Women and Children in Conflict Protection Act of 2003

Women and Children in Conflict Protection Act of 2003 - Directs the Secretary of State to: (1) develop a strategy for the protection of women and children who are affected by a complex humanitarian emergency (a situation occurring outside the United States and caused by armed conflict, natural disaster, food shortage, or state-sponsored harassment or persecution, which results in a significant number of refugees, internally displaced persons, or other civilians requiring urgent basic humanitarian assistance) (emergency); and (2) designate coordinators to implement such strategy. Requires such coordinators to: (1) maintain and disseminate a database of information on gender-based violence or exploitation of children during an emergency; (2) assist embassies and consular posts in responding to such risks; and (3) establish a gender-based violence or exploitation reporting and monitoring system for U.S. diplomatic missions and consular posts. Prohibits any State Department refugee or migration assistance from being provided to an organization that has failed to adopt a code of conduct regarding the protection of beneficiaries of humanitarian assistance that incorporates six core principles (established herein) against sexual exploitation and abuse as recommended by the Inter-Agency Standing Committee. Requests all national, multilateral, and nongovernmental agencies to review and revise their administrative, management, and employment practices in refugee and displaced persons camps. Requires each coordinator to: (1) ensure that U.S.-funded organizations that respond to an emergency have the necessary resources to address the specific health needs of women affected by the emergency; and (2) identify an organization or individual to facilitate the coordination and implementation of such activities. Directs the Secretary to urge the United Nations High Commissioner for Refugees to work with nongovernmental organizations to design and implement a model whistleblower system under which humanitarian workers, refugees, and internally displaced persons can report instances of gender-based violence or exploitation of children. Requires: (1) the State Department to work with certain entities to ensure that, in situations of long-term displacement, refugees and internally displaced persons are granted work permits and other documentation to enable them to generate legitimate income; and (2) a report from the Secretary on the development of protection initiatives for the prevention of gender-based violence and exploitation of children. Directs the Secretary to: (1) develop and implement programs to assist communities that have been affected by an emergency and former combatants (women or children affiliated with an armed group); and (2) report on all current programs to assist nations to reconstitute civilian police authority and capability following an emergency. Amends the Foreign Assistance Act of 1961 to authorize the President to provide assistance to promote the security of, provide equal access to basic services for, and safeguard the human rights and dignity of civilian women and children who are refugees, displaced persons, or inhabitants of areas affected by an emergency.

Calls on the President to implement and observe all NPT obligations and commitments and to revise national policies on nuclear weapons accordingly. Urges the President, in the interests of protecting and advancing human, national, and global security, to: (1) declare unconditionally that the United States will not use nuclear weapons first, and that pending their elimination, such weapons serve only to deter a nuclear attack by a hostile state or other entity; (2) initiate and conclude multilateral negotiations on verifiable steps nuclear states, including the United States, shall take to reduce and eventually eliminate nuclear weapons; (3) cooperate with the Russian Federation to remove from deployment nuclear weapons that are operational; (4) reaffirm the moratorium on nuclear testing and work for ratification of the Comprehensive Test Ban Treaty; and (5) terminate all efforts to enhance U.S. military capabilities of the U.S. nuclear arsenal and to develop ballistic missile defenses.

Medicare Extension of Drugs to Seniors (MEDS) Act of 2003 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new part D (Prescription Medicine Benefit for the Aged and Disabled) establishing a voluntary insurance program to provide prescription medicine benefits, including pharmacy services, for eligible individuals (including low-income individuals) who are aged or disabled or have end-stage renal disease, and who elect to enroll during a prescribed period. Provides that the program shall be financed from monthly premium payments by enrollees together with Federal appropriations. Creates the Prescription Medicine Insurance Account within the Federal Supplemental Medical Insurance Trust Fund. Directs the Secretary of Health and Human Services to develop and implement an Employer Incentive Program that encourages employers to provide adequate prescription medicine benefits to retired individuals and maintain such existing benefit programs. Outlines provisions for substantial reductions in the price of prescription drugs for Medicare beneficiaries. Amends the Federal Food, Drug, and Cosmetic Act, as amended by the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001, with respect to the importation of certain prescription drugs, to revise testing requirements (granting the Secretary certain waiver discretion), and add approved labeling requirements. Requires the recipient of a patent to make a reasonable pricing agreement with the Secretary (or the Secretary to waive such an agreement in the public interest) if any Federal agency or any non-profit entity: (1) undertakes federally funded health care research and development; and (2) is to convey or provide a patent or other exclusive right to use such research and development for a drug or other health care technology.

