Kids Deserve Freedom from Tobacco Act of 2001 or the KIDS Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for additional restrictions on the marketing, advertising, and access to tobacco products. Comprehensive Insurance Coverage of Childhood Immunization Act of 2001 - Amends ERISA, PHSA, and the Internal Revenue Code (IRC) to outline standards relating to coverage of childhood immunization. Children's Environmental Protection Act - Amends the Toxic Substances Control Act to provide for environmental protection for children and other vulnerable subpopulations. School Environment Protection Act - Amends the Federal Insecticide, Fungicide, and Rodenticide Act to provide for integrated pest management systems for public schools. Directs the Secretary of Health and Human Services (HHS Secretary) to make grants to eligible States to support parenting support and education programs. Family Income to Respond to Significant Transitions Insurance Act - Directs the Secretary of Labor to make grants to pay for the Federal share of projects to provide wage replacement for eligible individuals responding to family caregiving needs, including those resulting from the birth or adoption of a child. Children's Environmental Protection and Right to Know Act - Amends: (1) the Emergency Planning and Community Right-To-Know Act of 1986 with respect to reporting toxic chemicals; and (2) the Federal Hazardous Substances Act to require publication of a list of substances or mixtures determined toxic to children. Amends SSA title IV part D (Child Support and Establishment of Paternity) to provide block grants to States for media campaigns promoting responsible fatherhood. Focus On Committed and Underpaid Staff for Children's Sake Act or the FOCUS Act - Establishes the Child Care Provider Development and Retention Grant Program and the Child Care Provider Scholarship Program. Federal Employees Child Care Act - Provides for child care centers in Federal facilities as well as for child care services for Federal employees. Early Learning Linkages Act of 2001 - Repeals the Early Learning Opportunities Act to replace it with a program of grants by the HHS Secretary to State and Local Councils to provide funds to early childhood learning providers to: (1) increase the number of full-day full-year Head Start programs, and the number of children served by Early Head Start and State prekindergarten education programs; and (2) develop linkages among such programs within a community and between them and health care services for young children in ways that facilitate greater access to such programs. Child Care Facilities Financing Act - Authorizes the Secretary to award grants for the Federal share of the cost of the acquisition, construction, or improvement of child care facilities or equipment. Book Stamp Act - Directs the Secretary to make grants to State agencies to promote child literacy and improve children's access to books at home and in early learning and other child care programs. America's Better Classroom Act of 2001 - Amends the IRC to establish an income tax credit for qualified public school modernization, school construction, and zone academy bonds. Child Opportunity Zone Family Center Act of 2001 - Amends the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to partnerships for child opportunity zone family centers. Tax Relief for Working Families Act of 2001 - Amends the IRC to increase the earned income tax credit for married couples and for two or more qualifying children. Extends the dependent care tax credit to respite care services. Establishes the Gateways Grant Program to improve the administration of State and county low-income families with children programs. Child Support Distribution Act of 2001 - Amends SSA title IV parts A (Temporary Assistance for Needy Families) (TANF) and B (Child Support and Establishment of Paternity) to provide for increased child support payments to families and enforcement of child support obligations. Child Support Assurance Act of 2001 - Directs the HHS Secretary to make grants to States for child support assurance demonstration projects. Fair Minimum Wage Act of 2001 - Amends the Fair Labor Standards Act of 1938 to provide for a graduated increase in the minimum wage (and apply it to the Commonwealth of the Northern Mariana Islands). Federal Living Wage Responsibility Act - Specifies minimum hourly wages and other employment terms for employees under Federal contracts. Amends the Richard B. Russell National School Lunch Act concerning the child and adult care food program, and the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 concerning the food stamp program. Directs the Secretary of Housing and Urban Development (HUD) to establish a rental assistance voucher program. Establishes the Voucher Success Fund and the National Affordable Housing Trust Fund. Housing Preservation Matching Grant Act of 2001 - Directs the HUD Secretary to make grants to States for low-income housing preservation. Amends SSA title IV part E (Foster Care and Adoption Assistance) to direct the HHS Secretary to reimburse States for preventive, protective, crisis, permanency, independent living, and post-permanency services. Amends SSA title IV part B (Child and Family Services) for expansion of the promoting safe and stable families program. Social Services Block Grant Restoration Act of 2001 - Amends SSA title IV part A (TANF) and SSA title XX (Block Grants to States for Social Services) to provide for restoration of funds for the social services block grant. Child Protection/Alcohol and Drug Partnership Act of 2001 - Amends SSA title IV part B to provide for child protection and alcohol and drug partnerships for children. Amends SSA title IV part E to provide for a permanency grants program. Amends the Family Violence Prevention and Services Act to direct the HHS Secretary to award grants for programs to encourage domestic violence models using multisystem partnerships to address the needs of children exposed to domestic violence. Directs the Secretary to make grants to States to address the mental health and developmental needs of young children. Revises the 21st Century Community Learning Centers Act. Younger Americans Act - Establishes a national youth policy, an Office of National Youth Policy in the Executive Office of the President, and a Council on National Youth Policy. Establishes grants for State and community programs to encourage and assist State agencies, community boards, and area agencies on youth to assure that all youth have access to the full array of core resources. Mental Health Juvenile Justice Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 (JJDPA) to establish grants for a State and local juvenile justice agency training program regarding access to mental health and substance abuse treatment for juveniles in contact with the State juvenile justice system. Establishes a Federal Coordinating Council on Criminalization of Juveniles With Mental Disorders. Juvenile Justice and Accountability Act - Amends the JJDPA to establish grants to States for juvenile accountability block grants. Amends the Federal criminal code to: (1) provide for the regulation of firearms transfers at gun shows; and (2) require child handgun safety locks on firearms. Amends the Consumer Product Safety Act to require child handgun safety locks. Prohibits weapons transfers to juveniles and imports of large capacity ammunition feeding devices. Amends the Violent Crime Control and Law Enforcement Act of 1994 to establish grants for: (1) State and local domestic violence offender recordkeeping improvements; (2) State and local gun prosecutors; and (3) local and antigun violence media campaigns. Provides for regulation of Internet firearms transfers. Prohibits multiple handgun sales or purchases. Directs the HHS Secretary to establish the Advisory Committee on Private Sector Support for Children and Families.

