Radioactive Import Deterrence Act

Radioactive Import Deterrence Act - Amends the Atomic Energy Act of 1954 to prohibit the Nuclear Regulatory Commission (NRC) from issuing a license authorizing the importation into the United States of: (1) low-level radioactive waste; or (2) specific radioactive waste streams exempted from regulation by the NRC. Exempts from such prohibition low-level radioactive waste: (1) being returned to a federal or military facility which is authorized to possess the material; or (2) resulting from the use in a foreign country of nuclear material obtained by the foreign user from an entity in the United States that is being returned to the United States for management and disposal. Authorizes the President to waive such prohibition and authorize the grant of a specific license to import materials only after finding that such importation would meet an important national or international policy goal, such as the use of waste for research purposes. Grandfathers certain licenses issued before the date of enactment of this Act, but prohibits their extension or amendment with respect to the amount of material permitted to be imported.

Reduces the prison term to one year if the offense involves less than five horses or less than 2,000 pounds of horse flesh or carcass and the offender has no prior conviction for this offense.

Great Lakes Collaboration Implementation Act

Great Lakes Collaboration Implementation Act - Amends the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 to: (1) require certain vessels operating in U.S. waters to have invasive species management plans; (2) direct the Secretary of Homeland Security to establish vessel performance requirements, including provisions for ballast water exchange, treatment, and discharge, and civil and criminal penalties for violations; (3) require federal agencies to restrict the importation of live aquatic organisms of species not in trade without screening and approval; and (4) declare importation of such species to be unlawful and prescribe civil and criminal penalties for violations. Renames the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 as the Nonindigenous Aquatic Invasive Species Prevention and Control Act of 1990. National Invasive Species Council Act - Prohibits federal agencies from authorizing, funding, or carrying out any action that would promote the introduction or spread of invasive species unless the benefits of the action outweigh the harm. Establishes the National Invasive Species Council (NISC) as an independent entity in the executive branch to lead and coordinate efforts to minimize the negative effects caused by invasive species and to reduce the threat of further invasions. Requires NISC to develop a National Invasive Species Management Plan and to establish an Invasive Species Advisory Committee. Reauthorizes and modifies the Great Lakes Fish and Wildlife Restoration Act of 1990. Amends the Federal Water Pollution Control Act to: (1) authorize the Administrator of the Environmental Protection Agency (EPA) to provide funding for wastewater assistance to certain municipalities and small publicly-owned treatment works; (2) authorize states to provide additional subsidization to benefit certain municipalities or state agencies that already receive assistance from the water pollution control revolving fund or to implement certain alternative techniques; (3) replace each reference to "navigable waters of the United States" with a reference to "waters of the United States"; (4) require the Great Lakes National Program Office to provide grants to reduce the quantity of mercury in the Great Lakes; and (5) require the President include a joint Great Lakes research plan in the annual budget submitted to Congress. Authorizes funding for the Great Lakes Environmental Research Laboratory. Requires the National Oceanic and Atmospheric Administration (NOAA) to provide grants for Great Lakes research and monitoring activities. Requires: (1) the President, acting through the National Ocean Research Leadership Council, to establish a system that detects and predicts changes in the ocean, coastal, and Great Lakes environment that impact certain U.S. systems; and (2) the Council to establish an interagency program office to be known as OceanUS to be responsible for program planning and coordination of such system. Amends the Federal Water Pollution Control Act to require the Program Office to develop specified science-based indicators of water quality and related environmental factors in the Great Lakes. Authorizes the Secretary to: (1) provide financial assistance for certain restoration or remediation projects; and (2) restore and remediate waterfronts and related areas. Establishes: (1) the Great Lakes Interagency Task Force, as established by Executive Order 13340, as a task force within EPA; (2) a Great Lakes Regional Collaboration Executive Committee to hold meetings and make recommendations and reports on Great Lakes restoration goals and progress; and (3) the Great Lakes Regional Collaboration to develop a restoration and protection strategy for use in Great Lakes program implementation and funding decisions, to serve as a forum for addressing regional issues relating to ecosystem restoration and protection of the Great Lakes, and to establish an oversight forum to coordinate and enhance implementation of Great Lakes programs. Provides funding for a variety of Great Lakes programs.

