of joint fundraising committees with any political committee other than a candidate's authorized committee; and (13) a specified limitation on coordinated expenditures by political party committees with participating candidates. Amends the Communications Act of 1934 to require the deposit into the Fair Elections Fund of 10% of the proceeds from competitive auctions for recovered analog spectrum. Amends the Internal Revenue Code to allow for designation of a certain amount of income tax liability to the Fair Elections Fund. Amends the Communications Act of 1934 to: (1) prohibit the preemption of the use of a broadcasting station by a legally qualified House candidate who has purchased and paid for such use; (2) revise Federal Communications Commission (FCC) authority to revoke licenses for broadcasting stations who fail to provide access to House candidates; and (3) revise the formula for determining reduced broadcast rates for participating candidates in certain circumstances. Directs the FCC to initiate a rulemaking proceeding to establish a standardized form to be used by broadcasting stations to record and report the purchase of advertising time by or on behalf of a candidate for nomination for election, or for election, to federal elective office. Amends FECA to: (1) empower the Federal Election Commission (FEC) to petition the U.S. Supreme Court for a writ of certiorari to appeal a civil action; (2) require all designations, statements, and reports required to be filed under FECA to be filed directly with the FEC, and in computer-accessible electronic form; and (3) reduce from 48 to 24 hours after their receipt the deadline for the FEC to make designations, statements, reports, or notifications available to the public in the FEC office and on the Internet.

Safe and Efficient Transportation Act of 2009 - Allows a state to authorize the operation of a vehicle with a maximum gross weight (including enforcement tolerances) in excess of certain federal weight limitations on Interstate Highway System (IHS) routes in the state if: (1) the vehicle is equipped with at least six axles; (2) the weight of any single axle does not exceed 20,000 pounds; (3) the weight of any tandem axle does not exceed 34,000 pounds; (4) the weight of any group of three or more axles does not exceed 51,000 pounds; and (5) the gross weight of the vehicle does not exceed 97,000 pounds. Directs the Secretary of Transportation to establish a safe and efficient vehicle bridge infrastructure improvement program. Requires the Secretary to apportion amounts from the Safe and Efficient Vehicle Trust Fund to states for eligible bridge replacement or rehabilitation projects. Amends the Internal Revenue Code to: (1) impose an overweight vehicle tax on any vehicles that exceed federal weight limitations operating on the IHS; and (2) establish the Safe and Efficient Vehicle Trust Fund.

Quality FIRST (From Incentives, Reporting, Standards, and Technology) Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services to make performance-based payments each fiscal year to hospitals that provide high quality inpatient hospital services to inpatients entitled to benefits under Medicare part A (Hospital Insurance). Requires the Secretary to select appropriate evidence-based, statistically valid, and sufficiently field tested quality measures of care furnished by hospitals in inpatient settings for evaluating hospital performance. Requires a utilization and quality control peer review organization to give priority of quality improvement assistance to low-performing hospitals. Directs the Secretary to establish a program under which a hospital seeking to improve the quality of inpatient hospital services based on the results of a performance evaluation may apply to the Secretary to receive quality improvement assistance from a private quality organization with expertise in supporting inpatient service quality improvement.

Chesapeake Bay Science, Education, and Ecosystem Enhancement Act of 2009 - Amends the National Oceanic and Atmospheric Administration Authorization Act of 1992 to require the Director of the Chesapeake Bay Office of the National Oceanic and Atmospheric Administration (NOAA) to: (1) collaborate with constituents in the Bay's watershed to support the development of an integrated observations system for the Bay; (2) support the establishment and implementation of the Captain John Smith Chesapeake National Historic Trail; (3) incorporate the Chesapeake Bay Interpretive Buoy System into the Integrated Ocean Observing System regional network of observatories; (4) establish a Chesapeake Bay watershed education and training program (authorizes related grants); and (5) establish a Chesapeake Bay coastal living resources management and habitat program. Requires peer review for projects funded under the Act. Authorizes the director to make contracts, leases, grants, or cooperative agreements as necessary to carry out the Act. Authorizes appropriations (at an increased level) for the Office for FY2011-FY2014.