PROTECTION Act

Providing Reliable Officers, Technology, Education, Community Prosecutors, and Training In Our Neighborhoods Act of 2001 or PROTECTION Act - Modifies provisions of the Omnibus Crime Control and Safe Streets Act of 1968 regarding public safety and community policing ("cops on the beat" program, COPS) to authorize the Attorney General to use funding under COPS grants to: (1) increase prosecutor presence and to enhance law enforcement access to new technologies; (2) pay overtime to existing career law enforcement officers to the extent that such overtime is devoted to community policing efforts; and (3) promote higher education among in-service State and local law enforcement officers by reimbursing them for the costs associated with seeking a college or graduate school education. Includes among permitted additional grant projects: (1) specialized integrity and ethics training; and (2) innovative proactive crime control and prevention programs involving school officials and religiously-affiliated organizations. Authorizes the Attorney General to use up to five percent of appropriated funds for technical assistance and training to States, local governments, Indian tribal governments, and other public and private entities. Repeals provisions of the Act regarding termination of grants for hiring officers. Allows grants to be used to assist: (1) police departments in employing specified professional, scientific, and technological advancements; and (2) State, local, or tribal prosecutors' offices in implementation of community-based prosecution programs that build on local community policing efforts. Reserves specified funds for units of local government with a population of less than 50,000. Authorizes the Attorney General to use no more than 50 percent of grant renewal funds to award grants targeted specifically for retention of police officers.

Uniformed Services Former Spouses Equity Act of 2001 - Requires payment from the monthly disposable retired pay of a member to his or her former spouse in compliance with court orders (division of property) to terminate upon the remarriage of that spouse, effective as of the last day of the month in which the remarriage occurs. Provides that, in the case of a member to whom a final decree of divorce, dissolution, annulment, or legal separation is issued before the member begins to receive retired pay, the disposable retired pay of such member, for purposes of such monthly payments, shall be computed based on the pay grade and length of service of the member while married. Increases such amount concurrently with retired pay increases. Requires a member's spouse or former spouse to obtain a court order for reapportionment of a member's monthly disposable retired pay by the later of the following dates: (1) two years of the date of the final decree of divorce, dissolution, annulment, or legal separation; or (2) six months after the enactment of this Act. Prohibits the court from treating as part of a member's disposable retired pay amounts which have been waived from such pay in order to receive veterans' disability compensation.