Prescription Drug Parity for Americans Act - Amends provisions of the Federal Food, Drug, and Cosmetic Act set forth in the Medicine Equity and Drug Safety Act of 2000 to: (1) direct the Secretary of Health and Human Services to promulgate regulations permitting pharmacists and wholesalers to import Food and Drug Administration (FDA)-approved prescription drugs from Canada (currently, from Australia, Canada, Israel, Japan, New Zealand, Switzerland, South Africa, the countries in the European Union and the European Free Trade Association, or other countries designated by the Secretary); and (2) exclude an infused or intravenously injected drug or a drug that is inhaled during surgery. Prohibits discrimination in the sale of prescription drugs by manufacturers to pharmacists or wholesalers, requiring: (1) terms as favorable as those provided to foreign purchasers; and (2) full access to drugs permitted to be imported. Continues the requirement that exported donated prescription drugs may only be reimported by the manufacturer. Permits the Secretary to waive the prohibition against importing a prescription drug or device on a case-by-case basis, particularly those from Canada that are FDA-approved and for limited personal use. Requires a study and report by the: (1) Institute of Medicine of the National Academy of Sciences on the regulatory compliance of importers of drugs; and (2) Comptroller General on how drug prices were affected.

Elder Justice Act - Amends the Social Security Act (SSA) to add a new title XXII (Elder Justice) to establish: (1) within the Department of Health and Human Services (HHS) an Office of Elder Justice; (2) within HHS an Intra-Agency Elder Justice Steering Committee to coordinate HHS elder justice programs and policy; (3) the Elder Justice Coordinating Council to make recommendations for the coordination of activities to HHS, the Department of Justice, and other relevant Federal, State, local, and private agencies and entities; and (4) the Advisory Board on Elder Abuse, Neglect, and Exploitation. Outlines provisions with respect to uniform collection, maintenance, and dissemination of national data relating to elder abuse, neglect, and exploitation. Authorizes the HHS Secretary to award various grants, including grants for: (1) prevention of elder abuse, neglect, and exploitation; (2) five Centers of Excellence nationwide that shall specialize in research, clinical practice, and training relating to elder abuse, neglect, and exploitation; (3) six diverse communities to examine various types of elder shelters and to test various models for establishing safe havens; (4) nonprofit organizations and faith-based organizations to encourage such organizations to establish or continue volunteer programs that focus on the issues of elder abuse, neglect, and exploitation, or that provide related services; and (5) various multidisciplinary elder justice activities. Provides for: (1) reporting to law enforcement of crimes occurring in Federally-funded long-term care facilities; (2) revising the quality of long-term care; and (3) increasing consumer information about long-term care. Amends: (1) SSA titles XVIII (Medicare) and XIX (Medicaid) to establish programs to prevent abuse of skilled nursing facility and nursing facility residents; (2) the Public Health Service Act to increase the number of health care professionals with geriatric training; (3) the Older Americans Act of 1965 with respect to the long-term care ombudsman program; (4) part A (General Provisions) of SSA title XI to establish in HHS the Office of Adult Protective Services; and (5) SSA titles XVIII and XIX to assure safety of residents when nursing facilities close. Establishes in the Department of Justice an Office of Elder Justice. Amends the: (1) Federal criminal code to provide for a cause of action for elder abuse and neglect; and (2) Internal Revenue Code to provide for a long-term care facility worker employment tax credit.

Law Enforcement Officers Equity Act - Redefines the term "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) Federal employees not otherwise covered by such term whose duties include the investigation or apprehension of suspected or convicted individuals and who are authorized to carry a firearm; and (2) such employees of the Internal Revenue Service whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns. Requires that such service which is performed by an incumbent law enforcement officer be treated: (1) on or after the enactment date of this Act, for all purposes, as service performed as a law enforcement officer, irrespective of how such service is treated under the following; and (2) before, on, or after such date, for purposes of CSRS and FERS, as service performed as such an officer, but only if an appropriate written election is submitted to the Office of Personnel Management five years after such date or before separation from Government service, whichever is earlier. Provides that nothing under current law respecting mandatory separation from Government service under CSRS or FERS shall cause the involuntary separation of an officer before the end of the three-year period beginning on such date.

