Federal Employees Paid Parental Leave Act of 2008 - Allows federal employees to substitute any available paid leave for any leave without pay available for either the: (1) birth of a child; or (2) placement of a child with the employee for either adoption or foster care. Makes available for any of the 12 weeks of leave an employee is entitled to for such purposes: (1) eight administrative weeks of paid parental leave in connection with the birth or placement involved; and (2) any accumulated annual or sick leave. Amends the Congressional Accountability Act of 1995 to allow the same substitution for covered congressional employees. Amends the Family and Medical Leave Act of 1993 to allow the same substitution for Government Accountability Office (GAO) and Library of Congress employees. Requires GAO to study and report on the feasibility and desirability of providing an insurance benefit to federal employees which affords partial or total wage replacement with respect to periods of qualified leave. Defines "qualified leave" as leave that: (1) is available by reason of the need to care for the spouse, child, or parent of the employee having a serious health condition or by reason of a serious health condition affecting the employee that renders such employee unable to perform the functions of his or her position; and (2) would otherwise be leave without pay.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Ensuring Continued Access to Student Loans Act of 2008 - Amends the Higher Education Act of 1965 to increase the maximum annual and aggregate unsubsidized Stafford loan amounts that may be provided to undergraduate and graduate students under the Federal Family Education Loan (FFEL) program. Gives parent borrowers of PLUS FFELs the option to defer loan principal repayment for up to six months after the students for whom such loans are borrowed cease to carry at least one-half the normal full-time academic workload. Authorizes lenders, for loans made from July 2008 through June 2009, to determine that borrowers of PLUS loans under the FFEL or Direct Loan programs who are up to 180 days delinquent on their home mortgages meet a specified extenuating circumstances requirement which makes them eligible for such loans despite having an adverse credit history. Includes parent borrowers in the FFEL lender-of-last-resort program for borrowers otherwise unable to obtain such loans. Allows institutions of higher education (IHEs) to participate in such program, thereby requiring guaranty agencies serving as lenders-of-last-resort to make FFELs to student and parent borrowers of such IHEs regardless of their ability to otherwise obtain such loans. Authorizes the Secretary of Education to advance needed funds to guaranty agencies acting as lenders-of-last-resort in such situations. Gives the Secretary the authority, until July 2009, to purchase FFELs from lenders upon the determination that there is an inadequate availability of loan capital to meet the demand for such loans. Prohibits such loan purchases from resulting in any cost to the federal government. Expresses the sense of Congress that the federal financial institutions should consider using available authorities in a timely manner, if needed, to enhance student and family access to federal student loans in a manner that results in no increased costs to taxpayers.

Recognizes and commends the Alvin Ailey American Dance Theater for 50 years of service as a cultural ambassador of the United States to the world, during which it has provided world-class American modern dance to people across the globe. Recognizes that: (1) Alvin Ailey American Dance Theater has been a true pioneer in the world of dance by establishing an extended cultural community which provides dance performances, training, and community programs for all people while using the beauty and humanity of African-American heritage and other cultures to unite people; and (2) the Ailey II company, the Ailey School, and the extensive and innovative Arts in Education and Community Programs train future generations of dancers and choreographers while exposing young people to the arts.

Recognizes: (1) National Public Health Week; (2) the efforts of public health professionals, first responders, states, municipalities, and local communities to incorporate measures to adapt health care systems to address impacts of climate change; and (3) the role of adaptation in preventing impacts of climate change on vulnerable communities, the improvement of health status and equity through efforts to address climate change, and the need to include health policy in the development of climate responses. Encourages: (1) further research, interdisciplinary partnership, and collaboration to understand and monitor the health impacts of climate change, for preparedness activities, and for improvement of health care infrastructure; and (2) every American to learn about the impact of climate change on health.

Smuggled Tobacco Prevention Act of 2008 - Amends the Internal Revenue Code to require manufacturers and importers of tobacco products to legibly print a unique serial number on all packages of tobacco products manufactured or imported for sale or distribution. Imposes marking requirements for exports of tobacco products. Authorizes the Secretary of the Treasury to require additional secure methods of identification or marking of tobacco products. Requires the Secretary to prescribe a system of tobacco tax stamps, meter impressions, or other tax-payment indicia for tobacco products. Requires tobacco products sold on Indian reservations to be visibly and prominently labeled as such. Prohibits the export of tobacco products without the posting of a bond with the Secretary. Extends permit, recordkeeping, and reporting requirements to wholesalers of tobacco products. Establishes new criminal offenses relating to the distribution of tobacco products. Increases the civil penalty for tobacco-related infractions from $1,000 to $10,000. Amends the federal criminal code to: (1) extend criminal penalties for contraband cigarettes to tobacco products (i.e., cigars, cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own tobacco) and define "contraband tobacco product" for purposes of such penalties; (2) establish new unlawful acts relating to tobacco products and machines used to manufacture or package tobacco products; and (3) establish whistleblower protections for employees who provide information about violations relating to contraband tobacco.