Veterans Medicare Reimbursement Demonstration Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to authorize the Secretaries of Health and Human Services (HHS) and of Veterans Affairs (VA) to establish a Medicare subvention demonstration project under which the HHS Secretary, acting under a coordinated care health plan model, shall reimburse the VA Secretary from the Federal Hospital Insurance Trust Fund and the Federal Supplementary Medical Insurance Trust Fund for Medicare health care services furnished to targeted Medicare-eligible veterans who volunteer for such project. Requires the demonstration project to be conducted at up to ten sites jointly designated by the Secretaries. Directs the VA Secretary to establish and operate coordinated care health plans to provide benefits to the targeted veterans enrolled in the project.

New Insurance Coverage Equity (NICE) Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new Medicare part D (NICE Drug Benefit Program) (NICE program), administered by the NICE Board, also charged with running a New Insurance Coverage Equity Office established within the Department of Health and Human Services, under which all individuals entitled to Medicare part A (Hospital Insurance) benefits and enrolled in Medicare part B (Supplementary Medical Insurance) shall be provided access to coverage of outpatient prescription drugs that meet specified requirements. Grants such access via either enrollment in a Medicare+Choice (Medicare part C) plan, enrollment in a NICE Medicare supplemental policy, or enrollment in a group health plan. Provides for financial assistance to enable covered beneficiaries to obtain enrollment coverage. Vests the NICE Board with outreach and other specified duties, such as establishing procedures for enrollment and enhanced financial assistance. Outlines requirements for the offering of NICE program coverage, which include prohibiting pre-existing condition exclusions. Establishes in the Treasury the NICE Trust Fund, consisting in part of amounts from the on-budget surplus, to be available only for expenditures to carry out the NICE program. Amends the Omnibus Budget Reconciliation Act of 1990 to include with Medicare supplemental policy (Medigap) comparison information for Medigap policies, information on the NICE program for purposes of State grant application plans for State-wide health insurance, counseling, and assistance grants.

Post Office Community Partnership Act of 2001 - Modifies Federal postal law to revise requirements for the closing or consolidation of a post office and apply them, as well, to its proposed closing, consolidation, relocation, or construction. Requires a 60-day notice, under certain conditions, to persons (including local government officials) who are (or would be) served by the post office involved to allow such individuals an opportunity to present their views before such proposed action. Requires the notice: (1) by the deadline, to be hand delivered or delivered by mail and published once a week for at least four weeks in one or more newspapers regularly issued and of general circulation within the zip code areas which are (or would be) served by the post office involved; and (2) to include a description of the proposed action, a summary of the reasons for it, and the date on which the action is to be taken (or, in the case of the construction of a post office, the proposed timetable). Revises the factors to be considered in deciding whether or not to take such proposed actions. Requires the Postal Service to follow a community's public participation procedures to address the relocation, closing, consolidation, or construction of buildings in the community if such procedures are more stringent than those provided in this Act.

Law Enforcement Officers Equity Act - Redefines the term "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) Federal employees not otherwise covered by such term whose duties include the investigation or apprehension of suspected or convicted individuals and who are authorized to carry a firearm; and (2) such employees of the Internal Revenue Service whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns. Requires that such service which is performed by an incumbent law enforcement officer be treated: (1) on or after the enactment date of this Act, for all purposes, as service performed as a law enforcement officer, irrespective of how such service is treated under the following; and (2) before, on, or after such date, for purposes of CSRS and FERS, as service performed as such an officer, but only if an appropriate written election is submitted to the Office of Personnel Management five years after such date or before separation from Government service, whichever is earlier. Provides that nothing under current law respecting mandatory separation from Government service under CSRS or FERS shall cause the involuntary separation of an officer before the end of the three-year period beginning on such date.