Medicines to Eliminate Diseases in Developing States Act or MEDDS Act - Requires the Secretary of the Treasury, the Administrator of the U.S. Agency for International Development (USAID), and the U.S. Trade Representative (USTR) to encourage developing countries and pharmaceutical companies to make medicines for HIV/AIDS and other diseases available without charge or at affordable prices in developing countries. Prohibits agencies from obligating or expending Federal funds to seek the revocation or revision of any intellectual property or competition law or policy of a developing country that regulates medicines for HIV/AIDS and other diseases, if the law or policy promotes access to such medicines for the population of the country. Prohibits the USTR from initiating a proceeding in the World Trade Organization (WTO) challenging any law or policy of a developing country that promotes such access. Requires the President to direct the U.S. respresentative to the WTO to urge the WTO to exempt developing countries from the application of any provision of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) or other trade agreements that would prohibit or restrict those countries from establishing law or policy promoting access to medicines for HIV/AIDS and other diseases for their populations, and to support full implementation of the Declaration on the TRIPS Agreement and Public Health. Requires the USTR to oppose the inclusion in future trade agreements of any provision that would prohibit or otherwise restrict developing countries from establishing or implementing the laws or policies encouraged by this Act.

Surveillance Oversight Act and Disclosure Act of 2003 - Amends the Foreign Intelligence Surveillance Act (FISA) to authorize courts established to hear applications, grant orders, and review denials regarding electronic surveillance to establish rules and procedures and take actions necessary to administer their responsibilities under FISA. Directs that such rules and procedures be transmitted to the judges on such courts, the Chief Justice of the United States, and specified congressional committees. Requires the Attorney General to issue a public report annually on the aggregate number of U.S. persons targeted for FISA orders, the aggregate number of applications for orders for U.S. persons and for all persons without regard to nationality, and the number of times that the Attorney General has authorized that such information be used in a criminal proceeding. Amends: (1) the Federal criminal code to require that the semiannual report of the Director of the Federal Bureau of Investigation (FBI) to the intelligence and judiciary committees concerning requests for access to telephone and transactional records include a separate statement of requests made of institutions operating as public libraries or serving as libraries of secondary schools or institutions of higher education; (2) the Right to Financial Privacy Act of 1978 to require that the Attorney General's semiannual report regarding requests for financial records go to the judiciary committees; and (3) the Fair Credit Reporting Act to require that the Attorney General's semiannual report regarding disclosures by credit reporting agencies to the FBI be made to the judiciary committees.

Pharmaceutical Market Access Act of 2003 - Amends the Federal Food, Drug and Cosmetic Act to direct the Secretary of Health and Human Services to promulgate regulations allowing qualifying individuals to import covered products (in addition to pharmacists and wholesalers, whom current law authorizes to import such products). Amends provision pertaining to record keeping regarding imported covered products. States that the Secretary shall not have to store records in cases in which qualifying individuals have imported a covered product. Amends provisions regarding the testing of imported covered products. Declares that specified tests, including ones involving authenticity and degradation of products, shall not be required unless the importer is a wholesaler. Requires such tests to be conducted by the importer unless a product is a prescription drug subject to the provisions of this Act pertaining to counterfeit-resistant packaging. (Currently either the importer or the manufacturer may conduct such tests). Eliminates the sunset date current law establishes for the provisions pertaining to the importation of covered products. Classifies prescription drugs as misbranded if they do not incorporate specified counterfeit -resistant technologies in packaging.

Authorizes State or local educational agencies that are recipients of I-A funds to defer commencing, suspend, or modify their administering functions under such requirements with respect to such program, project or activity. Directs the Secretary of Education to ensure that otherwise applicable negative consequences shall not apply to such recipients because of such actions.