Short Sea Shipping Act of 2009 - Amends the Internal Revenue Code to exempt from the harbor maintenance tax commercial cargo (other than bulk cargo) loaded at: (1) a port in the U.S. mainland and unloaded at another such port after transport solely by coastal route or river or unloaded at a port in Canada located in the Great Lakes Saint Lawrence Seaway System; or (2) such a port in Canada and unloaded at a port in the U.S. mainland. Defines the "Great Lakes Saint Lawrence Seaway System" as the waterway between Duluth, Minnesota, and Nova Scotia, encompassing the five Great Lakes, their connecting channels, and the Saint Lawrence River.

Supporting America's Manufacturers Act

Supporting America's Manufacturers Act - Amends the Trade Act of 1974 to require a recommendation from the International Trade Commission (ITC) before the President can impose increased duties or other import restrictions on an imported Chinese product that causes or threatens market disruption to a like U.S. product. Revises the authority of the President and the U.S. Trade Representative (USTR) to consider an equally divided ITC vote regarding a determination on the question of whether an imported Chinese product causes or threatens market disruption in the United States. Repeals the authority of the President and the USTR to consider the determination of either group of equally divided Commissioners to be the ITC's determination. Requires such a deadlocked vote to be considered an affirmative ITC determination. Provides that if the Commissioners voting are equally divided with respect to its determination, then the determination agreed upon by either group of Commissioners may be considered by the President and the Trade Representative as the determination of the Commission. Requires the USTR to make available promptly to the public reports recommending the President to take action, if any, to remedy market disruption. Revises requirements involving ITC determinations of critical circumstances and requests for provisional relief with respect to a Chinese product that causes or threatens market disruption to a like U.S. Product Requires the President to provide import relief from Chinese products that cause or threaten market disruption to a like U.S. product within a specified time if an agreement is not reached with the People's Republic of China (PRC) or if the President determines that an agreement reached with the PRC is not remedying the market disruption. Authorizes the President to provide import relief (including provisional relief in critical circumstances) that differs from that recommended by the ITC, or to deny such import relief only: (1) in extraordinary cases; and (2) if the President determines that providing such relief would cause serious harm to U.S. economic interests or to U.S. national security. Requires the President's decision on import relief to be reported to specified congressional committees. Requires import relief recommended by the ITC to take effect upon enactment of a congressional joint resolution in the event that the President: (1) takes action that differs from that recommended by the ITC; or (2) declines to provide import relief (including that recommended by the ITC) because it would cause serious harm to U.S. economic interests or to U.S. national security.

Housing Fairness Act of 2009 - Instructs the Secretary of Housing and Urban Development to conduct, and report to Congress on, a nationwide testing program to: (1) detect and document differences in the treatment of persons seeking to rent or purchase housing or obtain or refinance a home mortgage loan; (2) measure patterns of adverse treatment because of the race, color, religion, sex, familial status, disability status, or national origin of a renter, home buyer, or borrower; and (3) measure the prevalence of such discriminatory practices across housing and mortgage lending markets. Amends the Housing and Community Development Act of 1987 to reauthorize the fair housing initiatives program. Expresses the sense of Congress that the Secretary should: (1) fully comply with such Act's requirements to establish, design, and maintain a national education and outreach program for the development and dissemination of the fair housing rights of individuals who seek to rent, purchase, sell, or facilitate the sale of a home; (2) use all amounts appropriated for such program; and (3) promulgate regulations on the fair housing obligations of each recipient of federal housing funds to affirmatively further fair housing. Directs the Secretary to implement a competitive matching grant program to assist private nonprofit organizations in: (1) conducting comprehensive studies of specified aspects of the causes and effects of housing discrimination and segregation; and (2) implementing pilot projects that test solutions to help prevent or alleviate housing discrimination and segregation.