Eliminates and revises specified provisions regarding Compact implementation, duration, restricting authority, and Commodity Credit Corporation compensation. States that Congress consents to the Southern Dairy Compact entered into by Alabama, Arkansas, Georgia, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Oklahoma, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia. States that only Florida, Nebraska, and Texas may join such Compact. Limits price regulatory authority to Class I fluid milk unless otherwise consented to by the Congress. Provides for Commodity Credit Corporation compensation. Sets forth the Southern Dairy Compact. States that Congress consents to: (1) the Pacific Northwest Dairy Compact proposed for California, Oregon, and Washington; and (2) the Intermountain Dairy Compact proposed for Colorado, Nevada, and Utah. Limits price regulatory authority to Class I fluid milk. Provides for Corporation compensation. States that such Compacts shall be the same as the Southern Dairy Compact with specified differences.

Small Business Health Fairness Act of 2001 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to revise provisions relating to access and choice for small business employers with respect to medical care for their employees. Establishes rules governing association health plans (group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations), including requirements relating to certification, sponsors and boards of trustees, participation, coverage, plan documents, contribution rates, benefit options, applications for certification, notice for voluntary termination, corrective actions, and mandatory termination. Requires association health plans which provide health benefits in addition to health insurance coverage to maintain certain reserves and comply with other solvency provisions. Directs the Secretary of Labor to apply for appointment, and carry out specified duties, as trustee of any such insolvent association health plans which provide health benefits in addition to health insurance coverage. Allows a State to impose a contribution tax on any association health plan commencing operations in such State after the enactment of this Act. Requires association health plans to include in their summary plan descriptions, in connection with each benefit option, a description of the form of any solvency or guarantee fund protection secured under ERISA or applicable State law. Revises provisions relating to treatment of: (1) single employer arrangements; and (2) certain collectively bargained arrangements. Sets forth provisions for association health plans with respect to: (1) enforcement; (2) cooperation between Federal and State authorities; and (3) treatment of certain existing health benefit programs.

Revises and renames ESEA title II as Teacher and Principal Quality, Professional Development, and Class Size. Establishes a new ESEA title III, Language Minority Students and Indian, Native Hawaiian, and Alaska Native Education, which combines and revises provisions of current titles VII and IX. Redesignates, reauthorizes, and revises the current title III as title X, Technology for Education. Transfers to a new title III subtitle B the Emergency Immigration Education Program. Establishes a new ESEA title IV, Public School Choice, and authorizes a new public school choice program. Extends the authorization of appropriations for Magnet Schools Assistance and Public Charter Schools. Sets forth a new title IV part D, Report Cards. Directs the Secretary to make grants to qualifying States to publish report cards for each elementary and secondary school receiving ESEA funding. Transfers ESEA Impact Aid provisions from title VIII to a new title V, eliminating certain current title V programs. Establishes a new title VI, High Performance and Quality Education Initiatives for grants to State education agencies to award subgrants to local education agencies for: (1) school improvement; (2) 21st Century Opportunities programs; (3) safe learning environments; and (4) New Economy Technology Schools. Establishes a new ESEA title VII, Accountability. Requires certain sanctions if performance objectives have not been met by a State receiving grant funds. Provides for inmate wages and deductions. Amends the Federal judicial code regarding the Department of Justice Assets Forfeiture Fund to authorize payments to the Bureau of Prisons exclusively for the purpose of providing additional vocational and remedial educational training for inmates. Amends the Federal criminal code to require that not less than 20 percent of the gross profits of the corporation at the end of each fiscal year be allocated to fund vocational training for inmates. Requires the Director of the Bureau to afford to inmates opportunities to participate in programs and activities designed to help prepare such inmates to obtain employment upon release. Authorizes FPI to: (1) locate more than one workshop at a Federal correctional facility; and (2) operate a workshop outside of a correctional facility if all of participating inmates are minimum security inmates.