Increases set-aside portion of funds for child care quality under the Child Care and Development Block Grant Act of 1990. Improved Nutrition and Physical Activity Act - IMPACT Act - Amends the Public Health Service Act to address issues of overweight and obesity. Expands certain existing grant programs for health professional training to include the treatment of overweight and obesity. Creates grant programs at the local level to promote increased physical activity and improved nutrition. Expands an existing coordinated school health program to include grants for the development of programs which focus on healthy lifestyle, including balanced diet and physical activity. Authorizes the collection and analysis of data concerning the fitness levels of children and youth. Requires a study of the food and nutrition assistance programs run by the Department of Agriculture to determine how they can be improved or altered to help prevent obesity and overweight. Requires an evidence report study on the effectiveness of weight reduction programs. Permits the use of preventive health and health services block grants for community education programs which promote healthy eating and exercise habits. Creates a Medicare demonstration project to reduce obesity and other chronic disease risks in older Americans. Makes grants available to local healthcare delivery systems for overweight and obesity treatment and prevention demonstration programs. Provides grants and contracts for a national youth media campaign to change children's health behaviors. Family and Medical Leave Expansion Act - Family Income to Respond to Significant Transitions Insurance Act - Directs the Secretary of Labor to make grants to a State or local government to pay for the Federal share of the cost of carrying out projects that assist families by providing wage replacement for eligible individuals responding to caregiving needs resulting from the birth or adoption of a son or daughter or other family caregiving needs. Family and Medical Leave Fairness Act of 2003 - Amends the Family and Medical Leave Act of 1993 (FMLA) to extend coverage to employees at worksites where the employer employs at least 25 (currently 50) employees at the worksite and within 75 miles of that worksite. Amends FMLA and Federal civil service law to entitle to leave those employees who must address the effects of domestic violence. Federal Employees Paid Parental Leave Act of 2003 - Permits the Office of Personnel Management to contract with one or more employing agencies to conduct a demonstration project that provides paid leave for eligible individuals who are responding to caregiving needs resulting from the birth or adoption of a son or daughter or other family caregiving needs. Requires the leave to last for at least six weeks during a 12-month period. Time for Schools Act of 2003 - Amends FMLA to allow employees covered by such Act to take up to 24 hours, during any 12-month period, of school involvement leave to participate in: (1) an academic activity of their child's school, such as a parent-teacher conference or an interview for a school; or (2) literacy training under a family literacy program. Amends Federal civil service law to provide the same school involvement leave allowance for Federal employees.

Burmese Freedom and Democracy Act of 2003 - Prohibits the importation into the United States of any article that is produced, mined, manufactured, grown, or assembled in Burma (Myanmar) until the President determines and certifies to Congress that Burma has taken certain democratic and counternarcotics actions. Authorizes the President to waive such requirements. Directs the Secretary of the Treasury to direct any U.S. financial institution holding funds of the State Peace and Development Council (SPDC) of Burma or the assets of individuals who hold senior positions in the SPDC or its political arm, the Union Solidarity Development Association, to report those assets to the Office of Foreign Assets Control and take such action as may be necessary to secure them. Directs the Secretary of the Treasury to instruct the U.S. executive director to each appropriate international financial institution to oppose any extension of a loan or financial or technical assistance to Burma until the requirements of this Act are met. Authorizes the President to deny visas and entry to the former and present leadership of the SPDC or the Union Solidarity Development Association. Urges the Secretary of State to use all appropriate fora, including the Association of Southeast Asian Nations Regional Forum and Asian Nations Regional Forum, to encourage other states to restrict financial resources to the SPDC and Burmese companies while offering support to Burma's democratic movement, including the National League for Democracy and Burma's ethnic groups. Authorizes the President to assist Burmese democracy activists dedicated to nonviolent opposition to the regime in their efforts to promote freedom, democracy, and human rights in Burma.

Expands the definition of a disqualified debt instrument with respect to deduction disallowance on certain debt instruments of corporations. Expands the authority to disallow deductions, credits, or other allowances under provisions disallowing such benefits due to acquisitions made to evade or avoid income tax. Amends provisions affecting passive foreign investment companies to state that the term "qualified portion" (of a shareholder's holding period) does not include any period if there is only a remote likelihood of an inclusion in gross income under subpart F (Controlled Foreign Income). Adds to the definition of the term "real estate investment trust" by stating that such term includes a corporation, trust, or association which is not a controlled entity. Directs the Secretary to establish a program requiring the payment of user fees, until September 30, 2013, for: (1) requests to the Internal Revenue Service for ruling letters, opinion letters, and determination letters; and (2) other similar requests.

Requires the Secretary to reserve certain amounts for research regarding best practices for incubator programs, including the development of a benchmarking system based on uniform measures, and for dissemination of information regarding such practices. Authorizes contracts for such purposes with organizations with expertise in business incubation practices.