Equity in Prescription Insurance and Contraceptive Coverage Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and PHSA to prohibit a group health plan from excluding or restricting benefits for prescription contraceptive drugs, devices, and outpatient services if the plan provides benefits for other outpatient prescription drugs, devices, or health care services. Applies such prohibitions to coverage offered in the individual market. Emergency Contraception Education Act of 2009 - Directs the Secretary of Health and Human Services to develop and disseminate information on emergency contraception to the public and to health care providers. Compassionate Assistance for Rape Emergencies Act of 2009 - Requires hospitals, as a condition of receiving federal funds, to offer and to provide, upon request, emergency contraception to victims of sexual assault. At-Risk Communities Teenage Pregnancy Prevention Act of 2009 - Authorizes the Secretary to award grants for teenage pregnancy prevention programs. Requires the Secretary to award grants for teenage pregnancy prevention research. Truth in Contraception Act of 2009 - Requires that any information concerning the use of a contraceptive provided through specified federally funded education programs be medically accurate and include health benefits and failure rates. Unintended Pregnancy Reduction Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act to expand Medicaid's coverage of family planning services. Responsible Education About Life Act of 2009 - Authorizes the Secretary to make grants to states to conduct sex education programs, including programs that provide education on abstinence and contraception for the prevention of teenage pregnancy and sexually transmitted diseases.

340B Program Improvement and Integrity Act of 2009 - Amends the Public Health Service Act to expand the drug discount program to allow participation as a covered entity by certain: (1) children's hospitals; (2) critical access hospitals; (3) entities providing maternal and child health services, community mental health services, or treatment services for substance abuse; (4) Medicare-dependent, small rural hospitals; (5) sole community hospitals; and (6) rural referral centers. Prohibits enrolled hospitals from obtaining covered outpatient drugs through a group purchasing arrangement. Requires the Secretary of Health and Human Services to establish reasonable exceptions to such requirements, including for drugs unavailable through the program and to facilitate generic substitution when a generic covered drug is available at a lower price. Expands the program to include a drug used in connection with an inpatient or outpatient service by enrolled hospitals. (Currently, only outpatient drugs are covered under the program.) Requires hospitals enrolled in the 340B drug discount program to provide to each state a credit on the estimated annual costs to such hospital of single source and innovator multiple source drugs and noninnovator multiple source drugs provided to Medicaid recipients for inpatient use. Sets forth a formula for calculating the credit. Allows a hospital to avoid paying such credits under certain circumstances. Requires the Secretary to: (1) carry out activities to improve compliance by manufacturers and covered entities with the requirements of the drug discount program; and (2) establish an administrative process for resolving claims by covered entities and manufacturers of violations of such requirements. Requires manufacturers to offer each covered entity covered drugs for purchase at or below the applicable ceiling price if such a drug is made available to any other purchaser at any price.

Public Safety Employer-Employee Cooperation Act of 2009 - Provides collective bargaining rights for public safety officers employed by states or local governments. Directs the Federal Labor Relations Authority to determine whether state law provides specified rights and responsibilities for public safety officers, including: (1) granting public safety employees the right to form and join a labor organization which excludes management and supervisory employees, and which is, or seeks to be, recognized as the exclusive bargaining agent for such employees; and (2) requiring public safety employers to recognize and agree to bargain with the employees' labor organization. Requires the Authority to issue regulations establishing rights and responsibilities for public safety employers and employees in states that do not substantially provide for such public safety employee rights and responsibilities. Directs the Authority, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a voting majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrator's awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of Authority regulations and orders, as well as prohibitions against lockouts or strikes, through appropriate state courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts or strikes. Provides that existing collective bargaining units and agreements shall not be invalidated by this Act.