Infant Crib Safety Act - Amends the Federal Hazardous Substances Act to make it unlawful for any commercial user to manufacture, sell, or otherwise place in the stream of commerce any full-size or nonfull-size crib which was made before 1999, does not conform to the standards of this Act, or has any missing, loose, or broken components. Makes it unlawful for any hotel, motel, or similar lodging facility to offer or provide such a crib. Considers to be a banned hazardous product under the Consumer Product Safety Act any crib which does not conform to specified regulations in the Code of Federal Regulations and standards of the American Society for Testing Materials, unless labeled as not intended to be used for, and dangerous to, an infant. Requires the Consumer Product Safety Commission (CPSC) to begin a rulemaking to include the requirements of the American Society for Testing Materials standards and to address any hazards due to crib and play yard durability. Requires the CPSC to promulgate a consumer product safety rule to require that cribs manufactured and introduced into interstate commerce contain a label warning consumers against the use of soft bedding. Includes in the definition of commercial user any person who manufactures or sells cribs or, by his or her occupation holds himself or herself out as having knowledge or skill peculiar to cribs, including child care facilities and family child care homes. Excludes from that definition an individual who sells a used crib at a one-time private sale.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

Physician Payments Sunshine Act of 2008 - Amends part A of title XI of the Social Security Act to require quarterly transparency reports to the Secretary of Health and Human Services of payments to physicians or their employers, or to a covered organization in which a physician has a significant professional membership interest, by manufacturers of covered drugs, devices, or medical supplies under titles XVIII (Medicare), XIX (Medicaid), or XXI (State Children's Health Insurance Program (SCHIP)) of the Social Security Act. Amends the Internal Revenue Code to prohibit tax deductions for the advertising, promotion, or marketing by manufacturers of drugs, devices, and medical supplies on whom a penalty is imposed for failing to meet the requirements of this Act.

Assuring and Improving Cancer Treatment Education and Cancer Symptom Management Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007, to provide for Medicare coverage of comprehensive cancer patient treatment education services. Amends the Public Health Service Act to direct the Director of the National Institutes of Health (NIH) to expand, intensify, and coordinate programs for the conduct and support of research with respect to: (1) improving the treatment and management of symptoms and side effects associated with cancer and cancer treatment; and (2) evaluating the role of nursing interventions in the amelioration of such symptoms and side effects. Requires the NIH Director to make nursing intervention research grants for studying cancer symptom management care and services delivered by registered nurses. Directs the Secretary of Health and Human Services to enter into an arrangement under which the Institute of Medicine of the National Academy of Sciences shall evaluate and report to the Secretary and Congress on the current state of symptom management, patient treatment education, and supportive care given to people with cancer.

Missing Mercury in Manufacturing Monitoring and Mitigation Act - Declares that the United States should develop policies and programs that will reduce: (1) mercury use and emissions; (2) mercury releases from the reservoir of mercury currently in use or circulation; and (3) exposures to mercury, particularly of women of childbearing age and young children. Amends the Toxic Substances Control Act to prohibit the manufacture of chlorine or caustic soda using mercury cells, effective January 1, 2012. Requires the owner or operator of each chlor-alkali facility to submit to the Environmental Protection Agency (EPA) Administrator and the state in which the facility is located an annual report for 2009-2012 concerning mercury waste, emissions, and content in products. Requires the Administrator to : (1) conduct a comprehensive mercury inventory covering the life and closure of chlor-alkali facilities that cease operations on or after January 1, 2009; and (2) obtain mercury purchase records and such other information from each such facility as are necessary to determine the magnitude and nature of mercury releases from the facility into air and other environmental media.

Directs the Secretary of Commerce, acting through the Under Secretary for Oceans and Atmosphere, to prescribe regulations to reduce the incidence of vessels colliding with North Atlantic right whales by limiting the speed of vessels. Requires those regulations to incorporate the whale protection measures contained in a specified proposed rule and to provide the same or greater level of protection.