Revises audit capacity requirements to require the voting system to produce a voter-verified paper record suitable for a manual audit equivalent or superior to that of a paper ballot box system. Requires the voting system to provide a mechanism for voter-verification of results with respect to individuals with disabilities which separates the function of vote generation from the function of vote casting, but does not require the use of paper. Requires instruction of election officials in the rights of the disabled to vote with the assistance of an aide of their selection under the Voting Rights Act of 1965. Requires the Commission to study and develop best practices to enhance accessibility and voter-verification mechanisms for disabled voters. Accelerates the deadline for compliance with voting systems standards from January 1, 2006, to the regularly scheduled November 2004 general Federal election. Requires each State and jurisdiction unable to meet such deadline to receive a paper voting system at Commission expense that shall be deemed compliant with such standards for use in the November 2004 general election. Requires Federal certification of technological security of voter registration lists. Directs the Commission to: (1) conduct manual mandatory surprise recounts of the voter-verified records of each election for Federal office (and, at State or local option, of elections for State and local office) in .5 percent of the jurisdictions in each State and .5 percent of the overseas jurisdictions in which voter-verified records are preserved in accordance with this Act immediately following each general election for Federal office; and (2) promptly publish the results of those recounts.

Limits a part B grant award's duration to not more than five years. Prohibits the Secretary of Education from awarding more than one part B grant to an HSI in any one fiscal year. Authorizes appropriations for FY 2005 through FY 2009 for: (1) the current part A program of grants to HSIs that offer baccalaureate degrees or are junior or community colleges; and (2) the new part B program of grants to HSIs that offer postbaccalaureate certifications or degrees. Eliminates the requirement that an eligible HSI provide assurances that at least 50 percent of its Hispanic students are low-income students. Includes, among authorized activities under part A grants, articulation agreements and student support programs to help transfers from two-year to four-year institutions. Eliminates the two-year wait-out period between any two five-year part A grants to an HSI.

Prohibits any provision of the Federal Food, Drug, and Cosmetic Act from prohibiting or restricting a State entity, in a State in which marijuana may be prescribed by a physician for medical use, from producing or distributing marijuana for the purpose of its distribution for prescription or recommendation by a physician.

Requires the Director of the Institute of Museum and Library Services to establish specified grant, scholarship, internship, and fellowship programs relating to African American museums. Directs the Board of Regents to select the Museum's site from one of four specified sites on or adjacent to the national mall. Safe Highways and Infrastructure Preservation Act - Amends Federal transportation law to prohibit a State from prescribing or enforcing any regulation that allows a restricted property-carrying unit (any trailer, semi-trailer, container, or other property-carrying unit longer than 53 feet, except for a fire-fighting unit) to operate on the National Highway System (including the Interstate System), unless the operation of such unit is authorized by the State on June 1, 2003, and in actual and lawful operation on a regular or periodic basis (including seasonal operations) on or before that date. Prohibits a State from allowing the operation of a commercial motor vehicle combination on the National Highway System (except a vehicle or load that cannot be dismantled or divided easily, and that has been issued a special permit under State law) with more than one property-carrying unit (excluding the truck tractor) whose property-carrying units are more than: (1) the maximum combination trailer, semi-trailer, or other type of length limitation allowed by State law on June 1, 2003; or (2) the length of the property-carrying units of those commercial motor vehicle combinations, by specific configuration, in actual and lawful operation on a regular or periodic basis (including continual seasonal operation) in such State on or before June 1, 2003. Permits a commercial motor vehicle combination authorized in a State to continue to operate on System highways provided it is in compliance with State law, including routing-specific and configuration-specific designations and all other restrictions in force in the State on June 1, 2003. Amends Federal highway law to prohibit a State from allowing the operation of a vehicle or combination (other than a longer combination vehicle) exceeding Interstate weight limits on the Interstate System unless its operation was lawful: (1) on July 1, 1956; (2) in the case of the overall gross weight of any group of two or more consecutive axles, on the date of enactment of the Federal-Aid Highway Amendments of 1974; or (3) under a special permit pursuant to State (grandfather) law. Subjects such vehicles and combinations to all routing-specific, commodity-specific, and weight-specific designations in force in such State on June 1, 2003. Sets forth requirements with respect to: (1) the operation of vehicles and loads which cannot be easily dismantled or divided (nondivisible loads) on the Federal-aid highway system as they relate to Interstate weight limitations; and (2) waiver of weight limitations for vehicles that operate on the Federal-aid highway system during periods of national emergency. Declares that Interstate weight limitations on vehicles and combinations (other than longer combination vehicles) that operate on the Interstate System shall also apply to such vehicles and combinations that operate on non-Interstate segments of the National Highway System, unless: (1) such segments are subject to lower State weight limits; or (2) a State allows the operation of any vehicle or combination on an existing non-Interstate segment of the National Highway System that could be so operated lawfully on June 1, 2003. Requires establishment of a model schedule of fines for violations of this Act.