(Under current law, best prices shall not take into account prices that are merely nominal in amount.) Revises the list of entities to which sales by a manufacturer of covered outpatient drugs at nominal prices shall be considered to be sales at a nominal price, or merely nominal in amount (and thus excluded from computation of the best price for such drugs). Adds to such list any entity that is: (1) operated by a health center of an institution of higher education, primarily for its students (university-based clinic); or (2) a public or private nonprofit entity that provides family planning services under the Public Health Service Act (safety-net clinic).

Drug Sentencing Reform and Cocaine Kingpin Trafficking Act of 2009 - Amends the Controlled Substances Act and the Controlled Substances Import and Export Act to increase the amount of a controlled substance or mixture containing a cocaine base (i.e., crack cocaine) required for the imposition of mandatory minimum prison terms for crack cocaine trafficking to eliminate the sentencing disparity between crack and powder cocaine. Eliminates the five-year mandatory minimum prison term for first-time possession of crack cocaine. Directs the U.S. Sentencing Commission to review and amend, if appropriate, its sentencing guidelines for trafficking in a controlled substance to reflect the use of a dangerous weapon or violence in such crime and the culpability and the role of the defendant in such crime, taking into account certain aggravating and mitigating factors. Directs the Attorney General to make grants to improve drug treatment to offenders in prisons, jails, and juvenile facilities. Authorizes the Attorney General to make grants to establish demonstration programs to reduce the use of alcohol and other drugs by substance abusers while incarcerated and until the completion of parole or court supervision. Increases monetary penalties for drug trafficking and for the importation and exportation of controlled substances. Authorizes appropriations to the Departments of Justice (DOJ), the Treasury, and Homeland Security (DHS) for FY2009-FY2010 for the prosecution of, and for supporting the prosecution of, high-level drug offenses.

Shark Conservation Act of 2009 - Amends the High Seas Driftnet Fishing Moratorium Protection Act to direct the Secretary of Commerce to list a nation in the biennial report on international compliance if the nation's fishing vessels are or have been engaged in fishing activities that target or incidentally catch sharks and the nation has not adopted a shark conservation program that is comparable, taking into account different conditions, to that of the United States, including measures to prohibit removal any of the fins of a shark (including the tail) and discarding the carcass of the shark at sea. Amends the Magnuson-Stevens Fishery Conservation and Management Act to revise provisions prohibiting the removal of shark fins to make it a prohibited act to: (1) remove any shark fin (including the tail) at sea; (2) have a fin aboard a fishing vessel unless the fin is naturally attached to the carcass; (3) transfer a fin from one vessel to another or receive a fin unless it is naturally attached; or (4) land a fin that is not naturally attached to a carcass or land a carcass without fins naturally attached. Revises the current rebuttable presumption provision concerning shark fins on fishing vessels to create a rebuttable presumption that, if any shark fin (including the tail) is aboard a non-fishing vessel without being naturally attached, the fin was transferred from a fishing vessel in violation.

Requires a state seeking a grant to carry out its activities through a lead entity to be known as a 2-1-1 Collaborative. Requires grant amounts to be used solely to make available to a state 2-1-1 telephone service for community information and referral on human services to all citizens of that state with phone access, including telephone connections between families and individuals seeking services and the service providers. Requires grant recipients to: (1) abide by the Key Standards for 2-1-1 Centers; and (2) collaborate with human service organizations to provide an exhaustive database of services with which to provide information or referral to individuals utilizing the 2-1-1 service.