Bear Protection Act of 2008 - Amends the Lacey Act Amendments of 1981 to make it unlawful for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce bear viscera. Defines "bear viscera" as the body fluids or internal organs of a bear, including its gallbladder and excluding its blood or brains. Provides that this Act does not affect the regulation by any state of its bear populations or affect the hunting of bears that is lawful under state laws.

Combustible Dust Explosion and Fire Prevention Act of 2008 - Requires the Secretary of Labor to promulgate, within 90 days, an interim final standard and, within 18 months, a final occupational safety and health standard regulating combustible dusts, which shall apply to manufacturing, processing, blending, conveying, repackaging, and handling of combustible particulate solids and their dusts (including food, plastics, wood, rubber, furniture, textiles, pesticides, pharmaceuticals, fibers, dyes, coal, metals, and fossil fuels power), but shall not apply to processes already covered by the Occupational Safety and Health Administration's (OSHA) standard on grain facilities. Requires such standard to provide no less protection than the recommendations contained in the National Fire Protection Association's Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids-2006 (NFPA 654) and Standard for Combustible Metals-2006 (NFPA 484). Requires such standard to provide requirements for: (1) a combustible dust hazard assessment; (2) a written program which includes plans for hazardous dust inspection, testing, housekeeping, and control, with established frequency and methods; (3) engineering, administrative controls and operating procedures, such as means to controlling fugitive dust emissions and ignition sources, the use of dust collection systems and filters, minimizing horizontal surfaces where dust can accumulate, and sealing of areas inaccessible to housekeeping; (4) managing change of dust producing materials, technology, equipment, staffing, and procedures; (5) housekeeping to control accumulation of combustible dust; (6) building design; (7) explosion protection; (8) employee participation in hazard assessment, development of and compliance with the written program, and other elements of hazard management in this standard; and (9) providing safety and health information and training to employees. Requires the Secretary, through OSHA, to modify the hazard communications standard to: (1) revise the definition of "physical hazard" to include "a combustible dust" as an additional example of a physical hazard; and (2) define "combustible dust" as a combustible particulate solid or finely divided metal that presents a fire or deflagration hazard when suspended in air or some other oxidizing medium over a range of concentrations regardless of particle size and shape.

Recovery and Stability of Iraq Act of 2008 - Establishes within the Executive Office of the President the position of Iraqi Displacement Coordinator who shall identify programs that address the humanitarian needs of displaced Iraqis and who shall advise and coordinate with the heads of appropriate U.S. departments and agencies, the government of Iraq, countries hosting displaced Iraqis in the region, the United Nations, and other involved nongovernmental and international organizations. Directs the Coordinator to: (1) design a comprehensive strategy to address the needs of displaced Iraqis; and (2) encourage the government of Iraq to develop a long-term plan for the voluntary and safe return of displaced Iraqis to their homes.

Strategic Petroleum Reserve Fill Suspension and Consumer Protection Act of 2008 - Directs the Secretary of Energy to suspend, during calendar year 2008, petroleum acquisition for the Strategic Petroleum Reserve (SPR) through the royalty-in-kind program or any other acquisition method. Authorizes resumption of such acquisition during calendar 2008 not earlier than 30 days after the Secretary notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $50 or less per barrel.

Dorothy I. Height and Whitney M. Young, Jr. Social Work Reinvestment Act - Directs the Secretary of Health and Human Services to establish the Social Work Reinvestment Commission to provide independent counsel to Congress on policy issues associated with the recruitment, retention, research, and reinvestment in the profession of social work. Directs the Commission to study and report to Congress on issues facing the social work profession, including: (1) fair market compensation, high social work educational debt, social work workforce trends, knowledge development, and social work safety; and (2) state-level social work licensure and reciprocity agreements for providing services across state lines. Authorizes the Secretary to award various grants to eligible entities to support demonstration programs and other activities related to research, workplace improvements, education, training, and programs of excellence. Directs the Secretary to: (1) contract with a national social work research entity to serve as a coordinating center and clearinghouse for information on activities under the demonstration program; and (2) develop and issue public service announcements that advertise and promote the social work profession. Expresses the sense of Congress that the President should designate a National Social Work Awareness month.