Breast Cancer Education and Awareness Requires Learning Young Act of 2009 or EARLY Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct a national evidence-based education campaign: (1) to increase public awareness regarding the threats posed by breast cancer to young women, including the particular risks faced by certain ethnic and cultural groups; and (2) focusing on awareness of risk factors and achieving early detection through community-centered informational forums, public service advertisements, and media campaigns. Directs the Secretary to award grants to entities to establish national multimedia campaigns that: (1) will encourage young women to be aware of their personal risk factors, strategies for increasing early detection and self awareness, evidence based preventative lifestyle changes, and other appropriate breast cancer early detection and risk reduction strategies; (2) will encourage young women of specific higher-risk populations to talk to their medical practitioners about those risks and methods for appropriate screening and surveillance; and (3) may include advertising through specified media. Requires the Secretary, acting through the Director, to: (1) establish an advisory committee to assist in creating and conducting the public education campaign; (2) conduct an education campaign to increase awareness among health care professionals; and (3) conduct prevention research. Directs the Secretary to award grants to organizations and institutions to provide to young women diagnosed with breast cancer substantive assistance and health information from credible sources on: (1) education and counseling regarding fertility preservation; (2) social, emotional, psychosocial, financial, lifestyle, and caregiver support; (3) familial risk factors; and (4) risk reduction strategies to reduce recurrence or metastasis.

Voluntary State Discount Prescription Drug Plan Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act to require drug manufacturers to pay rebates to state prescription drug discount programs as a condition of participating in a Medicaid rebate agreement for outpatient prescription drugs, but only if the state has elected to establish an optional state prescription drug discount program.

Encourages: (1) local communities to raise awareness surrounding nutritional health; and (2) awareness about diseases and death caused by lack of nutrition. Recognizes health care professionals, such as registered dietitians, who spread the knowledge and importance of nutrition each day.

Imposes an additional income tax on bonuses paid to employees or former employees of covered Troubled Assets Relief Program (TARP) recipients. Defines "covered TARP recipient" to include: (1) entities and their affiliates that received capital infusions under the Emergency Economic Stabilization Act of 2008 exceeding $5 billion; and (2) the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac). Exempts entities that repay TARP amounts exceeding a $5 billion threshold. Sets the rate of such tax at 90% of the lesser of: (1) the bonus amounts paid; or (2) the amount of such taxpayer's adjusted gross income exceeding $250,000 ($125,000 in the case of a married individual filing a separate return). Exempts any employee who irrevocably waives or returns a bonus payment before the close of the taxable year in which such payment is due.

Pathway for Biosimilars Act - Amends the Public Health Service Act to allow a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product). Requires the Secretary of Health and Human Services to approve the application if: (1) the biological product is biosimilar to the reference product with respect to each condition of use for which the reference product is approved; and (2) the applicant consents to the inspection of the facility that is the subject of the application. Sets forth requirements for a determination by the Secretary that a biological product is interchangeable with a reference product. Prohibits a biological product from being evaluated against more than one reference product. Prohibits licensure under this Act of a biological product containing specified agents or toxins or a schedule I or II controlled substance unless the Secretary determines there would be no increased risk to the security or health of the public from licensing such a biological product. Prohibits the Secretary from making approval of an application under this Act effective until 12 yeas after the date on which the reference product was first licensed. Provides for confidentiality of information received pursuant to this Act. Sets forth provisions governing patent infringement actions related to this Act. Deems as patent infringement the submission of a statement under this Act by the applicant setting forth reasons why the making, use, or sale of the biosimilar product would not infringe the patent, or why the patent is invalid or unenforceable, if the purpose of such submission is to obtain approval to engage in the commercial manufacture, use, or sale before the expiration of such patent.

Securing America's Future Economy Commission Act or SAFE Commission Act - Establishes the Securing America's Future Economy (SAFE) Commission to develop legislation designed to address: (1) the unsustainable imbalance between long-term federal spending commitments and projected revenues; (2) increases in net national savings to provide for domestic investment and economic growth; (3) the implications of foreign ownership of federally issued debt instruments; and (4) revision of the budget process to place greater emphasis on long-term fiscal issues. Requires the Commission to: (1) develop one or two methods for estimating the cost of legislation as an alternative to the current Congressional Budget Office (CBO) method; and (2) hold at least one town-hall style public hearing within each federal reserve district. Requires the Commission to submit a legislative proposal to Congress and the President. Authorizes the President to submit to Congress an alternative proposal. Authorizes the Committee on the Budget of either chamber to publish its own alternative proposal in the Congressional Record. Sets forth procedures for consideration of such legislation. Requires CBO to prepare a long-term cost estimate and have it published in the Congressional Record as expeditiously as possible whenever requested to do so by the Commission, the President, or the chairman or ranking minority member of the Committee on the Budget of either chamber.