Requires each incumbent local exchange carrier to provide: (1) Internet users with the ability to subscribe to and have access to any Internet service provider that interconnects with such carrier's high speed data service; (2) any Internet service provider with the right to acquire necessary facilities and services to facilitate such interconnection; and (3) any Internet service provider with the ability to collocate equipment in order to achieve such interconnection. Includes high speed data service or Internet access service within the definition of "incidental interLATA services" permitted for a Bell operating company.

Requires the FLRA to issue regulations establishing collective bargaining procedures for public safety employers and employees in States that do not substantially provide for such public safety employee rights and responsibilities. Directs the FLRA, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrator's awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of such FLRA regulations and authority through appropriate State courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts or strikes. Provides that existing collective bargaining units and agreements shall not be invalidated by this Act.

Federal Living Wage Responsibility Act - Requires the Federal government and any employer under a Federal contract or subcontract exceeding $10,000 to pay each of their respective workers: (1) an hourly wage (or salary equivalent) necessary for such employee to earn, while working 40 hours a week on a full-time basis, the amount of the Federal poverty level for a family of four; and (2) an additional amount, based on the locality in which a worker resides, sufficient to cover the costs to such worker to obtain any fringe benefits not provided by the worker's employer. Exempts employers that are: (1) small business concerns; or (2) nonprofit, tax-exempt organizations, if the ratio of the total compensation of the chief executive officer to that of the full-time equivalent of their lowest-paid employee is not greater than 25 to 1. Directs the Secretary of Labor to enforce this Act. Makes Federal contractors that are part of a pattern or practice of violations of such wage requirements subject to Federal contract suspension, a five-year ineligibility period, and liability for Government costs of obtaining a replacement contractor. Provides for judicial review of the Secretary's determinations, and authorizes the President to suspend the provisions of this Act in times of emergency. Allows an aggrieved worker to bring a civil action against an employer for appropriate relief for a violation of this Act, if the employer has not paid or reinstated the worker as a result of the administrative action.

Directs the Attorney General to give priority for assistance to crimes committed by offenders who have committed crimes in more than one State and to rural jurisdictions that have difficulty covering the extraordinary investigation or prosecution expenses. Authorizes the Attorney General to award grants to assist State, local, and Indian law enforcement officials with such extraordinary expenses. Directs the Office of Justice Programs to: (1) work closely with funded jurisdictions to ensure that the concerns and needs of all affected parties are addressed; and (2) award grants to State and local programs designed to combat hate crimes committed by juveniles. Prohibits specified offenses involving actual or perceived race, color, religion, national origin, gender, sexual orientation, or disability. Directs the U.S. Sentencing Commission to study and provide sentencing enhancements for adult recruitment of juveniles to commit hate crimes. Amends the Hate Crimes Statistics Act to require the crime data to be collected and published by the Attorney General to include data about crimes that manifest evidence of prejudice based on gender.

Prohibits the discharge of or any other discrimination against an individual for opposing any act or practice made unlawful by this Act, or for assisting in an investigation or proceeding under it. Directs courts, in any action brought under this Act for violation of such prohibition, to allow expert fees as part of the costs awarded to prevailing plaintiffs. Allows any such action to be maintained as a class action. Requires employers subject to such prohibition to: (1) preserve records which document and support the method, system, calculations, and other bases used by the employer in establishing, adjusting, and determining the wages paid to their employees, for periods of time prescribed by the Equal Employment Opportunity Commission (EEOC); and (2) make reports to the EEOC. Directs the EEOC to: (1) undertake studies and provide information and technical assistance to employers, labor organizations, and the general public concerning effective means available to implement this Act; (2) carry on a continuing program of research, education, and technical assistance with specified components related to the purposes of this Act; and (3) include a separate evaluation and appraisal regarding the implementation of this Act in its annual report to the Congress. Makes conforming amendments relating to congressional and executive branch employees to the Congressional Accountability Act of 1995 and the Presidential and Executive Office Accountability Act.

Establishes the Emergency Retiree Health Loan Guarantee Program and its Board. Authorizes the Program, through its Board, to guarantee loans provided by private banking and investment institutions to eligible plan sponsors to assist them in meeting obligations under this Act to restore benefits reduced after retirement. Authorizes the Secretary to assess civil penalties for violations of this Act.