Provides that, if the federal medical assistance percentage (FMAP) determined under title XIX (Medicaid) of the Social Security Act without regard to this Act for a state for FY2008 is less than the FMAP as so determined for FY2007, the FY2007 FMAP shall be substituted for the FMAP for the third and fourth calendar quarters of FY2008, before the application of this Act. Provides that, if the FMAP determined without regard to this Act for a state for FY2009 is less than the FMAP as so determined for FY2008, the FY2008 FMAP shall be substituted for the FMAP for the first, second, and third calendar quarters of FY2009, before the application of this Act. Provides that, for each eligible state for the third and fourth calendar quarters of FY2008, and for the first, second, and third calendar quarters of FY2009, the FMAP shall be increased by 2.95 percentage points. Provides for an increase in the cap on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Declares that, only for FMAP computation purposes, any significant disproportionate employer pension or insurance fund contribution shall be disregarded in computing the per capita income of a state, but not in computing the per capita income for the continental United States (and Alaska) and Hawaii.

Credit Cardholders' Bill of Rights Act of 2008 - Amends the Truth in Lending Act to prohibit a creditor from using certain adverse information, including information in a consumer report or any change in a consumer's credit score, as the basis for increasing any annual percentage rate (APR) of interest on the consumer's outstanding balance under an open end consumer credit plan, except for actions or omissions of the consumer directly related to such account. (Thus eliminates the universal default for credit already outstanding.) Bars a creditor from changing any term of the contract or agreement of an open end consumer credit plan until contract renewal, except for specific material reasons already contained in the contract or agreement. Requires advance notice of credit card account rate increases. Authorizes a consumer who receives such notice to: (1) cancel the credit card without penalty or the imposition of any fee; and (2) pay any outstanding balance that accrued before the effective date of the increase at the APR and in the repayment period in effect before notice was received. Prohibits a creditor from imposing interest on credit repaid within the interest-free repayment time period. (Thus prohibits double cycle billing). Prohibits the imposition of fees on any outstanding balance on a credit card account attributable only to accrued interest on previously repaid credit. Requires each periodic statement of account to provide specified information on obtaining the payoff balance. Prohibits a creditor from furnishing information to a consumer reporting agency concerning a newly opened credit card account until the consumer has used or activated the credit card. Details mandatory pro rata payment allocations by a creditor. Authorizes a consumer to opt-out of creditor authorization of over-the-limit transactions if fees are imposed. Restricts the frequency of over-the-limit fees. Specifies the contents of credit card price and availability information the Board of Governors of the Federal Reserve System must collect and make public semiannually. Prescribes a standard for the initial issuance of subprime or "fee harvester" cards (accounts requiring first-year fee payments in excess of 25% of the total amount of credit authorized).

Automobile Arbitration Fairness Act of 2008 - Amends federal arbitration law to require that a controversy arising out of a motor vehicle consumer sales or lease contract, including a refusal to perform all or any part of such contract, may not be settled by arbitration unless, after the controversy arises, all parties to it agree in writing to settle it by arbitration.

Combat Veterans Debt Elimination Act of 2008 - Prohibits the Secretary of Veterans Affairs from collecting debts owed to the United States by certain veterans who die as a result of a service-connected disability incurred or aggravated on active duty in a war after the Persian Gulf War or a combat zone after September 11, 2001, if the Secretary determines, in his or her discretion, that the termination of collection is in the best interest of the United States. Excepts any amounts owed the United States under federal housing and small business loan programs from such prohibition on debt collection.

States that any formal agreement emerging from the "Declaration of Principles for a Long-term Relationship of Cooperation and Friendship Between the Republic of Iraq and the United States of America" shall not have the effect of force of law unless the agreement is approved by Congress after the date of enactment of this Act. Expresses the sense of Congress that any formal agreement emerging from such Declaration must be approved by the Iraqi legislature. Prohibits funds appropriated or otherwise made available to the Department of Defense (DOD) or any other U.S. department or agency from being used to enforce or implement any formal agreement emerging from such Declaration unless the agreement is approved by Congress.