Cell Tax Fairness Act of 2009 - Prohibits states or local governments from imposing any new discriminatory tax on mobile services, mobile service providers, or mobile service property for five years after the enactment of this Act. Defines "new discriminatory tax" as a tax imposed on mobile services, providers, or property that is not generally imposed on other types of services or property, or that is generally imposed at a lower rate.

Multinational Species Conservation Funds Semipostal Stamp Act of 2009 - Requires the United States Postal Service to issue and sell, at a premium, a Multinational Species Conservation Funds Semipostal Stamp. Requires proceeds from the sale of such stamp to be: (1) transferred to the United States Fish and Wildlife Service (USFWS) to help fund the operations supported by the Multinational Species Conservation Funds; and (2) divided equally among the African Elephant Conservation Fund, the Asian Elephant Conservation Fund, the Great Ape Conservation Fund, the Marine Turtle Conservation Fund, and the Rhinoceros and Tiger Conservation Fund. Prohibits such proceeds from being taken into account in any decision relating to the level of appropriations or other federal funding to be furnished to the USFWS or such Funds. Requires the stamp to: (1) be made available to the public for at least five years; and (2) depict images of flagship multinational species.

Food Allergy and Anaphylaxis Management Act of 2009 - Requires the Secretary of Health and Human Services to develop and make available to local educational agencies, schools, early childhood education programs, and other interested entities voluntary guidelines to develop plans for individuals to manage the risk of food allergy and anaphylaxis in schools and early childhood education programs. Directs that such guidelines address: (1) parental obligation to provide the documentation of their child's allergies; (2) the creation of an individual food allergy management plan for each such child; (3) communication between schools or programs and emergency medical services; (4) reduction of exposure to anaphylactic causative agents; (5) food allergy management training; and (6) administration of epinephrine. Allows the Secretary to award matching grants to assist local educational agencies in implementing such food allergy and anaphylaxis management guidelines.

Concussion Treatment and Care Tools Act of 2009 or the ConTACT Act of 2009 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to: (1) establish concussion management guidelines that address the prevention, identification, treatment, and management of concussions in school-aged children, including standards for student athletes to return to play after a concussion; and (2) convene a conference of medical, athletic, and educational stakeholders to establish such guidelines. Authorizes the Secretary to make grants to states for: (1) adopting, disseminating, and ensuring the implementation by schools of the guidelines; and (2) funding implementation by schools of computerized preseason baseline and post-injury neuropsychological testing for student athletes. Directs the Secretary to require states to utilize, to the extent practicable, applicable expertise and services offered by local chapters of national brain injury organizations.

Iran Sanctions Enabling Act of 2009 - States that it is the policy of the United States to support the decision of state and local governments and educational institutions to divest from, and to prohibit the investment of assets they control in, persons that have investments of more than $20 million in Iran's energy sector. Authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit the investment of assets they control in, such persons, including financial institutions which extend them credit to so invest. Amends the Investment Company Act of 1940 to shield any registered investment company from civil, criminal, or administrative action based upon its divesting from, or avoiding investing in, securities issued by such persons. Expresses the sense of Congress that a fiduciary of an employee benefit plan under the Employee Retirement Income Security Act of 1974 (ERISA) may divest plan assets from, or avoid investing plan assets in, a person that has investments of more than $20 million in Iran's energy sector without breaching his or her fiduciary duties under ERISA, if such determination is based on credible information and in accordance with federal law.

Savings Enhancement for Education in College Act - Amends the Internal Revenue Code to: (1) make permanent the allowance for payment of expenses for computer technology and equipment from qualified tuition programs; (2) allow a tax credit for contributions to such programs; and (3) allow limited direction of investment of contributions or earnings in a qualified tuition program.

Veterans Mental Health Screening and Assessment Act - Expresses the sense of Congress that: (1) the increasing rate of suicide among veterans returning from Operations Enduring Freedom and Iraqi Freedom is a serious problem; and (2) the Secretary of Defense should conduct mandatory, face-to-face, and confidential mental health and traumatic brain injury screenings for each member of the Armed Forces (member) during the period beginning 90 days after the member completes a deployment in support of a contingency operation and ending 180 days thereafter. Directs the Secretary to carry out such screenings. Prohibits the Secretary from prohibiting a member from returning to the United States due to any screening result or determination. Requires the Secretary and the Secretary of Veterans Affairs to establish a joint protocol to share existing and future reports from confidential screenings conducted to help aid members in their transition from health care and treatment provided by the Department of Defense (DOD) to health care and treatment provided by the Department of Veterans Affairs (VA).