Lilly Ledbetter Fair Pay Act of 2009 - Amends the Civil Rights Act of 1964 to declare that an unlawful employment practice occurs when: (1) a discriminatory compensation decision or other practice is adopted; (2) an individual becomes subject to the decision or practice; or (3) an individual is affected by application of the decision or practice, including each time wages, benefits, or other compensation is paid. Allows liability to accrue, and allows an aggrieved person to obtain relief, including recovery of back pay, for up to two years preceding the filing of the charge, where the unlawful employment practices that have occurred during the charge filing period are similar or related to practices that occurred outside the time for filing a charge. Applies the preceding provisions to claims of compensation discrimination under the Americans with Disabilities Act of 1990 and the Rehabilitation Act of 1973. Directs the Secretary of the Treasury to make specified payments to: (1) living Guam residents who were raped, injured, interned, or subjected to forced labor or marches resulting from, or incident to, such occupation and subsequent liberation; and (2) survivors of compensable residents who died in war or survivors of compensable injured residents (such payments to be made after payments have been made to surviving Guam residents). Defines "compensable Guam decedent" and "compensable Guam victim." Directs the Foreign Claims Settlement Commission to specify injuries that would constitute a severe personal injury or a personal injury. Authorizes the Commission to adjudicate claims and determine payment eligibility. Requires: (1) claims to be filed within one year after the Commission publishes public notice of the filing period in the Federal Register; and (2) the Commission to make filing period information available to the public through the media in Guam. Directs the Secretary of the Interior to establish a grant program for research, educational, and media activities that memorialize the events surrounding the occupation of Guam during World War II or honor the loyalty of the people of Guam during such occupation, or both.

Excludes from computation of debts the secured or unsecured portions of: (1) debts secured by the debtor's principal residence if the current value of that residence is less than the secured debt limit; or (2) debts secured or formerly secured by debtor's principal residence that was either sold in foreclosure or surrendered to the creditor if the current value of such real property is less than the secured debt limit. Declares the credit counseling requirement inapplicable to a Chapter 13 debtor who certifies that he or she has received notice that the holder of a claim secured by the debtor's principal residence may commence a foreclosure on the debtor's principal residence. Requires the court to disallow a claim that is subject to any remedy for damages or rescission due to violations of state or federal consumer protection law, including the Truth in Lending Act, notwithstanding the prior entry of a foreclosure judgment. Allows modification of the rights of claim holders, in the event of a foreclosure notice for a chapter 13 debtor, among other means by: (1) reducing a claim to equal the value of the debtor's interest in the residence securing such claim, and any adjustments to a related adjustable rate of interest; (2) waiving early repayment or prepayment penalties; and (3) extending the repayment period. Denies debtor liability for certain fees and charges incurred while the bankruptcy case is pending and arising from a debt secured by the debtor's principal residence, unless the claim holder observes specified requirements. Adds to conditions for court confirmation of a plan in bankruptcy that: (1) the holder of a claim secured by the debtor's principal residence retain the lien securing the claim until the later of the payment of such claim as reduced and modified or the discharge of a debtor from all debts; and (2) the plan modifies the claim in good faith. Excludes from final discharge of a debtor from all debts: (1) any payments to claim holders whose rights are modified under this Act; and (2) any unpaid portion of a claim as reduced.

Makes it unlawful for a person to import, export, transport, sell, receive, acquire, or purchase a live animal of any prohibited wildlife species in interstate or foreign commerce (i.e., for pet trade purposes). Sets forth exceptions to such prohibition, including, under certain conditions, for: (1) transporting a nonhuman primate to or from a veterinarian; (2) transporting a nonhuman primate to a legally designated caregiver as a result of the death of the preceding owner; and (3) transporting a single primate of the genus Cebus that was obtained from and trained by a charitable organization to assist a permanently disabled individual with a severe mobility impairment. Sets forth civil and criminal penalties for violations of the requirements of this Act. Extends the authorization of appropriations to carry out such prohibition for FY2010-FY2014. Authorizes appropriations to the Secretary for FY2010 to hire additional law enforcement personnel of the United States Fish and Wildlife Service to enforce the Lacey Act Amendments of 1981.

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation; (2) is job-related with respect to the position in question; and (3) is consistent with business necessity. Avers that such defense shall not apply where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential; and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer has made substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey; (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity; and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Directs the Comptroller General to conduct a full audit of the Federal Reserve System in every year before a presidential election year. Directs the Board to: (1) publish a quarterly and annual summary of total credit market debt; (2) release the statistics required to be compiled by this Act at a quarterly news conference; and (3) the survey of consumer finances and the total credit market debt report at an annual news conference.