Civil Rights Act of 2008 - Amends the Civil Rights Act of 1964, the Education Amendments of 1972, and the Age Discrimination Act of 1975 to set forth requirements for: (1) establishing discrimination based on disparate impact; and (2) rights of action and recovery for unlawful discrimination (intentional or based on disparate impact). Amends those Acts and the Rehabilitation Act of 1973 to set forth requirements regarding a right of recovery for harassment. Amends the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), the Age Discrimination in Employment Act of 1967 (ADEA), and the Fair Labor Standards Act of 1938 (FLSA) to provide that a state's receipt or use of federal financial assistance for a state program or activity constitutes a waiver of sovereign immunity for a suit by a program employee. Amends the Air Carrier Access Act of 1986 to authorize civil actions in federal court for discrimination based on disability. Settlement Encouragement and Fairness Act - Modifies the definition of "prevailing party" for purposes of provisions governing the recovery of attorney's fees to include a party whose pursuit of a non-frivolous claim or defense was a catalyst for a voluntary or unilateral change in position by the opposing party that provides any significant part of the relief sought. Preservation of Civil Rights Protections Act of 2008 - Makes arbitration clauses in employment contracts unenforceable, with exceptions. Authorizes recovery of expert fees by prevailing parties in civil rights actions. Equal Remedies Act of 2008 - Repeals provisions limiting the amount of compensatory and punitive damages that may be awarded in cases of intentional discrimination in employment. Amends the FLSA to revise provisions governing discrimination in the payment of wages, including equal pay requirements. Amends the Immigration and Nationality Act to prohibit denying back-pay or other monetary relief for unlawful employment practices against undocumented immigrant workers. Applies specified provisions of this act to violations pending as of enactment or occurring prior to enactment.

Iran Diplomatic Accountability Act of 2008 - Directs: (1) the President to appoint a high-level U.S. representative or special envoy for Iran for the purpose of easing tensions and normalizing relations between the United States and Iran; and (2) the Secretary of State to establish a Department of State office to support the work of such representative or special envoy.

Expresses support for: (1) the goals and ideals of National Black HIV/AIDS Awareness Day; (2) full and equitable funding for the Ryan White HIV/AIDS Treatment Modernization Act of 2006; (3) development of a national AIDS plan to reduce new HIV infections; (4) appropriate funding for HIV/AIDS prevention and treatment; (5) the strengthening of stable African-American communities; (6) reducing the impact of incarceration as a driver of new HIV infections within the African-American community; (7) HIV prevention education programs to promote the early identification of HIV through voluntary routine testing and to connect those in need to treatment as early as possible; (8) reducing the number of HIV infections in the African-American community resulting from injection drug use; and (9) efforts to link those infected with HIV to accessible care and treatment options. Applauds the codification of the Minority AIDS Initiative within the reauthorization of the Ryan White CARE Act.

Emergency Unemployment Compensation Act of 2008 - Provides for federal-state agreements during a period of rising unemployment under which a state will pay emergency unemployment compensation to individuals who: (1) have exhausted all rights to regular compensation under state or federal law for a benefit year (excluding any benefit year that ended before March 1, 2007); (2) have no rights to regular compensation or extended compensation with respect to a week under such law or any other state unemployment compensation law or to compensation under any other federal law; and (3) are not receiving compensation for such week under the unemployment compensation law of Canada. Requires federal payments to states to cover 100% of such temporary extended unemployment compensation payments. Provides for federal-state agreements for increased regular unemployment compensation payments to certain individuals. Amends the Social Security Act to provide for special transfers to state accounts in the Unemployment Trust Fund for unemployment compensation modernization incentive payments and for administration.

Domestic Partnership Benefits and Obligations Act of 2007 - Provides that a federal employee and his or her domestic partner shall be entitled to benefits available to, and shall be subject to obligations imposed upon, a married federal employee and his or her spouse. Defines "domestic partner" to mean an adult unmarried person living with another adult unmarried person of the same sex in a committed, intimate relationship. Defines "benefits" to include federal health insurance and enhanced dental and vision benefits, retirement and disability benefits, family, medical, and emergency leave, group life insurance, long-term care insurance, compensation for work injuries, and benefits for disability, death, or captivity. Excludes members of the uniformed services from the definition of "employee." Sets forth requirements for filing: (1) an affidavit of eligibility as such a domestic partner, which shall include a certification that the employee and the domestic partner are each other's sole domestic partners and intend to remain so indefinitely; and (2) a statement upon dissolution of such a domestic partnership.

Amends the Federal Law Enforcement Pay Reform Act of 1990 to revise the special pay adjustments for (percentage differentials payable to) federal law enforcement officers in specified consolidated metropolitan statistical areas. Includes Capitol Police as law enforcement officers under such Act. Eliminates the limitation on the aggregate of basic pay and premium pay with respect to availability pay for federal criminal investigators.
